InMay,theFCCputitsnewwebsitewww.fcc.govonline.Theyhadbetatesteditforacoupleofmonthsandaskedforcommentsduringthattime.Thesitehasacompletelynewlookandfunctionsmuchdifferentlythantheoldone.TheoldsitehadthelatestreleasesofFCCactionsonthehomepage,aswellasdirectlinkstothebureausandotherimportantsectionsofthewebsite.Thenewwebsitehaslinkstootherpartsofthewebsitemorebysubject,aswellashighlightingsubjectsthattheFCCisplacingmuchimportanceon.Togettothebureausandotherpartsofthewebsitethatwerepreviouslylinkeddirectlyfromthefrontpage,youeithergotoalinkorapulldownthatwilltakeyoutoanintermediatepagethatwilllinktowhereyouneedtogo. OnAugust24th,theCommissionadoptedandreleasedanorder(http://transition.fcc.gov/Daily_Releases/Daily_Business/2011/db0825/DA-11-1432A1.pdf)whichdeleted83oftheCommissionsRulesincluding18Rulesthatpertainedtoeitherbroadcastorcableservices.TheRulesthatweredeletedincludedasectionofPart1oftheRulesconcerningtheRulesthatdirectedthereadertoseesimilarrenumberedRules.TheseRulesweredeletedastherenumberedRuleshavebeenproperlyindexedandareaccessible. Forbroadcastersandcableproviders,theCommissiondeletedtheRulesreferencingtheFairnessDoctrine.TheCommissiondecidedin1987theRulesnolongerservedthepublicinterest,werenotstatutorily-mandatedandinconsistentwiththeFirstAmendment.In1989,theD.C.CircuitCourtaffirmedtheFCC’sconclusionandtheRuleshavenotbeenenforcedsince.TheCommissionalsodeletedRulesforcableprovidersthatwheretiedtotheFairnessDoctrinetherelatedtopersonalattackandpoliticaleditorials. TheCommissiondeletedtheRulethatrequiredtelevisionbroadcastersfromhavingtoplacetheso-called“broadcastflag”intheirDTVdatastreamtopreventtheindiscriminatedistributionof
televisioncontentovertheInternet.ThiswasbasicallycopypreventionforTVbroadcastprogramming.TherulewasvacatedbytheCourtofAppealsfortheDistrictofColumbiaCircuitCourt. ThefinalsetofRulestheCommissiondeletedpertainedtotheprocessforfilingandadjudicatingcomplaintsconcerningtheratestheychargedforitscableprogrammingtiers.TheCommission’sauthoritiestoregulatetheseratesweresunsetin1999.TheCommissionnolongerhadanylegaleffectontheseRules. TheCommissionperiodicallygoesthroughtheRulesanddeletesthosethatforsomereasonwerenotdeletedduringthenormalRulemakingprocessorwereoverturnedbythecourtsandnotdeletedatthetimeofthecourtruling.TheseRuleswouldhavenotbeenenforcedforaperiodoftimebeforebeingdeleted.

TheRules,thatwereadoptedintheReportandOrderanddirectlyaffectTVbroadcasters,isPart74.602whichassignsthe6825-7125and12,700-13200MHzforTVfixedandremotepick-upuse.Thesectionnowstatesthatthebandistobeco-equallysharedwithPart78andPart101users.Part78appliestocableproviderandthebandwassharedwiththeminthepast.Part101usersarecommoncarriersandprivatemicrowaveusers-thenewpartoftherules.Also,anewsectionoftheRuleswasadded(74.605)whichrequiresbroadcasterstoregistertheirTVpick-upreceivesiteinthe6825-7125and12,700-13200MHzbandsusingtheUniversalLicensingSystem.Broadcastersmaynowoperatestudio-to-transmitterlinksunderPart101.603whichsaysthat“licensesmaytransmitprogrammaterialfromonelocationtoanother.”UnderPart101.147FrequencyAssignments,theRulestatesthat“Inthebandsof6,857-7,125MHzand12,700-13-150MHz,linksshallnotintersectwithserviceareasoftelevisionpick-upstations.” UnderthenewRules,thoseoperatingunderPart101maynotoperatewithmorethen25MHzbandwidthinthe6,825-7,125MHzbandand50MHzbandwidthinthe12,700-13,200MHzband.Intheinterestofspectrumefficiency,Part101stationsmustoperatewithminimumbandwidthfortheamountofdatatransmitted.Anexamplewouldberequiringtheuseof256QAMcarriermodulationinsteadof64QAMcarriermodulation.Licenseeswouldbeabletouselowercarriermodulationduringfadeperiodsundertherules.Inbothbands,Part101stationsmayoperatewith5,8.33,12.5and25MHzbandwidths,withthe12,700-13,200MHzbandalsoabletooperatewith50MHzbandwidth.Thereisatableforthecenterfrequencyateachbandwidthforeachchannelintheband.
