1. Project overview

1.1 Location of the ProjectThe Additional Second Line of Liupanshui-Zhanyi (Zhanyi-Liupanshui) Section ofGuiyang-Kurnming Railway Line (hereinafter referred to as Liu-Zhan Railway orZhan-Liu Railway for short), located at the border area of Yuiman Province andGuizhou Province, is a part of Guiyang-Kunming Line. Liupanshui-Zhanyi Section ofGuiyang-Kunming Railway is located in Liupanshui City of Guizhou Province andQujing District of Yunnan Province. The railway line starts from Lanba Station ofLiupanshui Terminal in the east, extends westwards and passes such counties and citiesas Shuicheng, Xuanwei, Zhanyi, Qujing, etc., and finally reaches Qujing RailwayStation. It has a total length of 253.633km, of which 79.533 km is in Guizhou Provinceand 174.1 km in Yunnan Province. Zhan-Liu Railway Line starts from Liupanshui City(Lanba) of Guizhou Province to the east connects to Qujing City (Zhanyi) of YunnanProvince to the west. Zhan-Liu Railway Line connects eastward to the newly-builtNeijiang-Kunming Railway Line and reaches northward to Chengdu City and reaches toGuiyang, the capital of Guizhou Province, and then eastward to most parts of thecountry through connecting to Zhu-Liu Double-track line. It goes down southward toNanning , connecting to Nan-Kun Railway via Pan-Xi Railway and Shui-Bai Railway;the line runs westward to Kunming, the capital of Yunian Province, via Qujing City,and connects to Kunming-Hanoi meter tract railway and the local railways ofCheng-Kun, Nan-kun and Kun-Yu via Kumning. It connects to Guang(Guangtong)-Da (Dali) Railway and the planned Yunnan International Railway Pass,Dali to Lijiang railway by ways of Kunming-Guangtong section of Cheng-Kun Railwayline. The target value ofspeed is 160km/h.

3) The contents of major projects of Liupanshui Terminal are as follows: additionalsecond line from Maga to Shuangshui via Liupanshui and Shuicheng, additionalsecond line from Maga to Shuangshui via Caojiawan and South Liupanshui, andnewly-built link from South Liupanshui to Shuicheng.0 The major construction works of Liu-Zhan railway project include:

Earth work of embankment is 2181.95x 104m3 , masonry work of embankmentis 123.22x104m 3, embankment section of soft soil 12km, carst section 23km,bridge works 52 of bridges with the extended meter of 18700m, culvert works904 culverts with cross extended meter of 31257.4m; 41 tunnels with extendedmeter of 71148m;newly-paved track of the main line is 347.24km; 411 sets ofturnovers; and 114.62x104m 3 of ballast. The ratio of bridges and tunnels is39.60%.

2. Scope of project impact2.1 Area to be affectedThe total length of the Additional Second Line Project of Liu-Zhan Railway is219.349km, which starts from Lanba of Liupanshui City, Guizhou province and entersXuanwei City, and Zhanyi County of Yunnan Province via Shuicheng County andZhongshan District of Liupanshui City, Guanzhou Province and Weining County ofBijie City, Guizhou Province, and then connects to Qujing City. It passes 2 provinces, 3cities and 6 counties (districts). 23 towns (townships or streets) and 85 administrativevillages (see Table 2-1) are affected by the land requisition and relocation of residentsunder the project.

2.2 People to be affected

The population to be affected by the project means that the actual population to beaffected by the project, such as population to be affected by relocation of residents andactLal population to be affected by land requisition under the project.

2.2.1 Residents to be affected

The population to be affected by the project consists of two types, population to beaffected by station & yard works and population to be affected by railway line works.Totally, a population of 1290 is to be affected by land requisition of Zhan-Liu Railwaywhole line, and a resettled population of 14103 (3526 households) is to be affected byrelocation of residents. To be specific, 11079 people (2770 households) are to beaffected by railway line works and 3(023 people (758 households) are to be affected bystation & yard works. For details, see Table 2-2 hereunder.

