2. Paragraph 4 of the principal Order shall be amended—

(a) by the substitution of a comma followed by the word "and" for the ful l stop, appearing at the end of the proviso thereto;

(b) by the addition of the following second proviso :—

"Provided also that subject to the provisions of subsection (3) of section 69, i f any fee payable under this section is not paid by the person by whom i t is payable wi th in 6 months from the date of coming into force of the Settlement of Tit le (Registration and Parti t ion Fees) (Amendment) Order, 1947, a sum equal to twenty per centum of the fee payable shall be added thereto and such sums shall be payable by the person by whom, and i n the manner i n which, such fee is payable."

1. These by-laws may be cited as the Government Railways Citation. (Special Tariff for the Carriage of Caustic Potash) By-laws, 1947.

2. —(1) The rate which shall be payable for the carriage by goods Rates, t rain at owners' risk of caustic potash in solid or dried form in wagon loads from Jerusalem station to Haifa Port for export shall be as set out i n the Schedule.

(2) The rate set out i n the Schedule shall not include loading and unloading charges which shall be levied additionally in accord­ance w i t h the tariff of such charges in force from time to time i n the event of the loading or unloading being performed by the Palestine Bai l ways.

(3) The rate set out in the Schedule shall not include siding charges or any miscellaneous charges which may be applicable. Such charges shall be levied additionally i n accordance w i t h the tariff of such charges i n force from time to t ime.

3 . Payment of the rate and charges shall be made to a railway officer duly authorised by the General Manager, Palestine Ba i l -ways, to collect such rate and charges.

4. These by-laws shall come into force on the 1st day of June,. 1947.

ORDER BY A COMPETENT A U T H O R I T Y UNDER R E G U L A T I O N 4 6 .

I N EXERCISE of the powers vested i n me by Regulation 46 of the Defence Regulations, 1939, as having effect by virtue of paragraph 2 of the Supplies and Services (Transitional Powers) Order, 1946, 1 , J O H N D O N A L D H E G E R T Y , Controller of Road Transport, being a Competent Authori ty for the purposes of the said Regulation, do hereby order as follows :—

1. This Order may be cited as the Defence (Control of Tyres and Tubes) Order, 1947.

2. I n this Order—:

' ' Controller" means the Controller of Road Transport and i n ­cludes the Deputy Controller of Road Transport and any Assistant Controller of Road Transport;

' 'dealer" i n relation to any tyres or tubes means any person whose business or part of whose business i t is to import , export, purchase or sell any tyres or tubes or do any of the above acts as an agent or i n any other intermediate capacity; and ''deal i n " shall be construed accordingly;

"registered retail dealer" and "registered wholesale dealer" mean any person holding a certificate granted to h im under the provisions of paragraph 3;

" t y r e " means a new pneumatic tyre for a vehicle and " tube" means a new inner tube for a tyre but does not include any tyre or tube of section 2.25 inches or less;

" this Order" includes any notice given under this Order.

3 . No person shall deal i n tyres or tubes unless a certificate has been granted to h im by or on behalf of the Controller declaring that he has been registered as a wholesale dealer or a retail dealer.

4. Every registered wholesale dealer and every registered retail dealer shall keep books, registers, accounts or other records, i n such form and in such manner as may be prescribed by notice given from time to time by or on behalf of the Controller, which shall contain complete and correct particulars relating to all his dealings i n tyres and tubes, including particulars identifying the persons who were parties to such dealings, and shall produce on demand for inspection by the Controller or any person duly authorised i n wr i t ing by h im any such books, registers, accounts or other records.

5. Every registered wholesale dealer and every registered retail dealer shall, whenever required by a notice given by or on behalf of the Controller so to do, furnish the Controller w i t h such peri-

6. Any notice given under paragraph 4 or 5 may be given in such manner as the person giving i t may deem fit, including publication in the Gazette, and on its being so given, every person to whom i t applies shall be deemed to have notice thereof and shall comply therewith.

7. Any person who, either by himself or by his servant, em­ployee or agent, contravenes any of the provisions of this Order or fails to comply wi th any notice given under this Order shall be guilty of an offence and. upon conviction, shall be liable to the penalties provided in the Defence Eegulations, 1939.

8. The Orders specified i n the Schedule are hereby revoked.

NOTIFICATION OF COMMENCEMENT OF SETTLEMENT.

T H E PUBLIC ARE HEREBY NOTIFIED that the Settlement Notice under section 7 of the Land (Settlement of Title) Ordinance was issued in respect of the lands of the village scheduled hereunder.

Any person claiming an interest i n the lands of the said village, or in the lands of adjoining villages which abut on the boundaries of the village mentioned in the schedule hereto, should act i n the manner prescribed i n the Land (Settlement of Title) Ordinance.

I N EXERCISE of the powers vested in me by section 4 of the Food Control Ordinance, 1942, and all other powers enabling me i n this behalf, I , GEORGE PATER SON CARTER, Food Controller, do hereby order as follows :—

1. This Order may be cited as the Food Control (Miscellaneous Maximum Prices) (Amendment No. 12) Order, 1947, and shall be read and construed as one w i t h the Food Control (Miscellaneous Maximum Prices) Order, 1947, hereinafter referred to as "the principal Order".

