IntroductionTheSt.Mary’sUniversity2016AnnualSecurityandFireSafetyReportispublishedincompliancewiththeJeanneCleryDisclosureofCampusSecurityPolicyandCrimeStatisticsAct.Thisreportincludesstatisticsforthepreviousthreeyearsconcerningreportedcrimesthatoccurredoncampus,incertainnon-campusbuildingsownedorcontrolledbySt.Mary’sUniversity,andonanypublicpropertywithinorimmediatelyadjacenttothecampus.
Thisreportispreparedincooperationwithourmaincampus,distancelearningandsatellitecampuses,andtheOfficeofStudentLife.EachentityprovidesupdatedinformationontheireducationaleffortsandprogramstocomplywiththeCleryAct.
TheproceduresforpreparingtheannualdisclosureofcrimestatisticsincludereportingstatisticstotheUniversitycommunityobtainedfromthefollowingsources:St.Mary’sUniversityPoliceDepartment,theSanAntonioPoliceDepartment,andnon-policeofficialsidentifiedbyFederalLawasCampusSecurityAuthorities.Forstatisticalpurposes,crimestatisticsreportedtoanyofthesesourcesarerecordedinthecalendaryearthecrimewasreported.
Campuscrime,arrest,andreferralstatisticsincludethosereportedtotheUniversityPoliceDepartment,designatedcampusofficials(includingbutnotlimitedtodirectors,deans,departmentheads,designatedResidenceLifestaff,judicialaffairs,advisorstostudents/studentorganizationsandathleticcoaches),aswellasreportssubmittedanonymously.
Thereportalsoincludesinstitutionalpoliciesconcerningcampussecurity,firesafety,alcoholanddruguse,crimeprevention,thereportingofcrimes,sexualassault,andothermatters.

Inadditiontothisreport,theUniversityPoliceDepartmentmaintainsadailycrimeandfirelogwhichisavailabletothepublic.TheinformationinthedailycrimelogincludesallcrimesreportedtotheUniversityPoliceDepartment.Theinformationinthefirelogincludesinformationaboutfiresthatoccurinresidentialfacilities,includingthenature,date,time,andgenerallocation.ItisavailableforreviewattheUniversityPoliceDepartmentAdministrativeOfficeduringnormalbusinesshours.

ComplianceStatementToensurecompliancewiththeCleryAct,St.Mary’sUniversitymustmeetobligationsinthefollowingthreecategories:(1)policydisclosure;(2)recordscollectionandretention;and(3)informationdissemination.
PolicyDisclosure—St.Mary’sUniversitymustprovidetheUniversitycommunityandthepublicwithstatementsofthecurrentpoliciesandpracticesregardingproceduresforreportingcrimesandotheremergenciesoncampus,aswellaspoliciesregardingsecurityandaccesstocampusfacilities,andpoliciesrelatedtotheUniversityPoliceDepartment’sjurisdictionandworkingrelationships.
RecordsCollectionandRetention—St.Mary’sUniversityisrequiredtokeepcampusrecordsofcrimesreportedoncampustocampussecurityauthorities,makeareasonablegoodfaithefforttoobtaincertaincrimestatisticsfromappropriatelawenforcementagenciestoincludeintheannualsecurityandfiresafetyreport,andkeepadailycrimelogopenforpublicinspection.
InformationDissemination—ToprovidemembersoftheUniversitycommunitywithinformationneededtomakeinformedpersonalsafetydecisions,theUniversitywillprovidethefollowing:1)TimelywarningnotificationsofCleryActcrimesthatrepresentanongoingthreattothesafetyofstudentsandemployees;2)Immediate(emergency)notificationstotheUniversitycommunityuponconfirmationofasignificantemergencyordangeroussituationinvolvinganimmediatethreattothehealthorsafetyofstudentsoremployees,and;3)Publishanannualsecurityandfiresafetyreport,makethereportavailabletoallcurrentstudentsandemployees,andensuretheannualsecurityreportismadeavailabletoprospectivestudentsandemployees.
TheUniversityisrequiredtoreportseriouscrimesthatoccuronuniversityownedorcontrolledproperty,publicpropertythatiswithinorimmediatelyadjacenttothecampus,andnon-campuspropertiesasdefinedbytheCleryAct.Thecrimesthatmustbereportedincludethefollowing:

IncompliancewiththeUniversity’sEqualOpportunity,Non-Discrimination,andSexualHarassmentpolicy,allemployeesoftheUniversityareclassifiedasCampusSecurityAuthoritiesandmustreportsuchcrimestotheUniversityPoliceDepartment.
Theonlyexceptiontotheaboveis:staffpsychologists,counselors,andclergywhenknowledgeofthecrimehasbeengainedintheirprofessionalcapacityonly.
Subsequenttoaninitialreport,UniversityofficialsmayneedadditionalinformationinordertofulfilltheUniversity’sobligationsunderfederal,state,andlocallaws.
TheUniversityPolicewilladvisetheTitleIXCoordinatorofanyreportsthatallegeviolationsoftheUniversity’sEqualOpportunity,Non-Discrimination,andSexualHarassmentpolicy.Forreportsofcrimesinvolvingstudents,theUniversityPolicewillalsonotifytheDeanofStudents.
CrimeReportingPoliciesandProceduresSt.Mary’sUniversityencouragesstudents,employees,visitors,andcommunitymemberstoreportallcrimesandpublicsafetyrelatedincidentstotheUniversityPoliceDepartmentinanaccurateandtimelymanner.
TheSt.Mary’sUniversityPoliceDepartmentisavailable24hoursadaytoansweryourcalls.Inresponsetoacall,UniversityPolicewilltaketherequiredaction,eitherdispatchinganofficerand/orotheremergencyservicesoraskingthecallertoreporttoUPDtofileanincidentreport.AllreportedcrimeswillbeinvestigatedbyUniversityPolice.ReportsinvolvingstudentsareforwardedtotheDeanofStudentsforreviewandpotentialjudicialaction.Incidentswillbeinvestigatedwhendeemedappropriate,andanyadditionalinformationobtainedviatheinvestigationmayalsobeforwardedtotheDeanofStudents.
StudentsandemployeesshouldreportcrimestotheUniversityPoliceDepartmenttobeassessedforinclusionintheannualcrimestatisticsand/orthedailycrimelog.PromptreportingalsoaidsinprovidingtimelynoticestotheUniversitycommunity,whenappropriate.

Withthevictim’spermission,theChiefofSt.Mary’sUniversityPoliceDepartmentorhisdesigneecanfileareportonthedetailsoftheincidentwithoutrevealingyouridentity.Theonlyexceptionisthatifthereportedincidentinvolvessexualmisconduct,thePoliceDepartmentisrequiredbyFederalLawtonotifytheSt.Mary’sUniversityTitleIXCoordinatoroftheincident.TheconfidentialreportallowstheUniversitytomaintaincompliancewiththeapplicableFederalRegulations,aswellasaidinthefuturesafetyofyourselfandothers.Withsuchinformation,theUniversitycankeepanaccuraterecordofthenumberofincidentsinvolvingstudents,determinewhetherthereisapatternofcrimewithregardtoaparticularlocation,method,orassailant,andalerttheUniversitycommunitytopotentialdanger.Reportsfiledinthismannerarecountedanddisclosedintheinstitution’sAnnualSecurityandFireSafetyReport.St.Mary’sUniversityencouragespastoralandprofessionalcounselors,ifandwhentheydeemitappropriate,toinformthepersonstheyarecounselingoftheUniversity’sconfidentialreportingprocedures.PastoralCounselor:Anemployeeofaninstitution,whoisassociatedwithareligiousorderordenomination,recognizedbythatreligiousorderordenominationassomeonewhoprovidesconfidentialcounselingandwhoisfunctioningwithinthescopeofthatrecognitionasapastoralcounselor.ProfessionalCounselor:Anemployeeofaninstitutionwhoseofficialresponsibilitiesincludeprovidingpsychologicalcounselingtomembersoftheinstitution’scommunity,andwhoisfunctioningwithinthescopeofhisorherlicenseorcertification.

CampusSecurityAuthorities(CSAs)Recognizingthatmanycrimes(especiallythoseinvolvingsexualmisconduct)arenotreportedtothepolice,theCleryActrequiresschoolstocollectdataaboutcrimesonandaroundtheircampusesfromawidevarietyofsources,referredtoasCampusSecurityAuthorities(CSAs),asdefinedbyFederalLaw.InadditiontoUniversityPolice,anyfacultyorstaffmemberwith"significantresponsibilityforstudentandcampusactivities"isconsideredaCSAandhasdutiesundertheCleryAct.
TheCleryActdefinesthelastcategoryofCSAsbroadlytoensurecompletecoverageandthoroughreportingofcrimes.WhileCSAsshouldbeidentifiedbyfunctionratherthantitle,thiscategorytypicallyincludesvicepresidents,deans,assistantdeans,residentialservicesstaff,athleticcoaches,studentactivitiescoordinators,andfacultyadvisorstostudentorganizations.
CampusSecurityAuthorities
TheCleryActdefinesfourcategoriesofCSAs:
• UniversityPolice;• Non-policesecuritystaffresponsibleformonitoringcollegeproperty;• Peopleorofficesdesignatedbyschoolpolicyasthosetowhomorwhichcrimesshouldbe
reported;• Officialswithsignificantresponsibilityforstudentandcampusactivities.
AccordingtotheUniversity’sEqualOpportunity,Nondiscrimination,SexualandOtherFormsofHarassmentPolicy,allemployeeshavebeenclassifiedasCSAsandreceiveannualtraining.Underthisclassification,CSAsarerequiredtoreportanyCleryrelatedoffenseimmediatelytotheUniversityPoliceDepartment.
WhoIsNotCategorizedasaCSA?
ThesefacultyandstaffmembersaretypicallynotconsideredCSAsandaregivenanexceptiontothereportingrequirementsaslongastheyareactingwithinthespecificofficialrolesof:
• Counselorsinthecounselingcenterwhoonlyprovidecaretoindividualstudents.• PastoralCounselors
Notealsothat(a)licensedprofessionalmental-healthcounselorsand(b)pastoralcounselorsemployedbyareligiousorganizationtoprovideconfidentialcounselingareexemptfromtheAct'sreportingrequirements,aslongastheyareworkingwithinthescopeoftheirlicenseorreligiousassignmentatthetimetheyreceiveacrimereport.
EmergencyNotificationandTimelyWarningNotificationEmergencyNotifications
InaccordancewiththeHigherEducationActof1965,St.Mary’sUniversityhasimplementedacomprehensivecommunicationssystemtoprovidepromptEmergencyNotificationalerts(calledStMUAlert)forincidentsinvolvingapotentialimmediatethreattothehealthandsafetyofmembersofthe

