NOTE: Many states and municipalities that have stay-at-home orders are not completely clear

on whether transportation companies’ employees and drivers are essential, meaning they can

be at a work location, traveling, or out driving. FMCSA issued guidance asking states and

municipalities to consider that the Department of Homeland Security through the Cybersecurity

Infrastructure Security Agency has declared transportation personnel and supporting personnel

Connecticut On 6/24, the governors of Connecticut, New Jersey, and New York

announced a travel advisory that requires anyone from a state with

high rates of COVID-19 to self-quarantine for 14 days. Criteria to

determine a high rate of COVID-19 is a positive test rate higher than

10 per 100,000 residents or a state with a 10 percent or higher

positivity rate over a 7-day rolling average.

On 7/2, Gov. Lamont updated the guidance, permitting travelers to

enter the state if they test negative for COVID-19 within 72 hours

prior to arriving.

Minnesota The state is reopening under Gov. Walz’s “Stay Safe Minnesota”

New Hampshire On 5/29, Gov. Chris Sununu extended the state’s stay at home order

to 6/15, Parts of the economy are reopening in a multi-phased

approach. There is a Universal Guidance, which serves as minimum

New Jersey On 6/24, the governors of Connecticut, New Jersey, and New York

announced a travel advisory that requires anyone from a state with

high rates of COVID-19 to self-quarantine for 14 days. Criteria to

determine a high rate of COVID-19 is a positive test rate higher than

10 per 100,000 residents or a state with a 10 percent or higher

positivity rate over a 7-day rolling average.

The declaration allows the governor to invoke emergency powers, including ordering businesses to close. On 6/4, Gov. Murphy extended this declaration another 30 days. Customers must wear face-coverings or masks when picking up takeout orders at places serving food but doesn’t apply to curbside pickups. Those food establishments must provide the personal protective equipment to their workers. The mask or face-covering order only applies to people walking into a restaurant for takeout orders, he said. Executive Order No. 125, imposes additional mitigation and sanitation requirements on NJ TRANSIT and all private carriers to limit the spread of COVID-19. Public and private transportation vehicles may be limited to 50% of capacity. People riding using the transit system must wear a face covering and use back-door entry whenever possible. The order also outlines specific policies on restaurants that have remained open for takeout orders. Read EO 125 for the details if you use or operate passenger transportation. Reports support that most facilities are providing the truck drivers with a face mask, if they don't have one. The order also states,“if a customer refuses to wear a cloth face covering for non-medical reasons and if such covering cannot be provided to the individual by the business at the point of entry, then the business must decline entry to the individual.” Essential retail businesses are limited to 50% of the building’s stated capacity. CDC warning issued 3/28/20 - Due to extensive community transmission of COVID -19 in the area, CDC urges residents of New York, New Jersey, and Connecticut to refrain from non-essential domestic travel for 14 days effective immediately. This Domestic Travel Advisory does not apply to employees of critical infrastructure industries, including but not limited to trucking, public health professionals, financial services, and food supply. These employees of critical infrastructure, as defined by the Department of Homeland Security have a special responsibility to maintain normal work schedules. New Jersey updated restrictions with Executive Order 107 which further limits movement for non-essential activity as outlined in the prior order EO104. EO107 allows people to report to or perform their job as long as it is critical support of an “ESSENTIAL BUSINESS”. Staff on site must be minimal to make sure essential operations can continue. JJK personnel would have to be deemed necessary to continue operations to be onsite.

*Violations of the order could result in a $1,000 fine and up to 6 months in jail for a disorderly person’s offense. The order allows manufacturing, industrial, logistics, ports, heavy construction, shipping, food production, food delivery, and other commercial operations to operate. New Mexico After a recent resurgence in cases, New Mexico Gov. Grisham has

delayed moving to Phase Two. The changes were planned for July

1st, but are now expected to be delayed by several weeks.

The state’s stay-at-home order was extended through 5/31. Most

retailers are allowed to operate at 25 percent of maximum capacity.

Under its reopening plan, retail business can be open at 25 percent

capacity. Hotels may operate at 50 percent. Masks are required for

everyone, including retail workers, in public.

The order does not include San Juan, McKinley, or Cibola counties;

however nonessential retailers may provide curbside pickup or

delivery.

If the state can contain the spread, phase two would be allowed

which would increase occupancy to 50%. It would also allow

outdoor sporting events at more than four participants at a time.

Phase two could come as early as May 18, according to the

governor who is also not yet reopening barbershops, hair salons,

bars and gyms which may reopen open no later than mid-May. The

governor stated that counties with five or fewer cases can

effectively skip to the phase two and reopen businesses at 50%

On 4/30, Gov. Jim Justice replaced the state’s stay at home order

with a ‘safer at home’ order, effective 5/4.Essential businesses can

continue to operate; small businesses can operate if they have 10 or

fewer employees and limited customer contact. Businesses must

practice social distancing.

On 4/27, Gov. Justice announced a comprehensive plan to reopen parts of the state. . The state is currently in its ‘Week 6’ phase. Week 1 phase: hospitals can resume elective medical procedures if follow CDC guidelines and have adequate personal protective equipment (PPE). Outpatient health care operations may resume with precautions and testing of daycare staff across the state will begin. Week 2: Any small business with fewer than 10 employees would be able to resume operations during Week 2. All businesses providing professional services, such as hair salons, nail salons, barbershops, and pet grooming will be permitted to reopen. Customers must make appointments and wait in vehicles. Weeks 3-6: Reopening additional businesses will be based on medical experts. These businesses will include office/government, specialty retail, parks, gyms, fitness and recreation centers, dine-in restaurants, hotels, casinos, spas/massage, and other businesses. Provisions of the latest Executive Order affecting only these three counties due to high infection rates include:

• Limiting groups to a maximum of 5 people.

• Directing ALL businesses to require employees to work from home to the maximum extent possible.

• Directing the Local Health Departments to establish the maximum occupancy of and proper social distance within essential businesses and taking action to enforce these health regulations.

• Directing the West Virginia National Guard to provide logistical support and services to assist county agencies.

• Directing the West Virginia State Police to assist with enforcement of local county orders.
