Free prekindergarten has been extended to students who have ever been in foster care. The Texas Education Agency (TEA) is

working with Texas Department of Family and Protective Services (DFPS) to determine documentation requirements.

School districts will receive state funding for students at least age 21 or less than age 26 on the first day of September and are attending school to complete the requirements for a high school diploma. [TEC 25.001(a)]

School districts may admit students at least age 21 or less than age 26 on the first day of September 1 if they are attending to complete requirements for a high school diploma [TEC 25.001(b)]

Students ages 22 and less than 26 on September 1 will not receive state funding weighted for student receiving special education services, however other state funding weights will apply.

Students who have been out of public school for 3 years cannot be in the same classroom, cafeteria or district sanctioned activity with students 18 years of age or under unless the event is open to the public. [TEC 25.001(b-2)]

Student Attendance Accounting Update HB 1137

Students 21 and over in age are not eligible for Disciplinary Alternative Education Program (DAEP) or Juvenile Justice Alternative Education Program (JJAEP) placements for conduct requiring placement for students younger than 21. Admission will be revoked for students 21 years of age or older who engage in conduct which would require placement for younger students. [TEC 25.001 (b-1)]

School districts may adopt policies to require students under 21 years of age to attend through the end of the school year. [TEC 25.085 (f)]

Students in attendance between 75% and 90% of the days a class is offered may receive credit for the class if the student completes a plan approved by the  school's principal. Students under jurisdiction of a court in a criminal or juvenile justice proceeding must have the consent of the judge presiding over the student’s case. [TEC 25.092(a-1)]

Excused absences – Students in grades 6-12 who play TAPS at a military honors funeral in Texas for a deceased veteran would receive and excused absence. These students would have a reasonable amount of time to make up in missed school work and would be counted for compulsory attendance. [TEC 25.087(c)]

A school district board of trustees may adopt a policy to require a person who voluntarily enrolls or attends school after their 18th birthday to attend school to the end of the school year. [TEC 25.085(f)]

Texas Education Code 25.094 (Failure to attend school) related to committing an offense for failure to attend school would apply to these students.

Texas Education Code 25.093 (parent contributing to nonattendance) and Texas Education Code 25.095 (warning notices to parents for nonattendance) would not apply to these students.

Student Attendance Accounting Update HB 2884/SB 1161

If a student fails to attend school without excuse on 10 or more days or parts parts of days within a six-month period in the same school year, a school district shall file a complaint against the student or student’s parent or both within 10 [seven] school days of the student's last absence. [TEC 25.0951 (a)]
