#4 STAFF REPORT NO. 082-15 TO: Mayor and City Council DATE: 5/18/2015 FROM: Eric Holmes, City Manager Subject: Termination of an Interlocal Agreement for Law Enforcement Services at Vancouver Lake Park and Frenchman’s Bar Park Key Points: An existing 20-year Interlocal was created in 1995; The terms of this Interlocal provide that in exchange for marine patrols by the Clark County Sheriff’s Office (“CCSO”), the City of Vancouver will provide law enforcement services for territory outside of the boundaries of the City of Vancouver (specifically, unincorporated areas of the Vancouver Lowlands up to the dead end of Lower River Road); The Vancouver Police Department (“VPD”) has studied the call volumes related to this Interlocal (comparing marine response calls inside City limits to calls for service on Lower River Road outside City limits) and determined that the citizens of the City of Vancouver would be best served by terminating this Interlocal. Objective: Authorize the City Manager, City Attorney and City Clerk to execute a Notice of Termination to end our existing Interlocal effective November 28, 2015. Present Situation: The current 20-year Interlocal was created in 1995. Over 20 years, the assets and partnerships of VPD have changed, as have the operational needs of surrounding community. This Interlocal provides that CCSO will provide a marine patrol unit to respond to Vancouver Lake to handle major water emergencies requiring rescue operations. However, in exchange, VPD is required to provide law enforcement services for territory that is not located within the boundaries of the City of Vancouver (specifically, unincorporated areas of the Vancouver Lowlands up to the dead end of Lower River Road to Willow Point on the north, and Lake River on the east). VPD has studied the impacts of this Interlocal and determined that the assets allocated to responding to calls associated with Lower River Road are considerably higher than the benefits it receives from CCSO for marine patrols. Accordingly, the interests of the citizens of the City of Vancouver would be best served by terminating this Interlocal. Upon termination, VPD anticipates that the City will be able to provide equivalent marine response levels through other partnerships. In order to terminate this Interlocal Agreement, a 180-day notice of intent to terminate is required in writing. A copy of this notice is attached.

1. Reduce law enforcement call volumes associated with calls for service outside of Vancouver City limits.

2. Allow VPD to distribute units to more service calls within Vancouver city limits. Disadvantage(s): No disadvantages are anticipated at this time. Budget Impact: There are no hard costs or budget impacts associated with this agenda item. Prior Council Review: The Vancouver City Council has not reviewed this matter since the Interlocal was adopted in 1995. Action Requested: Authorize the City Manager, City Attorney and City Clerk to execute a Notice of Termination.