2.2.3 Minorities to be affectedSpecific survey on minorities affected has demonstrated following facts and findings:1). Ethnic Minority Communities along the Project LineThis report confirms the following fact: The Project Line between Zhanyi in EasternYunnan to Liupanshui in Western Guizhou is about 254km (the old line). After therealignment and double-track, a new line will be shortened to 220km. Along the old linewithin ridius of 5km, there are towns with limited number of Muslim Hui residents inDiaspora, but the project impact to them is little.From Xuanwei eastward, the line entered into deep Wumeng Mountain and etlnicpopulation composed of Yi, Hui, and Miao increase to about 1/5 of the local populationalong the line. British Missionary Samuel Pollard had rendered a general configurationof this situation in this area in the early 20th century. However, there is no ethnicThe Ministry of Railways, P. R. compact establishment to the level of township along project line in Yunman Province(hereinafter YP) and there is no project impact on the them all.In terms of line closure, there is a sensitive point at the present Beikaizhu and Homalingstation. Here a "n" shaped bend about 8km is going to be replaced by a long bridge andHomaling stations will be closed.

Further east, at Banuokuai Station, the railway entered the Weining Yi, Hui & MiaoAutonomous County, Guizhou Province (hereinafter GP). From here to Meihuashan, the35km old line goes through 3 ethnic compact townships in Weining: Longchang, Xinfaand Houchang (including some villages around the Meihuashan Station). It is section,together with 3 stations: Shusher, Luopandi and Liju, that would be closed and replacedby a 20km tunnel. The ethnic population in this area amounts to 1/4 of the total. Amongthem, Longchang Yi, Xinfa Buyi and Houchang Hui are dominant groups. FromMeihuashan on, the line goes in Liupanshui City. There are still Yi, Buyi, Hui & Miao inDiaspora along the line, including a Yi & Miao ethnic township called Yushe. In a word,the Ethnic Minority consistency of Guizhou is more then that in Yunnan along therailway line, but being nearby the city, they are not sensitive to the closure.2) Ethnic Minority Not Sensitive Project Land Acquisition & ResettlementThis report confirms: The ethnic communities along the line are not sensitive to theLang Acquisition & Resettlement for the following reasons:A: MOR is the paramount leader of railway construction in China. In the past decade,the railway construction in the ethnic minority area is part of its job, including the mostdifficult Qinghai-Tibet line in the ethnic complicated area. No ethnic sensitive issuehas ever arised in these constructions. This is a strong indication that MOR has richexperiences in constructing railway in ethnic minority areas. One of its experiences is touse the benefit of railway to enlist help from the local government in coping with localquestions. In this action, MOR especially emphasizes 3 points: observing the policy andlaw toward ethnic minority rights, respecting their culture and customs and,safeguarding their rights and interests in land acquisition, resettlement and construction.MOR's credit of compensation to the affected people is sound and MOR alsoemphasizes the importance of keeping or improving the living standard of the affectedresidents by the Project.

B: In recent years, the railway construction in the mountainous Southwest China hasbeen a routine. The Neiniang-Kunming Railway penetrating Weining Countydiagonally from Southeast to Northwest was not completed until 2003. TheGuiyang-Guiling railway is now under construction. Both lines meet the same typesof ethnic minorities of NRP III. Neither has incurred any ethnic issues. This is astrong indication that MOR's experience for safeguarding ethnic minority rights andinterests is highly relevant to the local conditions and its preparedness is adequate.C: The new line construction involves only small number of Yi, Hui, Miao in Diasporain YP Xuanwei and GP Weining. Being mixed with the Han for a long time, they haveidentical social structure, value concepts and development mentality with that of themainstream society, in spite of the fact some of them still retaining their ethnic language,clothing and festive customs. RAP Table 3-1 to 3-9 listed the limited size and impact ofland acquisition & resettlement to the local ethnic minority:

People Affected 11,290 612 personResettlement 14,103 person in 3,526 household 126p in 32h.(90 minorities).D: Most importantly, MOR has using WB loan for many times and thus is familiar withthe international conventions. Since 2004, China also has heightened the compensationstandard for promoting social harmony. Against this background, the Project RAP hasbeen formulated by an independent institution with due authority. After reviewing itscontents, this report confirms that RAP is authentic and sufficient in safeguarding therights and interests of all the peoples, including ethnic minorities affected by theconstruction of new lines. In fact, since MOR construction has the credit of sufficient,timely and direct compensation and has the tradition of careful arrangement of thepeople affected, residents along the line are eager to be included in the RAP. Duringthis survey, an official in the Longchang Town was still trying to lobby the RAP expert,in a joking way, to involve the land and house of his family into the project. Light ofthe fact, this report confirms that so long as the RAP is carried out strictly, no ethnicissue will occur in the contraction of the new line.

