The program is designed to help people that have the tendency to wander. Project Lifesaver has two goals; to streamline search and rescue procedures and to help save lives. The Brighton Township Planning Commission was created by Township Ordinance, which sets the terms of membership and establishes the powers and duties of the Commission. Members of the Commission serve as volunteers, and are appointed by the Board of Supervisors to review land use proposals, such as subdivision and land developments, and make recommendations on their adoption to the Board. They also develop and review amendments to the Township’s land use codes. The Commission holds monthly meetings to conduct all business. The Commission welcomes all input from residents on the Township’s land use policies and other matters that fall under their review. The Commission’s goal is to maintain and improve the character of the Township.

Brighton Township Planning Commission 2017 Annual Report

Land Use Ordinance PreparationMinimum Construction Standards and Details – Zoning Code Amendments: The Planning Commission engaged the services of a professional planner to conduct a comprehensive review of the C-2 Highway Commercial Zoning District. The Commission recommended the district be renamed the C-2 Mixed Use Zoning District. The new district permits a mixed use buildings and mixed use developments, subject to specific conditions. A public hearing was conducted on the ordinance by the Board of Supervisors on November 30, 2017 and the Board adopted the ordinance on December 11, 2017.

Revised Zoning Map: As a result of the C-2 Highway Commercial Zoning District being renamed the C-2 Mixed Use Zoning District, and the substantive nature of the code revisions, a revision to the Official Zoning Map was also conducted. A public hearing was conducted on the ordinance to amend the Official Zoning Map by the Board of Supervisors on November 30, 2017 and the Board adopted the ordinance on December 11, 2017.

Property Maintenance Code: The Commission reviewed the 2015 International Property Maintenance Code and has recommended that the Board of Supervisors proceed with the adoption of the Code for the Township. The Board of Supervisors is reviewing the Code for consideration of adoption.

Other Business ItemsTownship Greenway and Trail Plan: The PA DCNR has awarded a grant to the Township for the preparation of the Greenway and Trail Plan. Following review and comment on the plan by the PA DCNR, it was adopted by the Board of Supervisors in March 2017.

Stormwater Review: The Township Engineer’s office provided training to the Commission on the Township’s MS4 program and the Township’s written Stormwater Management Program. There was also review of the upcoming 2018 permit revisions that would be required, including the Pollutant Reduction Plan.

Chief Blinn thanks all Township residents for their kind support to the Department and encourages the reporting of all suspicious activity to the Police Department. Please be reminded of the following:

• Lock Vehicles – Vehicles parked outdoors should be locked at all times, especially when parked upon a street. Do not leave valuables (purses, laptops, etc.) within the vehicles. Unlocked vehicles are an easy and common target for theft.

• Vacation Checks – If you are going to be away from your home for a period of time, the police department will make periodic checks on your residence while you are away. Prior to leaving, phone the department at 724-728-1134 with departure and return dates.

• Dogs – It is unlawful for the owner of any dog in Brighton Township to permit the dog to run at large upon any street or upon the property of any other than the owner or keeper. Violators are subject to penalties. Dogs are prohibited in Township Parks, other than areas specifically designated.

• Soliciting or Peddling – Soliciting and peddling is regulated within the Township and requires the securing of a license. Soliciting or peddling is prohibited on Sundays and holidays, before 9:30 a.m. or after sunset or 6:00 p.m., whichever occurs first.

• Parking – Vehicles must be parked on the right-hand side of the road with the flow of traffic or it will be subject to ticketing.

• Curfew – It is unlawful for any person under the age of 18 years to be or remain in or upon any street, park or public place in the Township between the hours of 11:00 p.m. and 6:00 a.m. unless a parent, guardian or other person having legal custody, accompanies the person.

The Department is looking for members 18 years of age or older. The Department permits Junior members ages 16 and 17. Volunteers are also needed for the Ladies Auxiliary. Stop in at Fire Station No. 3 at 84 Grange Road on Mondays from 6:00 to 9:00 p.m. or email us at [email protected] if you want more information or are interested in volunteering. Remember, your Fire Department is TOTALLY VOLUNTEER.

The Fire Department is also looking for individuals over 18 who would like to join as a Social Member and assist with fundraising activities, such as our Fish Fries. Please email us at [email protected] for more information.

