This matter was opened by the New Jersey Division of Consumer Affairs, Office of

Consumer Protection ("Division"), as an investigation to ascertain whether violations of the

New Jersey Consumer Fraud Act, N.,J.S.A. 56:8-1 et seq. ("Consumer Fraud Act"), the

Contractors' Registration Act, N . .J.S.A. 56:8-136 et seq., the Regulations Governing

Contractor Registration, N . .J.A.C. 13:45A-17.1 et seq. ("Contractor Registration

Regulations"), and/or the Regulations Governing Home Improvement Practice, N.J.A.C.

13:45A-16.1 et seq. ("Home Improvement Regulations") have been or are being committed by

Burga Construction, LLC ("Respondent") (hereinafter referred to as the "Investigation"). That

Investigation disclosed that:

Respondent, with a main business address of 32 Bonnell Lane, Randolph, New Jersey

07869, was found to be in violation of the Consumer Fraud Act, Contractors' Registration

Act, the Contractor Registration Regulations, and Home Improvement Regulations.

Specifically, Respondent was found to have offered for sale home improvements, but failed to:

(1) provide to the consumer a copy of the certificate of insurance; (2) include in the contract the

required "Notice to Consumer"; (3) begin or complete all work outlined in the contract; and (4)

give timely written notice to the consumer for any delay. A search of the records maintained by

the Division revealed that Respondent was not registered as a home improvement contractor at

that time he contracted with Consumer

The Consumer Fraud Act, N.J.S.A. 56:8-2, prohibits the act, use or employment by any

person of any unconscionable commercial practice in connection with the sale or advertisement

of merchandise, which includes the advertisement, offering and sale of home improvement

services.

The Contractors' Registration Act, N.J.S.A. 56:8-136 et seq., specifically N.J.S.A.

56:8-138(a) and the Contractor Registration Regulations, specifically, N.J.A.C. 13:45A-

17.3(a) provides that no person shall offer to perform, engage in and/or attempt to engage in the

sale or performance of "Home Improvement[s]" within the definition of the Contractors'

Registration Act, specifically, N.J.S.A. 56:8-137 and the Contractor Registration

Regulations, specifically, N.J.A.C. 13:45A-17.2, unless registered with the Division as a

Contractor. Moreover, the Contractors' Registration Act, specifically N.J.S.A. 56:8-151(a)2,

requires that a contractor provide with every home improvement contract a copy of the certificate

of general liability insurance. In addition, the Contractors' Registration Act, specifically,

N.J.S.A. 56:8-151b, provides that each home improvement contract shall contain a conspicuous

"Notice to Consumer" printed in at least 10-point bold-faced type.

Moreover, the Home Improvement Regulations, specifically, N.J.A.C. 13:45A-

16.2(a)(12)(iv), provides that the dates or time period on or within which work is to begin or be

completed must be in the home improvement contract.

Finally, the Home Improvement Regulations, specifically, N.J.A.C. 13:45A-

16.2(a)(7)(iii), provides that you must give timely written notice to the consumer of reasons

beyond Your control for any delay in performance, and when the work will begin or be

completed.

As such, pursuant to N.J.S.A. 56:8-3.1, the Director of the Division may: (1) order the

Respondent to cease and desist from engaging in unlawful activity, pursuant to N.J.S.A. 56:8-18;

(2) assess civil penalties against the Respondent, pursuant to N.J.S.A. 56:8-13; and (3) direct

Respondent to pay restitution, pursuant to N.J.S.A. 56:8-15.

A Notice of Violation and Offer of Settlement ("NOV") was served on Respondent on

October 23, 2015, by hand delivery, setting forth the findings of fact and conclusions of law

above. Attached to the NOV was the Certification of Division Investigator Jessica Lugo

("Investigator Lugo"), with accompanying exhibits and the Certification of the Assistant Deputy

of Registrations and Licensing of the Regulated Businesses and Charities Sections of the

Division, Diana Petrella. Such information established the factual basis for the alleged violations.

