The Declaratioq Code of Regulations and Deelaratlon Plan are sometimeshereinafter referred to as the'Condominium Doeuments.n

WIIEREAS' the Unit owners of at least eighty pereent (80%) of the Units yoted toamend the Deelaration in aeeordanee with the requirements of Section ZS of theDeclaration, and the amendments have been approved by at least seventy-five pereent(?5%) of the first mortgages on all the Units; and

-WIIEREAS' the Couneil desires to execute and reeord this amendment whieh eontains

the amendments to the Deelaration which have been approved as aforesaid by at leastelghty percent (80%) of the Unit Owners.

Now' THEREFOR$ the undersigned, intending to be legally bound hereby, eovenantsand agrees as follows:

l. In Seetion ?A of the Deelaratioq the tanguage loeated in Paragraph I on page 3

of the Eighth Amendment to Deelaration Creating and Establishing Westwood VlllageCondominlum ls hcreby deleted and the phrase nprlor to January 28, lgggn ts herebysubstltuted ln lts plaee.

2. ln Seetion 7E of the Deelaration, the language loeated in Paragraph 2 on page 3

of the Eighth Amendment to Deelaration Creating and Establlshing Westwood VillageCondominium is hereby deleted and the language nJanuary 28, lg90t' is hereby substitutedin its place.

3. Notwithstanding anything to the contrary eontained in the doeuments reeltedabove, Deelarant is hereby granted an easement over all those streets and roads now or

. hereafter construeted providing aeeess to, and loeated within, Westwood VillageCondominium for general purposes, including but not llmited to the rlght of lngress and

egress for the purposes of eonstrueting such bulldings as are necessary to eomplete thedevelopment of Block 5, and lor the construction of such bulldlngs as are eontemplatedupon the submlssion of Blocks I and 6 to the Decl,aratlon Plan of Westwood VillageCondominlum and further lneludlng the rlght of ingress and egress and the rlght to extend

that ln the event damage to sald streets and roadq beyond ordlnary wear and tearr oecurs

by reason of sueh use, lt wlll eause sueh streets and roads to be repalred in a manner and to

the extent necessery to return sueh streets and roads to the condltlon they were ln prlor to

sueh use.

4. Notwlthstanding anything to the eontrary eontalned ln the dmuments reclted

abovq upon the explratlon of the extenslon set forth ln paragraphs I and 2 hereof' all

rights of Deelarant exeept those set forth in paragraph 3 hereof shall eease as to Declarant

and further shalldevolve upon Couneil whieh shall then be at liberty to develop and submit

units to the extent permitted by the Development Plan and governing law.

S. Except as expressly amended hereby, the terms and conditions of the Declara-

tion shall remain in full force and effeet.

If the time or place of a regulai rneeeing bechanged by circumstances beyond the control of the Council, noEiceof the change shall 'be given in the sarne manner as for a specialmeeting. Notice of a regular or speciar meeting need not be given'to any.member of the Council who submits a waiver of .notice, whethersuch waiver be before or after the meebing. Attendance at themeeting shall be deemed to be a wai-ver of notice th'ereof.

59. Quorum.