The Sensitivity of Closure Can Be Reduced by Coordination of PartiesThis report confirms that closing old line and stations part of this project will affect thetraffic & transportation facilities to the community and residents along the old lines.Among which, four townships along the provincial boundary has no high grade roads.So up-grade of local road should be encouraged.In light of this fact, this report proposes the following actions to the Project:A: add pedestrian or highway function to the Super Beikaizhu Bridge for connecting thepeople near the closing Homaling station to the New Beikiazhu in the design stage.Meanwhile, a stop near the present Caojiagou Stop near Meihuashan Station should beretained for the convenience of local residents of Ertang, Houchang and eastern Xinfatownships.

B: Move the current the Newv Banuokuia Station on the current design toward thedirection of Longchan Town as a center of the 4 townships between YP & GP. Therecommended substitute station site is an open mountain slope near Xingying village,about 3km to the northwest of Longchang Town. The 2nd Railway Survey and DesignInstitute has a comparison between Xingying and New Banuokuai. It reveals thatXingying is economically more feasible. This report adds social benefit to the Xingyingselection.

C: As an incentive, the MOR in its designing, constructing the new line and closing theold ones, tries to coordinate and integrate with the local highway planning of YP and GP.Moreover, it should try to develop the construction working roads and the bed, bridgeand tunnel of the old line into the framework of the new highway for connecting the oldstations to the new one. In this way, YP and GP would find they get twice result withhalf the effort.WB as a financial institution emphasizing the rights and interests ofetl-hnic minority and poor-aiding, in consideration of the interests of local ethnic minority,should try to arrange a small grant of million USD for this undertaking. It is estimatedthat with the aid of MOR Old Line facilities, the system could be established by aninvestment of 20 million RMB. Weining government has reported that the highway oflow degree from Adu Township in YP to Longchang has been completed.D: At last MOR and WB should have an uniform stand to negotiate with the twoprovince. A road system leading to both the new station and to the W-S highWay would

be furnished in this poverty stricken ethnic minority area. The 4 townships of YP andGP would be equipped with better infrastructure to getting rid of poverty and achievingdevelopment.

2.2.4 The impact of railway station closedown along the lineThe Additional Second Line Project of Liu-Zhan Railway will close 14 old railwaystations, all of which are in Qujing City of Yunan Province. They are Leju Station,Luopandi Station, Shushe Station, Banuokuai Station, Hemaling Station, BeikaizhuStation, Muga Station, Tianba Station, Dengjiacun Station, Xutun Station, GeyitouStation, Yanfang Station, Hongtugou Station and Lila Station.The reasons for station closedown are as follows. First, it is to promote the railwaytransport arrangement efficiency, because the lines between the former stations are shortand zigzag. Second, it is to cater for the new trend of passenger and freighttransportation, because the current railway passenger and freight transportation ismainly of long distance transportation, while the short distance transportation relies onKunqu Expressway and Qulu ENpressway as well as National Highways 213, 320, 324and 326. Actually, the transportation volumes of the stations to be closed graduallydecrease in the recent years. See Table 2-4 for details.

Proprietor together with governments of Yunnan and Guizhou provinces have workedout substitution measurements to guarantee outgoings of residents nearby the 14 closedstations along the line summarized into the following four aspects:A. Utilization of abandoned railway linesTotal length of the Project is 253 km including retained 50km of original line. Mostpart of the Project will take shortcut. Roadbeds of the railway lines to be removed willstill be put into use, which means the local residents may use those roadbeds, bridges,tunnels, access roads and even power lines, facilities and equipments which may berefomed to infrastructure favorable to local economic development upon reconstruction.The former roadbeds may be reformed to be sand & gravel roads and tractor-plowingroads, constituting part of the local higlhway network. With these facilities, it is expectedthat the residents can raise their living standards.