Attached to this Final Order On Default ("Final Order") is a copy of an email from Investigator

Maureen Browne ("Investigator Browne") confirming hand-delivery, establishing that service of

the NOV was effected upon Respondent.

Respondent was offered the opportunity to be heard on these charges, as set forth in the

terms of the NOV. Respondent failed to reply within the fifteen (15) days as allowed by the terms

of the NOV and thus, the alleged violations are deemed uncontested and ttue.

1. Respondent shall cease and desist from engaging in any practices in violation of

the CF A, the Contractors' Registration Act, the Contractor Registration

Regulations, and Home Improvement Regulations.

2. Respondent shall pay the Division the sum of $4,800.00 as a civil penalty, and

$4,250.00 as consumer restitution, pursuant to N.J.S.A. 56:8-13. The amount due

and owing totals $9,050.00 and shall be made by a certified check, attorney trust

account check or other guaranteed funds made payable to the "New Jersey

Division of Consumer Affairs" and shall be delivered to the following address:

3. Service of this Final Order will be deemed effective if sent by regular mail and

certified mail, return receipt requested, and regular mail to Respondent's last

4. Payment shall be made within ten (10) days of issuance of this Final Order.

5. Failure to pay any civil penalties within the time allowed will result in the filing of

a Certificate of Debt.

6. Any subsequent violation of this Final Order may subject Respondent to

additional penalties of up to $25,000.00, pursuant to N . .J.S.A. 56:8-18.

The New Jersey Division of Consumer Affairs, Office of Consumer Protection ("Division") has conducted an investigation of Burga Construction, LLC ("You" or "Your") as a result of the complaint filed by Consumer ("Consumer") in connection with the Home Improvement Contract entered into with You on June 18, 2015 ("Investigation"). As set forth in the attached Certifications of Investigator Jessica Lugo and Diana Petrella, Assistant Deputy of Registrations and Licensing of the Regulated Businesses and Charities Section. You have been found to have operated as a "Contractor" or "Home Improvement Contractor" within the definitions of the Contractors' Registration Act, N.J.S.A. 56:8-136 et seq., and the Regulations Governing Contractor Registration, N .J .A. C. 13 :45A-17 .1 et seq. ("Contractor Registration Regulations") and to be in violation of one or more of the following: the New Jersey Consumer Fraud Act, N.J.S.A. 56:8-1 et seq., ("CFA"), the Regulations Governing Home Improvement Practice, N.J.A.C. 13:45A-16.1 et seq. 3. Failed to include in the home improvement contract the "Notice to Consumer" in 10-point bold-face type, in violation of the Contractors' Registration Act, speciflcally, N.J.S.A. 56:8-15l(b);

4. Failed to begin or complete work on the date or within the time period specified in the home improvement contract, or as otherwise represented, in violation of the Home Improvement Regulations, specifically N.J.A.C. 13:45A-16.2(a)(7)(ii); and

5. Fatled to give timely written notice to the consumer of reasons beyond Your control for any delay in performance, and when the work will begin or be completed, in violation of the Home Improvement Regulations, specifically, N.J.A.C. 13:45A-16.2(a)(7)(lli).

These violations constitute violations of the CFA, subjecting You to civU penalties, pursuant to N.J.S.A. 56:8-13, consumer restitution pursuant to N,J,S.A. 56:8-15, as well as reimbursement of investigative costs and/or attorneys' fees, pursuant to N.J.S.A. 56:8-11 and 56:8-19.

Please note that if You fail to respond to this Notice of Violation ("Notice"), the Division may take action against Your Home Improvement Contractor registration, including any future application to register as a home improvement contractor, pursuant to N.J.S.A. 56:8-14lb(8), for failure to cooperate under N.J.A.C. 13:45A~ 17.8.

