I, MICHAELIA CASH, Assistant Minister for Immigration and Border Protection, acting under

Subclause 186.234(3) and paragraphs 186.221(b), 186.222(b), 186.231(b), 186.232(b), 187.221(b),

187.222(b), 187.231(b), 187.232(b), 187.234(a) and sub-subparagraph 5.19(4)(h)(ii)(D) of the

Migration Regulations 1994 (the Regulations):

1. REVOKE Instruments IMMI 12/059 (F2012L01292), signed on 12 June 2012, IMMI 12/060

(F2012L01283), signed on 12 June 2012, and IMMI 13/059 (F2013L01147), signed on 21 June

2013; and

2. SPECIFY the following class of persons for the purposes of subclause 186.234(3) and paragraphs

186.222(b), 186.232(b), 187.222(b), 187.232(b) and 187.234(a) of the Regulations:

Class 1

Persons who have applied under the Regulations for a visa, and whose earnings will be at least

equivalent to the current Australian Tax Office’s top individual income tax rate.

3. SPECIFY the following class of persons for the purposes of paragraph 187.234(a) of the

Regulations

Class 2

Persons who hold Subclass 444 – Special Category visa; or Subclass 461 – New Zealand Citizen

Family Relationship (Temporary) visa and who have been working in their nominated

occupation for their nominating employer for at least two years (excluding any periods of unpaid

leave) in the previous three years, immediately before applying for their Subclass 187 –

Regional Sponsored Migration Scheme visa.

4. SPECIFY the following class of persons for the purpose of paragraphs 186.222(b) and 187.222(b)

of the Regulations:

Class 3

Persons who have completed at least five years of full-time study in a secondary and/or higher

education institution where all of the tuition was delivered in English.

5. SPECIFY the following class of persons for the purposes of subclause 186.234(3) of the

Regulations:

Class 4

Persons who are employed in certain occupations, as follows:

a) Researchers, scientists and technical specialists at the ANZSCO skill levels one or two,

who have applied for a visa under the Regulations to occupy a position as nominated by

Australian scientific government agencies; and

b) Academics who have applied for a visa under the Regulations to occupy a position as

nominated by an Australian university in Australia. An academic is a person to be

employed at an Academic Level of A, B, C, D or E, in the position of a:

i. University Tutor (ANZSCO: 242112);

ii. University Lecturer (ANZSCO: 242111); or

iii. Faculty Head (ANZSCO: 134411).

6. SPECIFY the following class of persons for the purposes of paragraphs 186.221(b), 186.231(b),

187.221(b) and 187.231(b) of the Regulations:

Class 5

Persons who are employed in certain occupations, as follows:

a) researchers, scientists and technical specialists at the ANZSCO skill levels one or two, who

have applied for a visa under the Regulations to occupy a position as nominated by

Australian scientific government agencies; or

b) senior academics who have applied for a visa under the Regulations to occupy a position as

nominated by an Australian university in Australia. A senior academic is a person to be

employed at an Academic Level of B, C, D or E, as a:

i. University Lecturer (ANZSCO 242111); or

ii. Faculty Head (ANZSCO 134411).

7. SPECIFY the following classes of persons for the purposes of paragraphs 186.221(b) and

187.221(b) of the Regulations:

Class 6

Persons:

a) who have been working for their nominating employer as the holder of a Subclass 457 –

Temporary Work (Skilled) visa for at least four years immediately before applying for their

Subclass 186 or Subclass 187 visa; and whose annual earning for each year in the four year

period was at least equivalent to the Fair Work High Income Threshold; or

b) Medical practitioners (ANZSCO MINOR GROUP 253):

i. who have been working in their nominated occupation as the holder of a Subclass

457 – Temporary Work (Skilled) visa for at least four years immediately before

applying for their Subclass 186 or Subclass 187 visa;

ii. this employment was located in regional Australia, as prescribed in an instrument in

writing made under subregulation 5.19(7), for at least two of these years; and

iii. whose nominated position is located in regional Australia, as prescribed in an

instrument in writing made under subregulation 5.19(7); or

c) Medical practitioners (ANZSCO MINOR GROUP 253):

i. who have been working in their nominated occupation as the holder of a Subclass

422 – Medical Practitioner visa before becoming a holder of a Subclass 457 –

Temporary Work (Skilled) visa at least two years in the four years immediately

before applying for their Subclass 186 or Subclass 187 visa;

ii. this employment was located in regional Australia, as prescribed in an instrument in

writing made under subregulation 5.19(7), for at least two of these years; and

iii. whose nominated position is located in regional Australia, as prescribed in an

instrument in writing made under subregulation 5.19(7).