B. Utilization of engineering driftways.

Engineering roads will be kept as traffic passages for local village residents. The projectpasses mostly the hilly lands, and engineering roads with a total length of 146km areexpected to be built with most of the part as permanent traffic facilities for outgoingconvenience of local residents. Mileage of engineering roads at bordering area ofYunnan and Guizhou provinces will be longer for the part is located at mountainousarea.

C. Build short-mileage road links

The budget of RMB 3.7 million will be put into construction of short road links in orderto alleviate the affect on outgoings of local residents by close-down of stations. Shortlinks road system built around the closed stations along the line is shown in Table 2-5.

Liu-Zhan Railway will involve requisition of all kinds of land with a total area of20384.77 Mu (lMu=0.0667 hectares), including: cultivated land of 10284.45 Mu,garden plot of 2027.41 Mu, woodland of 1051.95 Mu, land for construction of1435.55 Mu, and unused land of 55585.415 Mu. The temporarily used land for construction of the Additional Second Line Project ofLiu-Zhan Railway refers to the temporarily-borrowed land during the construction ofthe Engineering, including stock yard, dumping yard, area for production and livingand temporary roads during construction, this Project will temporarily borrow allkinds of land with an area of 8866.65 Mu, including 7952.6 Mu for the railway lineworks, 914.05 Mu for the station & yard works and with the average period forborrowing of 4 years. 2.4 Houses to be affected

The total area of all kinds of houses and buildings needed to be removed due to theAdditional Second Line Project of Liu-Zhan Railway is 528857m 2(l 13,377m 2 forrailway line works and 415,480m 2 for station & yard works), with 14,103 people of3,526 households in 85 administrative villages of 23 townships (towns or streets)involved, including private or collective houses. Thereinto, houses with the structure

M2of brick and concrete covers an area of 103,464m , those with the structure of brickand timber 375,145m2 and those with the structure of earth and timber 50,248m2 ; inaddition, more than 50,000 trees and a few special facilities are affected. For theconstruction area of all kinds of houses and auxiliary facilities to be removed inprovinces, counties (cities or districts), see Table 2-11, Table 2-12 and Table 2-13.

2.5 Trees and tombs to be affected

This Project will have impact on the scattered trees that are around the houses andfields of immigrants, which are to be cut or transplanted due to landrequisition.50,230 scattered trees will be affected by the reconstruction of line of thisEngineering and 529 tombs need to be removed, and the construction of station &yard doesn't need migration of scattered trees and tombs. 3. Compensation policies and standards for resettlement

3.1 Policies

Main laws and policies on which the land requisition, relocation of residents andresettlement in this project are based:

(I) The Land Administration Lawt, of the People's Republic of China (Effective asof January 1st, 1999);

(2) Regulations for the implemnentation of the Land Admninistartion Law of thePeople's Republic of China (Decree No. 256 of the State Council of thePeople's Republic of China);

(3) Management Rules on Urban Houses Removal of the People's Repuiblic ofChina (Year 2001);

3.2 Compensation standards

Land and buildings involved in the land requisition and relocation of residents of theAdditional Second Line Project of Liu-zhan Railway shall all be compensatedaccording to actual impact conditions and pursuant to requirements of policies inSection 3.1. Relevant compensation standards are shown in Table 3-1, Table 3-2 andTable 3-3.

3.3 Supplement to and description of the standard

3.3.1 Basis for standard of house compensation

The standard of house compensation shall ensure that the compensation paid to theaffected people is enough for them to rebuild the new house of the same area andsame type under the new market price condition.

3.3.2 Procedure for market price evaluation of urban house to be demolishedThe amount of compensation for house to be demolished shall be determined on thebasis of the market price of real estate according to the location, use, decoration andbuilding area of the house.

