DEFINITIONS
“Accounting officer” means an individual or close corporation appointed under the Close Corporations Act, 69 of
1984, as amended, to a close corporation in order to render specific services as listed in section 62 (1) (c).
“Independent Regulatory Board for Auditors” is the Regulatory Board established in section 3 of the Auditing
Profession Act, 26 of 2005, and is a juristic person and subject to the Constitution and the law, specifically the Public
Finance Management Act.
“Professional Accountant (South Africa)” means an individual registered with the South African Institute of
Professional Accountants (SAIPA).
“Registered Auditor” means an individual or firm registered as an auditor with the Independent Regulatory Board for
Auditors under the Auditing Profession Act, 26 of 2005.

INTRODUCTION
The Technical Department provides this introductory overview of the most common reporting and related services
that SAIPA members are entitled to provide, as a guide to new members and as a reference to current members.
The guide is based on the content as provided on the SAIPA Working Paper CD and additional input received from
members.
Due to the nature of the environment in which the Institute and its members operate the reporting duties that
members are entitled to perform are continuously under review. The technical department will therefore endeavour
to continuously update this guide with the most recent additions to the reporting duties. In this regard members are
invited to comment and add to the information contained within the guide if a specific reporting duty is not referred to
or not adequately covered.
The guide also lists a selection of reference sources that are invaluable to members performing reporting duties for
clients.

REPORTING AND RELATED SERVICES
Every SAIPA member has the responsibility to ensure that the services they offer are aligned to the professionalism
expected of SAIPA members. This implies that reporting and related services performed by them should be of an
appropriately high professional standard. This includes ensuring that work is performed at an adequate level of
competency and that sufficient knowledge is available to perform the work at hand. It is incumbent on every member
to perform only work which the member is competent and legally permitted to perform and adequately equipped to
do. This includes taking into account all relevant legislation, courses studied, training undertaken and continuing
professional development courses attended. In this regard, particular attention must be given to paragraph 4 of the
Code of Conduct, and paragraph 13 of the By-laws.
The resources listed below provide a basic list of reference material that a Professional Accountant will need when
reporting and related services are provided to clients:
1. SAIPA Working Paper Manual
Example checklists, schedules and working papers are available in the SAIPA working paper manual. This manual
should guide members to ensure that members provide services of a high standard and to ensure that members
keep a reliable record of work performed. In this regard each member should give due consideration to the guidance
provided, taking cognisance of the client’s particular circumstances. SAIPA does not prescribe a particular
methodology for the preparation of working papers. Members are entitled to utilise any of the offerings available on
the market to assist them with the compilation of working papers. The key point to remember when deciding on a
methodology is that the method chosen should be of such a standard that members would be able to rely on their
working papers as evidence that they performed their work in accordance with what was expected and required of
them. Members should therefore use their professional judgement to determine if they comply with any legislative
requirements applicable to the particular service they provide.
2. Handbook of International Auditing, Assurance & Ethics Pronouncements
The Handbook (http://www.ifac.org/Guidance) as issued by the International Federation of Accountants (IFAC)
provides standards and guidance on the performance of various reporting services. These include:
� International Standards on Auditing (ISAs): to be applied in the audit of historical financial information;
� International Standards on Review Engagements (ISREs): to be applied in the review of historical
financial information;
� International Standards on Assurance Engagements (ISAEs): to be applied in assurance engagements
dealing with subject matters other than historical financial information;
� International Standards on Related Services (ISRSs): to be applied to compilation engagements (these
would include compilation of annual financial statements for clients), engagements to apply agreed
upon procedures to information and other related services engagement as specified by the
International Auditing and Assurance Standards Board (IAASB).
When performing any of the reporting services that members are entitled to provide listed in section 3 below,
members should give due consideration to the standards as provided by IFAC.

3. International Financial Reporting Standards (IFRS)
Members that prepare financial reports for their clients should give due consideration to the standards as provided by
the International Accounting Standards Board (IASB). Three references are currently available: IFRS, SA GAAP and
South African Statements of GAAP for SMEs.

International Accounting Standards Board (IASB) which has the responsibility for accounting standard-setting.
IFRS for SME’s has recently been released as an exposure draft (ED) by the IASB. These are available at:

The objective of the IFRS for SME project of the IASB is to develop an International Financial Reporting Standard
(IFRS) tailored to meet the needs of – and intended for use only by – small and medium-sized entities (SME’s). IFRS
for SME will be a more useful reference than IFRS when financial statements are prepared on behalf of small and
medium clients. The Accounting Standards Board (ASB) in South Africa has approved and accepted this IFRS for
SMEs, which can be obtained from the website above.
The IFRS statements and the South African Statement of GAAP for SMEs are useful sources of reference when
considering the accounting treatment of certain items and the preparation and approval of financial statements in
accordance with IFRS (where applicable), or generally accepted accounting practice as appropriate to the business
(where IFRS is not required, for example close corporations, partnerships and sole proprietors). It is recommended to
make reference to the Handbook, IFRS and South African Statement of GAAP for SMEs when seeking authoritative
guidance on certain matters.

REPORTING AND RELATED SERVICES THAT SAIPA MEMBERS
ARE ENTITLED TO PROVIDE
SAIPA members are entitled to provide a wide array of services to their clients. For practical purposes three generic
focus areas have been identified:
REPORTING SERVICES REQUIRED BY STATUTE
A statute, such as the Close Corporations Act 69 of 1984, may require that a report be issued to the regulator or the
relevant entity, by an: Accounting Officer, qualified person, or by a Professional Accountant (SA). Such reports are
generally factual in nature requiring the report provider to compare financial statements with the information
contained in accounting records, to review the appropriateness of the accounting policies that were applied in the
preparation of financial statements, and to report on any contraventions of the particular legislation.
The Professional Accountant (SA) is generally expected to report to the client in respect of the nature and extent of
the work that has been done and the results of such work. The report concerned is factual in nature and should not
be confused with an attestation or assurance report of a Registered Auditor. The report does not express an opinion.
Only Registered Auditors may provide reporting services that fall within the ambit of the Independent Regulatory
Board for Auditors (IRBA) and its legislation. Reporting services may be required in terms of legislation or be the
result of agreement between the client and the Professional Accountant (SA).
PROFESSIONAL SERVICES ASSOCIATED TO A STATUTORY REPORTING
FUNCTION
Such professional services include accounting services such as completing and maintaining accounting records,
drafting and preparing annual financial statements, providing advice in respect of the accounting treatment of
transactions, analysing and interpreting financial statements, and implementing accounting software.
OTHER PROFESSIONAL SERVICES
These services include: secretarial services, taxation services, various management consulting services, estate and
financial planning services. Secretarial services include the completion of various returns, the giving of advice in
respect of the completion of various returns, maintaining a close corporation’s members register, and completing CK
forms and correspondence on behalf of clients with various authorities. Taxation services include the preparation of
returns and planning relating to normal tax, value added tax, employee taxation, etc., and various management
consulting services.