campuscommunityusingbothemailandtextmessages.SomebuildingshavePublicAddressSystems,whichmaybeusedbytheStMUPolicetocommunicatewithoccupantsofanindividualbuilding,whenappropriate.TheUniversitymayalsousetheUniversitywebsiteand/orsocialmediatoprovideinformation,aswellandthecontentforandactivationofthesesystemsistheresponsibilityUniversityCommunications.IfeitherthesesystemsfailortheUniversitydeemsitappropriate,inpersoncommunicationorotheravailableformsofcommunicationmaybeusedtocommunicateanemergency.
IftheStMary’sUniversityPoliceDepartment,inconjunctionwithotherUniversityadministrators,localfirstrespondersand/ortheNationalWeatherService,confirmsthatthereisanemergencyordangeroussituationthatposesanimmediatethreattothehealthorsafetyofsomeorallmembersoftheSt.Mary’sUniversityCommunity,thefollowingwillapply.Uponconfirmationofasignificantemergencyordangeroussituationinvolvinganimmediatethreattothehealthorsafetyofstudentsoremployeesoccurringoncampus,theSt.Mary’sUniversityPoliceDepartmentwillberesponsiblefordeterminingifanImmediate(emergency)Notificationiswarranted,essentiallyconfirmingtheemergencyandimmediatelynotifyingthecampuscommunity.IfanImmediate(emergency)Notificationisneeded,itissenttomembersoftheUniversitycommunityviaemailandanStMUAlert.Thecontentofthemessagewillbedeveloped,andthemessagewillbesentbytheUniversityPoliceDepartment.UniversityPolicewillsendthemessagetotheSt.Mary’sUniversityCommunityortotheappropriatesegmentofthecommunity,ifthethreatislimitedtoaparticularbuildingorsegmentofthepopulation.
FollowupmessageswillalsofollowtheabovedescribedprocessandwillbesentbytheUniversityPoliceDepartment.
TheSt.Mary’sUniversityPoliceDepartmentwill,withoutdelay,andtakingintoaccountthesafetyoftheUniversitycommunity,determinethecontentofthenotificationandinitiatethenotification,unlessdoingsowill,intheprofessionaljudgementoflawenforcementpersonnel,compromiseeffortstoassistavictimortocontain,respondto,orotherwisemitigatetheemergency.
Beforesendinganimmediate(emergency)Notification,theofficerortelecommunicatorwill,iftimepermits,notifyhis/hersupervisorwhenitisdeterminedthatasignificantemergencyordangeroussituationexists.Thesupervisorwillselecttheappropriatemessagetemplateordraftanewalert,thensendthemessagetotheUniversityCommunitybyemailandtextmessage.Ifthesupervisorisunable,oriftimedoesnotpermit,tosendanemailortextmessage,permissionhasbeengiventothetelecommunicatororofficertosendtheappropriatemessage.
Thelocalnewsmediamaybeutilizedtodisseminateemergencyinformationtomembersofthelargercommunity,includingneighbors,parentsandotherinterestedparties.ThelargercommunitycanalsoaccessemergencyinformationviatheSt.Mary’sUniversityhomepageand/orsocialmedia.

TimelyWarningsTheSt.Mary’sUniversityPoliceDepartmentand/orUniversityCommunicationshavetheauthoritytodevelopanddistributetimelywarningnotices(calledCrimeAlerts)fortheUniversitytonotifymembersofthecommunityaboutseriouscrimesagainstpeoplethatoccurwithinthecampusboundaries(whichincludesonuniversityownedorcontrolledpropertyoncampusandpublicpropertythatiswithinorimmediatelyadjacenttothecampus)andinnon-campuspropertiesasdefinedbytheCleryAct.TheseunitsmaycollaboratewithotherUniversityDepartments,iftimepermits,howevertheyhavetheauthoritytodistributethemwithoutcollaboration,ifdeemednecessary.AlthoughnotrequiredbyFederalLaw,timelywarningnoticesmayalsobedistributedforcrimesthatoccuroutsidetheCleryActgeographicareas,ifthecrimeisdeemedtoposeanongoingthreattothecampuscommunity.Thedecisiontoissueatimelywarningnoticeforanoffcampuscrimewillmadeonacasebycasebasisdependingonanassessmentofvariousfactors,whichincludebutarenotlimitedto:thenatureofthecrime,theexactlocation,thetimeoftheincident,thelocalpoliceresponseandguidancetocampusofficialsandthepotentialdirecteffectonthecampuscommunity.
AtimelywarningnotificationwillbedistributedwhenitisdeterminedthatthereisanongoingorseriousthreattomembersoftheSt.Mary’sUniversitycommunity.Inaddition,thesetimelywarningswilltypicallybeissuedforCleryActreportablecrimesindicatedbelow.Allothercrimecategorieswillbeassessedonacasebycasebasis.
TheUniversityPoliceDepartmentreviewsinformationthatisreportedeitherdirectlytoUniversityPoliceorindirectlyreportedbymembersofthecommunity,CampusSecurityAuthorities,andotherlocallawenforcementtodetermineifareportedcrimeposesaseriouson-goingthreattomembersoftheUniversitycommunity.
TimelyWarningNoticeswillbedistributedassoonaspertinentinformationisavailable,inamannerthatwithholdsthenamesofvictimsasconfidential,andwiththegoalofaidinginthepreventionofsimilaroccurrences.
TimelyWarningsaretypicallyissuedforthefollowingUniformCrimeReportingProgram(UCR)/NationalIncidentBasedReportingSystem(NIBRS)crimeclassifications:
• Murder/Non-NegligentManslaughter• AggravatedAssault(casesinvolvingassaultsamongknownparties,suchastworoommates
fightingwhichresultsinanaggravatedinjury,willbeevaluatedonacase-by-casebasistodetermineiftheindividualisbelievedtobeanongoingthreattothelargerSt.Mary’sUniversitycommunity)

• Robberyinvolvingforceorviolence(casesincludingpickpocketingandpursesnatchingwilltypicallynotresultintheissuanceofaTimelyWarningNotice,butwillbeassessedonacase-by-casebasis)
• SexualAssault(consideredonacase-by-casebasisdependingonthefactsofthecase,whenandwheretheincidentoccurred,whenitwasreported,andtheamountinformationknownbytheUniversityPolice,ordesignee).Incasesinvolvingsexualassault,theyareoftenreportedlongaftertheincidentoccurred,thusthereisnoabilitytodistributea“timely”warningnoticetothecommunity.Allcasesofsexualassault,includingstrangerandnon-stranger/acquaintancecases,willbeassessedforpotentialissuanceofaTimelyWarningNotice.
• MajorincidentsofArson• OtherClerycrimesasdeterminednecessarybytheUniversityPolice.
Alltimelywarningnoticeswillincludethefollowing,unlessissuinganyofthisinformationwouldriskcompromisinglawenforcementefforts:
• Dateandtimeortimeframeoftheincident• Abriefdescriptionoftheincident• Informationthatwillpromotesafetyandpotentiallyaidinthepreventionofsimilarcrimes

DrugsFederallaw,Statelaw,andUniversitypolicyprohibittheuse,possession,sale,manufacture,ordistributionofanyillegaldrugs.TheSt.Mary’sUniversityPoliceDepartmentisresponsiblefortheenforcementofbothStateandFederaldruglaws.Tobacco(Nicotine)Some30percentofcancerdeaths(130,000peryear)arelinkedtosmoking.Chronicobstructivelungdiseasessuchasemphysemaare10timesmorelikelytooccuramongsmokersthannon-smokers.Smokingduringpregnancyalsoposesseriousriskssuchasspontaneousabortion,pre-termbirth,lowbirthweights,andfetalandinfantdeaths.DesignerDrugsInordertocircumventlegalrestrictions,undergroundchemistsmodifythemolecularstructureofcertainillegaldrugstoproducedesignerdrugs.Manyoftheso-calleddesignerdrugsarerelatedtoamphetamines(MDMA,X).Thesesubstancescanproduceasevereneurochemicalchangetothebrain.Narcotictypedrugs(chinawhite)cancauseParkinson’sdisease-likesymptoms(uncontrollabletremors,drooling,impairedspeech,paralysisandirreversiblebraindamage).Amphetamineandmethamphetaminetypesubstancescausesnausea,blurredvision,chillsorsweatingandfaintness.Psychologicaleffectsincludeanxiety,depressionandparanoia.Designerphencyclidinecausesillusions,hallucinationsandimpairedperception.NarcoticsNarcoticsinitiallyproducefeelingsofeuphoriafollowedbydrowsiness,nauseaandvomiting.Usersmayexperienceconstrictedpupils,wateryeyesanditching.Anoverdosemayproduceslowandshallowbreathing,clammyskin,convulsions,coma,andpossibledeath.Addictioninpregnantwomencanleadtopremature,stillbornoraddictedinfantswhoexperienceseverewithdrawalsymptoms.CocaineTheuseofcocainecancausedeathbycardiacarrestorrespiratoryfailure.Immediateeffectsincludedilatedpupils,elevatedbloodpressure,heartrate,respiratoryrateandbodytemperature.Occasionalusecancausestuffyorrunnynose,whilechronicusecanulceratethemucousmembraneofthenose.Cocainecanproducepsychologicaldependency;afeelingthattheusercannotfunctionwithoutthedrug.Crackorfreebaserockisextremelyaddictive,andphysicaleffectsincludedilatedpupils,increase

