resourceful and experienced persons/firms/companies capable of undertaking the job of maintenance for Guest House at VISL House, 2nd Floor, No. 8, J.C. Road, & Transit House,Flat No. A 513, Yamuna Block, NGV, Koramangala, Bangalore.

2.0 Eligibility of Tenderers : Tenderers who fulfil the following conditions would be considered for the job:

a) Have regular establishment with employees on their pay roll and provide similar services to other customers through their permanent employees only, by rotation. Only male employees should be engaged. b) They must be registered with PF and ESI authorities at the time of award of contract. c) Must have an experience of a minimum of two year in providing similar Maintenance Services in an organization .

3-0 In support of their records of performance and experience the Tenderers should

provide certificates in original as per proforma enclosed from concerned. In the event of experience of providing service in any units of SAIL in the last two years the tenderer should produce certificate as per enclosure from concerned unit of SAIL.

Tenderers whose contract was terminated due to non-performance or bad performance shall not be considered.

4-0 The Tenderer may, by prior appointment, see for themselves the Transit House

from 10.00 AM on any working day and fully familiarize with the services required to be carried out. Tenderer may like to note that presently the Guest House/Transit House are being operated at VISL House, 2nd Floor, No. 8,

By submitting a quotation, the Tenderer shall be deemed to have fully familiarized himself / themselves with the layout of the Guest House /Transit House as well as requisite data including those indicated in the tender document and shall be deemed to have fully satisfied himself / itself of his / its capabilities to undertake and perform the job under the contract to the satisfaction of the company. 5.0 The tender shall be kept valid for a period of sixty days from the date of opening

of Part I of the Tender and any modification, variation, clarification made thereto by the Tenderer during the above period shall be construed as withdrawal of the tender, in which event the Company (SAIL) shall forfeit the EMD without any reference to the Tenderer.

6.0 SAIL reserves the right to accept or reject any or all tenders or apportion the

work amongst the different Tenderers in any manner without assigning any reason whatsoever.

ANNEXURE I

INSTRUCTIONS TO TENDERERS 1. All Tender papers duly filled in and signed on each page and sealed in an

envelope superscribed “Transit House Maintenance Services” must be deposited in the TENDER BOX kept at 4TH FLOOR, VISL HOUSE, , No. 8, J.C. ROAD, BANGALORE- 560 002 before 3.00 pm on 31-12-2009.

2. Tender must be accompanied by a Pay Order / Bank Draft for Rs. 5000/- (Rs.

Five thousand . only ) drawn on any nationalised bank in favour of ‘STEEL AUTHORITY OF INDIA LIMITED, BANGALORE as Earnest Money. In case the tender documents downloaded from the website, the tenderer has to submit a DD for Rs.500/- towards the cost of tender documents. Tender not accompanied with the Earnest Money & cost of tender documents will be summarily rejected.

3. The successful Tenderer will be required to deposit a total amount of

Rs25,000/- (Rupees Twenty five thousand only) as Security Deposit and for this purpose, Earnest Money of Rs5,000/- (Rupees Five thousand only ) will be converted into Security Deposit, with any remaining amount to be separately submitted by the Tenderer. The Security Deposit will not be earning any interest.

4. The Tenderer has to submit the offer in two parts viz. a) TECHNICAL BID

and b) PRICE BID in two separate sealed envelopes with name, address and telephone nos. of the Tenderer to be given in the left hand bottom corner of each envelope. Each envelope should have the following superscribed on it :

‘TECHNICAL BID' or ' PRICE BID' or ‘ EMD’ (as applicable).

Tender for providing Maintenance Service For Guest House /Transit House at Bangalore

1. The TECHNICAL BID consisting of …..... nos. of pages and signed copies (with

seal) of Description of Services, General Terms and Conditions & other documents required to fulfil requirements of Technical Bid, and the PRICE BID consisting of …..... nos. of pages, are to be enclosed in two separate sealed envelopes and each envelope should be marked accordingly. Bank Draft as indicated at para 2 above should be enclosed with covering letter in a third envelope with the two separate sealed envelopes and submitted.

2. Technical Bid will be opened at 3:30 PM on 31-12-2009 in the presence of the

Tenderers or their representatives who may wish to be present at the opening of tenders, and shall remain valid for acceptance for a period of sixty days from the date of opening of tenders.