8. SPECIFY the following class of persons for the purposes of subclause 186.231(b) and paragraph

187.231(b) of the Regulations:

Class 7

Persons:

a) Persons who hold Subclass 444 – Special Category visa; or Subclass 461 – New Zealand

Citizen Family Relationship (Temporary) visa and who have been working in their

nominated occupation for their nominating employer for at least two years (excluding any

periods of unpaid leave) in the previous three years, immediately before applying for their

Subclass 186 – Employer Nomination Scheme visa or Subclass 187 – Regional Sponsored

Migration Scheme visa.: or

b) Medical practitioners (ANZSCO MINOR GROUP 253):

422 – Medical Practitioner visa for at least the four years immediately before

applying for their visa;

ii. this employment is located in regional Australia, as prescribed in an instrument in

writing made under subregulation 5.19(7), for at least two of these years; and

iii. whose nominated position is located in regional Australia, as prescribed in an

instrument in writing made under subregulation 5.19(7); or

c) Medical practitioners (ANZSCO MINOR GROUP 253):

i. who have been working in their nominated occupation as the holder of a Subclass

422 – Medical Practitioner visa before becoming a holder of a Subclass 457 –

Temporary Work (Skilled) visa in the four years immediately before applying for

their Subclass 186 or Subclass 187 visa;

ii. this employment was located in regional Australia, as prescribed in an instrument in

writing made under subregulation 5.19(7), for at least two of these years; and

iii. whose nominated position is located in regional Australia, as prescribed in an

instrument in writing made under subregulation 5.19(7).

9. SPECIFY the following occupations in Schedule A for the purposes of sub-subparagraph

5.19(4)(h)(ii)(D) of the Regulations, that the tasks to be performed in the position correspond to

the tasks of an occupation at the skill level of ANZSCO skill level one, two, or three.

This Instrument, IMMI 15/083, commences on 1 July 2015.

186.234(2)(a))

I, MICHAELIA CASH, Assistant Minister for Immigration and Border Protection, acting under

regulation 1.03, subregulations 1.15I(1) and 2.26B(1), paragraphs 2.72(10)(aa) and 2.72I(5)(ba),

sub-subparagraph 5.19(4)(h)(i)(A), Item 4(a) of the table in subitem 1137(4), Item 4(a) of the

table in subitem 1138(4) and Item 4(a) of the table in subitem 1230(4), paragraph 1229(3)(k)

and paragraph 186.234(2)(a) of the Migration Regulations 1994 (the Regulations):

1. SPECIFY for the purposes of paragraph 2.72(10)(aa) of the Regulations, the occupation

and its corresponding 6-digit code listed in Columns A and B of Schedule 1 to this

Instrument; and

2. SPECIFY, in relation to a person who is nominated by a State or Territory government

agency, or the spouse or de facto partner of a person who is nominated by a State or

Territory government agency, and who is issued an invitation, on or after 1 July 2015 to

make an application for a:

a) Subclass 190 Skilled – Nominated visa; or

b) Subclass 489 Skilled – Regional (Provisional) visa;

and, if applicable, in relation to the spouse or de facto partner of that person:

i. the occupation listed in Column A of Schedule 1 to this Instrument is to be a

skilled occupation that is applicable to the person, for the purposes of paragraph

1.15I(1)(a) of the Regulations; and

ii. the person or body listed in Column D of Schedule 1 to this Instrument is the

relevant assessing authority for the corresponding skilled occupation listed in

Column A of Schedule 1 to this Instrument, for the purposes of paragraph

2.26B(1)(a) of the Regulations; and

iii. the country or countries corresponding to the skilled occupation listed in

Column A of Schedule 1 to this Instrument and relevant assessing authority

listed in Column D of Schedule 1 to this Instrument as the country or countries

for which the specified person or body is the relevant assessing authority for the

purposes of an application for a skills assessment in that skilled occupation,

made by a resident of one of those countries included in Column C of Schedule

1 to this Instrument, for the purposes of paragraph 2.26B(1)(b) of the

Regulations; and

iv. the skilled occupation in Column A of Schedule 1 to this Instrument that is

applicable to the person, for the purposes of Item 4(a) of the table in subitem

1138(4) and Item 4(a) of the table in subitem 1230(4) of Schedule 1 to the

Regulations; and

3. SPECIFY for the purposes of sub-subparagraph 5.19(4)(h)(i)(A) of the Regulations, the

occupation listed in Column A of Schedule 1 to this Instrument, in relation to an

application for approval of a nomination made on or after 1 July 2015 for a Subclass 186