Marijuana(Cannabis)Useofcannabismayimpairorreduceshort-termmemoryandcomprehension,alterone’ssenseoftimeandreduceabilitytoperformtasksrequiringconcentrationandcoordination,suchasdrivingacar.Motivationandcognitionmaybealtered,makingtheacquisitionofnewinformationdifficult.Marijuanacanalsoproduceparanoiaandpsychosisandisdamagingtothelungsandpulmonarysystem.Marijuanasmokecontainsmorecancercausingagentsthantobaccosmoke.AnabolicSteroidsSteroiduserssubjectthemselvestomorethan70possiblesideeffectsranginginseverityfromlivercancertoacne,andincludepsychological,aswellasphysicalreactions.Theliver,cardiovascularandreproductivesystemsaremostseriouslyaffectedbysteroiduse.Inmales,usecancausesterilityandimpotence.Infemales,irreversiblemasculinetraitscandevelopalongwithsterility.Psychologicaleffectsincludeveryaggressivebehaviorknownas“roidrage”anddepression.HallucinogensLSD,mescalineandpsilocybincauseillusionsandhallucinations.Thephysicaleffectsmayincludedilatedpupils,elevatedbodytemperature,increasedheartrateandbloodpressure,lossofappetite,sleeplessness,andtremors.Sensationsandfeelingsmaychangerapidly.Theusemayexperiencepanic,confusion,suspicion,anxietyandlossofcontrol.Delayedeffects,orflashbacks,canoccurevenafterusehasceased.UsersofPCPreportpersistentmemoryproblemsandspeechdifficulties,depression,anxietyandoftenviolentbehaviorpatterns.DepressantsTheeffectsofdepressantsareinmanywayssimilartotheeffectsofalcohol.Smallamountscanproducecalmness,relaxedmuscles,butsomewhatlargerdosescancauseslurredspeech,staggeringgaitandalteredperception.Largedosescancauserespiratorydepression,comaanddeath.Thecombinationofdepressantscanmultiplytheeffectsofthedrugs,therebymultiplyingtherisks.Theuseofdepressantscancausebothphysicalandpsychologicaldependence.

• Rapeisdefinedasthepenetration,nomatterhowslight,ofthevaginaoranuswithanybodypartorobject,ororalpenetrationbyasexorganofanotherperson,withouttheconsentofthevictim.
• Fondlingisdefinedasthetouchingoftheprivatepartsofanotherpersonforthepurposesofsexualgratification,withouttheconsentofthevictim,includinginstanceswherethevictimisincapableofgivingconsentbecauseofhis/herageorbecauseofhis/hertemporaryorpermanentmentalincapacity.

Stalking:
• Engaginginacourseofconductdirectedataspecificpersonthatwouldcauseareasonablepersonto—

• Forthepurposesofthisdefinition—o Courseofconductmeanstwoormoreacts,including,butnotlimitedto,actswhichthe
stalkerdirectly,indirectly,orthroughthirdparties,byanyaction,method,device,ormeansfollows,monitors,observes,surveils,threatens,orcommunicatestoorabout,aperson,orinterfereswithaperson’sproperty.
o Reasonablepersonmeansareasonablepersonundersimilarcircumstancesandwithsimilaridentitiestothevictim.
o Substantialemotionaldistressmeanssignificantmentalsufferingoranguishthatmay,butdoesnotnecessarily,requiremedicalorotherprofessionaltreatmentorcounseling.
JurisdictionalDefinitionsofDomesticViolence,DatingViolence,SexualAssaultandStalkingBelowaredefinitionsfordomesticviolence,datingviolence,stalking,andsexualassaultasdefinedbytheStateofTexas.
DomesticViolence:IntheStateofTexasdomesticviolenceisreferredtoasfamilyviolence.Familyviolencemeans:
• anactbyamemberofafamilyorhouseholdagainstanothermemberofthefamilyorhouseholdthatisintendedtoresultinphysicalharm,bodilyinjury,assault,orsexualassaultorthatisathreatthatreasonablyplacesthememberinfearofimminentphysicalharm,bodilyinjury,assault,orsexualassault,butdoesnotincludedefensivemeasurestoprotectoneself;
• abuse,asthattermisdefinedbySections261.001(1)(C),(E),and(G)oftheTexasFamilyCode,byamemberofafamilyorhouseholdtowardachildofthefamilyorhousehold;or
• datingviolence,asthattermisdefinedbySection71.0021.
DatingViolence:Anact,otherthanadefensivemeasuretoprotectoneself,byanactorthat:
• iscommittedagainstavictim:o withwhomtheactorhasorhashadadatingrelationship;or

o becauseofthevictim'smarriagetoordatingrelationshipwithanindividualwithwhomtheactorisorhasbeeninadatingrelationshipormarriage;and
• isintendedtoresultinphysicalharm,bodilyinjury,assault,orsexualassaultorthatisathreatthatreasonablyplacesthevictiminfearofimminentphysicalharm,bodilyinjury,assault,orsexualassault.
Forpurposesofthistitle,"datingrelationship"meansarelationshipbetweenindividualswhohaveorhavehadacontinuingrelationshipofaromanticorintimatenature.Theexistenceofsucharelationshipshallbedeterminedbasedonconsiderationof:
• thelengthoftherelationship;• thenatureoftherelationship;and• thefrequencyandtypeofinteractionbetweenthepersonsinvolvedintherelationship.• Acasualacquaintanceshiporordinaryfraternizationinabusinessorsocialcontextdoesnot
constitutea"datingrelationship"underSubsection(b).

SexualAssault-(a)Apersoncommitsanoffenseiftheperson:
• intentionallyorknowingly:o causesthepenetrationoftheanusorsexualorganofanotherpersonbyanymeans,
withoutthatperson'sconsent;o causesthepenetrationofthemouthofanotherpersonbythesexualorganoftheactor,
withoutthatperson'sconsent;oro causesthesexualorganofanotherperson,withoutthatperson'sconsent,tocontactor
penetratethemouth,anus,orsexualorganofanotherperson,includingtheactor;or• intentionallyorknowingly:

• theactor'sancestorordescendantbybloodoradoption;• theactor'scurrentorformerstepchildorstepparent;• theactor'sparent'sbrotherorsisterofthewholeorhalf-blood;• theactor'sbrotherorsisterofthewholeorhalfbloodorbyadoption;• thechildrenoftheactor'sbrotherorsisterofthewholeorhalfbloodorbyadoption;or• thesonordaughteroftheactor'sauntoruncleofthewholeorhalfbloodorbyadoption.
Stalking-(a)Apersoncommitsanoffenseiftheperson,onmorethanoneoccasionandpursuanttothesameschemeorcourseofconductthatisdirectedspecificallyatanotherperson,knowinglyengagesinconductthat:
• constitutesanoffenseunderSection42.07,orthattheactorknowsorreasonablyshouldknowtheotherpersonwillregardasthreatening:
o bodilyinjuryordeathfortheotherperson;o bodilyinjuryordeathforamemberoftheotherperson'sfamilyorhouseholdorforan
individualwithwhomtheotherpersonhasadatingrelationship;oro thatanoffensewillbecommittedagainsttheotherperson'sproperty;

Consent
St.Mary’sUniversitydefinesconsentasknowing,voluntary,andclearpermissionbywordoraction,toengageinmutuallyagreeduponsexualactivity.Sinceindividualsmayexperiencethesameinteractionindifferentways,itistheresponsibilityofeachpartytomakecertainthattheotherhasconsentedbeforeengagingintheactivity.Forconsenttobevalid,theremustbeaclearaffirmativeexpressioninwordsoractionsthattheotherindividualconsentedtothatspecificsexualconduct.Consentcannotbeobtainedbythreat,coercion,orforce.Agreementundersuchcircumstancesdoesnotconstituteconsent.
Apersoncannotconsentifheorsheisunabletounderstandwhatishappeningorisdisoriented,helpless,asleep,orunconsciousforanyreason,includingduetoalcoholorotherdrugs.Anindividualwhoengagesinsexualactivitywhentheindividualknows,orshouldknow,thattheotherpersonis

physicallyormentallyincapacitatedhasviolatedthispolicy.Itisnotanexcusethattheindividualaccusedofsexualmisconductwasintoxicatedand,therefore,didnotrealizetheincapacityoftheother.
Incapacitationisdefinedasastatewheresomeonecannotmakerational,reasonabledecisionsbecausetheylackthecapacitytogiveknowingconsent(e.g.,tounderstandthe“who,what,when,where,whyorhow”oftheirsexualinteraction).Thispolicyalsocoversapersonwhoseincapacityresultsfrommentaldisability,involuntaryphysicalrestraint,and/orfromthetakingofincapacitatingdrugs.Consenttosomesexualcontact(suchaskissingorfondling)cannotbepresumedtobeconsentforothersexualactivity(suchasintercourse).
Acurrentorpreviousdatingrelationshipisnotsufficienttoconstituteconsent.Theexistenceofconsentisbasedonthetotalityofthecircumstances,includingthecontextinwhichtheallegedincidentoccurredandanysimilarpreviouspatternsthatmaybeevidenced.Silenceortheabsenceofresistancealonemaynotindicateconsent.Apersoncanwithdrawconsentatanytimeduringsexualactivitybyexpressinginwordsoractionsthatheorshenolongerwantstheacttocontinue,and,ifthathappens,theotherpersonmuststopimmediately.
InTexas,aminor(meaningapersonundertheageof17years)cannotconsenttosexualactivity.Thismeansthatsexualcontactbyanadultwithapersonyoungerthan17yearsoldisaviolationofthispolicy.TheStateofTexasdefinestheageofconsentinPenalCodeSection22.011.Sexualassault(c)(1)"Child"meansapersonyoungerthan17yearsofage.
HowtoBeanActiveBystander
Bystandersplayacriticalroleinthepreventionofsexualandrelationshipviolence.Theyare“individualswhoobserveviolenceorwitnesstheconditionsthatperpetuateviolence.Theyarenotdirectlyinvolvedbuthavethechoicetointervene,speakup,ordosomethingaboutit.”1Wewanttopromoteacultureofcommunityaccountabilitywherebystandersareactivelyengagedinthepreventionofviolencewithoutcausingfurtherharm.Wemaynotalwaysknowwhattodoevenifwewanttohelp.Belowisalistofsomewaystobeanactivebystander.Furtherinformationregardingbystanderinterventionmaybefound.

