1. Introduction

M/s Satluj Contractors, H.no. 25 Garden Colony Jalandhar has obtained the Environmental

Clearance Letter from Ministry of Environment, Forests and Climate Change for Chandpur Sand

Mining Project from the bed of River Satluj in Village Chandpur, Tehsil Anandpur Sahib,

District Rupnagar, Punjab for a production of 81,000 TPA Ref. No. No. J-11015/159/2010-IA.II

(M) Dated 20 Feb. 2015.The total area of the mining site is 61.44 Ha. The total cost of the

project will be Rs.67.04 Lakhs.

1.2 Purpose of the Report

As per the “Sub Para (ii)” of “Para 10” of EIA Notification 2006, it is stated that “It shall be

mandatory for the project management to submit six monthly compliance reports in respect of

the stipulated prior environmental clearance terms and conditions in hard and soft copies to the

regulatory authority concerned, on 1st June and 1

st December of each calendar year” and as per

compliance of condition mentioned in Environment Clearance Letter (i.e. Part B General

Condition, point number XVII), Six Monthly Compliance Reports should be submitted to the

Regulatory Authority of Central and State Government.

It is mandatory to submit a Six Monthly Compliance Report to show the status & compliance of

all the Conditions mentioned in Environment clearance Letter, along with monitoring of various

Environmental Parameters (as per CPCB Norms).The regulatory authorities in this case are

MoEF& CC, Delhi, MoEF& CC, Chandigarh and PPCB Patiala. Various scheduled Site

Visits were conducted by a team of Experts to Monitor Pollution related parameters as defined

by CPCB / PPCB. Samples for water and soil were also collected for further analysis.

Based on the Specific and General Conditions mentioned in the EC Letter, a Compliance Report

was prepared by the Eco Laboratories & Consultants Pvt. Ltd on behalf of Project Proponent;

details of which are present in Chapter – “Compliance Report”

This report is supposed to submit after every six month as per the conditions stipulated in

Environment Clearance Order. The Environmental Assessment has been carried out to verify:

1. That the proposed project has not any adverse effect on the project site as well

as its surrounding.

2. That there is compliance with the conditions stipulated in the Environmental Clearance

Letter.

3. That the Project proponent is implementing the environmental safeguards and

environmental pollution mitigation measures as suggested in approved Form-1 and Form

– 1A, Environmental Management Plan with true spirit.

4. The non conformity in the project with respect to the environmental implication of the

project.

6. Salient features

a) of the project

The Chandpur Sand Mining Project is for mining from

the bed of River Satluj in Village Chandpur, Tehsil

Anandpur Sahib, District Rupnagar, Punjab for a

production of 81,000 TPA. The mine lease area is

61.44 ha in topo sheet No. 53A/12. An Interstate

Boundary between Punjab and Himachal Pradesh lies

within 10km radius of the mine lease area. No

forestland is involved. There is no Protected Forest

within 10 km radius from mine lease boundary. It was

reported by the project proponent that Jhajjar Bachauli

Wildlife Sanctuary lies within buffer zone of the mine

at a distance of 8 km in North direction. b) of the environmental management plans

Mine working will be open cast by manual method

without involving drilling and blasting using hand

tools like shovel, pan, sieve etc. Ultimate working

depth will be upto 3 m from river bed level. Mining

will be done in layers of 1 m depth to avoid ponding

effect and after first layer is excavated, the process

will be repeated for next layers. The ground water

level is reported to be 4-5 m below ground level.

Water requirement will be 2.91 KLD which will be

sourced from nearby villages. Cost of the project is

Rs. 67.04 Lakhs and EMP cost is Rs 5.1 lakhs per

annum.

5. To submit annual replenishment report certified by an authorized agency. In case the replenishment is lower than the approved rate of production, then the mining activity / production levels shall be decreased / stopped accordingly.

Yes, will be ensured. As the mining activity have not yet started on full fledge scale, thus replenishment report is being prepared. However it is brought to you notice that the replenishment is higher than the approved rate of production at present.

6. To establish a Monitoring Committee including Local Panchayat, to check on traffic due to transportation and submit an annual report on the same.

7. All the provisions made and restrictions imposed as covered in the Punjab Minor Mineral Rule, 2013 are to be complied with, particularly regarding Environment Management Practices and its fund management & Payment of compensation to the land owners.

8. The PP shall make arrangement for drinking water, first aid facility (along with species specific anti-venom provisioning) in case of emergency for the workers.

Medical kit and drinking water has been provided to the workers at the project site. Necessary and immediate steps are taken in case of emergency.

9. The cumulative impact of the mining activity is high; therefore the mining in mines located within one km radius of each other shall be done in a phased manner.

10. It shall be ensured that no mining shall be carried out during the monsoon season.

11. No mining activities will be allowed in forest area, if any, for which the Forest Clearance is not available.

Agreed, no forestland is involved. There is no National Park/Wildlife Sanctuary within 10 km from the boundary of the mine lease boundary.

12. Project Proponent shall plant native and other local species.

Agreed, Project proponent has planned to plant native and other local species for landscaping under the mining closure plan.