REPORTING SERVICES PRESCRIBED BY STATUTE
The following Acts, regulations and policies require the appointment of a person to issue reports to either the relevant
regulator or entity:
ACCOUNTING OFFICER FOR A CLOSE CORPORATION
Close Corporations are governed by the Close Corporations Act 69 of 1984. Sections 56 and 58 of the Act provide
that all close corporations are required to keep accounting records and prepare annual financial statements. In terms
of sections 59 and 62 a close corporation must appoint an Accounting Officer to perform certain duties and report to
the close corporation on the performance of those duties. The statutory duties of an Accounting Officer are
contained in section 62 of the Act. Section 60 of the Act determines the qualifications of accounting officers, and
provides that only those persons who are members of the professions that have been published by the Minister in the
Gazette are entitled to be appointed as an Accounting Officer. Members of SAIPA are recognised to act as
Accounting Officers.
Relevant sections of the Act read as follows:
Close Corporations Act 69 of 1984
56. Accounting records
(1) A corporation shall keep in one of the official languages of the Republic such accounting
records as are necessary fairly to present the state of affairs and business of the corporation,
and to explain the transactions and financial position of the business of the corporation. . .
58. Annual financial statements
(1) The members of a corporation shall within nine months after the end of every financial year
of the corporation cause annual financial statements in respect of that financial year to be made
out in one of the official languages of the Republic.[Sub-s. (1) amended by s. 4 of Act 64/88]
59. Appointment of accounting officers
(1) Every corporation shall appoint an accounting officer in accordance with the provisions of
this Act.
60. Qualifications of accounting officers
(1) No person shall be appointed as or hold the office of an accounting officer of a
corporation, unless he or she is a member of a recognized profession which -
(a) as a condition for membership, requires its members to have passed examinations in
accounting and related fields of study which in the opinion of the Minister would qualify such
members to perform the duties of an accounting officer under this Act;

(b) has the power to exclude from membership those persons found guilty of negligence in
the performance of their duties or of conduct which is discreditable to their profession; and
(c) has been named in a notice referred to in subsection (2). [Sub-s. (1) amended by s. 9 of
Act 81/92]
62. Duties of Accounting Officers
(1) The Accounting Officer of a corporation shall, not later than three months after completion
of the annual financial statements-
(a) subject to the provisions of section 58 (2) (d), determine whether the annual financial
statements are in agreement with the accounting records of the corporation; [Para. (a)
substituted by s. 13 (1) (a) of Act 38 of 1986.]
(b) review the appropriateness of the accounting policies represented to the Accounting Officer
as having been applied in the preparation of the annual financial statements; and [Para. (b)
substituted by s. 13 (1) (a) of Act 38 of 1986 and by s. 4 (a) of Act 17 of 1990.]
(c) report in respect of paragraphs (a) and (b) to the corporation.
(2) (a) If during the performance of his duties an Accounting Officer becomes aware of any
contravention of a provision of this Act; he shall describe the nature of such contravention in his
report.
(b) Where an Accounting Officer is a member or employee of a corporation, or is a firm of
which a partner or employee is a member or employee of the corporation, his report shall state
that fact.
(3) If an Accounting Officer of a corporation-
(a) at any time knows, or has reason to believe, that the corporation is not carrying on business
or is not in operation and has no intention of resuming operations in the foreseeable future; or
(b) during the performance of his duties finds-
(i) that any change, during a relevant financial year, in respect of any particulars mentioned in
the relevant founding statement has not been registered;
(ii) that the annual financial statements indicate that as at the end of the financial year
concerned the corporation's liabilities exceed its assets; or
(iii) that the annual financial statements incorrectly indicate that as at the end of the financial
year concerned the assets of the corporation exceed its liabilities, or has reason to believe that
such an incorrect indication is given, [Sub-para. (iii) added by s. 13 (1) (d) of Act 38 of 1986.]

he shall forthwith by registered post report accordingly to the Registrar. [Sub-s. (3) amended by
s. 14 of Act 22 of 2001.]
(4) If an Accounting Officer of a corporation has in accordance with subparagraph (ii) or (iii) of
paragraph (b) of subsection (3) reported to the Registrar that the annual financial statements of
the corporation concerned indicate that as at the end of the financial year concerned the
corporation's liabilities exceed its assets or that the annual financial statements incorrectly
indicate that as at the end of the financial year concerned the assets of the corporation exceed
its liabilities, or that he has reason to believe that such an incorrect indication is given, and he
finds that any subsequent financial statements of the corporation concerned indicate that the
situation has changed or has been rectified and that the assets concerned then exceed the
liabilities or that they no longer incorrectly indicate that the assets exceed the liabilities or that
he no longer has reason to believe that such an incorrect indication is given, as the case may
be, he may report to the Registrar accordingly.[Sub-s. (4) added by s. 4 (b) of Act 17 of 1990.]
Close Corporations Act 69 of 1984 Administrative Regulations
21. Accounting officer
Any person who is a member of a profession whose members are qualified to perform the
duties of an accounting officer in terms of section 60 of the Act and who signs any documents
of or in respect of a corporation in his capacity as accounting officer of such corporation, shall
state the name of the said profession of which he or she is a member and his or her registration
number with such profession, beneath his or her signature.[Reg. 21 substituted by GN
R607/2005]
ACCOUNTING OFFICER FOR A BODY CORPORATE
A body corporate is governed by the Sectional Titles Act, Act 95 of 1986. Section 35 of the Sectional Titles Act
provides that a scheme must, from the date of the establishment of the body corporate, be controlled by means of
rules. Annexure 8 sets out the management rules, and these rules can be added to, amended or repealed in certain
circumstances as provided for in the Act. The rules require that the trustees must keep books of account and
records, prepare an annual financial estimate, financial statements and reports, and appoint an Auditor to hold office.
However, where a scheme comprises less than 10 units, an accounting officer, rather than an auditor, may be
appointed for that purpose and the auditor or accounting officer, as the case may be, must sign the financial
statements.
Annexure 8 defines ‘Accounting Officer’ as a person who is qualified to perform the duties of an Accounting Officer in
terms of the Close Corporations Act. ‘Auditor’ is defined as an auditor registered with the Independent Regulatory
Board for Auditors as established in terms of section 3 of the Auditing Profession Act 26 of 2005.
Although Annexure 8 limits the appointment of an Accounting Officer to only those Schemes consisting of less than
10 units, a change in the Management Rules of the Scheme will entitle an Accounting Officer to be appointed to a