NewstudentsarerequiredtocompleteouronlineThinkAboutItprogramasapartoftheirND101class,whichisamandatorycourseforincomingstudents.Theonlineprogramtakesabout3½to4hourstocompleteandpresentsthestudentwithoptionsforsituationstheymightencounterasapartofcollegelife.
DuringZaragoza,St.Mary’sorientationfornewstudents,theChiefofPolicegivesapresentationtotheincomingclassandtheirparentsregardingsafetyandsecurity.IncominginternationalstudentsattendapresentationbythePoliceCaptainonthetopicsofsafety,security,andtipsabouthowtointeractwithAmericanlawenforcement.
ResidentAdvisorstakepartinroleplayduringtheirannualtraining,scenariosreviewhowtohandlealcoholviolations,drugviolations,sexualassault,domesticviolence,stalking,andassaultswithinoncampusresidencefacilities.
NewemployeesaregivenawelcomepacketwithinformationandarerequiredtowatchavideorelatedtoTitleIXandsexualharassmentintheworkplace.InOctoberof2014,HumanResourcespartneredwiththeUniversityPoliceDepartmenttodeveloponlinetrainingmodulesforboththeCleryActandTitleIX.

CommunityEducationemploysgrouppresentations,movies,videogames,flyers,onlinetraining,raffles,giveaways,andotherstrategiesforpreventionandawarenesscampaigns.Manyfreshmanclassesalsorequireattendanceorofferextracreditopportunitiesforattendingaprogram.Throughreferralsandresearch,programmingismaintainedeachyear.

ProtectiveOrderProcedures
Oncetheapplicationhasbeenapproved,aprotectiveorderhearingwillbescheduledin2weekstogivetheSheriff'sOfficetimetoservetheperpetrator.Oncegranted,aprotectiveorderlastsuptotwo(2)years.
TheSheriff'sOfficewillhanddeliverthepaperworktotheactor.Thepaperworkconsistsofanapplicationfortheprotectiveorder,theswornstatementyousignedinourofficedescribingtheviolence,andaTemporaryExParteOrdertokeeptheperpetratorfrombotheringyouuntilthehearingdate.Thisincludeskeepingtheactorawayfromyourresidenceandplaceofemployment.
Iftheperpetratorisserved,youwillneedtogotocourt.Aprosecutorandanadvocatewillgowithyoutocourttorepresentyouandanswerallyourquestions.
Iftheactoragreestoleaveyoualone,anAgreedProtectiveOrderwillbeissued.Ifheorshedoesnotshow,youautomaticallygetaProtectiveOrderbydefault.Ifheorshedeniesthecharges,ahearingwillbeheldinfrontofaJudgewhowilldecideifyougettheProtectiveOrder.

AdjudicationofViolations
TheUniversity’sdisciplinaryprocessincludesaprompt,fair,andimpartialinvestigationandresolutionprocess.Inallinstances,theprocesswillbeconductedinamannerthatisconsistentwiththeinstitution’spolicyandthatistransparenttotheaccuserandtheaccused.Usually,theresolutionofdomesticviolence,datingviolence,sexualassaultandstalkingcomplaintsarecompletedwithin60days

1. HowtoFileaDisciplinaryComplaintUnderthisPolicyThereisnotimelimitonreportingviolationsoftheCodeofStudentConduct;however,thelongersomeonewaitstoreportanoffense,theharderitbecomesforuniversityofficialstoobtaininformationandwitnessstatements,and/ortomakedeterminationsregardingalleged

violations.Thoughanonymouscomplaintsarepermitted,doingsomaylimittheuniversity’sabilitytoinvestigateandrespondtoacomplaint.ThosewhoareawareofmisconductareencouragedtoreportitasquicklyaspossibletouniversityofficialsincludingtheDeanofStudentstheOfficeofJudicialAffairsandCommunityEducation,andUniversityPolice.AnymemberoftheSt.Mary’sUniversitycommunity,visitor,orguestmayreportapolicyviolation(s)byanystudentformisconductunderthisCodeofStudentConducttotheDeanofStudents,JudicialAffairsandCommunityEducation,UniversityPolice,ResidenceLife,ortheUniversity’sTitleIXCoordinator.
2. HowtheUniversityDeterminesWhetherThisPolicywillbeUsedTheCodeofStudentConductandtheconductprocessapplytoindividualSt.Mary’sUniversitystudentsincludingundergraduate,graduateandlawandotherstudentsparticipatinginacademicprogramsoftheUniversity(e.g.:IntensiveEnglishProgramparticipants).Thiscodealsoappliestouniversity-affiliatedregisteredstudentorganizations.Forthepurposesofstudentconduct,theUniversitymayconsideranindividualtobeastudentwhenanofferofadmissionhasbeenextendedandthereafteraslongasthestudenthasacontinuingeducationalinterestintheUniversity.TheUniversityretainsconductjurisdictionoverstudentswhochoosetotakealeaveofabsence,withdraworhavegraduatedforanymisconductthatoccurredpriortotheleave,withdrawalorgraduation.Ifsanctioned,aholdmaybeplacedonthestudent’sabilitytore-enrollorobtainofficialtranscripts.Allsanctionsmustbesatisfiedpriortore-enrollmenteligibilityorthedegreemayberevoked.TheCodeofStudentConductappliestobehaviorsthattakeplaceonthecampus,atuniversity-sponsoredevents,andmayalsoapplyoff-campuswhentheDeanofStudents(ordesignee)determinesthattheoff-campusconductaffectsasubstantialuniversityinterest.Asubstantialuniversityinterestisdefinedtoinclude:
• Anysituationwhereitappearsthatthestudentmaypresentadangerorthreattothehealthorsafetyofhimself/herselforothers;or
• Anysituationthatsignificantlyimpingesupontherights,propertyorachievementsofselforothers,significantlybreachesthepeace,orcausessocialdisorder;or
• Anysituationthatisdetrimentaltotheeducationalmissionorinterestsoftheuniversity
TheCodeofStudentConductmaybeappliedtobehaviorconductedonline,suchasharassmentviaemail.Studentsmustalsobeawarethatblogs,webpageentriesonsitessuchasGoogle+,Facebook,InstagramandTwitterandothersimilaronlinepostingsareinthepublicsphereandarenotprivate.Thesepostingscansubjectastudenttoallegationsofconductviolationsifevidenceofpolicyviolationsarepostedonline.St.Mary’sUniversitydoesnotregularlysearchforthisinformationbutmaytakeactionifandwhensuchinformationisbroughttotheattentionofuniversityofficials.However,mostonlinespeechbystudentswillbeprotectedasfreeexpressionandnotsubjecttothisCode,withtwonotableexceptions:
• Atruethreatdefinedas“athreatareasonablepersonwouldinterpretasaseriousexpressionofintenttoinflictbodilyharmuponspecificindividuals”;or