13. Proponent shall appoint an Occupational Health Specialist for Regular and Periodical medical examination of the workers engaged in the Project and records maintained; also, Occupational health check-ups for workers having some ailments like BP, diabetes, habitual smokers, etc. shall be undertaken once in six months and necessary remedial/preventive measures taken accordingly. Implementation of the Recommendations of National Institute for ensuring good occupational environment for mine workers; All the old age people of the surrounding villages may be provided medical facilities.

Agreed, proponent has liaison with local government hospitals and physicians for regular medical checkups of the labours.

14. An independent study be organised during peak activity, to understand how the actuals compare with the carrying capacities and further decisions taken to maintain sustainability of this essential sand extraction and supply activity. Project Proponent shall ensure that the road may not be damaged due to transportation of the sand; and transport of minerals will be as per IRC Guidelines with respect to complying with traffic congestion and density.

Agreed, all measures will be implemented to ensure sustainability of the project, roads will not be damaged due to transportation of the sand.

15. Implementation of Action Plan on the issues raised during the Public Hearing. The proponent shall complete all the tasks as per the action plan submitted with the budgetary provisions during the Public Hearing. The major issues raised during Public Hearing were related to effect on the agricultural land due to mining activity, transportation of mineral, effect on children, students & local people, employment and adoption of control measures to prevent pollution.

16. The mining operations shall be restricted to above ground water table and it should not intersect groundwater table. In case of working below ground water table, prior approval of the Ministry of Environment, Forests & Climate Change and Central Ground Water Authority shall be obtained, for which a detailed hydro-geological study shall be carried out.

17. The pollution due to transportation load on the environment shall be effectively controlled & water sprinkling shall also be done regularly. Vehicles with PUCC only will be allowed to ply. The mineral transportation shall be carried out through covered trucks only and the vehicles carrying the mineral shall not be overloaded. Project should obtain 'PUC' certificate for all the vehicles from authorized

18. There shall be planning, developing and implementing facility of rainwater harvesting measures on long term basis in consultation with Regional Director, Central Groundwater Board and implementation of conservation measures to augment ground water resources in the area in consultation with Central Ground Water Board.

19. Washing of all transport vehicle should be done inside the mining lease.

Agreed, the project proponent has just mobilized the infrastructure for initiating the mining operations at the site, full fledge operations are yet to start.

20. The Committee viewed that as per existing guidelines regarding depth of mining in River bed will be upto 3m or at least a meter above the water level whichever is less. Similarly, depth of mining shall be 9m in Agricultural land or upto the depth above existing layer of the soil whichever comes first.

21. Implementation of Environment Management Policy of the Company w.r.t. judicious use of Mineral resources for growth & development synchronizing mining & environment with prosperity.

Agreed, the project proponent will Implement the Environment Management Policy of the Company.

22. The illumination and sound at night at project site, disturb the villages in respect of both human and animal population. Consequent sleeping disorders and stress may affect the health in the villages located close to mining operations. Habitations have a right for darkness and minimal noise levels at night. Project Proponent must ensure that the biological clock of the villages is not disturbed; by orienting the floodlights/ masks away from the villagers and keeping the noise levels well within the prescribed limits for day light/night hours.

Agreed, the project proponent has not planned any activity during night time, thus the project will not impact the biological clock of the village.

23. Main haulage road in the mine should be provided with permanent water sprinklers and other roads should be regularly wetted with water tankers fitted with sprinklers.

Agreed, sprinkling is done on areas prone to pollution having high levels of PM such as loading and unloading point and all transfer points. Photographs is attached as Annexure-V

24. The Project Proponent shall ensure that the productivity of agricultural crops is not affected due to mining operations. Crop Liability Insurance Policy has to be taken by the Project Proponent as a precaution to compensate for any crop loss. The impact zone shall be 5km from the boundary of mine lease area for such insurance policy.

25. Transportation of the minerals by road passing through the village shall not be allowed. A 'bypass' road should be constructed (say, leaving a gap of at least 200 meters) for the purpose of transportation of the minerals so that the impact of sound, dust and accidents could be mitigated. The Project Proponent shall bear the cost towards the widening and strengthening of existing public road network in case the same is proposed to be used for the Project. No road movement should be allowed on existing village road network without appropriately increasing the carrying capacity of such roads.

Agreed, a 'bypass' road is constructed (say, leaving a gap of at least 200 meters) for the purpose of transportation of the minerals so that the impact of sound, dust and accidents could be mitigated.

26. Likewise, Alteration or re-routing of foot paths, pagdandies, cart roads, and village infrastructure/public utilities or roads (for purposes of land acquisition for mining) shall be avoided to the extent possible and in case such acquisition is inevitable, alternative arrangements shall be made first and then only the area acquired. In these types of cases, Inspection Reports by site visit by experts may be insisted upon which should be done through reputed Institutes.