Scheme consisting of 10 and more units. The Management Rules of a body corporate can be amended by
unanimous resolution, provided the correct procedures are followed. These procedures are prescribed by the Act
and the regulations to the Act.
Relevant sections of the Act read as follows:
Sectional Titles Act 95 of 1986
1. Definitions
“unanimous resolution” means, subject to subsection (3), a resolution -
(a) passed unanimously by all the members of a body corporate who are present or
represented by proxy or by a representative recognized by law at a general meeting of the body
corporate of which at least 30 days’ written notice, specifying the proposed unanimous
resolution, has been given, and at which meeting at least 80% of all the members of a body
corporate (reckoned in number) and at least 80% of all the members (reckoned in value) are
present or so represented: Provided that in circumstances determined in the rules, a meeting of
the body corporate may be convened for a date 30 days or less after notice of the proposed
resolution has been given to all the members of the body corporate; or [Para. (a) substituted by
s. 1 of Act 63/91]
(b) agreed to in writing by all the members of the body personally or by proxy or by a
representative of any such member recognized by law;
35. Rules
(1) A scheme shall as from the date of the establishment of the body corporate be controlled
and managed, subject to the provisions of this Act, by means of rules. [Subs. (1) substituted by
s. 8 of Act 7/92]
(2) The rules shall provide for the control, management, administration, use and enjoyment of
the sections and the common property, and shall comprise -
(a) management rules, prescribed by regulation, which rules may be substituted, added to,
amended or repealed by the developer when submitting an application for the opening of a
sectional title register, to the extent prescribed by regulation, and which rules may be
substituted, added to, amended or repealed from time to time by the unanimous resolution of
the body corporate as prescribed by regulation; [Para. (a) substituted by s. 19 of Act 63/91]
Sectional Titles Act 95 of 1986, Regulations
30. Rules
(4) The management rules set out in Annexure 8 may be added to, amended or repealed by
unanimous resolution of the body corporate: Provided that no such addition, amendment or

repeal shall be made until such time as there are owners, other than the developer, of at least
50 per cent of the units in the scheme save in the case of a body corporate which is established
in a scheme which was approved in terms of the Sectional Titles Act, 1971.
Sectional Titles Act 95 of 1986, Regulations
Annexure 8: Management Rules (Section 35 (2) (a) of the Sectional Titles Act, 1986)
Interpretation
In the interpretation of these rules, unless the context otherwise indicates –
(b) “accounting officer” means a person who in terms of section 60 (2) of the Close Corporation
Act, 1984 (Act 69 of 1984), is qualified to perform the duties of an accounting officer;
(c) “auditor” means an auditor qualified to act as such under the Public Accountants’ and
Auditors’ Act, 1951 (Act 51 of 1951); This now means under the Auditing Profession Act, 26 of
2005.
35. Books of account and records
(1) The trustees shall cause proper books of account and records to be kept so as fairly to
explain the transactions and financial position of the body corporate. . .
36. Annual financial estimate, financial statement and report
(1) Before every annual general meeting, the trustees shall cause to be prepared an itemised
estimate of the anticipated income and expenses of the body corporate during the ensuing
financial year, which estimate shall be laid before the annual general meeting for consideration
in terms of rule 56 hereof.
(2) The estimate of expenses referred to in sub-rule (1) shall include a reasonable provision
for contingencies and the maintenance of the common property;
40. Audit
At the first general meeting and thereafter at every ensuing annual general meeting, the body
corporate shall appoint an Auditor to hold office from the conclusion of that meeting until the
conclusion of the next annual general meeting : Provided that where a scheme comprises less
than 10 units, an Accounting Officer may be appointed for that purpose and the Auditor or
Accounting Officer, as the case may be, must sign the financial statements.[Rule 40 substituted
by GN R2345/90 and GN R1109/2005]
51. (1) An annual general meeting shall be held within four months of the end of each financial
year.

(2) Unless otherwise decided at a general meeting or by the trustees, the financial year of the
body corporate shall run from the first day of March of each year to the last day of February of
the following year.[Rule 51 substituted by GN R1422/97]
52. All general meetings other than the annual general meeting shall be called special general
meetings.
The duties of the Accounting Officer are not the same as that required of the Registered Auditor. As Annexure 8
provides for an Accounting Officer to hold office it is recommended that a report be issued to the Scheme based on
the performance of similar duties as is detailed in the Close Corporation Act. Any report issued should contain
similar wording to that prescribed for Accounting Officers in terms of the Close Corporation Act.
ACCOUNTANT / ACCOUNTING OFFICER / AUDITOR FOR A TRUST
The purpose of the Trust Property Control Act, 57 of 1988 is to regulate the control of trust property; to prescribe the
minimum duties for trustees, and to provide for matters connected therewith. In addition to the Trust Property Control
Act, trusts and trustees are regulated by the trust deed. A trust deed is a trust’s ‘constitutive charter’ and accordingly
the specific terms of the trust deed must be complied with.
The appointment of a trustee in a trust deed must be conformity with the terms of the trust deed and must also
comply with section 6 of the Trust Property Control Act. Section 6 requires that a trustee must be authorised in
writing by the Master of the High Court before that person can act as a trustee. In approving the appointment of a
trustee, the Master must in terms of section 6 consider whether security ought to be furnished by the applicant or
whether security can be dispensed with. No person can act as a trustee prior to receiving the Master’s written
authority. In addition to security section 9 requires Trustees to act with such care, diligence and skill as ‘can
reasonably be expected of a person who manages the affairs of another’. Section 16 of the Act also empowers the
Master to call the Trustee to account for that person’s administration and disposal of trust property and shall ‘at the
written request of the Master, deliver to the Master any book, record, account or document relating to his
administration or disposal of the trust property and shall to the best of his ability answer honestly and truthfully any
question put to him by the Master in connection with the administration and disposal of the trust property.’
Based on the above, the Technical Committee of SAIPA recommends that Trustees obtain only the services of
competent and qualified persons to assist them with their stringent administration duties imposed in terms of the trust
deed, in terms of the common law and in terms of the Trust Property Control Act.
Although the Act does not require the appointment either of an Accounting Officer or of a Registered Auditor to audit
the financial affairs of the trust - the only reference to the word ‘audit’ is section 15 of the Act which requires the
person ‘that audits the accounts of a trust’ to report irregularities - the Technical Committee of SAIPA recommends
that the trustees should seriously consider the appointment of an appropriately qualified person to report on the
financial affairs of the trust. In the view of the Technical Committee, qualified persons would include only those
professional accountants that are members of an accountancy body that in turn is a member of the International
Federation of Accountants (IFAC); and who are in possession of a higher diploma or degree with specialisation in the
administration of Trusts.
The duties of the person appointed to report on the financial affairs of the trust should be determined by the trust
deed or by the trustees if the trust deed is silent or inadequate on the issue. It is recommended that these duties be
based on either the Agreed-Upon-Procedures or the Review engagements as provided for in the IFAC Handbook
SAIPA Guide Page 15 of 32
(see above). It can also be considered to provide for the performance of similar duties as required of Accounting
Officers as per the Close Corporation Act, 1984. If the trust deed requires the appointment of a Registered Auditor
only a Registered Auditor is allowed to perform the required duties.
It is recommended that SAIPA members performing such an assurance function should do so in terms of the
Handbook of International Auditing, Assurance, and Ethics Pronouncements. The Handbook
(http://www.ifac.org/Guidance) as issued by IFAC provides standards and guidance on the performance of various
reporting services.
ACCOUNTING OFFICER FOR A SCHOOL
Schools are governed by the SA Schools Act 84 of 1996. In terms of section 43(1), a governing body of a public
school must appoint a person registered as a Registered Auditor in terms of the Auditing Profession Act 26 of 2005
to audit the records and financial statements.
However section 43(2) provides that if an audit is not reasonably practicable, the governing body of the school may
appoint another person to examine and report on the records and financial statements of the school. The Act
specifically provides that such a person must be qualified to act as an Accounting Officer in terms of section 60 of the
Close Corporations Act or must be approved by a Member of the Executive Council. Although an Accounting Officer
may be appointed to perform the audit function, the report issued should not refer to the Accounting Officer as the
Auditor or Registered Auditor.
Section 43 of the Schools Act reads as follows:
“Audit or examination of financial records and statements
43. (1) The governing body of a public school must appoint a person registered as an auditor in
terms of the Auditing Profession Act, 2005 (Act No.26 of 2005) to audit the records and financial
statements referred to in section 42.
(2) If the audit referred to in subsection (1) is not reasonably practicable, the governing body of
a public school must appoint a person to examine and report on the records and financial
statements referred to in section 42, who-
(a) is qualified to perform the duties of an Accounting Officer in terms of section 60 of the Close
Corporations Act, 1984 (Act No. 69 of 1984); or
(b) is approved by the Member of the Executive Council for this purpose.
In terms of the Act, an Accounting Officer may be appointed where the appointment of an Auditor is “not reasonably
practicable”. SAIPA recommends that the following be taken into account to determine the meaning of the term “not
reasonably practicable”, although each appointment should be individually considered:
� The economic significance of the school budget (Revenue, Assets, Number of Employees etc.);
� The nature of the school and the community the school operates in;
� The cost of a Registered Auditor’s report (taking into account the above);
� The availability of a Registered Auditor.