The market price of the house to be demolished shall be estimated according to theCode for Real Estate Price Estimation and the Guide for Price Estimation of UrabanDemolished Houses by a qualified real estate assessment organization jointlyentrusted by the party of demolishing and the party of house ower.

3.3.3 Compensation standard for infrastructure constructionConstruction of infrastructure at resettlement sites includes site leveling, power supplyworks, water supply & drainage works and road works. The compensation fee of thisproject shall be calculated as 500 Yuan/ Person.

3.3.4 Compensation standard for land requisition

The compensation standards for requisition of various kinds of land in this project aredetermined according to relevant national and local compensation policies and theinvestigation conclusions on the average output value per Mu for three years in 2003of various kinds of land in areas affected by the project, and in combination With thespecific circumstances of areas affected by the project.

3.3.5 Compensation standard for temporary land useCompensation fees for temporary sites shall be determined respectively according tothe type of land and the time of occupation during construction of the project. Becausethe time of occupation of temporary sites in this project is relatively long, thecompensation for various kinds of land temnporarily occupied during construction invarious counties (cities, districts) of Guizhou Province and in Qujing City of YumnanProvince shall include compensation fees for young crop or trees and land lease fees.Among which the annual output value of paddy fields in Liupanshui City is 1150Yuan/Mu, while the output value of dry land is 716 Yuan/Mu; the annual output valueof cultivated land in Bijie City is 1000 Yuan/Mu; the annual output value of paddyfields (vegetable plots) is 1200 Yuan/Mu, while the annual output value of dry land is1000 Yuan/Mu.

The construction unit of the project shall be responsible for the reclamation of thetemporarily-use land in Guizhou and Yunnan Province. This is deemed to be one ofthe necessary conditions in acceptance check for construction completion.

3.3.6 Compensation standards for relocation and construction of governmentunits, enterprises and institutions

The compensation fee for relocation and construction of government units,enterprises and institutions includes the compensation fee for buildings and auxiliarybuildings, the compensation fee for relocation and the compensation fee for downtimeof enterprises. The compensation standards for buildings and auxiliary buildings shallbe the same with that for the urban migrants (according to market assessments, inwhich the overall average compensation fee for relocation shall be calculated as 10Yuan/M2 (building area of houses to be demolished) while for business shops, the

4. Proposal of resettlement and its implementation

4.1 General plan for resettlement of migrants

The Additional Second Line Project of Zhan-liu Railway will affect only the smallpart of houses and land for each village along the line, and will not cause great impactto the original production and living system. Migrant resettlement proposal has beendiscussed in the form of conversazione in the towns and villages involved, and inaccordance with the comments of the migrants and the actual situation of the impactedregions, it has been decided that: the residents affected by the Project shall be settledwithin the original community, it can in this way keep the original production andliving style, custom and the stability of social relationship of the migrants, is favorableof restoring or enhancing the production and living levels after land acquisition andremoval. For the purpose of reducing the influence of the Project construction on theproduction and living of the households to be removed, all the houses affected by theProject shall be removed after the new houses having been completed. All ruralhouseholds to be removed shall be settled within the scope of their respective villages,production and development shall be performed by giving priority to land resettlementand developing the secondary and third industry as complement. After the economiccompensation has been sent to the villages, the land adjustment is to be conductedwithin the same village (Residents Committee) or the same group, resettlement ofland for farmers to be carried out, The system of basic living safeguard for the farmerswhose land has been requisitioned in some villages greatly affected by landrequisition shall be established in accordance with the local relevant policies.

4.2 Planning for resettlement of migrants

4.2.1 Planning for resettlement of production

4.2.1.1 Rural residents to be affected

The degree of influence to each village and group for land requisition of engineeringconstruction is quite different, planning of restoration for corresponding productionresettlement has been worked out by local relevant authorities and the migrantsaccording to the actual situations and land requisition of each village. Planning forrestoration of production resettlement to be adopted in each village can be summed upas follows:

A. Land adjustment within the scope of whole village or whole group shall beemployed for the villages relatively larger affected by land requisition. Forvillages where villagers averagely have relatively small amount of cultivatedland, the villagers will be resettled as non-farming houshoulds. Besides thecompensation for land requisition, the affected people will get more resettlementcompensation acccording to the minimum living gurantee standard as well as thesocial insurance police. The department in charge of resettlement will launchemployement training for villages who have labour abilities. The employment ofthese villagers will take the advantage of the railway station nearby. They canhave priority to hold the positions related to the production and living activitieswithin the station, such as goods handling, cleaning, food & beverage and trade.The local department in charge of resettlement will also arrange the trainedvillagers to the coastal or outside organizations via the labour exportingdepartment .