27. CSR activities by Companies including the Mining Establishments has become mandatory up to 2% of their financial Turn-over, Socio Economic Development of the neighborhood Habitats could be planned and executed by the Project Proponent more systematically based on the 'Need based door to door survey' by established Social Institutes/Workers. The report shall be submitted to the Ministry of Environment & Forests and its Regional Office located at Chandigarh on six monthly basis.

Agreed. CSR activities will be done by the project proponent, and the details will be submitted when the project operation will start.

28. Provision shall be made for the housing of construction labour within the site with all necessary infrastructure and facilities such as fuel for cooking, mobile toilets, mobile STP, safe drinking water, medical health care, creche etc. The housing may be in the form of temporary structures to be removed after the completion of the project.

The workers are mostly local living in the close proximity of area so there is no requirement of major infrastructure facility at the site. Whereas rest shelter, mobile STP, Mobile toilets drinking water facility, first aid facility, crèche etc are always available for the workers on site.

29. A Final Mine Closure Plan along with details of Corpus Fund shall be submitted to the Ministry of Environment, Forests & Climate Change 5 years in advance of final mine closure for approval

30. Regular monitoring of ambient air quality shall be carried out and records maintained. The results of monitoring shall be submitted to MoEF and its Regional Office and CPCB, SPCB regularly.

Half yearly sampling is done for regular monitoring of ambient air quality standards. Test report is attached at Annexure-VI

31. The project proponent shall undertake adequate safeguard measures during extraction of river bed material and ensure that due to this activity the hydro-geological regime of the surrounding area shall not be affected. Regular monitoring of ground water level and quality shall be carried out around the mine lease area by establishing a network of existing wells and installing new piezometers during the mining operation. The periodic monitoring [(at least four times in a year- pre-monsoon (April-May), monsoon (August), post-monsoon (November) and winter (January); once in each season)] shall be carried out in consultation with the State Ground Water Board/Central Ground Water Authority and the data thus collected may be sent regularly to the Ministry of Environment and Forests and its Regional Office Chandigarh, the Central Ground Water Authority and the Regional Director, Central Ground Water Board. If at any stage, it is observed that the groundwater table is getting depleted due to the mining activity, necessary corrective measures shall be carried out.

As per Condition, it has been emphasized that the project authority should implement suitable conservation measures to augment ground water resources in the area in consultation with the Regional Director, Central Ground Water Board. To fulfill this condition, the project proponent has approached the above department and communicated for consultation vide letter dated 05.04.2017 (Copy enclosed for your ready reference as Annexure - IV).

32. The project proponent shall obtain necessary prior permission of the competent authorities for drawl of requisite quantity of water (surface water and groundwater), if any, required for the project.

Agreed.

33. Appropriate mitigative measures shall be taken to prevent pollution of the river in consultation with the State Pollution Control Board. It shall be ensured that there is no leakage of oil and grease in the river from the vehicles used for transportation.

Agreed, appropriate mitigation measures should be taken to prevent pollution of the river, all the vehicles are in good condition.

34. Vehicular emissions shall be kept under control and regularly monitored. The mineral transportation shall be carried out through the covered trucks only and the vehicles carrying the mineral shall not be overloaded.

Agreed, The material is covered with a tarpaulin sheet during the transportation of the material. Tractor trolley overloading is controlled along with speed limit.

35. No drilling and blasting operation shall be carried out.

Agreed, the mine work will be open cast by manual method only. No drilling and blasting operation will be carried out at mining site.

36. Mineral handling area shall be provided with the adequate number of high efficiency dust extraction system. Loading and unloading areas including all the transfer points should also have efficient dust control arrangements. These should be properly maintained and operated.

Agreed, regular water sprinkling is done in critical areas and all transfer points. Photographs are attached as Annexure V.

37. The project proponent shall take all precautionary measures during mining operation for conservation and protection of endangered fauna found in the study area. Action plan for conservation of flora and fauna shall be prepared in consultation with the State Forest and Wildlife Department. All the safeguard measures brought out in the Wildlife Conservation Plan so prepared specific to this project site shall be effectively implemented.

As per Condition, action plan for conservation of flora and fauna to be implemented. To fulfill this condition, the project proponent has approached the concern department and communicated for consultation vide letter dated 05.04.2017 (Copy enclosed for your ready reference as Annexure -IV)

the same should be forwarded to the Regional

17. The Ministry or any other competent

authority may alter/modify the above

conditions or stipulate any further condition

in the interest of environment protection.

18. Concealing factual data or submission of

false/fabricated data and failure to comply

with any of the conditions mentioned above

may result in withdrawal of this clearance and

attract action under the provisions of

Environment (Protection) Act, 1986.

Sub: Twenty six (26) proposals for Minor Mineral Mining of M/s PSIEC, Chandigarh -Environmental Clearance regarding.

Sir, This is regarding the proposals for mining of sand/gravel (minor minerals)

from various Districts of Punjab namely Patiala, Rupnagar, S.A.S. Nagar, Gurdaspur & Pathankot. The 55 proposals were considered for environmental clearances in 6th EAC meeting held during 16th to 18th April, 2013. The matter

was further examined in the Ministry and it was decided that 26 proposals shall be asked to re-conduct public hearing as per EIA notification and submit the

cumulative impact study report. On submission of the information, the proposals were re-considered in the EAC meeting held during December 16-17, 2013. The proposals were recommended by EAC for grant of EC.