� The result of any legal advice sought on this issue.
An Accounting Officer may be appointed to examine and report on the records and the financial statements. This is
not the same as an audit function and does not lead to the expression of an opinion. It is recommended that such
examination should be based on the duties of an Accounting Officer in terms of the Close Corporation Act. An
opinion is therefore not expressed. However the Accounting Officer should ensure that the governing body
understands and agrees to this distinction. Additional work, as part of the examination, may be undertaken by formal
written agreement between the Accounting Officer and the governing board but not audit. Such additional work
should be based on the standards as provided within the Handbook of International Auditing, Assurance, and Ethics
Pronouncements (see above).
It is recommended that before any appointment is made or accepted, all of the following Acts and other references
should be consulted:
� The South African Schools Act, 1996;
� The applicable Provincial Schools legislation (these may require an audit or additional reports to be
issued);
� The applicable School’s rules and regulations (constitution) (this may require an audit);
� The Public Finance Management Act;
� Although it applies only to Kwa-Zulu Natal, the “School Governing Body Manuals” of that province give
a good indication of the duties and responsibilities of the auditing or examining process.
ACCOUNTING OFFICER FOR AN INSURANCE INTERMEDIARY
Insurance intermediaries and/or Financial Service Providers are specifically governed by the Short-term Insurance
Act, Act no. 53 of 1998 and the Financial Advisory and Intermediary Services Act, Act no 37 of 2002.
SHORT-TERM INSURANCE ACT:
Every insurance intermediary is required to issue guarantees in favour of the South African Insurance Association.
Such guarantees should be in a form prescribed by regulation 4 of the Short-term Insurance Act and reviewed by an
Auditor or Accounting Officer.
The prescribed reports, certificates and returns are available from Intermediaries Guarantee Facility Ltd
(http://www.igfsec45.co.za).
An Accounting Officer may review the relevant documentation provided the Accounting Officer is independent and
the insurance intermediary is not a registered company and subject to the limitations by the Intermediaries
Guarantee Facility Limited (currently limited to guarantee requirements below R60 million for the period April 2008 to
March 2009).
Section 45 and regulation 4 of the Short Term Insurance Act, 1998, states:
“Collection of premiums by intermediaries:
45. No Independent Intermediary shall receive, hold or in any other manner deal with
premiums payable under a short-term policy entered into or to be entered into with a short-

term insurer, other than a short-term reinsurance policy, and no such short-term insurer
shall permit such independent intermediary to so receive, hold or in any other manner deal
with such premiums:
- unless authorised to do so by the short-term insurer concerned: as prescribed by
regulation; and
- otherwise than in accordance with the regulations.”
“Regulation 4.1
(1) A short-term insurer may, subject to sub-regulation (2), in writing authorize an
independent intermediary to receive, hold or in any other manner deal with premiums
payable to it under short-term policies.
(2) A person shall not be authorized, as contemplated in sub-regulation (1) unless that
person has provided security, to the extent and in accordance with the requirements of this
Part, in respect of his or her obligations in terms of Regulation (4.3) by means of:
(a) a guarantee policy issued by a short-term insurer registered to do so in accordance with
a guarantee facility created by short-term insurers generally for the purposes of providing
such security; or
(b) a contract which, but for the fact that the undertaking concerned is given by a bank,
would be a guarantee policy,
and under which policy benefits are to be provided in the event of the failure of that person
to meet those obligations.”
According to the Intermediaries Guarantee Facility Ltd (http://www.igfsec45.co.za): “Intermediaries are deemed to
“receive premiums” where the premium passes through a bank account controlled by the intermediary. Where the
intermediary merely collects cheques issued in favour of the insurer from the client and delivers to the insurer, no
authorization or guarantee is required.”
The Intermediary Guarantee Facility Ltd. Solvency Certificate requires in paragraph 5 that an auditor or an
accounting officer report on whether during the course of the examination there was any reason to believe that the
Intermediary will / will not continue as a going concern in the foreseeable future having taking into account all
contingent liabilities of the Intermediary, if any. An accounting officer does not necessarily consider whether an entity
is a going concern in the performance of the accounting officer’s duties. We recommend that the relevant sections of
ISA 570 - Going Concern be used as guidance in this regard.
FINANCIAL ADVISORY AND INTERMEDIARY SERVICES ACT:
The Financial Advisory and Intermediary Services Act 37 of 2002 (FAIS) was assented to on 15 November 2002.
The main aim of this Act is to regulate the rendering of certain financial advisory and intermediary services to clients
by financial service providers (FSP). The Financial Services Board (FSB) administers FAIS and also acts as the
Registrar for Financial Service Providers.