B. The villages whose land requisition is less or whose land is mostly bare,proposal of resettlement is also subject to the comments of the migrants and thediscussion in villagers' representative meeting, and generally, land adjustmentwithin the scope of whole village or whole group shall not be adopted, exceptthe compensation of young crop to be paid directly to the land contractor, thedistribution and use methods for the rest expenses are as follows:

a. The flexible land possessed collectively by some villages shall be adjustedto the migrants whose land has been used, the compensation of land ismainly used to improve infrastructure, subsidies of resettlement shall becontrolled by collectivity of village or group for development of the 2"dand 3rd industries or distributed in average to the villagers of the wholevillage or whole group on the basis of land adjustment.

b. For the villages have no or less flexible land, and land adjustment within isquite difficult or big amount of working quantity, as well as difficult tohandle, the loss of the villagers shall be compensated in the second roundland contracting period, the remaining expenses shall be shared by thevillagers of the whole village, and land adjustment shall be completed inthe third land contracting period.

directly to the farmer whose land has been requisitioned.

4.2.1.2 Enterprises and public institutions to be affectedThe enterprises and public institutions to be affected mainly center in towns along theLiu-Zhan Railway where the population is dense, including enterprise, school,hospital and other organizations. Besides the receivable compensation as per theprocedure and contract, the production type emterprises will immigrate into the localindustrial park of the cities and town, and special lands will be allocated to shops,schools and hospitals, in order to ensure the reconstruction of affected organizationand restoration of production.

4.2.1.3 The infrastructure to be affected

The infrastructures such as irrigation works, power and roads to be affected by theAdditional Second Line Project of Liu-Zhan Railway will be restored by the lenderaccording to the actual conditions and in a way to facilitate the production and livingconditions. In the project design, the lending institution will, together with the localgovernment and the affected people, determine the method of restoration according tothe result of fied investigation. During the acceptance check upon the project deliveryafter completion, the restoration of infrastructures is deemed to be one of thenecessary conditions.

4.2.2 Planning for relocation of migrants

4.2.2.1 Selection of the house sites for the migrants and its standard3526 households of residents affected by the Project are distributed in 85administrative villages of 23 towns. The villagers affected within the urban planningshall be arranged incorporating into urban resettlement areas or in currency. Themethod of resettlement for most of rural residents shall be of at the place nearby.According to above characteristics and combining with local situation, the house sitefor settlement of migrants shall be profited of the adjacent roads within the villages orgroups and the wasted hillside land near the existed relatively centralized residentialarea, the houses shall be built in dispersion, occupation of cultivated land shall betried to avoid, and distribution of residential areas be relatively centralized. Thestandard of residential house site shall be implemented as per the relevant stipulationsof each county (city or district).

4.2.2.2 Site leveling and infrastructure planning

(I) Site leveling

Because the house site for settlement of migrants shall be built mostly in dispersion,and the wasted hillside land within the villages or groups shall be used as house site,generally speaking, geological conditions for the house site selected are good, housescan be built by leveling, the new and relatively centralized resettlement area for theaffected villagers shall be defined in accordance with the new rural planning, siteleveling for the resettlement area shall be conducted by the department of resettlement,meanwhile, the affected villagers can also select themselves the places of building thehouses. The house site for dispersed house to adopted by the migrants shall be leveledmainly by the migrants themselves. Resettlement houses within the scope of urbanplanning shall be principally centralized ones, and site leveling is to be performedmainly by the unit in charge of resettlement.

(II) Infrastructure

(1) Water supply for the migrants

Existed village water supply network or wells drilled by each householdshall be adopted in accordance with the current status of residentsaffected by the Project.

