Exhibit A Origin and Breeding History of ‘SY TF 131’

Resource Seeds was purchased by Syngenta in 2008 and the winter triticale breeding program was relocated to Vernon, Texas. Prior to the formal transfer, RSI triticale breeder Stan Nalepa faced severe medical issues and many of the breeding records from his program were lost. Recorded notes indicate that the cross resulting in SY TF 131was made in Gilroy, California by Stan Nalepa. Parentage of SY TF 131 is “Baby//Baby/CHD888.” SY TF 131 was originally tested as 05tf131 and an Awnless sub-line designated by the letter “d” was identified. SY TF 131 was the sub-line and was carried through extensive forage, grain and silage tests in Texas as 05tf131d. One hundred individual headrows were grown for purification purposes in 2010 at Vernon, Texas. Each headrow was repeatedly examined for uniformity of plant height, awnlessness, relative maturity and reaction to endemic disease. Fifty uniform rows were selected for hand harvest and the harvested seed was transferred to Berthoud, Colorado for further increase. In 2011, fifty headrow progeny plots were planted near Berthoud. Uniform plots were selected and the seed bulked. This bulked seed is the source of the breeder seed increase planted near Berthoud in 2012 which has been advanced for Foundation seed production in 2013 (2014 harvest). SY TF 131 has been tested in several states from California to Texas and in multiple locations within states for at least 5 years. It has been uniform and stable in all tests over this period of time and has maintained its phenotypic stability through 4 years of seed increase in Colorado and Texas.

‘SY TF 131’ SY TF 131 is most similar to triticale variety "348" (PVP Certificate 200200215). However, it can be distinguished by the following characteristics:

SY TF 131's juvenile plant growth is "Erect". 348's juvenile plant growth is "Semi-prostrate".

SY TF 131 has a "Twisted" flag leaf; however, 348's flag leaf is "Not twisted".

SY TF 131's head shape is "Clavate" and it's awnedness is "Apically awnletted", whereas 348's head shape is "Oblong" and awnedness is "Awnletted".

SY TF 131 has a "White" glume at maturity. 348 has a "Yellow" glume at maturity.

SY TF 131's seed color is "Red"; however 348's seed color is "Other-Brownish".

Exhibit D Additional Description of ‘SY TF 131’

SY TF 131 is a cultivar of winter triticale developed originally by Resource Seeds in Gilroy, CA. SY TF 131 is most like the RSI winter triticale cultivar “348” although it is significantly earlier maturing, shorter statured and has stronger straw. SY TF 131 is best adapted to Southwest Oklahoma, the Rolling Plains of Texas and the Texas Cross Timbers Regions. SY TF 131is a tall semi-dwarf cultivar of winter triticale which is shorter statured than currently dominant silage cultivars. It matures earlier and is more productive than commonly grown checks. Grain yields of SY TF 131 have been substantially higher than the silage variety 348 and significantly greater than the forage cultivar TAMCALE 5019. SY TF 131 is well suited for multiple uses. It’s vegetative biomass production in the fall is superior to 348 and TAMCALE 5019 and silage harvests also have eclipsed the checks. SY TF 131 fits crop rotation schemes better than 348 due to its earlier maturity. SY TF 131 generally produces silage with higher crude protein than either 348 or TAMCALE 5019. SY TF 131 is less winter hardy than 348 and, therefore, has not been targeted for commercialization in the Texas Panhandle. Syngenta Seeds, Inc. maintains seed stock and certified classes of Foundation, Registered and Certified. Certified seed stocks of SY TF 131 will be available in the fall of 2015.

PLEASE NOTE:

Plant variety protection can only be afforded to the owners (not licensees) who meet the following criteria:

1. If the rights to the variety are owned by the original breeder, that person must be a U.S. national, national of a UPOV member country, ornational of a country which affords similar protection to nationals of the U.S. for the same genus and species.

2. If the rights to the variety are owned by the company which employed the original breeder(s), the company must be U.S. based, owned bynationals of a UPOV member country, or owned by nationals of a country which affords similar protection to nationals of the U.S. for the samegenus and species.

3. If the applicant is an owner who is not the original owner, both the original owner and the applicant must meet one of the above criteria.