3. We will carry out the inspection of the premises where the parties have indicated

maintenance of Transit House. Unsatisfactory performance of the job carried out by the agencies in such premises will lead to disqualification in the Technical Bid . Company's decision in this matter will be final..

4. The Earnest Money Deposit of the unsuccessful Tenderers will be returned to

them within sixty days from the date of opening of the tenders without any interest whatsoever.

5. The price of the tender documents is non-refundable. 6. The successful tenderer has to execute a performance guarantee bond in case

their rate is less than the estimated annual value of the contract. 7. The right to accept or reject any or all the tenders without assigning any

reason whatsoever is reserved with SAIL. 8. The successful Tenderer will execute a formal Agreement on non-judicial

stamp paper. The notice inviting Tender, Instructions to Tenderers, Description of Services, Terms and Conditions of contract along with all the enclosures, Letter of Intent and acceptance thereof shall form a part of the contract.

9. The successful Tenderer will keep responsible and experienced

representatives on the premises identified on a whole time basis to supervise the work so that jobs under the contract are discharged to the satisfaction of the Company.

ANNEXURE-I I

DESCRIPTION OF SERVICES AND RELATED TERMS AND

CONDITIONS 1. In consideration of the payments to be made, the Agency will provide and be

responsible for maintenance services as per details indicated in Annexure A which shall be read and construed as forming part of an Agreement between SAIL and the Agency.

2. This Agreement will be valid for a period of TWO years with effect from the

date indicated in the Work Order. However, the agreement can be terminated by SAIL by giving 60 (sixty) days notice.

3. The Agency will provide services for maintenance and upkeep of the

premises indicated below by use of special equipment/s, chemicals and consumables necessary for the job.

The Agency will carry out all actions to see that each room, including the

kitchen, furniture, fixtures, approaches and common passages, toilets / bathrooms, wood paneling, walls and ceiling, windows, doors and window panes, including outer surfaces of window panes, are in good shape to facilitate the functioning of the occupants of the respective premises. The work would be carried out through special equipment/s, chemicals and consumables provided by the Company and wherever necessary, the same shall be done manually. The Agency will ensure that scrap and waste material are disposed of as per norms. They would also ensure that the following premises are fully maintained as indicated in Schedule of Services at Annexure A, and work is to be carried out on daily / weekly / fortnightly and on as-and-when required basis.

i) Guest House

A-513 Yamuna Block,National Games Village Koramangala,Bangalore 4. All jobs/duties and any other items specifically not mentioned but which are

usual and are a functional requirement shall be deemed to be included in the tender, and for such work no extra claim shall be entertained.

5. The Agency will ensure that personnel deployed for rendering service at

places stipulated in Para 3, are neatly attired in proper uniforms with name badges. Material and other equipment as required are to be supplied by the

Agency at their own expense, except where specifically mentioned herein as being supplied by the Company (SAIL).

6. The Agency would be required to pay their workmen deployed in SAIL

premises at least the minimum wages applicable and ensure fulfillment of all other statutory obligations including such rules and notifications as are applicable.

7. No escalation would be allowed during the period of the agreement.

ANNEXURE- III

SCHEDULE OF SERVICES FOR GUEST / TRANSIT HOUSE MAINTENANCE

1. Effective maintenance including glass-panes from outside and inside

of the Transit House to be done without disturbing the occupants. Hygienic conditions in the Transit House are to be maintained..

2. The Agency will extensively use vacuum cleaners, floor buffing equipment and appropriate cleansers and chemicals etc. for the job..

ITEM ACTIVITIES1 a) Kitchen Utensils Regular cleaning by using VIM Bar & Scrubber b) Drinking Water To regularly collect from Aqua Guard and

supplied in every room. c) Towels To Change used towels with cleaned and pressed

fresh towels every 3rd day or on change of occupant. Towels will be supplied by SAIL.

d) Bed Linen

To wash & change bed linen including bed cover/bed sheet, pillow cover of each bed every 3rd day. In case of change of occupant, immediate change of bed linen to be organised Bed Linens/Towels will be supplied by SAIL. The cost of Washing/cleaning of the above items will be borne by the Company.

e) Curtains To organise cleaning and pressing of curtains once in every 3 months. Laundry charges will be borne by SAIL.

f) Toilet To ensure hygienic condition on a regular basis by using Harpic supplied by the company.