(2) Power supply

220V cable shall be connected into the households by making use of theexisting village power supply facilities within resettlement area.

(3) Roads

The new house site for the migrants shall be arranged near the existingroads and relatively centralized population areas, no necessary toconstruct new roads.. For the originally relatively dispersed residents,this arrangement shall radically solve the inconvenience of originaltraffic.

(4) Broadcasting and television

The migrants can install the receiving units by profiting of the existingbroadcasting facilities within the resettlement area, simultaneously, theoriginal TV receiving units for the migrants can be reinstalled in theresettlement area, and can also watch TV by making use of the existingreceiving units inside the resettlement area.

(5) Hospitalizing and schooling

In principle, the resettlement of the migrants for the Project shall bemoved to the existing large centralized residential area. Afterresettlement, they can profit of current school as well as medical

treatment and sanitary facilities, hospitalizing and schooling conditionshall be improved.

4.2.2.3 Construction of houses for the migrants

Migrants' living habit and adapting to the agricultural requirements, as well asreservation of proper development space shall be taken into consideration as theconstruction of houses. Construction of houses shall be done by the migrantsthemselves to their willing, compensation of houses shall be paid by stages inaccordance with the prepared materials and house construction progress.In addition, during house construction period, the migrants shall arranged theirtemporary lodging, such as seeking refuges with relatives or friends, renting housing,the criteria of expenses shall be of 5-10 Yuan/mr2 per capita and per month (calculatedon a 3-month basis), and shall be paid directly to the migrants in lump sum by themigrant administrative organ. Transportation cost for removal is to be calculated asper 300Yuan/household.

4.2.3 Configuration of social service establishment in the resettlement areaLand requisition for project construction shall generally not influence the socialservice-establishments such as school and medical treatment point. The migrants canstill make use of the former school, clinic and commercial network, no necessary fornew construction. furthermore, the distance from the residential area after removal tothe original service establishments is basically the same.

4.2.4 Management of community

All the migrants for the Project shall be resettled within the range of respectivevillages or groups. Therefore, the current administrative system shall keep no change,still under domination of the original villages (towns, streets).

4.2.5 Organization and management on resettlement implementation

Resettlement implementation plan will be organized by the construction unit and therelated provincial people's government; the resettlement organization will beestablished by the personnel from the related departments in various counties (cities,districts) where influenced by the Project-Construction Office of Additional SecondLine of Zhan-Liu Railway to formulate the resettlement policy and take charge ofpromotion, mobilization, organization and implementation of resettlement.Meanwhile, the resettlement organization is a main channel for the migrants to reflecttheir problems. The resettlement organization shall listen, collect and settle thesuggestions of the migrants in time and report to the higher authorities or the relateddepartment in charge; meanwhile it shall feedback the treatment to the migrants intime. See the "Organization Chart for Land Requisition, Relocation of Residents andSettlement under Liu-Zhan Railway Project" hereunder.

4.3 Process of resettlement implementation plan

4.3.1 Work flow

6. Public participation in implementation of RAP

This RAP encourage public participation all through the implementation:

A. Participation in relocation and rebuild of houses

a. Compensation standard for houses

Compensation rate influence directly on setters' interests. Related resettlementunits shall consult and sign agreement with migrants before the demolishment andrelocation of houses. Consultation results shall be put on the notice to besupervised by the masses..

b. Rebuild sites and building ways

Related departments have conducted survey on rebuild sites and building waysduring preparation and formulation period of RAP. According to survey results,most migrants prefer to be relocated in newly planned area within the village andare willing to demolish and rebuild by themselves. Local governments shallprovide corTesponding support in every rebuild stage.c. Disposal of old houses

All migrants will be compensated by replacement price principle. During thescheduled period of time, houses can be rebuild before demolished or demolishedbefore rebuild, and allowance for temperary residence will be granted for thosewhose houses are demolished before rebuild. Materials from demolished housesgo to migrants.

B. Participation in production resettlementLand adjustment and distritution must consult with migrants and pass upondiscussion in the villagers' representative assembly.

