RECOMMENDATION:

Submitted at this time for your Board's approval is the Older Americans Act (OAA) and Older Californians Act Grant (OCA) Grant Agreement No. AP-1011-09, Amendment 2 between the California Department of Aging and Alameda County for FY 2010-2011. To continue providing supportive services for seniors, it is recommended that your Board:

1. Approve the FY 2010-2011 Older Americans Act and Older Californians Act Grant Agreement, No. AP-1 011-09, Amendment 2, and authorize the President to sign seven (7) Grant Agreements on behalf of Alameda County, each with an original signature, with a Minute Order authorizing execution of the contract.

2. Authorize an additional appropriation of $489,631 completely offset by additional revenue, as detailed in the attached financial recommendation.

3. Approve contract increases to the subcontracts as detailed in Attachment A, and delegate authority to the Social Services Agency Co-Directors to sign the contract amendments, under the master contracting process.

SUMMARY/DISCUSSION:

This letter requests action by your Board to approve and execute Amendment 2 to the Older Americans Act and Older Californians Act Grant Agreement issued by the California Department of Aging (CDA) for FY 2010111. Your Board previously accepted Grant Amendment 1, which provided $66,615 in additional funds on January 25,2011 (file#26996; item# 31). This Grant Agreement, which provides an increase of $489,631 in One-Time-Only (OTO) funds, allocates a total of$6,140,689, to the Alameda County Area Agency on Aging. With the two amendments, the AAA has received an overall increase of $556,246 in funds for supportive, nutrition, disease prevention, elder abuse, ombudsman, and caregiver services. The AAA provides most of these services to seniors through management of contracts with community based organizations.

Honorable Board Members - 2 - February 17,2011

The AAA is allocating a total of$549,713 in additional funds to community-based organizations with existing contracts as outlined in attaclunent A. The AAA will retain $6,533 in One-Time-Only funds for the Ombudsman program, which is a direct service provided by the AAA. The AAA is distributing the increased funding from Amendments one and two on a pro rata basis, based on the initial amount of each provider's contract.

County Counsel has approved this amended Grant Agreement as to form.

SELECTION CRITERIAJPROCESS:

The subcontractors receiving funds under this Grant Agreement were selected based on recommendations resulting from the 2011-2014 Request for Proposals completed by the Alameda County Area Agency on Aging and the Advisory Commission on Aging. The Commission's recommendations for funding from the RFP were approved by your Board on June 29, 2010 (File #26306, Item 12).

FINANCING:

Financing will come from the federal One-Time-Only funds awarded to Alameda County by the California Department of Aging through this Grant Agreement amendment for FY 2010-2011. These additional program funds were not included in the Social Services Agency budget approved by your Board in June 2010. An additional appropriation of$489,631, completely offset by additional revenue, is necessary at this time. The subcontractors receiving OAA and OCA funds will meet all match requirements. There is no change to net county cost as a result of your approval of the amended Grant Agreement.

Federal OTO Funds

There are five sources of federal OTO funds included in the Area Plan Budget Display:

(1) $5,499,095 in unexpended federal funds carried over from FY 2009-10 were reallocated to the Area Agencies on Aging (AAA); AAAs were allowed to retain up to five percent of their previous

year's unexpended allocation by program, while remaining funds were redistributed based on the Intrastate Funding Formula (IFF) and the Ombudsman Funding Formula (OFF).

(2) $610,278 in supplemental federal grant funds received in federal FY 2009-10 were allocated in accordance with the IFF and OFF.

(3) $6,532,035 in unallocated grant reconciliation federal funds were allocated in accordance with the IFF and OFF.

(4) $34,159 in recovered funds from audit determinations were allocated.in accordance with the IFF.

(5) $561,713 in unallocated Nutrition Services Incentive Program (NSIP) grant reconciliation federal funds were allocated based on certified meal count data.

Use of OTO Funds

The California Department of Aging (CDA) amended the California Code of Regulations (CCR), Title 22, Section 7314 regarding the use of federal OTO funds. The amendment removed the prohibition against using OTO to increase baseline services and took effect on January 20,2010. Accordingly, the One-Time-Only Request form (COA 1031), was amended to include baseline services as an allowable use of OTO funds. A copy of the revised form, for use when making OTO requests, is available on the CDA website at www.aging.ca.gov.Asigned COA 1031 showing the status of project requests will be returned to AAAs.

As a reminder:

• OTO funds must be used in the program in which they were incurred and are not transferable to another program.

• OTO purchases must be for allowable program costs.

• A subcontractor receiving OTO funds should have an existing contract with the AAA for the same program from which the OTO funds accrued. Awarding OTO funds to a new subcontractor requires completion of an RFP process.

• OTO funding will not be available until the revised Area Plan Budget form (CDA 122) is approved and the Area Plan Contract Amendment #2 is executed.

If you have questions on whether or not a particular cost is allowable, please call your respective program or fiscal analyst for guidance.

Budget Revision

PM 10-07(P), dated March 30, 2010, released the new Service Categories and Data Dictionary that became effective July 1, 2010. The Data Dictionary replaced the now obsolete Division 4000 document. AAAs must use the new Data Dictionary service categories when submitting their revised Area Plan Budget.

The FY 2010-11 CDA 122 includes the new service categories and is available on the CDA website at www.aging.ca.gov. A CDA 122 that incorporates the amounts specified in the Area Plan Budget _ Display and corresponding CDA 1031 s, and accounts for all OTO funds, must be submitted electronically to your assigned AAA-Based Team Fiscal Specialist no later than 30 days from the date of this Program Memo.

Note: The table on the following page lists United States Department of Health and Human Services, Administration on Aging award information for this contract in compliance with federal reporting requirements.