• Fire Hydrants – Township Code makes it unlawful for any person, other than those authorized by the Township, Fire Department or Municipal Authority, to open, tamper with or interfere in any manner with any fire hydrant. No obstructions are to be planted, constructed or placed within six (6) feet of any hydrant.

• Burning – Burning of household papers or other permitted refuse must be done within a salamander wire basket or masonry enclosure with a top to prevent fly ash from escaping. Such burning is prohibited on Sundays, Mondays, Tuesdays or legal holidays. Burning is permitted Wednesday through Saturday between 7:00 a.m. and 7:00 p.m. Please monitor all outdoor burning activity closely to prevent brush and other wild fires.

On May 24th there will be a one day trip to visit the Washington D.C. national memorials such as the WWII Memorial, Korean War Memorial and Arlington National Cemetery. The trip is for WWII and Korean War Era Veterans, and all who served prior to May 15, 1975. The trip is free. The bus departs at 5:45 a.m. from the Beaver County Parking Garage (next to Court House) and returns around 9:00 p.m. There is a nurse on each bus as well as several assistants. Meals and drinks are provided and wheelchairs are available for those that need them. The goal is to fill every seat with a veteran and therefore we are unable to accommodate family or friends. Want to Help? Since the first trip in November 2016 over 1,800 WWII and Korean War veterans have had the opportunity to see our country’s tribute to their sacrifices and service. Final & First Quarter Earned Income Tax ReturnsFinal Earned Income Tax Returns are due by April 17th. Employed residents of Brighton Township are subject to a 1% tax on gross earnings. This tax is paid to the Beaver Area School District and Brighton Township at ½ of 1% each. The tax must be paid quarterly to avoid penalty. If you were/are employed in Pennsylvania it is mandatory, with a few exceptions, that your employer withhold the tax and your obligation is fulfilled except for the filing of a final return by April 17th. However, it is the employed person’s responsibility to pay the tax so payment should be verified. Failure to file a final return, even when no tax is due, may make individuals liable for penalty. The EIT Collector for all of Beaver County, including Brighton Township and Beaver Area School District, is Berkheimer. NOTICE: If you are self employed, work out of state or are a federal employee, local earned income tax is not deducted from your pay by your employer, so you are required to pay the tax quarterly or be subject to additional penalty, interest and costs.

The Brighton Township Sewage Authority invested nearly $220,000 on several major improvements within the sewage collection and conveyance system during the past year. The Lisbon Road Pump Station had new VFD motors and pumps replaced, including piping modifications. A pre-treatment chemical feed system was installed to reduce the presence of hydrogen sulfide which is highly corrosive to sewage system components. The emergency generators were replaced at the Lisbon Road Pump Station and Little Beaver Pump Station. Each major pumping station within the system is equipped with emergency power supply so that the motors and pumps can be operated in times of power loss. The storage capacity in the wet wells is insufficient to accommodate sewage flows for extended periods of time, necessitating the need for the emergency generators to prevent sewage from overflowing onto the ground or into adjacent waterways. In addition, the Authority contributed over $115,000 for a new grit chamber at the sewage treatment plant.

The Authority has authorized the replacement of the emergency generator at the Dawson Ridge Pump Station at a cost of $55,900 during 2018. The pumps and motors at the Allison Drive Pump Station and Dawson Ridge Pump Station are being evaluated for replacement over the next 1-3 years. Advance planning is necessary as these projects are expected to exceed $450,000 in cost.

Building & Zoning Permit RequirementsBrighton Township has adopted the International Construction Code (ICC) to regulate all construction within Brighton Township, with the exception of a few items that have been excluded pursuant to The Pennsylvania Construction Code Act, as amended. However, a Zoning Permit is required for all construction activity, including items that may be excluded by the Act. Confirmation of compliance with the ICC is by site inspections that are conducted by certified building inspection officers. The Township has contracted with the Middle Department Inspection Agency (MDIA) to perform plan reviews and inspection services. MDIA also issues final occupancy permits. Applicants for building permits are required to submit documentation with the application that the proposed construction complies with code. These codes apply to general construction, plumbing, electrical and HVAC/Mechanical. Due to the plan review requirements of the ICC, please allow more time for the processing and review of your permit application if you are planning a construction project this year. You may also visit the Applications and Forms Page within the Resident’s Center at brightontwp.org where Customer Assistance Guides have been posted to assist you through the permitting process.