C. Participation in use and management of land compensation fundLand compensation fund is owned by village collectivity prohibited from withholdand embezzlement by any unit or individual. Compensation fund will beintegrated into unified planning of the villige collectivity to ensure specificpurpose only. Use of the fund must pass upon discussion in the villagers'representative assembly subject to supervision of villagers.

D. Participation in project constructionProject construction will have influence on local environment more or less,especially of selection of temperarily-used land, construction and use of poineerroads, living facilities of workers and other problems which will affect localpeople. To guaranttee APs can be benefited from the project, peoples areencouraged to participate in project construction and will be provided withbuilding materials and employment opportunities.

7. Appealing mechanism and channels

Migrants are encouraged to participate in formulation and implementation of the RAPall the time. However variuos problems still occur more or less in practice. Besidesexisting appealing channels by letters and visits with local governments of all levels,the Project established transparent and effective appealing channels for rural migrantsto get construction and land acquisition under smooth way. Detailed appealingprocecure are as follows:

Step 1:

Migrants can lodge a complaint in words or by written with village (residents)committee or local town (street) resettlement working team for any discontentmentwith RAP. Village is required to deal with and record appeals in words. Reasonablerequiements and suggestions shall be settled within 2 weeks upon received by localtown (street) resettlement working team.

Step 2:

Where migrants are still discontent with the solution in step 1, they are entitled tolodge an appeal with construction headquerter and its project office upon receiving ofsolution by step 1, and construction headquerter and its project office shall make asolution within 2 weeks upon receiving of appeal.

Step 3:

Where migrants are still discontent with the solution in step 2, they can lodge anappeal with Provincial Leading Office for Important Construction which shall make adecision with 2 weeks upon acceptance.

Step 4:

And migrants can finally appeal to civil court upon receiving solution by step 3 bylaw of civil procedure if they feel still discontent with the solution.Migrants can lodge an appeal in regard to to any aspect of RAP, includingcompensation rate.

Above mentioned appealing channels will be annouced to migrants by meetings orother ways to make them fully understand that they have the right to appeal. And atthe same time, make it publicize by mass media and compile opinions and suggestionsfrom all directions for prompt attention of resettlement units of all levels.Organizations accepting appeals don't charge for any appeal, and the cost occurredtherein will be paid by resettlement units through contingency fund.

8. Monitoring and evaluation

Monitoring will be conducted by inside monitoring and outside independentmonitoring seperately.

8.1. Inside monitoring

Led by Construction Headquarter, inside monitoring will be conducted byconstruction leading groups of county ( cityu, district) level and villages. Professionalstaff will engage in monitoring work according to the RAP and follow the monitoringimplementation procedure stipulated in World Bank policies.

8.2. Outside independent monitoring and evaluation

Foreign Capital Center of MOR has engaged Foreign Capital Introduction andUtilization Institute(FCIUI) of Southwest Jiaotong University as ResettlementMonitoring Unit of the Project. FCIUI is experienced in resettlement as well asresettlement under World Bank projects. Listed herewith are some of resettlementmonitoring and evaluation tasks under World Bank loan projects as well asresettlement plan and resettlement support carried out by FCIUI.:

A. Resettlement monitoring and evaluation on World Bank Loan 6th Batch ofChina Railway Construction Projects;

B. Resettlement monitoring and evaluation on World Bank Loan YunnanProvince Environment Protection Project;

C. Instruction on RAP fonnulation of World Bank Loan Sichuan ProvinceElectric Power Transmission Project;

D. Resettlement monitoring and evaluation on World Bank Loan Second Lineof Baoji-Lanzhou Railway Project;

E. Resettlement monitoring and evaluation on World Bank Loan SichuanProvince Evironment Protection Project;

F. Resettlement monitoring and evaluation on World Bank Loan ChongqingG. Evironment Protection Project.

Monitoring and evaluation are according to the RAP and based on data provided bysurvey design unit and resettlement implementation unit. Spot check and fastevaluation will be adopted in monitoring and evaluation work subject to completesurvey and understand. Resettlement sampling scale: Affected people (migrants): 5%;Affected villages: 10%; Enterprises and industrial and commercial units: 20%.Outside monitoring and evaluation units shall also carry out the following works::