• Disparagingspeechpostedonlineabouttheuniversityoritscommunitymembersthatcauses,orintendstocause,asignificanton-campusdisruptiontouniversityoperationsormission.
TheCodeofStudentConductappliestoguestsofcommunitymemberswhosehostsmaybeheldaccountableforthemisconductoftheirguests.TheCodeofStudentConductmayalsobeappliedtoresidentnon-students,campersandhighschoolbridge/extension/partner/dual-creditandcontinuingeducationprogramsbycontractualagreements.VisitorstoandguestsoftheuniversitymayseekresolutionofviolationsoftheCodeofStudentConductcommittedagainstthembymembersoftheuniversitycommunity.
3. StepsintheDisciplinaryProcess
Investigation-ForallexceptTitleIXreportedallegations,theDirectorofJudicialAffairsandCommunityEducationwillreviewreportedCodeofConductviolations.ForreportedviolationsthatfallunderTitleIX(e.g.sexualmisconduct)orinvolveanyotherformofdiscrimination,theTitleIXCoordinatorordesigneewillappointaninvestigator(s)toreviewtheincidentonbehalfoftheUniversity.
Notice-OnceadeterminationismadethatreasonablecauseexistsfortheDirectorofJudicialAffairsandCommunityEducation(ordesignee)toreferacomplaintforaconductmeeting,noticewillbegiventotheaccusedstudent.Noticewillbeinwritingandmaybedeliveredbyoneormoreofthefollowingmethods:inpersonbytheDirectorofJudicialAffairsandCommunityEducation(ordesignee);mailedtothelocalorpermanentaddressofthestudentasindicatedinofficialuniversityrecords;oremailedtothestudent’suniversity-issuedemailaccount.Oncemailed,emailedand/orreceivedin-person,suchnoticewillbepresumeddelivered.
InterimSuspension-UndertheCodeofStudentConduct,theDeanofStudentsordesigneemayimposerestrictions,includingseparatingastudentfromthecommunity,pendingtheschedulingofacampushearingonallegedviolation(s)oftheCodeofStudentConductwhenastudentrepresentsathreatofseriousharmtoothers,isfacingallegationsofseriouscriminalactivity,topreservetheintegrityofaninvestigation,topreserveuniversitypropertyortopreventdisruptionof,orinterferencewith,thenormaloperationsoftheuniversity.AstudentwhoreceivesaninterimsuspensionmayrequestameetingwiththeDeanofStudents(ordesignee)todemonstratewhyaninterimsuspensionisnotmerited.Regardlessoftheoutcomeofthismeeting,theuniversitymaystillproceedwiththeschedulingofacampushearing.
Findings-Wheretheaccusedstudentisfoundnotresponsiblefortheallegedviolation(s),theinvestigationwillbeclosed.ForinvestigationsofTitleIXreportedCodeviolations(e.g.sexualmisconductoranyotherformofdiscrimination)theaccusingpartymayrequestthattheDeanofStudents,whoservesasTitleIXCoordinatorforcomplaintsagainststudents,re-opentheinvestigation.Thedecisiontore-openaninvestigationrestswiththeDeanofStudents.
HearingOptionsandPreparation-ExceptinacomplaintinvolvingfailuretocomplywiththesummonsoftheDeanofStudentsorDirectorofJudicialAffairsandCommunityEducation(ordesignee),nostudentmaybefoundtohaveviolatedtheCodeofStudentConductsolelyasaresultofthestudent’sfailuretoappearforahearing.Inallsuchinstances,conducthearingswill

proceedasscheduledandtheinformationinsupportofthecomplaintwillbepresentedto,andconsideredby,theDirectorofJudicialAffairsandCommunityEducation,AHO,orpanelpresidingoverthehearing.
WheretheaccusedstudentadmitstoviolatingtheCodeofStudentConduct,theDeanofStudentsorDirectorofJudicialAffairsandCommunityEducation(ordesignee)mayinvokeadministrativehearingprocedurestodetermineandadministerappropriatesanctionswithoutaformalhearing.Thisprocessisalsoknownasanadministrativehearing.Inadministrativehearings,complaintswillbeheardanddeterminationswillbemadebyanAHO.
WheretheaccusedstudentdeniesviolatingtheCodeofStudentConduct,theDirectorofJudicialAffairshasthediscretiontoarrangeeitheranadministrativeoraformalhearingtoresolveanymisconductallegation.
Thisformalhearingprocessisknownasapanelhearing.AtthediscretionoftheDirectorofJudicialAffairsandCommunityEducation(ordesignee),arequestbyoneormoreofthepartiestothecomplaintforanadministrativehearingmaybeconsidered.Studentswhodenyaviolationforwhichapanelhearingwillbeheldwillbegivenaminimumoffive(5)businessdaystoprepareforaformalhearingunlessallpartieswishtoproceedmorequickly.
SpecialHearingProvisionsforSexualMisconduct,DiscriminationandOtherComplaintsofaSensitiveNature-AllhearingsunderthissectionwillbeconductedbyathreememberadministrativepaneldrawnfromtheEquityDisputeResolutionPanel(EDRP)pool.Forsexualmisconduct,discriminationandothercomplaintsofasensitivenature,whethertheallegedvictimisservingastheaccusingpartyorasawitness,alternativetestimonyoptionsmaybeprovided,suchasplacingaprivacyscreeninthehearingroomorallowingtheallegedvictimtotestifyfromanotherroomviaSkype,aclosedcircuittelevision,orsimilartechnology.Whiletheseoptionsareintendedtohelpmaketheallegedvictimmorecomfortable,theyarenotintendedtoworktothedisadvantageoftheaccusedstudent.
ThepastsexualhistoryorsexualcharacterofapartywillnotbeadmissiblebytheotherpartiesinhearingsunlesssuchinformationisdeterminedtobehighlyrelevantbythepanelChair.AllsuchinformationsoughttobeadmittedbyapartyortheuniversitywillbepresumedirrelevantunlessashowingofrelevanceismadetotheChairinadvanceofthehearing.Demonstrationofpattern,repeat,orpredatorybehaviorbytheaccusedstudentwillalwaysberelevant.Thepartieswillbenotifiedinadvanceifanysuchinformationisdeemedrelevantandwillbeadmittedinthehearing.
ConductSanctions-Oneormoreofthebelowlistedsanctions(seenumber7)maybeimposeduponanystudentforanysingleviolationoftheCodeofStudentConduct.Oninquiry,theDeanofStudentsmay,aspermittedbylaworwithconsentofthestudent,releaseinformationregardingconductrecordsandsanctionstoemployers,licensingagencies,certifyingboards,graduateprograms,governmentbackgroundinspectorsandtransferorinstitutions.
ParentalNotification-TheUniversityreservestherighttonotifytheparentsorguardiansofdependentstudentsregardinganyconductsituation,particularlyalcoholandotherdrugviolations.Theuniversitymayalsonotifyparentsorguardiansofnon-dependentstudentswhoareundertheageof21ofalcoholorotherdrugviolations.Theuniversitywillattempttocontacttheparentsor

guardiansofanystudenttoinformthemofsituationsinwhichthereisahealthorsafetyrisk.TheuniversityalsoreservestherighttodesignatewhichuniversityemployeeshavealegitimateeducationalinterestinindividualconductcomplaintspursuanttotheFamilyEducationalRightsandPrivacyAct(FERPA)andwillshareinformationaccordingly.
NotificationofOutcomes-TheoutcomeofacampushearingispartoftheeducationrecordoftheaccusedstudentandisprotectedfromreleaseundertheFederalEducationRightsandPrivacyAct(FERPA),exceptundercertainconditions.InaccordancewithFERPA,whenastudentisaccusedofapolicyviolationthatwouldconstitutea“crimeofviolence”orforcibleornon-forciblesexoffense,theuniversitywillinformtheallegedvictimoraccusingparty(or,ifapplicable,thenextofkin)inwritingofthefinalresultsofahearingregardlessofwhethertheuniversityconcludesthataviolationwascommitted.Suchreleaseofinformationmayonlyincludetheallegedstudent’soraccusedstudent’sname,theviolationcommittedandthesanctionsassigned(ifapplicable).Incasesofsexoffensesonly,therationalefortheoutcomewillalsobesharedwithallpartiestothecomplaint.
AppealandFinalReview-AccusedstudentsoraccusingpartiesmaypetitiontheDeanofStudentsforareviewofadecisionorsanction(s)withinthree(3)businessdaysofissuanceofanAdministrativeHearOfficer’sorpanel’swrittendecisiontoincluderecommendedsanctions.AllrequestsforreviewmustbeinwritinganddeliveredtotheDeanofStudents.Anystudentwhomisseshisorherinitialhearingmaynotrequestareviewoftheinitialdecision.
FailuretoCompleteConductSanctions-Allstudents,asmembersoftheUniversitycommunity,areexpectedtocomplywithconductsanctionswithinthetimeframespecifiedbytheDirectorofJudicialAffairsandCommunityEducationorAdministrativeHearingOfficer.Failuretofollowthroughonconductsanctionsbythedatespecified,whetherbyrefusal,neglectoranyotherreason,mayresultinadditionalsanctions,uptoandincludingsuspensionfromtheUniversity.Insuchsituations,residentstudentswillberequiredtovacateuniversityhousingwithin24hoursofnotificationbytheDirectorofJudicialAffairsandCommunityEducation,thoughthisdeadlinemaybeextendeduponapplicationto,andatthediscretionof,theDirectorofResidenceLifeortheDirectorofJudicialAffairsandCommunityEducation.Asuspensionwillonlybeliftedwhencompliancewithconductsanctionsissatisfactorilyachieved.TheDirectorofJudicialAffairsandCommunityEducationwillmakethisdeterminationinconsultationwiththeDeanofStudents.
4. AnticipatedTimelines
Investigation-Conductanimmediatepreliminaryinvestigationwithinsevenbusinessdaystoidentifyacompletelistofallpoliciesthatmayhavebeenviolated,toreviewthehistoryoftheparties,thecontextoftheincident(s),anypotentialpatternsandthenatureofthecomplaint

Findings-Anypartytothecomplaintmayappealthedecisionorsanction(s)within3businessdays.

Hearing-Hearingswillbeheldwithin1-2weeksafterthestudentacceptsorrejectstheinvestigativefindings.
HearingPreparation-Studentswhodenyaviolationforwhichapanelhearingwillbeheldwillbegivenaminimumoffive(5)businessdaystoprepareforaformalhearingunlessallpartieswishtoproceedmorequickly.
IfanaccusedstudentfailstorespondtonoticefromtheDirectorofJudicialAffairsandCommunityEducation(ordesignee),theDirectorofJudicialAffairsandCommunityEducation(ordesignee)mayinitiateacomplaintagainstthestudentforfailuretocomplywiththedirectivesofauniversityofficialandgivenoticeofthisoffense.UnlessthestudentrespondstothisnoticewithintwoUniversitybusinessdaysbyansweringtheoriginalnoticethefollowingmayoccur:
• anadministrativehearingmaybescheduledandheldonthestudent’sbehalf;• thestudentmaybeadministrativelywithdrawnfromattendingclasses;or• adisciplinaryholdmaybeplacedontheiruniversityaccount,deemingthemineligibleto
registerforcoursesoruniversityhousinguntilsuchtimeasthestudentrespondstotheinitialcomplaint.
TheDirectorofJudicialAffairsandCommunityEducation(ordesignee)willensurethatthehearinginformationandanyotheravailablewrittendocumentationissharedwiththeaccusingpartyandtheaccusedstudentatleasttwo(2)businessdaysbeforeanyscheduledhearing.
Ifastudentcannotattendthehearing,itisthatstudent’sresponsibilitytonotifytheDirectorofJudicialAffairsandCommunityEducationnolessthanthree(3)dayspriortothescheduledhearingtoarrangeforanotherdate,timeandlocation.
HearingDeliberations-Thehearingpanelwillproduceadeliberationreportwithin2daysfromtheendofdeliberations.TheDirectorofJudicialAffairsandCommunityEducationwillconsidertherecommendationsofthePanel,maymakeappropriatemodificationstoitsreportandwillthenrenderadecisionandinformtheaccusedstudentandaccusingparty(ifapplicablebylaworuniversitypolicy)ofthefinaldeterminationwithinseven(7)businessdaysofthehearing.