Commercial and other non-residential establishments are reminded that participation in the Township’s recycling program is mandatory. Township ordinance requires that all businesses must separate high-grade office paper, aluminum food & beverage containers and corrugated paper (cardboard) from the waste stream, and store the materials until collection. Each location is also encouraged to recycle clear, brown and green glass food and beverage containers; steel and bimetal food and beverage containers; newspaper and magazines; and PET (1) and HDPE (2) plastics.

An annual report must be submitted to the Township by the establishment or their contracted hauler disclosing the type and weight of materials recycled during the previous year. The Township is required by the PA Department of Environmental Protection to report annually the types and amounts of materials recycled by both residential and commercial sources.

Non-Residential Recycling Requirements

Cardboard & Paper Recycling ProgramPlease Be a Good NeighborThe Township provides an opportunity to recycle cardboard through drop-off locations at Fire Station No. 2 on Tuscarawas Road and at Fire Station No. 3 located on Grange Road. The high use has resulted in abuses that make the collection areas nuisances to neighbors.

• Flatten the boxes prior to placing them in the collection bins. This takes up less space and allows for more material to be placed in the bins.

• If the bins are full Do Not place the material on the ground where it becomes litter, and blows to adjacent properties. Please return at a later date after the bins have been emptied. Please be considerate of our neighbors.

• In addition to the Township locations, a drop-off site is also available for use at the Beaver County Recycling Center in Brady’s Run Park. Contact the recycling center to verify their hours of operation 724-770-2064 ext. 2.

• If placing shredded paper within the paper recycling bins, please enclose it within a bag. Otherwise, when the container is dumped, the shredded paper tends to blow throughout the area.

All 2017 Yard Waste Composting Site Permits expired February 28th and must be renewed for use of the site. Permits may be renewed as follows:

1. In person at the Municipal Building, 1300 Brighton Road, Beaver, PA 15009. Cost of the permit is $10.00.

2. By mailing a check, made payable to Brighton Township, in the amount of $12.00 ($2.00 to cover return postage) along with the number from your previous permit. Your new permit will be issued and mailed to you within five days. (This form is also available on the Applications & Forms page in the Resident’s Center of our web site at brightontwp.org.)

First time permit applications must be made in person, with proof of residency, at the Municipal Building, 1300 Brighton Road, Beaver, PA 15009.

During the past year the township experienced numerous occasions of improper use of the site. Only grass, leaves, brush/tree limbs are to be deposited at the site. Please refer to the rules and regulations for site use. Plastic bags, stones, boards, landscape timbers and garbage are not acceptable. Disposal of unauthorized materials can damage the equipment used to operate the site, and can cause other hazards. Use of the site without a valid permit, or in violation of the rules, can result in enforcement action. The site is under video surveillance.

Township Continues Drug Drop Box ProgramFor the safe disposal of prescription drugs and medications, a drop box is available in the lobby of the Police Department. Flushing them down the toilet or throwing them in the trash can have potential safety and health hazards. Plus, unused medications are often subject to abuse or accidental poisonings and overdoses.

When disposing of medications they should remain in their original containers. Personal information on the labels ought to be crossed out, but information about the medication should be legible. Place prescriptions, prescription patches, over-the- counter medications, vitamins, samples and medications for pets in the drop box. Open containers of liquids should be completely sealed.

Drop Off Site Will Remain OperationalConsistent with the program offered in the fall, the Township will again provide a fee-based curbside collection program for leaf waste during April. The yard waste drop-off site will continue to operate on the same basis as it currently is and, therefore, participation in the curbside collection program is optional. Homeowners are encouraged to continue to use the drop-off site, or compost the leaves in their own yards.

The collection of leaves and yard waste is a fee-based program whereby residents purchase biodegradable paper collection bags at a cost of $2.00 each within which the leaves, garden residues, shrubbery clippings or tree trimmings must be placed. Bags must be placed at the curb on collection days to be designated. Bags will be pre-sold at the Municipal Building. Bags utilized must be purchased from the Township, and not be from another source, such as a home improvement store. Those purchasing bags will be contacted to schedule collection. Bags must be placed at the curb on collection day.