The successful tenderer will maintain a register of utensils and other items(e.g. towels, linen etc)provided by the company which will be inspected/examined by a SAIL representative at regular intervals.

The successful tenderer will also ensure the following jobs 2 Disposal of water/waste paper to be organised on daily basis in terms of

Municipal laws. 3 To ensure All Out Mosquito repellant is kept in every occupied room. The

material will be supplied by Company. 4 To maintain & regularly update register of guests/occupants of transit house. 5 To provide to the occupants/guests the following by the agency. i) Bed tea with biscuits, breakfast, lunch & dinner. These items are to be

provided on ‘no profit basis and charges will be based on the cost incurred and are to be approved by Branch Manager as per the prescribed menu as decided from time to time by the occupants of Transit House.

ii) The Agency will ensure that cooking gas is always in stock, procured from the authorised supply agency. The cost of gas will be borne by SAIL.

iii) The company (SAIL) will also provide kitchen utensils and crockery. iv) The agency will directly collect the room charges from the occupants and

maintain a register in this regard indicating the details and deposit the cash to the same / next day after issuing the money receipt.

6 To ensure all taps and pipes are in working order in all toilets/kitchen so that the outlets for refuse water and inlets from fresh water are not choked. Cost of repair will be borne by the Company.

7 Ensuring removal of dead pests/mice etc. whenever required and particularly after pest control services are conducted.

To organise repair & maintenance of taps, furniture, door closers/locks, wooden cupboards, door hinges, signboard/notices boards etc. as and when required. Cost will be borne by the company on production of receipt.

9 Replacement of broken glass panes, conducting minor repairs needing carpentry, masonry, plumbing jobs at the cost of the company.

10 The actual cost incurred by the agency in respect of repairs, parts / spares purchased and used for plumbing jobs, repairs of electric items including kitchenwares as mentioned above will be reimbursed by SAIL on production of cash memos etc. Such repair work should be taken up on approval of SAIL, preferably in writing. Apart from the above, no other charges, except as agreed to as monthly charges shall be payable by SAIL under any circumstances

11 The agency will ensure that its personnel are not using/misusing Telephones/ TV/ Geyser/ AC etc or any other equipment located in the Transit House.

12 The agency will be held responsible for safe keeping of all items located in the Transit House and shall make good any loss suffered by the Company/residents by way of loss/damage to any such item located in the Transit House.

13 The agency/its personnel will not allow any unauthorised entry of persons/material and any unauthorised removal of any item from Transit House.

14 The agency will take over the items from SAIL as per list given and on completion of their tenure the same should be returned in good condition. Any damage/loss will be at Agency’s account and the same will be adjusted from the Security Deposit/Payment due to the Agency.

15 Proper Stock Register is to be maintained for the materials received in the Transit House.

16 The guests on check-in should be provided with clean and pressed Towels and Soap(50 gram of Medimix/Lux/Humam quality) which will be supplied by the Company.

17 Room freshener spray of good quality is to be sprayed in all rooms and sit-out everyday. Room Freshener will be supplied by SAIL.

18 Bills received from various Agencies for Telephones, Electricity, Cable TV and other statutory payments, if any, may be submitted to P&A Department immediately and ensure payment to the Agencies thereafter.

19 Accommodation will be provided to one/two attendant(s) by SAIL in the premises of Guest House & Transit House, Koramangala.

Special equipments for cleaning and maintenance such as vaccum cleaners &ladders etc. will be provided by agency.

ANNEXURE IV GENERAL TERMS AND CONDITIONS

1.0 The following words and expressions as used in this document shall have the

meaning assigned to them except when the context otherwise requires. 1.1 The "Company" shall mean Steel Authority of India Limited (hereinafter

referred as "SAIL") with the registered Office at Ispat Bhavan, Lodi Road, New Delhi - 110 003 and also having one of its units as Central Marketing Organisation (hereinafter referred as "CMO") at 40, Jawaharlal Nehru Road, Calcutta - 700 071 as also Regional Office at 2-Kodambakkam High Road, Chennai-600 034 (hereinafter referred as "RO/SR" ) of Central Marketing Organisation presently located at 5-Kodambakkam High Road, Chennai and Branch Sales Offices (BSO) at different locations.

1.2 "Agency" shall mean the Guest House /Transit House Maintenance and allied

services provider who has been awarded the contract and has entered into a formal agreement as described.