There are two basic reporting duties that a Professional Accountant (SA) may perform in terms of the FAIS Act.
These relate to reporting on the financial statements of certain FSP’s and secondly, acting as compliance officers for
FSP’s.
Reporting duties related to financial statements:
According to the Guidance Note for Accountants and Auditors (http://www.fsb.co.za) as issued by the
FSB on 15 June 2005, the accounting and audit requirements applicable to an FSP are:
“Maintenance of business accounting records:
In terms of section 19(1)(a) and (b) the provider is required to maintain accounting
records and provide financial statements on an annual basis which must cover the
business carried on by the provider as authorised under the provider’s licence.”
“Full and proper accounting records:
For the purposes of FAIS full and proper accounting records are:
Accounting records as defined by the Companies Act for all providers registered as a
company in terms of the Companies Act.
Accounting records as defined by the Close Corporations Act, 1984 (Act No. 69 of 1984)
for all providers registered as close corporations in terms of the Close Corporations Act.
Accounting records for providers, not incorporated in terms of the Companies- or Close
Corporations Acts, are to include at least the following in one of the official languages of
South Africa:
� Records showing assets and liabilities;
� Records of all purchases on credit, and services received and rendered on credit, in
sufficient detail to enable the nature of the services and the parties to the
transactions to be identified;
� Records containing entries from day to day of all cash received and paid out, in
sufficient detail to enable the nature of the transactions to be identified; and
� Vouchers supporting entries in the accounting records and the names of the parties
to the transactions.
These accounting records are to be prepared on a continual basis and updated
monthly.”
“Financial statements:
For the purposes of FAIS financial statements are regarded as meaning:

Annual financial statements as set out in the Companies Act for all providers registered
as a company in terms of the Companies Act.
Annual financial statements as set out in the Close Corporations Act for all providers
registered as a close corporation in terms of the Close Corporations Act.
Financial statements for all other providers are to include at least the following in one of
the official languages of South Africa:
- a balance sheet and notes thereon;
- an income statement and notes thereon;
- a statement of changes in equity and notes thereon; and
- a cash flow statement.”
“Financial statements are to be:
� Prepared in a manner appropriate to the business of the provider in accordance with
generally accepted accounting practice, fairly present the financial position of the
business at the last day of the financial year and the results of operations and cash
flow information for the period then ended;
� Prepared using the accrual basis of accounting which requires the effects of
transactions and other events to be recognised when they occur and not as cash or
its equivalents are received or paid and recorded in the financial year to which they
relate;
� Prepared on a going concern basis unless the provider intends to liquidate the entity,
or cease trading, or has no realistic alternative but to do so;
� Refer to any material matter which has affected or is likely to affect the financial
affairs of the provider;
� Approved and signed by the provider;
� Subject to an audit; and
� Issued within six months of the financial year end of the provider.”
“Exemptions
In terms of exemption No. 1 of 2003, “Exemption of certain Authorised Financial
Services Providers from Requirements pertaining to Audited Financial Statements and
Financial Soundness”, certain providers are exempted from section 19(2) (a) and b (i) of
FAIS. Section 19(2) (a) obliges the provider to cause the financial statements, pertaining
to the business of the provider, to be audited and reported on by an external Auditor.

Section b (i) requires financial statements to be prepared in conformity with generally
accepted accounting practice. This exemption does not apply in those instances where
the provider is obliged by any other law (for example, the Companies Act or the Close
Corporations Act) to have financial statements audited and reported on by an external
Auditor or, otherwise prepared by an Accounting Officer.
The effect of this exemption is such that a provider who would not comply with generally
accepted accounting practice in preparing financial statements and would not cause
such financial statements to be subject to an audit save for the provisions of FAIS, are
not required to do so. For providers to which the exemption applies financial statements
still need to be prepared and submitted to the registrar.
This exemption does not apply to section 19(3). Providers must submit a report prepared
by the Auditor regarding money and assets held on behalf of clients.”
Guidance should also be obtained from Newsletter 2 of the FAIS division of the Financial Services Board.
Reporting duties that relate to compliance by FSP’s:
FSP’s are required to appoint a Compliance Officer (CO) to monitor compliance with the FAIS Act if the FSP employs
any of the following:
1. more than one key individual (any person responsible for managing or overseeing the activities of the FSP) or
2. one or more representative (any person who renders a financial service to a client for or on behalf of an FSP,
in terms of conditions of employment or any other mandatory agreement).
Section 17 and Regulations chapter IV of the FAIS act determine that the CO is appointed to monitor compliance
with the FAIS Act in accordance with procedures as established and maintained by the FSP, to liaise with the
registrar, to submit reports to the registrar in the manner and regarding the matters as determined by the registrar,
and to supply written reports to the FSP on his compliance monitoring duties and make recommendations.
The following persons may be appointed as a CO: a company director, a member, the Auditor (registered with the
IRBA - ed), a trustee, a principal officer, the public officer, or the company secretary. The CO can also be any other
person that meets the requirements laid down by the registrar in Section 17 and the Schedule to section 17.
QUALIFICATIONS AND EXPERIENCE OF COMPLIANCE OFFICERS
Schedule issued under FAIS, point 2 states:
A person to be appointed as compliance officer other than a director, member, auditor, trustee,
principal officer, public officer or company secretary of a particular authorised financial service
provider as contemplated in section 17(1)(b) of the Act must be a person complying with the following
qualifications and experience, namely, the person must-
a) hold a legal or accountancy university degree, and with at least 3 years experience as regards
the financial services industry; or