Pollutant Reduction Plan Implementation & Stormwater Service Fee AnalysisAs reported during 2017, the Township will implement Best Management Practices (BMPs) over the next five (5) year period to achieve the required reductions of pollutants identified within the Pollutant Reduction Plan (PRP) submitted to the Pennsylvania Department of Environmental Protection (PADEP) as part of the Township’s NPDES General Permit renewal application for Stormwater Discharges from Small Municipal Separate Storm Sewer Systems (MS4). Implementing the BMPs will be costly. The PRP estimates the Township will need to expend $394,000 over the next five (5) year permit period. Stormwater has become highly regulated requiring frequent inspection, maintenance and quality monitoring, similar to water, sewage or other utilities. Costs are expected to continue to increase with growing MS4 requirements and the

need for the Township to be more proactive with maintenance of its storm sewer system. As Brighton Township and other municipalities evaluate how to pay with this unfunded mandate, the PA Legislature has approved the use of Stormwater Fees as a funding source for these recurring expenditures, as opposed to real estate tax increases. To evaluate the implementation of a Stormwater Fee to fund these improvements and other annual costs, the Township has authorized its consulting engineer to prepare a Stormwater Service Fee Analysis and Report to establish the foundation of a Stormwater Fee. Unlike tax collections that fund general municipal purposes, a Stormwater Fee can become a stable and reliable funding source dedicated to stormwater related activities and expenses, much like water and sewage charges are. Tax-exempt

properties are also subject to these types of fees. The study will include an evaluation of the presence of impervious surfaces within a randomly selected sample of 50 single-family residential lots to establish and define an Equivalent Residential Unit. Non-residential properties will be evaluated on a lot-by-lot basis. All storm water related costs will need to be tabulated, along with future capital improvements. All these steps are necessary to move towards the calculation of a fee and to identify a possible billing structure. A final step will be the evaluation of possible credits for existing or newly constructed stormwater BMPs. The engineer has started with data collection, which is the first step in the Study’s preparation. An update and status report will be provided in the summer newsletter.

Storm Sewer Outfall Screening As part of compliance with the requirements of its NPDES MS4 Permit and to maintain water quality in our surface waters, the Township implements an Illicit Discharge Detection and Elimination (IDD&E) Program to monitor discharges from its storm sewer system. Part of the IDD&E Program includes annual routine screening of outfalls, or discharge points, throughout the Township. Approximately 20% of the Township’s known outfalls are screened each year, so that all outfalls are visited at least once in each five year permit cycle.

The purpose of the screening program is to identify and eliminate illicit discharges that may contribute pollutants to the Township’s streams and lakes. Any discharge of water from the Township’s storm sewer system not composed entirely of stormwater is considered an illicit discharge. When discovered,

these discharges are tested in the field and a sample is taken for laboratory testing to determine the presence of pollutants. Once tested, an investigation as to the source of the pollutants is conducted, potentially an illegal sanitary sewer connection or instance of illegal dumping, and steps are taken as appropriate to eliminate the pollution source. Residents may notice annual screening taking place each spring being conducted by representatives of the Township Engineer, Lennon, Smith, Souleret Engineering, Inc.

During the past year 30 outfalls not previously screened during the permit cycle expiring March 2018 were inspected. Of those inspected, 13 had flow requiring testing. Each of those will be followed up on during 2018 for the purposes stated previously. Maintenance observations are also recorded during the inspection program. These are provided to Public Works for corrective action, and include items such as corroded or separated piping, sediment build up or overgrown vegetation.

Aside from the routine annual screening being conducted, residents should remember that you play a large role in implementation of the Township’s IDD&E Program. The storm sewer system is intended to convey stormwater runoff only. If you observe any instance of someone dumping any substance into a Township storm inlet, or notice discolored or evidently contaminated discharge from any storm sewer, please notify the Township Office, Township Police or utilize the Illicit Discharge complaint form found on the Stormwater / MS4 Page of the Township Website.

2018 Waterline Replacement Construction ProjectThe Authority Engineer has completed a majority of the survey work and is working on the design and permitting of a waterline replacement project along Tuscarawas generally between Sebring Road and Ornida Drive. The proposed alignment will require additional easements along Tuscarawas Road for construction and future maintenance of the proposed waterline. A project easement coordinator at the Engineer’s office will be available to meet and/or discuss the project with each property owner. Contact information will be provided on the letter provided to each property owner contacted. Bidding for this project is tentatively proposed for early 2018 with construction occurring in mid-2018.