5. Decision-MakingProcess
Hearingswillbeclosedtothepublic.AdmissiontothehearingofpersonsotherthanthepartiesinvolvedwillbeatthediscretionofthepanelchairandtheDirectorofJudicialAffairsandCommunityEducation.Inhearingsinvolvingmorethanoneaccusedstudent,thestandardprocedurewillbetohearthecomplaintsjointly;however,theDirectorofJudicialAffairsandCommunityEducationmaypermitthehearingpertinenttoeachaccusedstudenttobe

conductedseparately.Injointhearings,separatedeterminationsofresponsibilitywillbemadeforeachaccusedstudent.
Theaccusingpartyandaccusedstudenthavetherighttoanadvisorofhis/herownchoosing,includingattorneys.Typicallyadvisorsaremembersofthecampuscommunity,butthepartiesmayselectwhomevertheywishtoserveastheiradvisor.Theadvisormaynotmakeapresentationorrepresentthepartybringingthecomplaintorrespondingstudentduringthehearing.Theymayconferquietlywiththeiradvisee,exchangenotes,clarifyproceduralquestionswiththechair,andsuggestquestionstotheiradvisee.
Theaccusingparty,theaccusedstudent,thepanelandtheDirectorofJudicialAffairsandCommunityEducation(ordesignee)willhavetheprivilegeofquestioningallpresentwitnessesandquestioningallpresentparties.
UndulyrepetitivewitnessescanbelimitedatthediscretionofthepanelChairpersonortheDirectorofJudicialAffairsandCommunityEducation(ordesignee).Pertinentrecords,exhibits,andwrittenstatementsmaybeacceptedasinformationforconsiderationbythePanelandtheDirectorofJudicialAffairsandCommunityEducation.Formalrulesofevidencearenotobserved.TheDirectorofJudicialAffairsandCommunityEducationmaylimitthenumberofcharacterwitnessespresentedormayacceptwrittenaffidavitsofcharacterinstead.
AllproceduralquestionsaresubjecttothefinaldecisionoftheDirectorofJudicialAffairsandCommunityEducation.
Afterapanelhearing,thePanelwilldeliberateanddetermine,bymajorityvote,whetheritismorelikelythannotthattheaccusedstudenthasviolatedtheCodeofStudentConduct.TheDirectorofJudicialAffairsandCommunityEducation(ordesignee)willbepresentandavailableasaresourceduringalldeliberations.Onceafindingisdeterminedifthefindingisthatofapolicyviolation,thePanelwilldetermineanappropriatesanction(s).TheDirectorofJudicialAffairsandCommunityEducation(ordesignee)isresponsibleforinformingthepanelofapplicableprecedentandanypreviousconductviolationsorotherrelevantpatterninformationabouttheaccusedstudent.ThePanelChairpersonwillprepareawrittendeliberationreportanddeliverittotheDirectorofJudicialAffairsandCommunityEducation,detailingtherecommendedfinding,howeachmembervoted,theinformationcitedbythePanelinsupportofitsrecommendation,andanyinformationthePanelexcludedfromitsconsiderationandwhy.Thisreportshouldconcludewithanyrecommendedsanctions.ThisreportshouldnotexceedtwopagesinlengthandmustbesubmittedtotheDirectorofJudicialAffairsandCommunityEducationwithintwo(2)daysoftheendofdeliberations.

Findingsarebasedonapreponderanceoftheevidencestandard.
7. PossibleSanctions
OneormoreoffollowingsanctionsmaybeimposeduponanystudentforanysingleviolationoftheCodeofStudentConduct.Oninquiry,theDeanofStudentsmay,aspermittedbylaworwithconsentofthestudent,releaseinformationregardingconductrecordsandsanctionstoemployers,licensingagencies,certifyingboards,graduateprograms,governmentbackgroundinspectorsandtransferorinstitutions.
• Warning:Awrittennoticewillbesenttothestudent(s)whoviolateduniversitypoliciesorrules.Thenoticewillspecifythatinappropriateandunacceptableactionshaveoccurredandthatmoresevereconductactionwillresultshouldthestudentbeinvolvedinotherviolationswhilethestudentisenrolledattheuniversity.
• Restitution:Compensationfordamagecausedtotheuniversityoranyperson’spropertymaybedetermined.Thisisnotafinebut,rather,arepaymentforpropertydestroyed,damaged,consumed,orstolen.
• Fines:Reasonablefinesmaybeimposed.Finesarespecifiedtoinclude:Alcoholrelatedactivities–finesinincrementsof$50to$300;Damages–actualrepaircosts,includinglaborandmaterials;Non-compliancewithdiscretionarysanctions-$10perhourforservicenotperformed;Unauthorizedresidencehallroomchange-$35;Failuretoreturnareservedspacetopropercondition–laborcostsandexpenses.
• Community/UniversityServiceRequirements:Requirementsmaybeissuedforastudentororganizationtocompleteaspecificsuperviseduniversityservice.
• LossofPrivileges:Thestudentwillbedeniedspecifiedprivilegesforadesignatedperiodoftime.
• ConfiscationofProhibitedProperty:Itemswhosepresenceisinviolationofuniversitypolicywillbeconfiscatedandwillbecomethepropertyoftheuniversity.ProhibiteditemsmaybereturnedtotheowneratthediscretionoftheDirectorofJudicialAffairsandCommunityEducation(orUniversityPolicewhenapplicable).
• BehavioralRequirement:Requiredactivitiesmayinclude,butnotlimitedto,seekingacademiccounselingorsubstanceabusescreening,writingaletterofapology,etc.
• EducationalProgram:Asanctionmayincludearequirementtoattend,presentorparticipateinaprogramrelatedtotheviolation.Itmayalsobearequirementtosponsororassistwithaprogramforothersoncampusthatwillaidtheminlearningaboutaspecifictopicorissuerelatedtotheviolationforwhichthestudentororganizationwasfoundresponsible.Theaudiencemayberestricted.
• RestrictionofVisitationPrivileges:Restrictionsmaybeleviedonaresidentialornon-residentstudent.Theparametersoftherestrictionwillbespecified.

• UniversityHousingProbation:Thestudentisputonofficialnoticethat,shouldfurtherviolationsofResidenceLifeorUniversitypoliciesoccurduringaspecifiedprobationaryperiod,thestudentmayimmediatelyberemovedfromuniversityhousing.Regularprobationarymeetingsmayalsobeimposed.
• UniversityHousingReassignment:Thestudentisreassignedtoanotheruniversityhousingfacility.ResidenceLifepersonnelwilldecideonthereassignmentdetails.
• UniversityHousingSuspension:Thestudentisremovedfromuniversityhousingforaspecifiedperiodoftimeafterwhichthestudentiseligibletoreturn.Conditionsforre-admissiontouniversityhousingmaybespecified.Underthissanction,astudentisrequiredtovacateuniversityhousingwithin24hoursofnotificationoftheaction,thoughthisdeadlinemaybeextendeduponapplicationto,andatthediscretionof,theDirectorofResidenceLife.Thissanctionmaybeenforcedwithatrespassactionifdeemednecessary.Priortoreapplicationforuniversityhousing,thestudentmustgainpermissionfromtheDirectorofResidenceLife(ordesignee).
• UniversityHousingExpulsion:Thestudent’sprivilegetolivein,orvisit,anyuniversityhousingstructureisrevokedindefinitely.Thissanctionmaybeenforcedwithatrespassactionifdeemednecessary.
• UniversityProbation:Thestudentisputonofficialnoticethat,shouldfurtherviolationsofuniversitypoliciesoccurduringaspecifiedprobationaryperiod,thestudentmayfacesuspensionorexpulsion.Regularprobationarymeetingsmayalsobeimposed.
• EligibilityRestriction:Thestudentisdeemed“notindisciplinarygoodstanding”withtheuniversityforaspecifiedperiodoftime.SpecificlimitationsorexceptionsmaybegrantedbytheDirectorofJudicialAffairsandCommunityEducationandtermsofthisconductsanctionmayinclude,butarenotlimitedto,thefollowing:
o Ineligibilitytoholdanyofficeinanyregisteredstudentorganizationorholdanelected,appointed,orpaidofficeattheuniversity;or
o Ineligibilitytorepresenttheuniversitytoanyoneoutsidetheuniversitycommunityinanywayincluding:participatinginthestudyabroadprogram,attendingconferences,orrepresentingtheuniversityatanofficialfunction,eventorintercollegiatecompetitionasaplayer,managerorstudentcoach,etc.
• UniversitySuspension:Thestudentisseparatedfromtheuniversityforaspecifiedminimumperiodoftime;uponthesatisfactionofspecificconditionsthestudentiseligibletoreturn.
• Thestudentisrequiredtovacatethecampuswithin24hoursofnotificationoftheaction,thoughthisdeadlinemaybeextendeduponapplicationto,andatthediscretionof,theDirectorofJudicialAffairsandCommunityEducation.Thissanctionmaybeenforcedwithatrespassactionasnecessary.
• UniversityExpulsion:Thestudentispermanentlyseparatedfromtheuniversity.Thestudentisbarredfrombeingoncampusandthestudent’spresenceatanyuniversity-sponsoredactivityoreventisprohibited.Thisactionmaybeenforcedwithatrespassactionasnecessary.[ThissanctionwillbenotedasaConductExpulsiononthestudent’sofficialacademictranscript.]