b) have passed any specific financial services industry, or compliance related course recognised
by the registrar by notice in the Gazette, with 3 year’s experience as regards the of financial services
industry; or
c) already be appointed as a compliance officer by virtue of a law other than the Act relating to the
financial services industry; or
d) be an accredited member of the Compliance Institute of South Africa, or any other organisation
recognised by the registrar by notice in the Gazette, and who has at least 3 years’ experience as
regards the financial services industry.
ACCOUNTING OFFICER FOR NON-PROFIT ORGANISATIONS
Non-profit Organisations are governed by the Non-profit Organisations Act 71 of 1997. In terms of section 17(2) of
the Act, every registered Non-profit Organisation must arrange for a written report to be compiled by an Accounting
Officer and for this report to be submitted to the organisation. The Accounting Officer must report on the matters
mentioned in section 17(2) of the Act.
Sections 17(1) and 17(2) of the Act read as follows:
“Accounting records and reports
17. (1) Every registered non-profit organisation must, to the standards of generally accepted
accounting practice—
(a) keep accounting records of its income, expenditure, assets and liabilities; and
(b) within six months after the end of its financial year, draw up financial statements, which
must include at least—
(i) a statement of income and expenditure for that financial year; and
(ii) a balance sheet showing its assets, liabilities and financial position as at the end of that
financial year.
(2) Within two months after drawing up its financial statements, every registered non-profit
organisation must arrange for a written report to be compiled by an Accounting Officer and
submitted to the organisation stating whether or not—
(a) the financial statements of the organisation are consistent with its accounting records;
(b) the accounting policies of the organisation are appropriate and have been appropriately
applied in the preparation of the financial statements; and
(c) the organisation has complied with the provisions of this Act and of its constitution which
relate to financial matters.
(3) Every registered non-profit organisation must preserve each of its books of account,
supporting vouchers, records of subscriptions or levies paid by its members, income and

expenditure statements, balance sheets and Accounting Officer’s reports, in an original or
reproduced form, for the prescribed period.”
It is a requirement that an Accounting Officer issue a report. It should be noted that the report required is not the
same as the report required in terms of the Close Corporation Act, 1984. Section 17(2)(c) requires the Accounting
Officer to state whether or not the organisation has complied with the provisions of the Non-profit Organisations Act
and with those parts of its constitution which relate to financial matters. Accordingly, any working documents
prepared should enable the Accounting Officer to state whether or not compliance was achieved. The IFAC
Handbook related to agreed-upon-procedures may be consulted to assist with a determination of the procedures to
be followed.
ACCOUNTING OFFICER FOR CREDIT PROVIDERS
The National Credit Act 34 of 2005 provides for the general regulation of consumer credit and provides for
registration of credit providers. The Act also establishes the National Credit Regulator and the National Consumer
Tribunal. It also repeals the Usury Act, 1968, and the Credit Agreements Act, 1980.
Regulations made in terms of the National Credit Act 34 of 2005 place a compliance and reporting duty on registered
credit providers.
Chapter 8 of the regulations requires registered credit providers to submit the following:
� A Compliance Report;
� Statistical Returns;
� An Annual Financial and Operational Return;
� An Assurance Report; and
� Annual financial statements with either the Accounting Officer’s Report or the Auditor’s Report, as
applicable.
The regulation also requires that any information that is required to be reported to the National Credit Regulator must
be “accurate and complete, and must fairly present the activities and status of the credit provider” and that any
“financial information that is required to be reported to the National Credit Regulator must be prepared in accordance
with generally accepted accounting practice as applied by that entity in the preparation of its financial statements”.
It should be noted that the NCR does not require the adherence to IFRS but to “generally accepted accounting
practice as applied” by an entity. Relevant legislation, trust deeds, constitutions or engagement letters need
therefore be consulted to determine which accounting practice was applied by a particular entity.
Sections 67 and 68 of the regulations are of particular importance to a Professional Accountant (SA). Section 67
requires the registered credit provider to appoint an Accounting Officer or Auditor to conduct an assurance
engagement in terms of regulation 68. If a credit provider is not required by statute to appoint an Accounting Officer
or Auditor, a member of one of the following professional bodies should be appointed: South African Institute of
Chartered Accountants (SAICA); Commercial and Financial Accountants (CFA) – South African Institute of
Professional Accountants (SAIPA); South African Institute of Secretaries and Administrators (ICSA); Institute of
Administration and Commerce (IAC); Chartered Institute of Management Accountants (CIMA). The person

appointed is required to report on the credit provider’s financial statements and to conduct the assurance
engagement in terms of Regulations 68.
Section 68 reads as follows:
“Assurance Engagement
68. (1) A credit provider must require the person appointed in terms of regulation 67 to perform
an assurance engagement in accordance with guidelines to be issued by the National Credit
Regulator and issue a report to the National Credit Regulator on the basis of that person’s
findings with regard to that engagement;
(2) A credit provider must submit the report contemplated in (1) to the National Credit Regulator
within 6 months after the credit provider’s financial year end.
(3) The National Credit Regulator must issue guidelines in respect of -
(a) the procedures which the person must follow in performing such assurance engagement,
and
(b) the format and content of the report which must be compiled based on the engagement.
The National Credit Regulator issued a guideline in 2007, named Guideline 001 / 007 – Assurance engagement –
Guide for credit providers. This document constitutes guidelines issued by the National Credit Regulator, in terms of
section 16 (1) (b) of the National Credit Act and Regulations 67 and 68.
This guideline is intended for credit providers who are by law required to appoint a registered auditor to perform an
audit of its annual financial statements. This guideline is not applicable to credit providers who are not required by
law to appoint a registered auditor to conduct an audit of its annual financial statements.
This document provides guidelines on the assurance engagement and the subsequent report that must be prepared
by the auditor for submission to the credit provider and the National Credit Regulator.
In terms of Regulations 67 and 68 issued under the National Credit Act, 34 of 2005 (the Act), a credit provider must
appoint an auditor or accounting officer to conduct an assurance engagement. This assurance engagement must be
performed in accordance with guidelines issued by the National Credit Regulator.
This guideline applies to credit providers who have appointed a registered auditor (RA), registered with the
Independent Regulatory Board for Auditors (IRBA), to perform an audit of its annual financial statements. This
guideline is not applicable to credit providers who are not required by law to appoint a registered auditor.
The procedures that will enable the Professional Accountant (SA) to issue a report in terms of the assurance
engagement will be based on the International Standards on Assurance Engagements (ISAEs): to be applied in
assurance engagements dealing with subject matters other than historical financial information; and/or the
International Standards on Review Engagements (ISREs), as issued by IFAC. This standard is available from the
IFAC Handbook (see above). The procedures to be followed differ substantially from that which is proposed for
Accounting Officers.