2. As per the Hon’ble Supreme Court order dated 28.10.2013 in the matter

of “Union of India Vs Vijay Bansal & Ors.” [SLP (civil) 729-731 of 2011], the Court has held that the application for EC will be filed by the Project Proponent and not by the State Government. However, during the meeting between the

Minister of Environment & Forests and the Chief Minister of Punjab in June 2014, it was brought out by the State Government that as complete proposals in

respect of all above cases were sent to MoEFCC before the aforesaid Court order i.e. 28.10.2013 and that the State Government intends issuing LOI with respect to these leases to Project Proponents after carrying out auction, MoEF may

consider granting environment clearance to concerned LOI holders on the basis of aforesaid recommendations of EAC so as to obviate the need to going through

the whole EC process again. It was therefore suggested that the State Government may auction the leases and issue LOI to these projects. Thereafter, the EC will be issued to the LOI holder (actual project proponent) after receiving

information about the details of LOI holders from the State Government. The EC will be issued subject to no change in scope of the project profile and mineral

production and with all stipulations for compliance as recommended by EAC. 3. The State Government has submitted the above documents for the 26

proposals. The 26 proposals were presented and discussed by EAC with regard to method of mining, production details, mine plan, baseline data,

transportation, socioeconomic status of the area, major issues raised during public hearing etc.

4. It was reported that in all the proposals, the method of mining would be

semi-mechanised except in proposals where the project lies near the protected areas, manual mining would be done. No drilling & blasting is proposed. Ultimate working depth will be upto 3 m from river bed level. Mining will be done in

layers of 1 m depth to avoid ponding effect and after first layer is excavated, the process will be repeated for the next layers. Approved Mine plan details the

process along with surface plan and as well as working plan including sections. It has also been mentioned to maintain safety and stability of river banks i.e. 3 m or 10% of the width of the river whichever is more will be left intact as no

mining zone. Baseline studies were conducted during March-May, 2011. Ambient Air Quality Parameters were reported to be within permissible limits except for

PM10 at few sites. As reported, the PM10 readings are exceeding the norms because of the wheat harvesting season in which the left over wheat stubble are burnt. All other parameters were found well within the permissible limits. The

socio-economic status of the areas which were gathered both by primary site survey using questionnaires (household as well as village level) and from

Census-2001 were reported. The issues raised during public hearing were discussed and taken on record during EAC meeting. The proposals of less than

50 ha were considered in MOEFCC as these were located within the radius of 10 from protected area/interstate boundary. The amendment to EIA notification dated 25.06.2014 which provides that the General Condition for mining projects

apply at a distance of 5km instead of 10 km from the boundary of the mine lease was notified later. The list of 26 proposals (details annexed) considered

and recommended by EAC during 16-17 December, 2013 is as follows:

6. The Ministry of Environment and Forests has examined the applications in

accordance with the EIA Notification, 2006 and hereby accords environmental clearance under the provisions thereof to the above mentioned Minor Mineral

Mining Projects to M/s Director, Punjab Small Industries & Export Corporation Ltd. Chandigarh of minor minerals (sand, stone and bajri) from the river bed subject to implementation of the following conditions and environmental

safeguards.

A. Specific conditions

i. The Environmental Clearance is valid for a period of 5 years i.e. upto the

period of the approved mine plan. ii. The project proponent shall obtain Consent to Establish and Consent to

Operate from the Punjab Pollution Control Board and effectively implement all the conditions stipulated therein.

iii. Environmental clearance is subject to final order of the Hon'ble Supreme

Court of India in the matter of Goa Foundation Vs. Union of India in Writ Petition (Civil) No. 460 of 2004, as may be applicable to this project.

iv. Environmental clearance to the proposals listed at Para 5 above is subject to obtaining clearance under the Wildlife (Protection) Act, 1972 from the Standing Committee of National Board for Wildlife.

v. To submit annual replenishment report certified by an authorized agency. In case the replenishment is lower than the approved rate of production,

then the mining activity / production levels shall be decreased / stopped accordingly.

vi. To establish a Monitoring Committee including Local Panchayat, to check

on traffic due to transportation and submit an annual report on the same. vii. All the provisions made and restrictions imposed as covered in the Punjab

Minor Mineral Rule, 2013 are to be complied with, particularly regarding Environment Management Practices and its fund management & Payment of compensation to the land owners.

viii. The PP shall make arrangement for drinking water, first aid facility (along with species specific anti-venom provisioning) in case of emergency for

the workers. ix. The cumulative impact of the mining activity is high; therefore the mining

in mines located within one km radius of each other shall be done in a phased manner.

x. It shall be ensured that no mining shall be carried out during the monsoon season.

xi. No mining activities will be allowed in forest area, if any, for which the Forest Clearance is not available.