1.3 The expression "Regional Manager" shall mean the Regional Manager of

Southern Region of CMO who is the head of the LP / FP Division of the Region (hereinafter referred as "RM/SR").

1.4 The expression, the "Chief Executive" of Central Marketing Organisation,

Steel Authority of India Limited means the Director (Commercial) or any other person delegated to exercise the authority and the power of the Director (Commercial).

1.5 "Contract" shall mean and include the agreement between the Company and

the Agency duly signed by the parties thereto for the execution of the work, together with all documents annexed / attached herewith or referred to.

1.6 "Premises" shall mean any location owned / occupied / taken on lease / rent

or hire by the Company. 1.7 "Guest House" shall mean the premises, VISL House, 2nd Floor, No.8, J.C.

Road & “Transit House” mean the premises- A 513 Yamuna Block, National Games Village, Koramangala, Bangalore where Guests stay on visit to Bangalore.

2. The Tender, Invitation to Tender, Instruction to Tenderers, General

Conditions , Description of Services and amount quoted with price bid against the tender together with the Letter of Intent awarding the work and

the Work Order will form part and parcel of the Agreement . The Tenderer will quote the rates, with all the components, failing which their tender may not be entertained.

3. Agreement will be signed by the successful Tenderer (hereinafter called

'Agency' ) or his duly authorised representative and by a competent person on behalf of Steel Authority of India Limited (hereinafter called “SAIL”) within seven days of issue of Letter of Intent and acceptance thereof.

4. The Agreement will be valid for a period of TWO year with effect from the

date indicated in the Work Order and the services shall be provided to ensure adherence to the Schedule of Services. Extension of services for a further specific period, if required, may be considered by mutual agreement under the same terms and conditions for further extension.

5. The Agreement can be terminated by the Company by giving ( 60 ) sixty days’

notice. In case of any serious misconduct or lapse on the part of the Agency adversely affecting the maintenance of the building and / or the reputation and business interests of the company, the Company reserves the right to summarily terminate the Agreement.

6. Canvassing in any form is strictly prohibited and the tenders submitted by the

Tenderers, who resort to canvassing will be liable to rejection. 7. If the Tenderer has a relative employed in any capacity with Steel Authority

of India Limited, he will inform the authority calling for tenders, of such fact while submitting his tender, failing which his tender may be rescinded, and if the fact subsequently comes to light, he shall be liable to make good to SAIL any loss or damage resulting from such cancellation.

8. The Tenderer will be required to deposit an amount of Rs. 5,000/- (Rupees Five

thousand only) as Earnest Money, which will be converted as part of Security Deposit of Rs 25,000/- (Rupees Fifteen thousand only) if the work is awarded. The Security Deposit will not be earning any interest. In case of premature termination of Agreement on the part of the Agency or in the event of the Agency committing any breach of Agreement or grave misconduct resulting in termination of the Agreement by SAIL, the Security Deposit will be forfeited / encashed. However, on completion of the Agreement satisfactorily, the Security Deposit would be refunded to the Agency on receipt of confirmation of clearance of all final dues and satisfactory fulfillment of statutory obligations.

9. In case any tenderer fails to perform as per the contract, the tenders will be liable

to be closed with due notice. Further, they will not be considered for participating in the retendering if the contract do not run for the tenure for which the same is awarded to the present tenderer, due to the default/non performance on the part of the Contractor.

10. In case the successful Tenderer fails to perform the job as per requirements of the

contract and/or to complete the job without satisfactory reasons, the Security Deposit shall be forfeited.

11. SAIL reserves the right to recover and adjust any amount which may be due from

successful Tenderer from their Security Deposit. The Agency will be liable for any remaining amount payable thereafter.

12 The Agency will observe and comply with all statutory obligations of different

statutes, rules, bye-laws and notifications as applicable and shall keep SAIL indemnified from all acts of omission or commission, faults, breaches and/or any claims/demands or loss, injury and expenses to which SAIL may be put to or involved as a result of the Agency’s failure to fulfil any of the obligations hereunder and/or under the said Acts, enactment, rules, regulations and/or statutes and/or any by-laws or rules framed thereunder or any of them. SAIL shall be entitled to recover any of such losses or expenses which it may have to suffer or incur on account of such claims, demands, loss or injury from the Agency’s monthly bill or from the Security Deposit or any other sum (s) of the Agency available with SAIL without prejudice to its any other rights under the law. The Agency will be responsible for all payments to its employees and in no case liability of payments like gratuity / terminal compensation under the Gratuity Act etc. would be that of SAIL for any of the Agency’s employees against their superannuation or other separations.