(Employer Nomination Scheme) visa; and

4. SPECIFY for the purposes of paragraph 186.234(2)(a) of Schedule 2 to the Regulations,

each person or body listed in Column D of Schedule 1 to this Instrument as the assessing

authority for the corresponding occupation listed in Column A of Schedule 1 to this

Instrument, in relation to a person who applies on or after 1 July 2015 for a Subclass 186

(Employer Nomination Scheme) visa; and

5. SPECIFY for the purposes of paragraph 2.72I(5)(ba) of the Regulations, the occupation

and their corresponding 6-digit code listed in Columns A and B of Schedule 1 to this

Instrument, in relation to the nominated occupational training in an application made on

or after 1 July 2015 for a Subclass 402 (Training and Research) visa; and

6. SPECIFY for the purposes of regulation 1.03 of the Regulations, that the meaning of

ANZSCO is the Australian and New Zealand Standard Classification of Occupations

published by the Australian Bureau of Statistics and current as at 1 July 2015.

7. All specifications in the attached Schedule 1 to this Instrument are to be interpreted

according to the qualifications in the Notes attached to this Instrument.

This Instrument, IMMI 15/108, commences on 1 July 2015.

187.221(b), 187.222(b), 187.231(b), 187.232(b), 187.234(a) and

Sub-subparagraph 5.19(4)(h)(ii)(D))

1. The Instrument is made under subclause 186.234(3) and paragraphs 186.221(b),

186.222(b), 186.231(b), 186.232(b), 187.221(b), 187.222(b), 187.231(b), 187.232(b),

187.234(a) and sub-subparagraph 5.19(4)(h)(ii)(D) of the Migration Regulations 1994

(the Regulations).

2. The Instrument revokes Department of Immigration and Borer Protection Instruments

IMMI 12/059 (F2012L01292), IMMI 12/060 (F2012L01283) and IMMI 13/059

(F2013L01147).

3. The purpose of the Instrument is to combine the contents of a number of Instruments,

IMMI 12/059, IMMI 12/060, and IMMI 13/059; and to update the occupations listed as

eligible occupations for nomination for a Subclass 187 (Regional Sponsored Migration

Scheme (RSMS)) visa in the Direct Entry stream.

4. The Instrument operates to specify:

a. the class of persons who are exempt from satisfying the primary criteria in relation

to English language for a Subclass 186 (Employer Nomination Scheme (ENS)) or a

Subclass 187 (RSMS) visa in the Direct Entry stream;

b. the class of persons who are exempt from satisfying the primary criteria in relation

to English language for a Subclass 186 (ENS) visa or a Subclass 187 (RSMS) visa

in the Temporary Residence Transition stream;

c. the class of persons who are exempt from satisfying the primary criteria in relation

to skills for the relevant occupation at the time of application for a Subclass 186

(ENS) or a Subclass 187 (RSMS) visa in the Direct Entry stream;

d. the class of persons who are exempt from satisfying the primary criteria in relation

to skills for the relevant occupation at the time of application for a Subclass 186

(ENS) or a Subclass 187 (RSMS) visa in the Temporary Residence Transition

stream;

e. the class of persons who are exempt from satisfying the primary criteria in relation

to being less than 50 years of age at the time of application for a Subclass 186

(ENS) or a Subclass 187 (RSMS) visa in the Direct Entry stream;

f. the class of persons who are exempt from satisfying the primary criteria in relation

5. The department did not undertake specific consultation in regards to the eligible

occupations change as it impacts on one occupation only.

6. The Office of Best Practice Regulation (OBPR) has advised that a Regulatory Impact

Statement is not required (OBPR Ref 17847).

7. Under section 44 of the Legislative Instruments Act 2003 the Instrument is exempt from

disallowance and therefore a Statement of Compatibility with Human Rights is not

required.
