STORAGE LOCKER AGREEMENT

This Storage Locker Agreement (“Locker Agreement”) between Harbour Cove Marina (“Marina”) and the undersigned (“Lessee”), is made effective as of __________________, 2015. Lease and Term: Marina agrees to lease to Lessee, land locker storage space (“Locker”) ___# _____located at Harbour Cove Mariana, 5910 Vacation Lane, Deale, Maryland 20751, for a term beginning on April 1, 2015 and ending on March 31st, 2016. Fee: Lessee agrees to pay a rental fee of $180.00 (One Hundred Eighty, U.S. Dollars) in full and in advance for the rental of the Locker. Use/Prohibited Activities: Lessee understands that the Locker is provided for the primary purpose of dry storage of equipment normally or incidentally used in connection with the ownership and operation of recreational and sport fishing vessels. Lessee may use the Locker for storage only, and may not conduct commercial activities nor operate a business or workshop utilizing the Locker. No persons shall be allowed to sleep or live in the Locker. Lessee may not store perishable goods or items, toxic, hazardous, flammable or other any items in or about the Locker which may be prohibited by a standard form of fire insurance policy or which may increase the existing rate of insurance upon the building in which Locker is located. Lessee agrees to remove and properly dispose of any such items upon demand by Marina. Lessee shall not commit, nor suffer to be committed, any waste or nuisance or other act or thing which may disturb the quiet use or enjoyment of any other Locker lessee. Lessee shall not permit persons who are not Lessee’s guests or invitees to enter upon or gain access to the Locker area. Access: Lessee agrees to provide Marina access to the Locker space for emergencies, fire safety, and ordinary maintenance and repair. Lessee agrees not to block access to other storage locker spaces at the Marina. Lessee hereby grants Marina the right to enter and inspect the contents of the Locker, with or without notice, to ascertain whether Lessee is in compliance with this Locker Agreement and applicable laws and regulations. Maintenance: Lessee shall at all times keep and maintain the Locker and every part thereof in a good and sanitary order, condition and repair. End of Lease: Upon termination of the lease granted herein, Lessee shall immediately vacate the Locker, remove personal property therefrom, and restore possession of the Locker to Marina in good order and repair. Breach /Termination: In the event of any breach of Lessee’s obligations under this Locker Agreement, Marina shall have the right of re-entry and may remove all persons and property from the Locker. Additionally, Marina reserves the right to terminate this Agreement at any time by giving Lessee thirty (30) days written notice of its intention to do so. In the event, Lessee fails to remove any personal property from Locker within the thirty (30) days period after termination or Lessee’s breach of this Agreement, Marina reserves the right to have such property removed at the cost and expense of Lessee. In such an event, Marina shall be relieved of any liability with respect to such goods therefore or thereafter incurred. If Lessee does not pay any unpaid balance of storage fees, Marina after giving Lessee an advance thirty (30) days written notice, may treat the property as abandoned. Marina may, at its option, dispose of such property in accordance with Maryland law up to and including sell such property in a commercially reasonable manner. The proceeds would be applied to the costs of sale and any unpaid storage fees. Rules and Regulations: Lessee understands and agrees to comply with all Marina rules and regulations, as well as the rules, regulations and instructions of the United States Coast Guard, local harbor authorities, the Marina Dock master or other authorized representatives of Marina. Risk of Loss: In taking possession of the Locker and accessing or otherwise utilizing Marina property and facilities under this Locker Agreement, Lessee acknowledges (s) he does so at Lessee’s own risk of loss or injury. MAKES NO WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE CONDTION OF THE LOCKER, LOCKER DOORS, LIGHTING, ELECTRICAL FIXTURES, VENTILATION OR OTHER CONDTIONS OF THE LOCKER OR THE BUILDING WHERE LOCKER IS LOCATED. MARINA DOES NOT WARRANT THE SUITABLITY OF THE LOCKER FOR LESSEE’S INTENDED USE. Indemnity: Marina shall not be liable for, and Lessee (on behalf of Lessee and Lessee’s agents, employees, guests and invitees) hereby waives all claims against Marina for damages or other loss, injury or damage whether direct, consequential or incidental, and regardless of cause of or source of injury, including litigation costs (collectively “Claims”) resulting from Lessee’s use of or access to the Locker, including but not limited to, damage to goods or property stored in the Locker, or for personal injury suffered by Lessee or guests or invitees of Lessee. Lessee shall insure, defend, indemnify and hold harmless Marina and Marina’s owners, officers, employees, agents, suppliers, guests and invitees, from such claims at Lessee’s sole expense. IT IS LESSEE’S RESPONSIBILITY TO OBTAIN INSURANCE ANGAINST LOSS OR DAMAGE TO LESSEE’S PROPERTY STORED IN THE LOCKER. Amendment: This Locker Agreement is an amendment to the Harbour Cove Marina 2015 Rental Agreement, (“Rental Agreement”), dated_________ between the parties and is incorporated by reference and made a part of the Rental Agreement. Governing Law: This Locker Agreement shall be governed by, and construed and enforced in accordance with the Laws of the State of Maryland. Entire Agreement: This Locker Agreement constitutes the entire agreement between the parties as it relates to the Locker, supersedes all prior agreements or understandings between the parties and may not be modified without their prior written consent. By executing this Locker Agreement, Lessee acknowledges and agrees (s) he has read, understands and approves this Locker Agreement and agrees to be bound.