13. All legal / statutory requirements would be complied with by the Agency and

the documentary records maintained and produced for inspection from time to time / when required.

14. The Agency will furnish all requisite certificates required under the statutory

provisions and necessary to take up such jobs and complete the same . On failure to produce any such certificate mentioned in the tender papers, the agreement may be liable to be terminated .

15. The Agency will be responsible for any loss or damage caused to any

installation, equipment or part thereof due to negligence on the part of the Agency or its staff personnel, and any such damage / loss shall be recovered as reasonable compensation from the bills / payments due to the Agency or from their Security Deposit at the discretion of the Company.

16. The Agency shall deploy 1 Cook & 2 Attendants in Guest House & 1 Cook-

cum-Attendant in Transit House, Koramangala, who are conversant with English /Hindi and Kannada and have good behaviour out of its permanent employees, for the captioned activities including surface maintenance of SAIL Guest House/Transit House.

17. The payment of bills to be claimed by the Agency will be submitted to the Company on monthly basis and SAIL will endeavor to release payment early. However, the disbursement of wages to its employees by the Agency will not be linked to payment of bills by SAIL. The monthly bills are to be submitted by the Agency in duplicate. 90% of the bill amount shall be paid on presentation after due verification. The balance 10% shall be released only after submission of proof of having made the PF payment. As proof of remittance of dues to PF & ESI authorities, the Agency will submit copies of PF & ESI challans along with a certified list of its employees deployed at SAIL's premises for whom the dues have been deposited by the 15th (fifteenth ) of each month. Delay in submission of such documents will result in deduction of 30% of bill amount.

18. Disbursement of wages to its workers will be made within the 7th (seventh) of the succeeding month by the Agency in the presence of a nominated representative of SAIL. The Agency must notify the date of such wage disbursement in advance to its employees The Wages to be paid should in no case be less than the minimum wages notified by Karnataka Government from time to time (Present rate for cook cum supervisor is Rs1159.00 Basic Wage and Rs 1031.25 DA per month and for cleaner cum attendar is Rs 1072.00 Basic Wage and Rs 1031.25 DA per month for each person).

The successful tenderer will also be required to pay his employee all statutory dues including PF, EDLI, Administration charges etc. amounting to 13.6% of Basic Pay + DA, ESI @ 4.75% of Basic + DA and Annual Bonus @ 8.33% of annual wages. Hence, the minimum monthly liability of the agency towards employee remuneration would not be less than Rs3870.00 for cook cum supervisor and Rs3716.00 for cleaner cum attender each.

If a tenderer quotes unworkable rate ie. if the quoted rate is lower than Rs3870.00 for cook cum supervisor and Rs3716.00 for cleaner cum attendar each per month (ie. the minimum employee remuneration of Rs3870.00 for cook cum supervisor and Rs3716.00 for cleaner cum attendar each per month including employees PF contribution, Bonus etc.) the quotation will be deemed as faulty and is liable to be rejected.

19. The Agency will provide for safety of the personnel engaged for carrying out the work. The Agency will take necessary insurance cover at its own expense in respect of the staff and other personnel or persons employed or engaged by the Agency in connection with rendering of all the aforesaid services. The Agency shall be responsible for making good all claims of compensation that may arise from any accident which may occur in the course of work.

20. The Agency will ensure effective supervision of the services for due performance of duties and responsibilities of its employees deployed in SAIL Transit House.

21. The Agency will maintain discipline amongst its staff / employees and shall be responsible for their conduct and behavior. The Agency shall ensure that none of its employees deployed in the premises indulge in disorderly and

riotous behavior or consume alcoholic / intoxicating drinks / drugs while on duty.

22. The Agency shall ensure good industrial relations with its staff and settle all grievances of its employees.

23. The Agency shall not appoint any sub-agency / sub-contractor to carry out any obligation under the Agreement

24. Any act of forbearance or latitude or extension granted or performance accepted of delayed execution or any omission of taking action on part of the Company shall not amount to a waiver of the right / action available to the Company and the Company shall be entitled to take action under the terms of this agreement.

