UNDER SECTIONS 42(4), 44(1) OR 45(4)

OF THE LAND ADMINISTRATION ACT 1997

The proposal detailed in this report is required by the above provisions to be laidbefore each House of Parliament.

Section 43 of the Land Administration Act 1997 provides as follows:

43(1) lf, after a proposal is laid before each House of Parliament under Sections42(4), 44(1) or 45(4) notice of a resolution disallowing the proposal

(a) is not given in either House of Parliament within 14 sitting days of thatHouse after the proposal was laid before it, the proposed reduction,excision, cancellation, change, grant or permission may beimplemented by order after the last day of the later of those periods of14 sitting days;

(b) is given in either or both of the Houses of Parliament within 14 sittingdays of that House, or each of those Houses, after the proposal waslaid before it, but that resolution is not lost in that House or each ofthose Houses within 30 sitting days after the proposal was laid before it,the proposed reduction, excision, cancellation, change, grant orpermission lapses; or

(c) is given in either or both of the Houses of Parliament within 14 sittingdays of that House, or each of those Houses, after the proposal waslaid before it, but that resolution is lost in that House or each of thoseHouses within 30 sitting days after the proposal was laid before it, theproposed reduction, excision, cancellation, change, grant or permissionmay be implemented by order after that loss or after the later of thoselosses, as the case requires.

(2) It does not matter whether or not a number of sitting days referred to insubsection (1) or some of them occur during

(a) the same session of Parliament; or

(b) the same Parliament,

as that in which the relevant proposal is laid beforeconcerned.

AMENDMENT TO CLASS A RESERVE 22429 UNDER SECTION 42(4)(b)OF LAND ADMINISTRATION ACT 1997 (LAA)

It is proposed to excise an area from Class 'A' Reserve 22429 for the purposeof creating a road to facilitate the Mundijong Road extension. Reserve 22429is set aside for the purpose of "Recreation and Parklands" and has not beenmanaged since its creation in 1944.

The City proposes to extend Mundijong Road between Baldivis Road andMandurah Road to complete a road link between the Kwinana Freeway andRockingham City centre.

The new link will provide commuter access to the City centre and StirlingNaval Base via Dixon Road, a strategic freight route both from the east andsouth to the east Rockingham and Kwinana industrial areas, east from theSouth West Highway via Mundijong Road and south via the New Perth toBunbury Highway and the Kwinana Freeway.

More than $6 million in Federal funding has been secured by the City to helpbuild the five kilometre extension of Mundijong Road with theState Government providing additional funding to enable project completion.

Part of the Mundijong Road extension requires the excision and dedication ofportion of Reserve 22429 as shown at Annexure 1 and further identified asLots 911 and 912. The extension will involve the excision of 2.7995 hectaresfrom the reserve which currently comprises 50.2671 hectares.

The City has advertised the proposed excision within The West Australian andsign posted the area, no comments for objections were received from thepublic. The proposal was also published in The West Australian newspaper inaccordance with section 42(5) of the LAA on 19 October 2011. A copy of theadvertisement is shown at Annexure 2. At the conclusion of the period forcomments/objections, no submissions were received.

The Rockingham Kwinana Development Office has advised the Member forRockingham and each Member from the South Metropolitan Region havebeen briefed all of whom have been supportive of the proposed.

As Reserve 22429 has Class 'A' status, it is necessary to obtain the approvalof both Houses of Parliament to excise a portion for road.