On the recommendation of a couple (friends of my daughter), I contracted Alonso Burga to have the top of my deck rebuilt with a new surface. The underneath would be maintained. Via fax, 1 wiU send you a copy of the contract which says the work would be done betWeen June 20-27. I gave him a deposit of $4800 tQ purchase the materials). and he noted that on the contract on 6/18/15. His crew came and removed the top of the deck. They d;scovered that additional support was needed and he &aid ha W()Uid absorb $500 of the $1000 support repair (I was OK with that). We also identified a few random repair jobs around the property as this was going on--re-ooncrete the gap around the pool between the blue stone and the coping; re--concrete the stones on the top of the front steps (both done beautifully); support a post and replace two pieces of fence which has been damaged when a neighbor's tree went down during Hurricane Sandy; and solidify footing of afbor in back of property. They did the arbor. I pakl on 6126/15 $750 for the $500 of additional support to the deck and odd jobs.

For almost a month now I have been diligently moving cars out of the driveway each morning expecting them to oome back. Repeated texts have given dead air or many excuses-weather, lumber yard ordering the wrong size, not have a vehicle to bring the lumber, et al. I have all my texts going back to 6/30. Then two weeks ago my daughter got involved, contacted him under the ruse that she was a prospective customer so he called back. She has been badgering him via text and phone as well. He keeps asking for a few days, next week etc. She even told him she has an injury (whlch Is true) when she tried to get my lawnmower out of the·garage and his tools tumbled off a pile and feU on her foot. I also have all her texts but no Idea how to retrieve all for you.

Two days ago I called Allied Building Products, which he referenced, and they have no reCQrd of an order under his name. l spoke yesterday to a Glen Ridge police officer who took all info but basical1y said since I have a contract it ts more of a civil legal issue, hence my call to you.

DECKING INSTALLATION:

All materials will be supplled by Burga Construction L:LC, and its included in total price of project. New decking material is a compo$1te TimberTech product: E:arthwood Evolutions .. legacy Collection (Mocha). The new decking will be installed in the same design as preceding deck. Contractor will build three benches, that will be wrapped in same new decking material, · and will permanently attach them to the deck structure.

The First deposit Will be of $4,800, which shall be due upon signing this contract. $4,000 will go to acquiring new decking materials, and $800 to begin work. $1 ,200·shall be due when actual decking installation begins, and a finbn vgal payment of $1,345 will be due when all work is finished and Inspected by both owner and contractor.

may be a civil action, however she wanted to advise the police department the progress up until this point. 1 attempted to call Burga Construction several times. however was unsuccessfUl. I was also unable to leave a message due to the volcemall box being full. I advised Ms. Kroll that If she wanted to press charges against Burgs Construction for breaking thelr contract. that she should consult her attorney and respond to the Glen Ridge Municipal Court. Ms. Kroll was satisfied ~ this time and stated that she would most likely take legal action against the contractor.

This case will remain open/inactive at this time.

We have been advised that while the remode_ling work commenced prior to June 27u., despite repeated demands by my client that you return to the property and finish the work. and despite her having paid you $4,800.00 in advance toward the $7,345.00 total pricet you disappeared and failed to complete the work by the June 271h time-of-the-essence deadline having left a dangerous condition· in the rear of the house with the old deck planking removed leaving exposed .. stringers" that are a hazard and that prevent the use of the large deck area (copies of deck-area pictures attached).

It is now nearly a month after the time-of-essence deadline and you have still failed to complete the Agreement as promised.

Accordingly, and on account of the foregoing, this constitutes formal NOTICE OF DEFAULT under the Agreement to you and Burga Construction LLC on account the above recited event of default.

If you fail to return to the propeny and fully complete and finish the deck work in accordance with the terms of the Agreement by the close of business. 5PM, Friday. July 31. 2015. you may anticipate that you will be on the receiving end of a lawsuit by Ms. Kroll that will seek all contract damages available to l. at law and in equity. including without limitation. treble damages under the New Jersey Consumer Fraud law.

Please be guided accordingly.
