CALL TO ORDER

Hector H. Henry, II, M.D. , President of the Board of Medical Examiners of the State ofNorth Carolina called the meeting to order on Wednesday January 22, 1992, at 7:30p.m. , atthe North Raleigh Hilton, Raleigh, North Carolina.

Board members present at this meeting included: John W. Nance, M.D., Secretary; John T.Daniel, Jr. , M.D.; Harold L. Godwin, Jr. , M.D.; Walter M. Roufail, M.D.; Hector H. Henry,M.D.; Nicholas E. Stratas, M.D.; F. M. Surunons Patterson, Jr. , M.D.; and Mrs. Katluyn H.Willis.

On January 25, 1992 during the Agenda report, the Board adopted a motion to approve theNovember 1991minutes of the Board as submitted.

ORGANIZATIONAL CHART

On January 25, 1992, during the Executive Secretary's Report, the Board reviewed anorganizational chart of present Board employees.

As a result, the Board adopted a motion to accept the chart as information.

STAFF LISTING

On January 25, 1992, during the Executive Secretary's Report, the Board reviewed a listingof all Board employees and their basic job functions.

As a result, the Board adopted a motion to accept the listing as information.

LITIGATION RESERVE FUND

On January 23, 1992, during the Attorney's Report the Board reviewed a recoimnendationof Bobbie W. Furr, Certified Public Accountant, to establish a litigation reserve fund.

As a result the Board adopted a motion made by Dr. Stratas and seconded by Dr. Pattersonthat $400,000 to be put in a litigation fund. The Board is to revisit this issue in one year.

On January 23, 1992 during the Attorney's Report the Board reviewed a blanket policywhich covers State employees and members of Boards and Conunissions state-wide.

JUDICIAL STAYS OF BOARD DECISIONS

On January 23, 1992 during the Attorney's Report the Board discussed its concerns with theease with which parties are able to obtain a stay for Board deisions. Mr. Weddingtonrecommended that the Board attempt to have Section 90-14.9 of the General Statutesainended to require the court to give due consideration to the harm that may result to thepublic from a stay, that the Board must be given an opportunity to be heard in opposition toany request for a stay and if a stay is granted the hearing must be set at the earliest availabletine.

As a result the Board adopted a motion made by Dr. Nance and seconded by Dr. Daniel thatthe Board attempt to rectify this problem by changing the Statute. Proposals for the changesin the Statute will be presented at the next meeting for approval to submit to the MedicalSociety.

STATEMENT OF RIGHTS

On January 23, 1992, during the Attorney's Report the Board reviewed the revisedstatement of rights.

As a result the Board instructed that Mike Weddington, Dr. Stratas and Dr. Spangler are todraft a final recommendation for an ainended Statement of Rights and present it to the Board.

EMS APPLICATIONS PROCESSED

On January 25, 1992 during the EMS Report the Board reviewed the following informationwhich was reported by Dr. Nance for the period of October 26, 1991 - December 19, 1991:

CVC REQUEST —DEPART'MENT OF HUMAN RESOURCES

On January 25, 1992 during the EMS Report the Board reviewed a letter from Nicholas Benson,Medical Director, Office of Emergency Medical Services asking for the Board's commentsregarding appropriate EMT personnel utilizing existing semi permanent central venous cathetersunder specified conditions.

As a result, the Board adopted a motion made by Dr. Patterson and seconded by Dr. Nance thatmore information be obtained from the American College of Surgeons, North Carolina Chapter,Oncology and Urology specialists to determine if non MDs may do this procedure safely.

KNOTTS ISLAND

On January 25, 1992 during the EMS Report Dr. Nance reported that Knotts Island had requesteda continued exception to Section .0701 of the Mobile Intensive Care Rules due to a lack ofgeographical access.

As a result the Board adopted a motion made by Dr. Nance and seconded by Dr. Patterson that theBoard grant the requested exception for two years.

DATA REQUESTS —Sachs Group, Ltd.

