CHANNEL 51 FROZEN On August 22nd, the FCC issued a temporary freeze (http://transition.fcc.gov/ Daily_Releases/Daily_Business/2011/ db0822/DA-11-1428A1.pdf) on all applications for minor changes of all existing full- and low-power TV stations on Channel 51, any new or pending low- power TV applications including flash-cut to digital, digital companion channels and displacement application to channel 51. This action includes all low-power stations including LPTV, Class A, translators and replacement translator stations. Stations on Channel 51 whose applications have been granted may proceed with construction and stations that are on the air may continue to operate. These stations may also seek a waiver to apply for minor changes as long as they do not increase coverage. Such changes can be due to zoning issues, tower failure or other unforeseen issues. LPTV stations will have a sixty-day window to amend their applications for a lower channel. The action is in response to a petition submitted on March 15, 2011 by the CTIA, the Wireless Association and the Rural Cellular Association. Guests are welcome to join us! >>> by Tom Smith FCC HAS NEW WEBSITE In May, the FCC put its new website www.fcc.gov on line. They had beta tested it for a couple of months and asked for comments during that time. The site has a completely new look and functions much differently than the old one. The old site had the latest releases of FCC actions on the home page, as well as direct links to the bureaus and other important sections of the website. The new website has links to other parts of the website more by subject, as well as highlighting subjects that the FCC is placing much importance on. To get to the bureaus and other parts of the website that were previously linked directly from the front page, you either go to a link or a pull down that will take you to an intermediate page that will link to where you need to go. In the Media Bureau home page, the news link gives you all of the information released by the Media Bureau including things that used to be found in the daily digest, which is the FCC’s daily report on most of its releases. Because of the amount of information in the news link, one must page through many pages of information to find anything that is more than a few days old. It used to be that most of the rulemakings and major releases for the year took a few pages and could be found easily, not things such as the daily application notices and grant lists and other minor actions that are now listed on the news page. The Commission still has some direct links to things such as the comment filing pages, but the website requires more searching to find things. Forbroadcastersandcableproviders,theCommissiondeletedtheRulesreferencingtheFairnessDoctrine.TheCommissiondecidedin1987theRulesnolongerservedthepublicinterest,werenotstatutorily-mandatedandinconsistentwiththeFirstAmendment.In1989,theD.C.CircuitCourtaffirmedtheFCC’sconclusionandtheRuleshavenotbeenenforcedsince.TheCommissionalsodeletedRulesforcableprovidersthatwheretiedtotheFairnessDoctrinetherelatedtopersonalattackandpoliticaleditorials. TheCommissiondeletedtheRulethatrequiredtelevisionbroadcastersfromhavingtoplacetheso-called“broadcastflag”intheirDTVdatastreamtopreventtheindiscriminatedistributionof

televisioncontentovertheInternet.ThiswasbasicallycopypreventionforTVbroadcastprogramming.TherulewasvacatedbytheCourtofAppealsfortheDistrictofColumbiaCircuitCourt. ThefinalsetofRulestheCommissiondeletedpertainedtotheprocessforfilingandadjudicatingcomplaintsconcerningtheratestheychargedforitscableprogrammingtiers.TheCommission’sauthoritiestoregulatetheseratesweresunsetin1999.TheCommissionnolongerhadanylegaleffectontheseRules. TheCommissionperiodicallygoesthroughtheRulesanddeletesthosethatforsomereasonwerenotdeletedduringthenormalRulemakingprocessorwereoverturnedbythecourtsandnotdeletedatthetimeofthecourtruling.TheseRuleswouldhavenotbeenenforcedforaperiodoftimebeforebeingdeleted.

OnAugust9th,theFCCadoptedandreleasedaReportandOrder,alongwithaNoticeofRulemaking(http://transition.fcc.gov/Daily_Releases/Daily_Business/2011/db0809/FCC-11-120A1.pdf)concerningthe7and13Gigahertzbroadcastauxiliaryband.IntheReportandOrderpartofthenotice,theCommissionopenedthebandtosharingwithcommoncarrierandprivatemicrowaveproviders.Thereasonfortheactionwastoallowfortheuseofthesemicrowavebandstobeusedforthebackhaulingofvoiceandbroadbanddatatraffictoandfromcellulartowersites.

TheRules,thatwereadoptedintheReportandOrderanddirectlyaffectTVbroadcasters,isPart74.602whichassignsthe6825-7125and12,700-13200MHzforTVfixedandremotepick-upuse.Thesectionnowstatesthatthebandistobeco-equallysharedwithPart78andPart101users.Part78appliestocableproviderandthebandwassharedwiththeminthepast.Part101usersarecommoncarriersandprivatemicrowaveusers-thenewpartoftherules.Also,anewsectionoftheRuleswasadded(74.605)whichrequiresbroadcasterstoregistertheirTVpick-upreceivesiteinthe6825-7125and12,700-13200MHzbandsusingtheUniversalLicensingSystem.Broadcastersmaynowoperatestudio-to-transmitterlinksunderPart101.603whichsaysthat“licensesmaytransmitprogrammaterialfromonelocationtoanother.”UnderPart101.147FrequencyAssignments,theRulestatesthat“Inthebandsof6,857-7,125MHzand12,700-13-150MHz,linksshallnotintersectwithserviceareasoftelevisionpick-upstations.” UnderthenewRules,thoseoperatingunderPart101maynotoperatewithmorethen25MHzbandwidthinthe6,825-7,125MHzbandand50MHzbandwidthinthe12,700-13,200MHzband.Intheinterestofspectrumefficiency,Part101stationsmustoperatewithminimumbandwidthfortheamountofdatatransmitted.Anexamplewouldberequiringtheuseof256QAMcarriermodulationinsteadof64QAMcarriermodulation.Licenseeswouldbeabletouselowercarriermodulationduringfadeperiodsundertherules.Inbothbands,Part101stationsmayoperatewith5,8.33,12.5and25MHzbandwidths,withthe12,700-13,200MHzbandalsoabletooperatewith50MHzbandwidth.Thereisatableforthecenterfrequencyateachbandwidthforeachchannelintheband.