xii. Project Proponent shall plant native and other local species. xiii. Proponent shall appoint an Occupational Health Specialist for Regular and

Periodical medical examination of the workers engaged in the Project and

records maintained; also, Occupational health check-ups for workers having some ailments like BP, diabetes, habitual smokers, etc. shall be

undertaken once in six months and necessary remedial/preventive measures taken accordingly. Implementation of the Recommendations of National Institute for ensuring good occupational environment for mine

workers; All the old age people of the surrounding villages may be provided medical facilities.

xiv. An independent study be organised during peak activity, to understand how the actuals compare with the carrying capacities and further decisions taken to maintain sustainability of this essential sand extraction and

supply activity. Project Proponent shall ensure that the road may not be damaged due to transportation of the sand; and transport of minerals will

be as per IRC Guidelines with respect to complying with traffic congestion and density.

xv. Implementation of Action Plan on the issues raised during the Public Hearing. The proponent shall complete all the tasks as per the action plan submitted with the budgetary provisions during the Public Hearing. The

major issues raised during Public Hearing were related to effect on the agricultural land due to mining activity, transportation of mineral, effect

on children, students & local people, employment and adoption of control measures to prevent pollution.

xvi. The mining operations shall be restricted to above ground water table and

it should not intersect groundwater table. In case of working below ground water table, prior approval of the Ministry of Environment, Forests &

Climate Change and Central Ground Water Authority shall be obtained, for which a detailed hydro-geological study shall be carried out.

xvii. The pollution due to transportation load on the environment shall be

effectively controlled & water sprinkling shall also be done regularly. Vehicles with PUCC only will be allowed to ply. The mineral transportation

shall be carried out through covered trucks only and the vehicles carrying the mineral shall not be overloaded. Project should obtain ‘PUC’ certificate for all the vehicles from authorized pollution testing centre.

xviii. There shall be planning, developing and implementing facility of rainwater harvesting measures on long term basis in consultation with Regional

Director, Central Groundwater Board and implementation of conservation measures to augment ground water resources in the area in consultation with Central Ground Water Board.

xix. Washing of all transport vehicle should be done inside the mining lease. xx. The Committee viewed that as per existing guidelines regarding depth of

mining in River bed will be upto 3m or at least a meter above the water level whichever is less. Similarly, depth of mining shall be 9m in Agricultural land or upto the depth above existing layer of the soil

whichever comes first.

xxi. Implementation of Environment Management Policy of the Company w.r.t. judicious use of Mineral resources for growth & development

synchronizing mining & environment with prosperity. xxii. The illumination and sound at night at project site, disturb the villages in

respect of both human and animal population. Consequent sleeping disorders and stress may affect the health in the villages located close to mining operations. Habitations have a right for darkness and minimal

noise levels at night. Project Proponent must ensure that the biological clock of the villages is not disturbed; by orienting the floodlights/ masks

away from the villagers and keeping the noise levels well within the prescribed limits for day light/night hours.

xxiii. Main haulage road in the mine should be provided with permanent water

sprinklers and other roads should be regularly wetted with water tankers fitted with sprinklers.

xxiv. The Project Proponent shall ensure that the productivity of agricultural crops is not affected due to mining operations. Crop Liability Insurance Policy has to be taken by the Project Proponent as a precaution to

compensate for any crop loss. The impact zone shall be 5km from the boundary of mine lease area for such insurance policy.

xxv. Transportation of the minerals by road passing through the village shall not be allowed. A ‘bypass’ road should be constructed (say, leaving a gap

of at least 200 meters) for the purpose of transportation of the minerals so that the impact of sound, dust and accidents could be mitigated. The Project Proponent shall bear the cost towards the widening and

strengthening of existing public road network in case the same is proposed to be used for the Project. No road movement should be allowed

on existing village road network without appropriately increasing the carrying capacity of such roads.

xxvi. Likewise, Alteration or re-routing of foot paths, pagdandies, cart roads,

and village infrastructure/public utilities or roads (for purposes of land acquisition for mining) shall be avoided to the extent possible and in case

such acquisition is inevitable, alternative arrangements shall be made first and then only the area acquired. In these types of cases, Inspection Reports by site visit by experts may be insisted upon which should be

done through reputed Institutes. xxvii. CSR activities by Companies including the Mining Establishments has

become mandatory up to 2% of their financial Turn-over, Socio Economic Development of the neighborhood Habitats could be planned and executed by the Project Proponent more systematically based on the ‘Need based

door to door survey’ by established Social Institutes/Workers. The report shall be submitted to the Ministry of Environment & Forests and its

Regional Office located at Chandigarh on six monthly basis. xxviii. Provision shall be made for the housing of construction labour within the

site with all necessary infrastructure and facilities such as fuel for cooking,

mobile toilets, mobile STP, safe drinking water, medical health care, crèche etc. The housing may be in the form of temporary structures to be

removed after the completion of the project. xxix. A Final Mine Closure Plan along with details of Corpus Fund shall be

submitted to the Ministry of Environment, Forests & Climate Change 5

xxx. Regular monitoring of ambient air quality shall be carried out and records maintained. The results of monitoring shall be submitted to MoEF and its

Regional Office and CPCB, SPCB regularly. xxxi. The project proponent shall undertake adequate safeguard measures

during extraction of river bed material and ensure that due to this activity the hydro-geological regime of the surrounding area shall not be affected. Regular monitoring of ground water level and quality shall be carried out

around the mine lease area by establishing a network of existing wells and installing new piezometers during the mining operation. The periodic

monitoring [(at least four times in a year- pre-monsoon (April-May), monsoon (August), post-monsoon (November) and winter (January); once in each season)] shall be carried out in consultation with the State Ground

Water Board/Central Ground Water Authority and the data thus collected may be sent regularly to the Ministry of Environment and Forests and its

Regional Office Chandigarh, the Central Ground Water Authority and the Regional Director, Central Ground Water Board. If at any stage, it is observed that the groundwater table is getting depleted due to the mining

activity, necessary corrective measures shall be carried out. xxxii. The project proponent shall obtain necessary prior permission of the

competent authorities for drawl of requisite quantity of water (surface water and groundwater), if any, required for the project.

xxxiii. Appropriate mitigative measures shall be taken to prevent pollution of the river in consultation with the State Pollution Control Board. It shall be ensured that there is no leakage of oil and grease in the river from the

vehicles used for transportation. xxxiv. Vehicular emissions shall be kept under control and regularly monitored.

The mineral transportation shall be carried out through the covered trucks only and the vehicles carrying the mineral shall not be overloaded.

xxxv. No drilling and blasting operation shall be carried out.

xxxvi. Mineral handling area shall be provided with the adequate number of high efficiency dust extraction system. Loading and unloading areas including

all the transfer points should also have efficient dust control arrangements. These should be properly maintained and operated.

xxxvii. The project proponent shall take all precautionary measures during mining

operation for conservation and protection of endangered fauna found in the study area. Action plan for conservation of flora and fauna shall be

prepared in consultation with the State Forest and Wildlife Department. All the safeguard measures brought out in the Wildlife Conservation Plan so prepared specific to this project site shall be effectively implemented.

Necessary allocation of funds for implementation of the conservation plan shall be made and the funds so allocated shall be included in the project

cost. A copy of action plan shall be submitted to the Regional Office of the Ministry of Environment and Forests, Chandigarh.

B. General conditions

(i) No change in mining technology and scope of working should be made without prior approval of the Ministry of Environment & Forests.

(ii) No change in the calendar plan including excavation, quantum of mineral

Sand, Gravel, Boulders (minor mineral) and waste should be made. (iii) Four ambient air quality-monitoring stations should be established in the

core zone as well as in the buffer zone for RSPM (Particulate matter with

size less than 10micron i.e., PM10) and NOx monitoring. Location of the stations should be decided based on the meteorological data,

topographical features and environmentally and ecologically sensitive targets and frequency of monitoring should be undertaken in consultation

with the State Pollution Control Board. (iv) Data on ambient air quality RSPM (Particulate matter with size less than

10micron i.e., PM10) & NOx should be regularly submitted to the Ministry

of Environment and Forests including its Regional office located at Chandigarh and the State Pollution Control Board / Central Pollution

Control Board once in six months. (v) Fugitive dust emissions from all the sources should be controlled

regularly. Water spraying arrangement on haul roads, loading and

unloading and at transfer points should be provided and properly maintained.

(vi) Personnel working in dusty areas should wear protective respiratory devices and they should also be provided with adequate training and information on safety and health aspects.

(vii) Occupational health surveillance program of the workers should be undertaken periodically to observe any contractions due to exposure to

dust and take corrective measures, if needed. (viii) A separate environmental management cell with suitable qualified

personnel should be set-up under the control of a Senior Executive, who will report directly to the Head of the Organization.

(ix) The funds earmarked for environmental protection measures should be

kept in separate account and should not be diverted for other purpose. Year wise expenditure should be reported to the Ministry of Environment

and Forests and its Regional Office located at Chandigarh. (x) The project authorities should inform to the Regional Office located at

Chandigarh regarding date of financial closures and final approval of the

project by the concerned authorities and the date of start of land development work.

(xi) The Regional Office of this Ministry located at Chandigarh shall monitor compliance of the stipulated conditions. The project authorities should extend full cooperation to the officer (s) of the Regional Office by

furnishing the requisite data / information / monitoring reports. (xii) The project proponent shall submit six monthly reports on the status of

compliance of the stipulated environmental clearance conditions including results of monitored data (both in hard copies as well as by e-mail) to the Ministry of Environment and Forests, its Regional Office Chandigarh, the

respective Zonal Office of Central Pollution Control Board the State Pollution Control Board. The proponent shall upload the status of

compliance of the environmental clearance conditions, including results of monitored data on their website and shall update the same periodically. It shall simultaneously be sent to the Regional Office of the Ministry of

Environment and Forests, Chandigarh, the respective Zonal Office of Central Pollution Control Board and the State Pollution Control Board.

(xiii) A copy of the clearance letter shall be sent by the proponent to concerned Panchayat, Zila Parisad / Municipal Corporation, Urban Local Body and the Local NGO, if any, from whom suggestions/ representations, if any, were

received while processing the proposal. The clearance letter shall also be put on the website of the Company by the proponent.

(xiv) The State Pollution Control Board should display a copy of the clearance letter at the Regional office, District Industry Centre and the Collector's

office/ Tehsildar's Office for 30 days. (xv) The environmental statement for each financial year ending 31st March in

Form-V as is mandated to be submitted by the project proponent to the concerned State Pollution Control Board as prescribed under the Environment (Protection) Rules, 1986, as amended subsequently, shall

also be put on the website of the company along with the status of compliance of environmental clearance conditions and shall also be sent to

the Regional Office of the Ministry of Environment and Forests, Chandigarh by e-mail.

(xvi) The project authorities should advertise at least in two local newspapers

widely circulated, one of which shall be in the vernacular language of the locality concerned, within 7 days of the issue of the clearance letter

informing that the project has been accorded environmental clearance and a copy of the clearance letter is available with the State Pollution Control Board and also at web site of the Ministry of Environment and Forests at

http://envfor.nic.in and a copy of the same should be forwarded to the Regional Office of this Ministry located at Chandigarh.

7. The Ministry or any other competent authority may alter/modify the above

conditions or stipulate any further condition in the interest of environment protection.

8. Concealing factual data or submission of false/fabricated data and failure to comply with any of the conditions mentioned above may result in

withdrawal of this clearance and attract action under the provisions of Environment (Protection) Act, 1986.

9. The above conditions will be enforced inter-alia, under the provisions of the Water (Prevention & Control of Pollution) Act, 1974, the Air

(Prevention & Control of Pollution) Act, 1981, the Environment (Protection) Act, 1986 and the Public Liability Insurance Act, 1991 along with their amendments and rules made thereunder and also any other

orders passed by the Hon'ble Supreme Court of India/High Court of Punjab and any other Court of Law relating to the subject matter.

10. Any appeal against this environmental clearance shall lie with the National

Green Tribunal, if preferred, within a period of 30 days as prescribed

under Section 16 of the National Green Tribunal Act, 2010.

Annexure

1. River Bed Mining of Sand from River Ghaggar, located in

Village Rajgarh, Tehsil Rajpura, District Patiala, Punjab (11.73 ha).

The proposal is for environmental clearance for Tepla Sand Mining Project from the

bed of River Ghaggar in Village Rajgarh, Tehsil Rajpura, District Patiala, Punjab for a

production of 2.52 lakh TPA. The mine lease area is of 11.73 ha. The proposed mining

area is reported lying between Latitude - 30° 24' 54.44” to 300 25’ 27.38’’ N and

Longitude - 76° 44’ 05.76” to 76° 44' 25.40" E in topo sheet No. 53 B/11. An Interstate

Boundary between Punjab and Haryana lies within 10km radius of the mine lease area.

No forestland is involved. There is no Protected Forest within 10 km radius from mine

lease boundary. It was reported by the project proponent that there is no National

Park/Wildlife Sanctuary within 10 km from the boundary of the mine lease. The mine

working will be opencast by semi-mechanized method without involving drilling and

blasting. Ultimate working depth will be upto 3 m from river bed level. Mining will be

done in layers of 1 m depth to avoid ponding effect and after first layer is excavated, the

process will be repeated for the next layers. The ground water level is reported to be 4-

6 m below ground level. In order to maintain safety and stability of river banks 3 m or

10% of the width of the river whichever is more will be left intact as no mining zone.

Water requirement will be 0.78 KLD which will be sourced from nearby village, NOC from

the Gram Panchayat has been procured for the utilization of water from the village

Rajgarh. It was reported by the project proponent that there is no court case pending

against the project. Cost of the project is Rs.75 lakh and EMP cost is Rs 5.1 lakhs per

annum. The terms of reference for the project were issued by MoEF [Ref No.: J-

11015/41/2010-IA.II(M)] on 4.03.2011. Draft EIA/EMP report was prepared by

complying the TOR points. Baseline studies were conducted during March-May, 2011.

Ambient Air Quality Parameters were reported to be within permissible limits except for

PM10. The PM10 readings are exceeding the norms because of the wheat harvesting

season in which the left over wheat stubble are burnt, this entrainment in higher PM10

value is a temporary phase. Sediment budget calculation was done by using Dandy-

Bolton Equation, in which the entire catchment area of the river was considered to

calculate the annual replenishment rate. The proponent has also submitted the Approved

Mine Plan which was approved by State Geologist, Director of Industries, Punjab vide

letter number 22729-ghi dated 28-12-2012. The Public hearing was held on 09.09.2013

at village Rajgarh, Patiala by Punjab Pollution Control Board chaired by Ms. Anindita

Mitra (ADC), Patiala. Major issues raised by the Public were regarding, start of mining in

the area, maintenance of road etc. The objections and suggestions raised by the

participants were taken on record and responded by the PP.