PROFESSIONAL ACCOUNTANT (SA) FOR CO-OPERATIVES
The Co-operatives Act 14 of 2005 provides for “the formation and registration of co-operatives; the establishment of a
Co-operatives Advisory Board; the winding up of co-operatives; the repeal of Act No. 91 of 1981; and matters
connected therewith.”
The Act requires that an audit (as defined) should be conducted in each financial year of the co-operative.
The Act defines an auditor as a person registered in terms of the Auditing Profession Act 26 of 2005 a firm as defined
in that Act; or where appropriate, any other person authorised by regulation to conduct an audit of a co-operative.
The definition of an auditor in section 1, and the exemption requirement as specified in section 55 (2) (b), determines
that only a “suitably qualified person” could be appointed instead of the Registered Auditor, to perform the audit (as
defined). Based on membership of SAIPA, and considering relevant competence and experience, a Professional
Accountant (SA) could be regarded as a ‘suitable person’ to perform the audit function (as defined), but is excluded
because of the requirement of an audit (as defined).
The meaning of the term ‘audit’ may be inferred from Chapter 7 section 47 of the Act:
“47. Audit
(1) An audit of the affairs of a co-operative must be conducted annually in respect of each
financial year, in order to-
(a) ensure that financial statements are drawn up in conformity with generally accepted
accounting practices;
(b) verify that the co-operative has maintained adequate records in accordance with the
requirements of its constitution and this Act;
(c) report generally as to whether the assets and facilities of a co-operative are being
properly managed and the operations of a co-operative are being conducted in accordance with
co-operative principles; and
(d) report on any other matter the auditors are required to report on in terms of a co-
operative’s constitution.”
However subsection 2 does allow for an exemption to the above requirements. An exemption
may be applied for in terms of section 55.
Section 55 reads as follows:
“55. Exemptions
(1) Upon application in terms of section 47(2) and subject to the requirements of subsections
(2) and (3), the registrar may exempt a co-operative from full compliance with the requirements
of this Chapter if satisfied that-
(a) the costs of an annual audit would materially affect the financial sustainability of the co-
operative;

(b) the co-operative has maintained adequate financial records, and is able to prepare annual
financial statements; and
(c) having regard to the size and kind of co-operative, the interests of members are
adequately protected.
(2) When exempting a co-operative in terms of subsection (1), the registrar must either
require such co-operative to be audited-
(a) at a period of longer than one year but not exceeding three years; or
(b) by a suitably qualified person other than an auditor.
(3) The board of directors of a co-operative that is exempted in terms of subsection (1) is
nevertheless required to prepare annual financial statements for submission to an annual
general meeting, and to submit a copy to the registrar within 15 days of the annual general
meeting approving such financial statements.
(4) In the event that an annual general meeting fails to approve the financial statements
referred to in subsection (3), the board of directors is required to comply with the provisions of
section 48(6)(b) in the same manner as would apply to audited financial statements.
(5) The registrar may stipulate conditions to an exemption granted in terms of this section, if the
registrar considers that it will serve the purpose of this Act to do so.”
In terms of section 47(1) (a) to (d) the auditor of a co-operative is not required to express an opinion on the fair
presentation of the financial statements. Very specific duties are required of the auditor. However, the Act requires
an audit to be carried out and may only be performed by a Registered Auditor. The definition and exemption are
misleading and the DTI has been informed of this ambiguity. Accordingly, a Professional Accountant (SA) is not
permitted to be appointed by a co-operative, and approved by the Registrar, to perform the audit duties as described
in section 47. It is suggested that in any application to the Registrar for exemption in terms of section 55, the
procedures to be followed in compliance to section 47 be clearly proposed and explained.
The rights and responsibilities as applicable to an auditor in terms of this Act, include sections:
� 49 - Auditor disqualified from acting;
� 50 - Appointment of auditor;
� 51 - Removal of auditor;
� 52 - Attendance of meeting by auditor;
� 53 - Right to information; and
� 54 - Notice of error.
Section 21 of the Act requires that the Co-operative keep accounting records in the manner determine by the
Registrar of Co-operatives. In terms of section 47 it may be inferred that annual financial statements should be

prepared in “conformity with generally accepted accounting practices”. It is assumed that the accounting practices
followed should be appropriate to the business of the Co-operative.
PROFESSIONAL ACCOUNTANT (SA) FOR FUND-RAISING ORGANISATIONS
The Fund-Raising Act 107 of 1978 provides for the control of the collection of contributions from the public, the
appointment of a Director of Fund-raising, the establishment of a various funds, and for related matters.
The Fund-Raising Act requires the appointment of an auditor registered with the Independent Regulatory Board for
Auditors as established in terms of the Auditing Profession Act 26 of 2005, in terms of section 12 (2) – Accounting of
financial activities. In terms of regulation 13 (3) (a) the auditor shall make a report stating that he has examined the
financial statements in so far as he deemed it necessary for the purposes of his audit and that in his opinion they
fairly represent the financial position and the results of the operations of such organisation or branch in the manner
required by the Act.
However section 12 (4) of the Act allows the Director of Fund-raising to exempt a fund-raising organisation from any
provisions of this Act relating to the furnishing of reports, returns or financial statements and may require alternative
conditions to be met.
Section 12 of the Act reads as follows:
“12. Accounting of financial activities
(1) Every fund-raising organization, registered branch or holder shall, in one of the official
languages of the Republic, keep the prescribed records of all the moneys received and
expended by it or him and of all its or his assets and liabilities and of all financial transactions
entered into by it or him and shall furnish the Director with the prescribed reports, returns and
financial statements at the prescribed times.
(2) Subject to the provisions of the Public Accountants’ and Auditors’ Act, 1951 (Act No. 51 of
1951), such financial statements shall be audited by an accountant and auditor registered in
terms of that Act. Now to be referenced to the Auditing Profession Act, 26 of 2005.
(3) The reports, returns and financial statements of a fund-raising organization, registered
branch or holder shall lie for inspection by the public at such places and during such periods
and after such notice as may be prescribed.
(4) The Director may in his discretion grant to a fund-raising organization, registered branch or
holder a certificate exempting such fund-raising organization, registered branch or holder for the
period and on the conditions and to the extent mentioned in such certificate from any provisions
of this Act relating to the furnishing of reports, returns or financial statements and may in his
discretion, withdraw or amend such certificate at any time by notice to such fund-raising
organization, registered branch or holder.”

