Public Contracts Regulation 2015 (26th February 2015) Directive aims for “better integration of social and
environmental considerations in procurement”
Regulation 40: Preliminary Market Consultation – useful for engaging the expertise of social enterprises
Regulation 20: allows contracts to be reserved for supported businesses whose main aim is integration of disabled and disadvantaged persons provided at least 30% of workers are disabled or disadvantaged
Regulation 77 allows contracts to be reserved for social enterprise spin-outs e.g. (Mutuals / Co-operatives) – Health / social / cultural services – Spin out companies given a “safe launch” for 3 years with minimal competition (only from similar organisations)
Other Developments Revised Welsh Procurement Policy launched Apply a Community Benefits(CB) approach to all public
sector procurements Apply the CB Measurement Tool to all such contracts
over £1m, as a minimum FCC Contract Procedure Rules and Corporate
Procurement Strategy are currently being updated to reflect policy and legislation changes