25. SAIL reserves its right to remove from the list of contractors / or to ban dealings if the contractor is found to have committed misconduct, as also to suspend dealings pending investigations. Further, in case the Agency, his partner, member, servant, labour, agent, representative and/or any person working for and on behalf of the Agency is found involved in any unauthorized, or wrongful removal of material or equipment, or in any attempt for such removal, this shall amount to breach of contract as well as misconduct caused by the Agency, and the Company shall be entitled to forfeit the entire Security Deposit and any other amounts, money or material that may be lying with SAIL at the risk and cost of the Agency, in addition to banning of future dealings as mentioned above.

No request for escalation of rates quoted / agreed for maintenance of Transit House will be entertained during the period of arrangement and its extension.

The agency will use only cleaning chemicals, consumables supplied by the Company. However, all equipment (non-consumables) such as ladders, vacum cleaners etc. which are required for the satisfactory maintenance and upkeep of the premises will be provided by the agency.

26. ARBITRATION 26.1 All questions, claims, disputes or differences of any kind whatsoever arising

out of or in connection with or concerning this agreement at any time, whether before or after the determination of this agreement ( except as to any matters the decision of which is specially provided for in the conditions referred to above), will be referred by the parties hereto for the decision by a Sole Arbitrator to be appointed as hereinafter mentioned.

26.2 The notice regarding the invoking of the arbitration clause will be served by

registered post and addressed to the Chief Executive of Central Marketing Organization, Steel Authority of India Limited, Ispat Bhawan, Lodi Road, New Delhi.

26.3 Matters in question, dispute, claim or difference other than the excepted matters, referred to in par 8.1 above, in respect of this agreement to be submitted to Arbitration as aforesaid will be referred for decision to a Sole Arbitrator to be appointed by the Chief Executive of the Central Marketing Organization, Steel Authority of India Limited (by whatever name he may be designated at the relevant time). However, before appointing the Sole Arbitrator, the Chief Executive of the Central Marketing Organization, Steel Authority of India Limited will notify to the Agency three names out of which one can be appointed as the Sole Arbitrator with the consent of both parties, failing which, after fifteen days of the issuance of the letter informing three names by the Chief Executive, the Chief Executive will have the power to appoint one of the persons out of the three so notified as the Sole Arbitrator.

26.4 In this Clause, the expression, the Chief Executive of the Central Marketing

Organization, Steel Authority of India Limited, means the Director (Commercial) or any other person delegated to exercise the authority and the power of the Director (Commercial) due to his absence on duty or due to his non-availability for any reasons whatsoever.

26.5 The Arbitrator, so appointed, will adjudicate upon all the disputes between

the parties hereto. 26.6 The Sole Arbitrator appointed as stated above, will from time to time after his

appointment and throughout the arbitration proceedings, without delay, disclose to the parties in writing, any circumstances likely to give rise to justifiable doubts as to his independence or impartiality. The Arbitrator will decide the questions, claims, disputes or differences submitted to him by the parties in accordance with the substantive law for the time being in force in India.

26.7 The Arbitrator will hear the cases independently and impartially and shall not

represent the interest of any party. 26.8 The Arbitrator having personal interest in the case at the time of his

appointment and at any time subsequently thereafter must withdraw from his office himself and the parties also have the right to ask him to do so.

26.9 The venue of Arbitration will be the place where the agreement is concluded

or at Calcutta being the headquarters of the Central Marketing Organization. The venue of Arbitration, at the place where agreement is concluded, will be convenient to both the parties to the Arbitration.

26.10 The question of procedure for conduct of the arbitration proceedings will be

decided by the Arbitrator in consultation with the parties before proceeding with the reference. The Arbitrator may hold preparatory meeting(s) for this purpose. In the preparatory meeting(s) as aforesaid, the Arbitrator, in

The Arbitrator will be entitled to actually incurred expenses only, in respect of preparatory meeting(s).

26.11 The provisions of the Arbitration and Conciliation Act, 1996 and the rules

framed thereunder, if any, and all modifications / amendments thereto shall deem to apply and / or be incorporated in this Agreement as and when such modifications / amendments to the Act / Rules are carried out.

26.12 Work / Supply under the Agreement will be continued by the Agency /

Supplier during the arbitration proceedings and recourse to arbitration will not be a bar to continuance of the work or supply.