A Professional Accountant (SA) may therefore be appointed by the fund-raising organisation, and approved by the
Director of Fund-Raising, to perform an agreed upon reporting procedure. It is suggested that in any application to
the Director for exemption in terms of subsection 4 of section 12 of the Act, the procedures to be followed in
compliance to section 12 be clearly proposed and explained.
It is recommended that SAIPA members performing this agreed function should do so in terms of the Handbook of
International Auditing, Assurance, and Ethics Pronouncements. The Handbook (http://www.ifac.org/Guidance) as
issued by IFAC provides standards and guidance on the performance of various reporting services. The standards
that could be considered could include the International Standards on Related Services (ISRSs): to be applied to
compilation engagements, engagements to apply agreed upon procedures to information and other related services
engagement as specified by the International Auditing and Assurance Standards Board (IAASB).
The same rights and responsibilities that apply to an auditor in terms of this Act, will also apply to a Professional
Accountants (SA) being appointed in terms of section 12 of the Act (with the exclusion of the procedures, agreed to
with the Director of Fund-Raising, to replace the audit function).
The Regulations to the Act, issued in terms of section 36, detail the requirements related to accounting records and
financial statements. These are contained in regulations 12 and 13. Accounting records should be kept to fully
disclose the nature and extent of its financial transactions and the state of its affairs. Financial statements should
fully set out the financial affairs of the fund-raising organisation or registered branch; and should consist of:
� an income statement in the form of Schedule VI;
� a statement in the form of Schedule VI (A), setting out the allocation of functional expenditure;
� a statement of source and application of funds in the form of Schedule VI (B);
� a balance sheet in the form of Schedule VII; the auditor’s report referred to in sub-regulation (3);
� an annual report containing:
○ information to supplement and elucidate the information furnished in the financial statements,
○ estimates of income and expenditure for the ensuing financial year,
○ the names and addresses of the persons who have collected contributions,
○ a statement showing the total amount of the contributions collected, and
○ the total amount of remuneration paid and expenses incurred in connection with collection of
contributions, and
○ the names and addresses of the members of its management, the names of any such members
who have died, resigned or retired during the year or whose term of office has otherwise been
terminated and the names and addresses of the persons elected or re-elected or appointed or
re-appointed in the vacancies which have thus occurred.

PROGRAMME
A number of incentive programmes are offered by the DTI for enterprise development. Some of these programmes
require an auditor or accredited person to issue a report to the DTI before payment is made to the relevant
enterprise.
SAIPA members as Professional Accountant (SA)’s are recognised as accredited persons for the purposes of certain
incentive programmes. A guide on these programmes and the duties of the accredited person is available on the
SAIPA website (www.saipa.co.za) under Technical. This guide was prepared by SAICA for the use of auditors and
accredited persons. A summary of the relevant programmes are presented in the table below.

SERVICES THAT MAY NOT BE RENDERED BY SAIPA MEMBERS
For the sake of completeness, this section provides a description of the most important services that SAIPA
members are not allowed to render. Professional Accountants (SA) should take care not to accept assignments
which they are not authorised to perform.
AUDITOR OF COMPANIES OR ANY OTHER ENTITY
Companies are governed by the Companies Act 61 of 1973. Every company must appoint an Auditor registered with
the Independent Regulatory Board for Auditors as established in terms of the Auditing Profession Act 26 of 2005.
The appointment and duties of an Auditor are prescribed by the Companies Act and by the Auditing Profession Act.
ADMINISTRATION OF ESTATES
The administration of estates is governed by the Administration of Estates Act 66 of 1965. An executor “appointed in
terms of a will” may personally liquidate a deceased estate. An agent may be appointed to liquidate the estate on the
executor's behalf.
In terms of regulations issued under the Attorneys Act 53 of 1979, entitled “Regulations prohibiting the liquidation or
distribution of the estates of deceased persons by any person other than an attorney, notary, conveyancer or law
agent”, published under Government Notice R910 in Regulation Gazette 967 of 22 May 1968, only lawyers, auditors
and certain other institutions may be appointed as executors. The appointment of an agent is approved by the
Master of the High Court.
ATTORNEYS TRUST ACCOUNTS
Attorneys are governed by the Attorneys Act 53 of 1979. Attorneys are members of provincial law societies and are
governed by the Rules of the Law Societies in each of the designated provinces.
Every attorney is required to keep a trust account that must be audited by an accountant, as defined in the Rules of
each Law Society. An accountant is defined in the rules as being a person registered with the Independent
Regulatory Board for Auditors as established in terms of the Auditing Profession Act 26 of 2005.
ESTATE AGENTS TRUST ACCOUNTS
Estate agents are governed by the Estate Agents Act 112 of 1976. This Act requires every estate agent to appoint
an Auditor registered with the Independent Regulatory Board for Auditors as established in terms of the Auditing
Profession Act 26 of 2005.
An Auditor is appointed to audit the trust accounts and the books and records if the entity is a company. The report
issued by the Auditor is prescribed by the regulations to the Estate Agents Act.
TRAVEL AGENTS AND TRAVEL AGENCIES
Travel agents registered with the International Air Transport Association (IATA) must keep annual financial
statements, which should be audited by an Auditor registered with the Independent Regulatory Board for Auditors as
established in terms of the Auditing Profession Act 26 of 2005.

AGRICULTURAL PRODUCE AGENTS
Agricultural produce agents are governed by the Agricultural Produce Agents Act, Act no. 12 of 1992. The
accounting records and trust account of each agricultural produce agent must be audited by a person registered with
the Independent Regulatory Board for Auditors as established in terms of the Auditing Profession Act 26 of 2005.
SHERIFFS OF THE COURT
Sheriffs of the Court are governed by the Sheriffs Act, Act no. 90 of 1986. Every Sheriff must keep a trust account
that must be audited by a Registered Auditor. The Regulations to the Sheriffs Act prescribe the form that must be
signed by the Auditor.
DROUGHT SCHEME FOR FARMERS
A drought scheme for farmers was announced in June 1992. The procedures for compliance with the scheme were
published by the Department of Agricultural Development. Initially, compliance with the scheme required the
appointment of an Accounting Officer or Auditor. This decision was subsequently revoked to provide for the
appointment of an Auditor.
HONORARY AUDITOR FOR A CLUB, INSTITUTE OR ASSOCIATION
A SAIPA member may accept the appointment as honorary auditor provided that he / she is a member of the club,
institute or association, which is not carried on with a view to profit, and that he / she receives no fee or other
consideration for his / her services (Auditing Profession Act, Act 26 of 2005 section 41 (3) (b)).
A SAIPA member should not accept the appointment to perform an engagement which is not allowed to be
performed in terms of the Auditing Profession Act, 2005 and should consider whether the reporting requirements of
any law or regulation does not imply that such services should be performed by a registered auditor in terms of the
Auditing Profession Act, 2005.

GENERAL GUIDELINES FOR REPORTING
PRINCIPLES APPLICABLE TO ANY REPORT ISSUED BY SAIPA MEMBERS
Section 2 of the SAIPA constitution contains the “Code of Conduct”. According to sections 4, 9 and 10, respectively a
SAIPA member:
� Should not portray himself or herself as having expertise or experience that he or she does not
possess;
� Should not perform any work that may only be performed by a person who is registered with the IRBA;
� Should only undertake such services as they can expect to complete with competence.
Each SAIPA member should have an “engagement acceptance policy” in place, regulating which engagements are
permitted to be accepted by members, in line with this guide.