2. The Thi rd Schedule to the principal Order shall be revoked and the following shall be substituted therefor :—

Commencement. 4 . This Order shall come into force on the date of its pub­lication in the Gazette, w i t h the exception of paragraph 3 thereof which shall come into force on the first day of August, 1 9 4 7 .

EXPLANATORY N O T E .

The above Order provides for reduced maximum selling prices of edible oil (blended of cottonseed oil and groundnut oil) and margarine which have been made possible by the fall i n the Cost of L i v i n g Index and a consequent reduction in manufacturers' overhead expenses, and by a small decrease in wholesale and retail margins on edible oil and in wholesale margins on margarine.

The Order, furthermore, reduces the maximum selling prices of beef which has been made possible by a further fall i n cattle prices.

I N EXERCISE of the powers vested i n me by regulation 4 6 of the Defence Regulations, 1 9 3 9 , as having effect by virtue of para­graph 2 of the Supplies and Services (Transitional Powers) Order, 1 9 4 6 , I , H A R O L D PERCY STYRING, Senior Assistant Commissioner for Commerce and Industry, being a Competent Authori ty for the purposes of the said regulation, do hereby order as follows : —׳

1 . This Order may be cited as the Defence (Control of Soda) Order, 1 9 4 7 .

2. I n this Order— "Commissioner" means the Commissioner for Commerce and

Industry, and includes any Deputy Commissioner for Com­merce and Industry and any Senior x^ssistant Commissioner for Commerce and Industry,

"dealer" means any person^ who during any one calendar month imports, exports, purchases, sells, uses or treats am r

soda in quantities exceeding 50 kilogrammes in weight, "inspector" means any person appointed by the Commissioner

for the purpose of enforcing any of the provisions of this Order.

"soda" means sodium hydroxide (caustic soda) and sodium carbonate (soda ash and washing soda or soda crystals).

3 . — ( 1 ) No person shall remove, or cause or allow the removal of, any soda from Customs control i n Palestine, save under the authority of and in accordance w i t h the terms of a wri t ten permit granted by or on behalf of the Commissioner under this Order.

to remove i t under sub-paragraph (1) shall not sell, dispose of, treat or use any quantity of such soda for any purpose whatsoever, save under the authority of and in accordance wi th the terms of a wri t ten permit granted by or on behalf of the Commissioner.

4. Any person who, on the first day of August, 1947, has i n his possession or under his control any quantity of soda exceeding 50 kilogrammes i n weight shall, not later than the 10th day of August, 1947, furnish the Commissioner w i t h a declaration i n wr i t i ng , signed by such person, i n the form set out i n the First Schedule to this Order.

5. Save under the authority of and in accordance wi th the terms of a wri t ten permit granted by or on behalf of the Commis­sioner no person shall during any one calendar month sell to any one person, for purchase, any quantity of soda exceeding a total quantity of 50 kilogrammes i n weight.

6. Every dealer shall keep books, registers or other records which shall contain complete particulars relating to all purchases, sales, transfers, movements, use or treatment of all soda of which such dealer is or shall become in possession or control, and such dealer shall produce on demand for inspection by any inspector such books, registers or other records.

7. Every dealer shall, not later than the seventh day of every calendar month, furnish the Commissioner w i t h a return i n w r i t ­ing signed by h im regarding his transactions i n , and stocks of, any soda during the preceding calendar month, in the form set out in the Second Schedule to this Order.

8. Notwithstanding anything contained i n this Order or i n any permit issued under this Order, any person being or becoming i n possession or i n control of any soda shall comply w i t h any special or general direction which may from time to t ime be given by or on behalf of the Commissioner as to the treatment, keeping, storage, movement, transport, distribution, disposal, acquisition, use or consumption of such soda.

9. W i t h a view to securing compliance w i t h the provisions of this Order or any permit granted under this Order, any inspector or police constable may at any time enter and inspect any place whereat, wherein or whereon he has reasonable grounds for be­lieving that any soda is stored or dealt i n or w i t h and for that purpose any inspector or police constable may request any person to furnish h im w i t h such information and documents as he may require.

10. A permit under this Order may be granted subject to such general or special conditions as the Commissioner or any person authorised by h im in that behalf may think fit to impose and the

11. Any permit granted by or on behalf of the Commissioner under the provisions of this Order may at any time be revoked or suspended and the conditions attached thereto varied by the Com­missioner without his giving any reason for such revocation, sus­pension or variation.

12. Any person claiming to be the holder of any permit granted by or on behalf of the Commissioner shall on demand by any inspector or police constable produce for inspection such permit to the person making the demand.

13. Any person who, either by himself or by his servant, em­ployee or agent, contravenes any of the provisions of this Order, or any condition of a permit granted under this Order, shall be guilty of an offence and, upon conviction, shall be liable to the penalties provided in the Defence Regulations, 1939.

EXPLANATORY N O T E .

As a result of the acute world-wide shortage of caustic soda, soda ash and soda crystals (washing soda) which is not likely to improve in the immediate future, i t was decided to put these chemicals under control w i t h a view to ensuring that the small quantities of such chemicals available i n this country be utilised for essential purposes only.

The provisions of the above Order give effect to this decision.