Waterline Replacement Construction Projects

The Brighton Township Municipal Authority (BTMA) and the Brighton Township Sewage Authority (BTSA) have approved increases in water and sewage rates effective with the May billing, with payment due in June.

Overall, the residential rate for water and sewage will increase 12.4%. The water rate will increase from $23.90 per month to $25.10 per month. Excess water will be billed at $5.20 per 1,000 gallons of consumption. The sewage rate will increase from $34 per month to $40 per month. Excess sewage will be billed at $10 per 1,000 gallons of water consumption. The combined base rate billing will be $65.10. A residential customer is permitted 4,000 gallons of consumption per month with the base rate. The Township is divided into three billing districts, and each month one district has a water meter reading. Therefore, each meter is read once every quarter (each three months) or four times per year. Any use over 12,000 gallons is classified as excess usage. A 2% discount is available to those residential customers registering for automatic bill payment.

Several factors have contributed to the rate increases. BTMA purchases water for distribution to its customers from the Vanport Township

Municipal Authority (VTMA). The VTMA has notified BTMA of a rate increase of nearly 21% for water purchases. This will increase expenses over $80,000 per year based upon historical water purchase records, compelling the BTMA rate increase. This rate increase from VTMA is a direct result of the transfer of expenses from CBS Corporation to VTMA for the operation and maintenance of the air stripping towers required by their PA DEP operational permits.

In 1989 Trichloroethylene (TCE) was detected in the VTMA Water Wells and the former Westinghouse facility was suspected as the source. Westinghouse at that time entered into an agreement with the DEP to construct, operate and maintain air stripping towers at the VTMA wells until such time that no TCE could be detected. Currently no TCE has been detected in the Water Wells in excess of three (3) years. Therefore CBS, which purchased the Westinghouse Facility, is no longer required by agreement to pay for the cost of operating and maintaining the air stripping towers. VTMA in now being required by DEP to operate and maintain the air striping towers which resulted in BTMA increasing it rates.

BTSA’s capital infrastructure requirements are increasing for the sewage collection system which

was constructed in the late 1970’s. The pumping stations have reached an age where pumps, motors and emergency power supply components are requiring extensive refurbishing or replacement. Four (4) of the eight (8) major pumping stations were equipped with pumps that no longer exists, and for which operating and maintenance parts are no longer available. Two (2) of the pumping stations have had new motors and pumps installed, but two (2) remain to be funded. Off-site treatment expenses have also continued to increase. Much of the Sewage Authority’s expenses are fixed costs. For example, nearly 65% of the Authority’s budget is for two line items – Debt Service and Treatment Expense. For the maintenance and operation of the sewage collection and conveyance system, the Authority maintains a maintenance work force of three (3) FT employees. These fixed costs leave little flexibility for additional cost reduction.

The BTMA last increased rates in 2007 and the BTSA last raised rates in 2013. It is never desirable to increase rates. However, please be assured that the Authorities will continue to take measures to provide quality service and maintain the valuable water and sewage infrastructure of the community in a fiscally responsible manner.

Water and Sewage Rate Increase Goes Into Effect May 2018

As reported in previous newsletters the Brighton Township Municipal Authority had entered into an agreement for the waterline replacement contract with Mortimer’s Excavating, Inc. for approximately 13,700 LF of waterline construction in the following areas:

Waterline construction is substantially completed, and will be entering into project restoration of yards and driveways. The construction project is constantly monitored by on-site inspectors from the Authority’s consulting engineer. The Authority encourages people to report any problems or issues they may experience promptly so they can be investigated by field personnel. This year’s Easter Egg Hunt has been relocated from Two Mile Run Park to Hardy Field (4900 Tuscarawas Road) due to the renovation project at Two Mile Run Park. Because Easter is early this year, the grounds will still be muddy from the site construction.

However, the Easter Bunny has confirmed that he will still be in attendance for the Annual Easter Egg Hunt on Saturday, March 31st at Hardy Field Pavilion at 11:00 a.m. Registration is required.