8. RangeofProtectiveMeasuresAvailabletoaVictimAllegingMisconduct
Forsexualmisconduct,discriminationandothercomplaintsofasensitivenature,whethertheallegedvictimisservingastheaccusingpartyorasawitness,alternativetestimonyoptionsmaybeprovided,suchasplacingaprivacyscreeninthehearingroomorallowingtheallegedvictimtotestifyfromanotherroomviaSkype,aclosedcircuittelevision,orsimilartechnology.Whiletheseoptionsareintendedtohelpmaketheallegedvictimmorecomfortable,theyarenotintendedtoworktothedisadvantageoftheaccusedstudent.
UndertheCodeofStudentConduct,theDeanofStudentsordesigneemayimposerestrictions,includingseparatingastudentfromthecommunity,pendingtheschedulingofacampushearingonallegedviolation(s)oftheCodeofStudentConductwhenastudentrepresentsathreatofseriousharmtoothers,isfacingallegationsofseriouscriminalactivity,topreservetheintegrityofaninvestigation,topreserveuniversitypropertyortopreventdisruptionof,orinterferencewith,thenormaloperationsoftheuniversity.AstudentwhoreceivesaninterimsuspensionmayrequestameetingwiththeDeanofStudents(ordesignee)todemonstratewhyaninterimsuspensionisnotmerited.Regardlessoftheoutcomeofthismeeting,theuniversitymaystillproceedwiththeschedulingofacampushearing.
Duringaninterimsuspension,astudentmaybedeniedaccesstouniversityhousing,theuniversitycampus,facilities,orevents.AsdeterminedappropriatebytheDeanofStudents,thisrestrictionmayincludeclassesorallotheruniversityactivitiesorprivilegesforwhichthestudentmightotherwisebeeligible.AtthediscretionoftheDeanofStudentsandwiththeapprovalof,andincollaborationwith,theappropriateacademicDean(s),alternativecourseworkoptionsmaybepursuedtoensureasminimalanimpactaspossibleontheaccusedstudent.

HowtheUniversityDeterminesWhetherThisPolicywillbeUsedTheUniversitywillactonanyallegationofaviolationoftheEqualOpportunity,Nondiscrimination,SexualHarassment,andOtherFormsofHarassmentPolicythatisreceivedbytheTitleIXCoordinator.Forallegationsinvolvingstudentsastheaccusedindividual,theDeanofStudents,asaDeputyTitleIXCoordinator,hasprimaryresponsibilityforeachofthestepsdefinedinthisprocess.Ifcircumstancesrequire,thePresidentorTitleIXCoordinatormaydesignateanotherpersontooverseetheprocessbelow,shouldanallegationbemadeagainsttheCoordinatorortheCoordinatorbeotherwiseunavailableorunabletofulfilltheirduties.Theproceduresdescribedbelowwillapplytoallallegationsinvolvingstudents,staff,administrators,orfaculty.Redressandrequestsforresponsiveactionsforallegationsbroughtagainstnon-membersoftheUniversitycommunityarealsocoveredbytheseprocedures.
3. StepsintheDisciplinaryProcessFileanallegation,determinationofpolicyviolation,investigation,allegationresolution,Formalhearingincluding:notification,hearingprocedures,decision,sanctions,andappeal.
4. AnticipatedTimelinesFollowingreceiptofanallegationthattheEqualOpportunity,Nondiscrimination,SexualHarassment,andOtherFormsofHarassmentPolicyhasbeenviolated,theTitleIXCoordinatorwillpromptlyassignanEDRPpanelmembertoworkasadvisertothepersonwhoreportedtheallegation.Normally,withintwobusinessdays,aninitialdeterminationismadewhetherapolicyviolationmayhaveoccurredand/orwhetherconflictresolutionmightbeappropriate.Iftheallegationdoesnotappeartoallegeapolicyviolation,orifconflictresolutionisdesiredbytheaccusingpartyandappearsappropriategiventhenatureoftheallegedbehavior,thentheallegationdoesnotproceedtoinvestigation.However,afullinvestigationwillbepursuediftheTitleIXCoordinator,inconsultationwiththeDeputyCoordinator(s),determinesthereisevidenceofapatternofmisconductoraperceivedthreatoffurtherharmtotheUniversityoranyofitsstudentsoremployees.TheUniversityaimstocompleteallinvestigationswithina60businessdaytimeperiod,whichcanbeextendedasnecessaryforappropriatecausebytheTitleIXCoordinatorwithnoticetotheparties.Iftheallegationappearstoindicateapolicyviolation,orifconflictresolutionisrejectedbytheaccusingpartyorisinappropriategiventhenatureoftheallegedbehavior,oriftheUniversity,basedontheallegedpolicyviolation,wishestopursueanallegation,thentheTitleIX

CoordinatorwillappointEDRPmemberstoconductaninvestigationintotheallegation,usuallywithintwobusinessdaysofdeterminingthataninvestigationiswarranted.Theinvestigationofallegationsbroughtdirectlybythoseallegingharmshouldbecompletedexpeditiously,normallywithin10businessdaysofnoticetotheTitleIXCoordinator.However,investigationmaytakelongerwheninitialallegationsfailtoprovidedirectfirst-handinformation.Further,theUniversitymayundertakeashortdelay,typically10businessdays,toallowforevidencecollectionwhencriminalchargesonthebasisofthesamebehaviorsthatinvokethisprocessarebeinginvestigated.Universityactionwillnotbealteredorprecludedonthegroundsthatcivilorcriminalchargesinvolvingthesameincidenthavebeenfiledorthatchargeshavebeendismissedorreduced.Allinvestigationswillbethorough,reliable,andimpartialandwillentailinterviewswithallrelevantpartiesandwitnesses,obtainingavailableevidence,andidentifyingsourcesofexpertinformation,ifnecessary.Atleastoneweekpriortoaformalhearing,orasfarinadvanceasisreasonablypossibleifanacceleratedhearingisscheduledwiththeconsentoftheparties,theEDRPCo-Chairwillsendalettertothepartieswiththefollowinginformation:
• Adescriptionoftheallegedviolation(s),adescriptionoftheapplicableprocedures,andastatementofthepotentialsanctions/responsiveactionsthatcouldresult;
• Thetime,date,andlocationofthehearingandareminderthatattendanceismandatory,supersedingallothercampusactivities.Ifanypartydoesnotappearatthescheduledhearing,thehearingwillbeheldintheirabsence.Forcompellingreasons,theCo-Chairmayreschedulethehearing.
• ThepartiesmayhavetheassistanceofanEDRPpanelmember,orotheradviser,atthehearing.Typically,advisersaremembersofthecampuscommunity,buttheTitleIXCoordinatormaygrantpermissionforanoutsideadviseruponrequest.Theadvisermaynotbeapracticingattorney.
• Hearingsforpossibleviolationsthatoccurnearoraftertheendofanacademictermwillbeheldimmediatelyaftertheendofthetermorduringthesummer,asneeded,tomeettheresolutiontimelinefollowedbytheUniversity.
Oncemailed,emailedtoUniversity-issuedemailaddress,orreceivedin-person,noticewillbepresumptivelydelivered.
EDRPHearingswillbeconvened,usuallywithinonetotwoweeksofthecompletionoftheinvestigation,andwillbeconductedinprivate.TheEDRPhastheauthoritytohearallcollateralmisconduct,meaningthatithearsallallegationsofviolationsoftheEqualOpportunity,Nondiscrimination,SexualHarassment,andOtherFormsofHarassmentPolicy,butalsomayhearanyadditionalallegedpolicyviolationsthathaveoccurredinconcertwiththeallegedconduct,eventhoughthosecollateralallegationsmaynotspecificallyfallwithinEDRPjurisdiction.
Accordingly,investigationsshouldbeconductedwithaswideascopeasnecessary.
Participantswillincludethenon-votingChair,themembersofthepanel,theinvestigator(s)whoconductedtheinvestigationontheallegation,theaccusingpartyandaccusedindividual(s),adviserstotheparties,andanycalledwitnesses.TheChairwillexchangethenamesofwitnessestheUniversity

intendstocall,allpertinentdocumentaryevidence,andanywrittenfindingsfromtheinvestigatorsbetweenthepartiesatleasttwobusinessdayspriortothehearing.Inaddition,thepartieswillbegivenalistofthenamesofeachoftheEDRPpanelmembersatleasttwobusinessdaysinadvanceofthehearing.Shouldeitherpartyobjecttoanypanelist,he/shemustraiseallobjections,inwriting,totheChairimmediately.PanelmemberswillonlybeunseatediftheChairconcludesthattheirbiasprecludesanimpartialhearingoftheallegation.Additionally,anypanelistorChairwhofeelshe/shecannotmakeanobjectivedeterminationmustrecusehimselforherselffromtheproceedingswhennotifiedoftheidentityofthepartiesandallwitnessesinadvanceofthehearing.
TheChair,inconsultationwiththepartiesandinvestigators,maydecideinadvanceofthehearingthatcertainwitnessesdonotneedtobephysicallypresentiftheirtestimonycanbeadequatelysummarizedbytheinvestigator(s)duringthehearing.Allpartieswillhaveampleopportunitytopresentfactsandargumentsinfullandquestionallpresentwitnessesduringthehearing,thoughformalcross-examinationisnotusedbetweentheparties.Ifalternativequestioningmechanismsaredesired,(screens,Skype,questionsdirectedthroughtheChair,etc.),thepartiesmustrequestthemfromtheChairatleasttwobusinessdayspriortothehearing.