On January 25, 1992 during the Agenda report the Board reviewed a data request from SachsGroup, Ltd. , requesting data from the database to include license 0, age, sex, and zip code.

As a result the Board adopted a motion made by Dr. Patterson and seconded by Dr. Henry to denythe request and indicate that the Sachs Group may purchase a roster for the amount of $15.00.

DATA REQUEST - American College of Radiology

On Januaty 25, 1992 during the Agenda report the Board reviewed a request from the AmericanCollege of Radiology requesting data to include names and addresses of physicians licensed inNorth Carolina

As a result the Board adopted a motion made by Dr. Roufail and seconded by Dr. Patterson todeny the request and indicate that this ud'ormation may be obtained from the State Medical Society.

PRESBVIEIUAN HOSPITAL - CHARIX)'ITE, N.C.

On January 25, 1992 during the Agenda report the Board reviewed a request from PresbyterianHospital regarding out-of-state surgeons being used in mini residencies.

As a result the Board adopted a motion made by Dr. Patterson and seconded by Dr. Roufail thatthe Board request that the hospital provide it with more information regarding the mini residency.

On January 25, 1992 during the Agenda report the Board reviewed Dr. Janeway's request that Dr.Snydennan, Dr. Bondurant, Dr. Hallock and himself be scheduled to meet with the Board.

As a result the Board adopted a motion made by Dr. Patterson and seconded by Dr. Spangler thatthe Board schedule the request meeting within the next six months.

On January 25, 1992, Dr. Boyd appeared for his licensure interview before Dr. Pattersonand Dr. Roufail.

As a result of this interview the Board arlopted a motion made by Dr. Patterson andseconded by Dr. Roufail that the Board delay making a decision until more information isobtained from Florida.

As a result of this interview the Board adopted a motion made by Dr. Roufail and secondedby Dr. Patterson that Dr. Modarress be approved for licensure.

Qn January 25, 1992, Dr. Ashraf appeared for his licensure interview before Dr. Stratas andMrs. Willis.

As a result of this interview, the Board adopted a motion made by Dr. Stratas and secondedby Mrs. Willis that Dr. Ashraf be approved for licensure.

WELSH, Mark Allen, M.D. —Portsmouth, VA - wl

Qn January 25, 1992 Dr. Welsh appeared before the full Board as requested for a licensureinterview.

As a result of this interview the Board adopted a motion to issue Dr. Welsh a 6 month temporarylicense. Dr. Welsh was also instructed to continue to abide by his PHEP contract, to keep theBoard informed of his employment status in North Carolina, to review and have approved, all jobpossibilities in North Carolina with Robert C. Vanderberry, M.D., Medical Director, Physician' sHealth and Effectiveness Program, and return for an informal interview in six months.

MINIRTH, Franklin Brent, M.D. —Richardson, TX - wl

Qn January 25, 1992 Dr. Minirth appeared before Dr. Henry and Dr. Daniel as requested for alicensure interview.

As a result of the interview the Board adopted a motion made by Dr. Henry and seconded by Dr.Daniel that the Board delay making a decision at this time. Dr. Minirth is to provide the Boardwith complete documentation and final disposition of the new complaint brought forth in Texas.Dr. Minirth is requested to submit a letter from his attorney or the courts system regarding thepossible pending suit against lum involving the release of patient records. Upon receipt of theabove, the Board will review the information and notify him of its decision.

Qn January 25, 1992 Dr. Khodaparast appeared before Dr. Henry and Dr. Daniel as requested fora licensure interview.

As a result of this interview the Board adopted a motion made by Dr. Henry and seconded by Dr.Daniel to approve Dr. Khadaparast for licensure.

Uponreceipt of the psychiatric evaluation and the results of his SPEX exatn, the Board will reconsiderhis application for licensure.

On January 25, 1992, Dr. Hedbexg appeared for the required licensure interview before asubconunittee of Dr. Stratas and Mrs. Willis.

On January 25, 1992, the Board of Medical Examiners unanimously adopted a motion that theBoard accept the reconuaendation of the licensure subconunittee and approve this physician forlicensure with the following:
