(BPT) - Ready to buy your first home, or move up to a larger home for your expanding family?

Home sales seem to be finally warming up after a five-year chill, as demand gradually builds among first-time homebuyers and existing homeowners seek-ing more room. Historically low mortgage rates, rising rents and relatively positive economic in-dicators are enhancing consumer confidence and driving the trend, according to the National Asso-ciation of Realtors (NAR).

As demand grows, home pric-es for a median existing home are expected to rise as much as 5 percent nationwide in 2013, ac-cording to the NAR. This should encourage existing homeowners who’ve been patiently sitting on the sidelines to consider putting their homes on the market.

Even though the outlook is looking brighter, Daniel Wat-kins, an attorney who specializes

in real estate law at the Watkins Firm, APC in San Diego, says the hurdles to buying a home in today’s market are significantly higher than they were a few years ago.

“The big hurdle is financing. Expectations among lenders and sellers are a lot higher today,” Watkins says. “If you’re serious about buying a home, you need to have a sizeable down payment,

a good credit score, low debt and a solid track record of employ-ment to qualify for a loan.”

Paying property taxes is a necessary side effect of home ownership. Across the United States and Canada, residents are required to pay property taxes based on an assessment of their homes’ value.

Taxes on land and the build-ings on it are one of the biggest sources of revenue for local gov-ernments. In the United States, property taxes are not imposed by the states, but by the small-er governing bodies in cities, towns, townships, counties, and other jurisdictions. In Canada, property taxes, or milliage taxes, are levied by the jurisdiction in which the property is located. They may be paid to a federated state or a municipality or the na-tional government. Sometimes multiple jurisdictions may tax the same property.

Although the taxes are man-dated by a higher governing power, the rate at which you pay taxes could be based on a very

local assessment of the area in which your house is located and the current market conditions. An assessor will visit a home - usually prior to purchase - and make a determination on the

percentage of tax to be paid de-pending on the condition of the home, the improvements that

have been made and the climate of the economy in your particu-lar town or city. Property taxes are usually calculated by taking the assessed value of your home and multiplying it by the tax rate that has been determined by your local government.

While no one can “legally” escape paying property taxes, there are several ways to have them lowered. Getting your home re-assessed is one such way. Individuals who have reached a certain age may be eligible for certain discounts on property taxes. But this may require a very low income to qualify. There are also some tax credits or homestead exemp-tions that may qualify you for a limited assessed value on the property.

Tax Foundation and Forbes, ar-eas of New Jersey, New York and Illinois boast some of the high-est property taxes. Residents of Hunterdon County, New Jersey paid on average $8,600 a year between 2005 and 2009. Those in Lake County, Illinois pay around $6,500.

People living in Westchester County, New York can plan on spending $8,400 per year.

Statistics indicate that homes located in Ontario cities in cen-tral Canada have the highest property taxes. Toronto resi-dents, for example, pay an aver-age of $3,900.

In this tough economy, low-ering property taxes (which are generally rolled into the mortgage amount for ease of payment) could substantially reduce bills. As many as 60 per-

cent of properties across the United States are overassessed, according to the National Tax-payers Union, a nonprofit group that promotes lower taxes.

If you suspect your property taxes are high, here are the steps to take.

• Get a copy of your property tax assessment from the local as-sessor’s office and double-check all the information contained to see if it is correct.

• Check the assessments of five comparable homes that have sold in your neighborhood in the last three years.

• An independent appraiser can also provide you accurate information at a cost. Make sure he or she is licensed with the Na-tional Association of Indepen-dent Fee Appraisers or by the American Society of Appraisers.

• It’s not possible to lower the property tax rate, just the assessed value of the home

through an official appeal. There may be fees associated with this appeal, however.

Some home improvements will increase the value of your home and, in turn, your prop-erty taxes. Here are some of the most common culprits:

- extra stories to the home- outhouses, like a guest house- sports courts, like tennis- installation of an inground

pool- improvements to fencing- addition of a garage or an-

other room on the homeA change in the status of a

neighborhood can also give rise to higher property taxes. An influx of new residents or new construction of stores and homes can have a major effect on the assessed value of your home.

tion to buyers’ ability to repay a loan, according to FindLaw.com, the nation’s leading legal infor-mation website. The generally ac-cepted principle is that no more than 30 percent of a household’s take-home income should go to-ward the principal, interest, taxes and insurance.

Here are some tips from Find-Law.com about buying a home within the next six to nine months:

Start planning now. Even if you’re a year or more away from buying a home, start prepar-ing now. Build up your cash for a down payment plus other ex-penses that come with owning a home. Check your credit report for accuracy. Pay all your bills on time and zero out all credit card debt. And don’t take on new debt, like a large car payment.

Get a pre-approval letter.

Home sellers want to know that you can get a loan to buy their home. It’s OK to window shop, but don’t make any offers unless you are certain you can obtain fi-nancing. After shopping around for a financial institution, get pre-approved for a home mortgage. Showing a seller a pre-approval letter will increase your chances of your offer being accepted. And don’t be surprised if the seller or his real estate agent contacts your loan officer to verify that you’ve been pre-approved.

Build a strong buying position. As the home market warms up, bidding wars will become more common. However, the highest bid doesn’t always win in today’s housing market. Instead, home sellers want to know the deal will go through with smooth sailing. So, today, the highest value is be-ing placed on non-contingent of-fers (not contingent on the sale of your home), pre-approved financing, higher-than-normal

earnest money deposit and per-sonalized bids (share with the seller why the home would be a perfect match for you and your family).

Get a lawyer. In some states, the law requires that a real estate attorney be part of the process of making an offer and reviewing loan documents as part of the closing, according to FindLaw.com. Where a real estate attorney

isn’t required, buyers and sellers should consider seeking legal as-sistance for relatively more com-plicated real estate transactions, such as purchasing a property directly from the homeowner, the purchase of a rental property, a short sale or the purchase of a foreclosed property.