AllappealsmustbesubmittedinwritingtotheTitleIXCoordinatorwithinthree(3)businessdaysofthedeliveryofthewrittenfindingoftheEDRP.Athree-memberpaneloftheEDRPdesignatedbytheTitleIXCoordinatorthatwasnotinvolvedintheallegationpreviouslywillconsiderstudent,staffandadministratorappealrequests.
FacultyappealswillbeconsistentwithSections2.16oftheFacultyHandbook,withresultsoftheappealreportedtotheTitleIXCoordinator.
TheTitleIXCoordinatorwillnormally,afterconferringwiththeEDRPappealspanel,renderawrittendecisionontheappealtoallpartieswithinsevenbusinessdaysfromhearingoftheappeal.

5. DecisionMakingProcess
TheEDRPpanelwilldeliberateinclosedsessiontodeterminewhethertheaccusedindividualisresponsibleornotresponsiblefortheviolation(s)inquestion.Thepanelwillbaseitsdeterminationonapreponderanceoftheevidence(i.e.,whetheritismorelikelythannotthattheaccusedindividualcommittedeachallegedviolation).Ifanaccusedindividualisfoundresponsiblebyamajorityofthepanel,thepanelwillrecommendappropriatesanctionstotheTitleIXCoordinator.TheChairwillprepareawrittendeliberationreportanddeliverittotheTitleIXCoordinator,detailingthefinding,howeachmembervoted,theinformationcitedbythepanelinsupportofitsrecommendation,andanyinformationthehearingpanelexcludedfromitsconsiderationandwhy.Thereportshouldconcludewithanyrecommendedsanctions.ThisreportshouldnotexceedtwopagesinlengthandmustbesubmittedtotheTitleIXCoordinatorwithintwo(2)businessdaysoftheendofdeliberations.

6. StandardofEvidence
IftheTitleIXCoordinatordecidesthatnopolicyviolationhasoccurred,orthatthepreponderanceofevidence(i.e.,whetheritismorelikelythannotthattheaccusedindividualcommittedtheallegedviolation)doesnotsupportafindingofapolicyviolation,thentheprocesswillendunlesstheaccusingpartyrequeststhattheTitleIXCoordinatormakeanextraordinarydeterminationtore-opentheinvestigationortoforwardthematterforahearing.ThisdecisionliesinthesolediscretionoftheTitleIXCoordinator.Ifthereisreasonablecause,theTitleIXCoordinatorwilldirecttheinvestigationtocontinue,orifthereisapreponderanceofevidenceofaviolation,thentheTitleIXCoordinatormayrecommendconflictresolution,aresolutionwithoutahearing,oraformalhearing.
TheEDRPpanelwilldeliberateinclosedsessiontodeterminewhethertheaccusedindividualisresponsibleornotresponsiblefortheviolation(s)inquestion.Thepanelwillbaseitsdeterminationonapreponderanceoftheevidence(i.e.,whetheritismorelikelythannotthattheaccusedindividualcommittedeachallegedviolation).
7. PossibleSanctions
StaffSanctions
SanctionsandcorrectiveactionsforstaffwhohasengagedinconductviolatingtheEqualOpportunity,Nondiscrimination,SexualHarassment,andOtherFormsofHarassmentPolicyinclude,butarenotlimitedto,verbalandwrittenwarning,requiredcounseling,demotion,suspensionwithpay,suspensionwithoutpay,anddismissal,inaccordancewiththetermsofSection5.0SeparationfromEmploymentintheUniversity’sPersonnelManual.

SanctionsandcorrectiveactionsforfacultywhohaveengagedinconductviolatingtheEqualOpportunity,Nondiscrimination,SexualHarassment,andOtherFormsofHarassmentPolicywillbeconsistentwithSections2.8.6and2.8.7oftheFacultyHandbook.
• DismissalforCause-SeveranceactionbywhichSt.Mary’sUniversityterminatesitscontractwiththefacultymemberforjustcause
• Dependingonthecircumstances,theProvostandVicePresidentforAcademicAffairsmayelecttoimposeadisciplinaryactionshortofdismissal,forcauseslistedinSection2.8.6.,suchassuspensionforaperiodoftimeorwithdrawaloffacultyprivileges.Inunusualcircumstances,theProvostandVicePresidentforAcademicAffairsmaytakedisciplinaryactionwithoutpreviouscitationorwarning.
• SuspensionmayalsobethetemporaryseparationofafacultymemberfromtheUniversitywhenitisdeterminedbythePresidentthatthereisastronglikelihoodthatthefacultymember'scontinuedpresenceattheUniversityposesanimmediatethreatofharmtotheUniversitycommunity.Suchsuspensionshallbewithpayandshalllastonlysolongasthethreatofharmcontinuesoruntildismissalforcauseoccurs.
• Inviewofthepastmeritsofthefacultymember,finalactionbytheProvostandVicePresidentforAcademicAffairsmaytakeamilderformoftemporarysuspensionratherthanoutrightdismissal.Suchsuspensionmaynotlastbeyondafullyear,butmayentailthetotalorpartialdiscontinuanceofallsalariesandbenefits,thesuspensionofallpromotionandsalaryincrements,andthetemporarysuspensionorwithdrawalofallfacultyprivileges.
• TheFacultySenateExecutiveCommitteeshallserveinanadvisorycapacitytotheProvostandVicePresidentforAcademicAffairsonsuchmattersandshallbecalledupontoreviewcaseswherethefacultymemberquestionsthedecision.TheProvostandVicePresidentforAcademicAffairs'decisionaftersuchareview,shallbefinal
8. RangeofProtectiveMeasuresAvailabletoaVictimAllegingMisconductIf,inthejudgmentoftheTitleIXCoordinatorandinconsultationwiththeDeputyCoordinator(s),thesafetyorwell-beingofanymember(s)oftheUniversitycommunitymaybejeopardizedbythepresenceoncampusoftheaccusedindividual,theTitleIXCoordinator(ordesignee)mayprovideinterimremediesintendedtoaddresstheshort-termeffectsofharassment,discrimination,orretaliation,i.e.,toredressharmtotheallegedvictimandthecommunityandtopreventfurtherviolations.Asitrelatestosafetydeterminations,thesedecisionswillbemadeinconsultationwiththeChiefofPolice(ordesignee).Theseremediesmayinclude,butarenotlimitedto,referraltocounselingandhealthservicesortotheEmployeeAssistanceProgram,educationtothecommunity,alteringthehousingsituationofanaccusedstudent(ortheallegedvictim,ifdesired),alteringworkarrangementsforstaff,providingcampusescorts,implementingcontactlimitationsbetweentheparties,orofferingadjustmentstoacademicdeadlinesandcourseschedules.TheUniversitymayinterimsuspendastudent,staff,oradministratorpendingthecompletionofEDRPinvestigationandprocedures.Inallcasesinwhichaninterimsuspensionisimposed,the

student,staff,oradministratorwillbegiventheopportunitytomeetwiththeTitleIXCoordinatorpriortosuchsuspensionbeingimposedorassoonthereafterasreasonablypossibletoshowcausewhythesuspensionshouldnotbeimplemented.TheTitleIXCoordinatorhassolediscretiontoimplementorstayaninterimsuspensionundertheEqualOpportunity,Nondiscrimination,SexualHarassment,andOtherFormsofHarassmentPolicy,andtodetermineitsconditionsandduration.Violationofaninterimsuspensionunderthispolicywillbegroundsforexpulsionortermination.Forallegationsinvolvingfaculty,theProvostandVicePresidentforAcademicAffairsmayinterimsuspendafacultymember,consistentwithSection2.8.7oftheFacultyHandbook,on
therecommendationoftheTitleIXCoordinator,pendingthecompletionofEDRPinvestigationandprocedures.
Duringaninterimsuspension,astudentwillbedeniedaccesstoUniversityhousingandtheUniversitycampus,facilities,andevents.AsdeterminedbytheDeanofStudentsordesignee,thisrestrictionmayincludeclassesandallotherUniversityactivitiesorprivilegesforwhichthestudentmightotherwisebeeligible.AtthediscretionoftheDeanofStudentsordesignee,alternativecourseworkoptionsmaybepursuedtoensureasminimalanimpactaspossibleontheaccusedstudent.
Forsexualmisconduct,discriminationandothercomplaintsofasensitivenature,whethertheallegedvictimisservingastheaccusingpartyorasawitness,alternativetestimonyoptionsmaybeprovided,suchasplacingaprivacyscreeninthehearingroomorallowingtheallegedvictimtotestifyfromanotherroomviaSkype,aclosedcircuittelevision,orsimilartechnology.Whiletheseoptionsareintendedtohelpmaketheallegedvictimmorecomfortable,theyarenotintendedtoworktothedisadvantageoftheaccusedindividual.
UniversityInitiatedProtectiveMeasures

In2004,theDepartmentofJustice’sOfficeonViolenceAgainstWomenannouncedtheyweresponsoringaFamilyJusticeCenterInitiativeGranttohelpfundtheplanninganddevelopmentofcomprehensivedomesticviolencevictimserviceandsupportcenters.TheBexarCountyCriminalDistrictAttorney’sOfficesawthepotentialforhavingapositiveandprofoundimpactonthefamiliesinBexarCountydealingwithdomesticviolenceandbeganworkingtocreateacollaborationbetweentheDistrictAttorney'sOfficeandotherorganizationssuchBexarCountyHousingandHumanServices,theSanAntonioPoliceDepartment,UniversityHealthSystems,andthe