2. River Bed Mining of Sand from River Ghaggar, located in

Village Nanheri, Tehsil Rajpura, District Patiala, Punjab (11.28 ha).

The proposal is for environmental clearance for Tepla Sand Mining Project from the

bed of River Ghaggar in Village Nanheri, Tehsil Rajpura, District Patiala, Punjab for a

Boundary between Punjab and Haryana lies within 10km radius of the mine lease area.

No forestland is involved. There is no Protected Forest within 10 km radius from mine

lease boundary. It was reported by the project proponent that there is no National

Park/Wildlife Sanctuary within 10 km from the boundary of the mine lease. The mine

11015/44/2010-IA.II(M)] on 4.03.2011. Draft EIA/EMP report was prepared by

complying the TOR points. Baseline studies were conducted during March-May, 2011.

Ambient Air Quality Parameters were reported to be within permissible limits except for

PM10. The PM10 readings are exceeding the norms because of the wheat harvesting

season in which the left over wheat stubble are burnt, this entrainment in higher PM10

value is a temporary phase. Sediment budget calculation was done by using Dandy-

Bolton Equation, in which the entire catchment area of the river was considered to

calculate the annual replenishment rate. The proponent has also submitted the Approved

Mine Plan which was approved by State Geologist, Director of Industries, Punjab vide

The proposal is for environmental clearance for Chak Ram Sahai Sand Mining Project

from the bed of River Ravi in Village Chak Ram Sahai, Tehsil Gurdaspur, District

Gurdaspur, Punjab for the production of 1.7 lakhs TPA. The mine lease area is 19.20 ha.

The proposed mining area is reported lying between Latitude - 320 11’ 5.23’’ to 32°11'

15.51" N and Longitude - 750 21’ 46.06” to 75° 22' 21.37" E in topo sheet No. 43P/8. An

international boundary between India and Pakistan lies within 10km radius of the mine

lease area. No forestland is involved. There is no Protected Forest within 10 km radius

from mine lease boundary. It was reported by the project proponent that Kathlaur

Kaushlian Wildlife Sanctuary lies within buffer zone of the mine at a distance of 9.5 km

in North West direction. Mine working will be semi-mechanized. However, no drilling &

blasting is proposed. Ultimate working depth will be upto 3 m from river bed level.

Mining will be done in layers of 1 m depth to avoid ponding effect and after first layer is

excavated, the process will be repeated for the next layers. The ground water level is

reported to be 5-7 m below ground level. In order to maintain safety and stability of

river banks 3 m or 10% of the width of the river whichever is more will be left intact as

no mining zone. Water requirement will be 1.06 KLD which will be sourced from nearby

villages; NOC from the Gram Panchayat has been procured for the utilization of water

from the village Chak Ram Sahai. It was reported by the project proponent that there is

no court case pending against the project. Cost of the project is Rs.20 Lakhs and EMP

cost is Rs 5.1 lakhs per annum. The terms of reference for the project were issued by

SEAC-Punjab (Reference No. SEAC/11223-30) dated 4/3/2010. Draft EIA/EMP report

was prepared by complying the TOR points. Baseline studies were conducted during

March-May, 2011. Ambient Air Quality Parameters were reported to be within

permissible limits except for PM10. The PM10 readings are exceeding the norms because

of the wheat harvesting season in which the left over wheat stubble are burnt, this

Village Tiwana, Tehsil Dera Bassi, District SAS Nagar, Punjab (17.97 ha).

The proposal is for environmental clearance for Tiwana Sand Mining Project from the

bed of River Ghaggar in Village Tiwana, Tehsil Dera Bassi, District SAS Nagar, Punjab for

the production of 8,170 TPA. The mine lease area is of 17.97 ha. The proposed mining

area is reported lying between Latitude - 30°27'41.83"N to 30°28'1.89"N and Longitude

- 76°44'50.48"E to 76°45'26.67"E in topo sheet No. 43K/11 and 43K/15. An Interstate

Boundary between Punjab and Haryana lies within 10 km radius of the mine lease area.

No forestland is involved. Bir Bagarpura Protected Forest lies within 10 km radius from

mine lease boundary. It was reported by the project proponent that there is no National

Park/Wildlife Sanctuary within 10 km from the boundary of the mine lease. Mine

working will be manual. No drilling & blasting is proposed. Ultimate working depth will be

upto 3 m from river bed level. Mining will be done in layers of 1 m depth to avoid

ponding effect and after first layer is excavated, the process will be repeated for the next

layers. The ground water level is reported to be 7 - 9 m below ground level. In order to

maintain safety and stability of river banks 3 m or 10% of the width of the river

whichever is more will be left intact as no mining zone. Water requirement will be 0.83

KLD which will be sourced from nearby village, NOC from the Gram Panchayat has been

procured for the utilization of water from the village Tiwana. It was reported by the

project proponent that there is no court case pending against the project. Cost of the

project is Rs.10.2 Lakhs and EMP cost is Rs 5.1 lakhs per annum. The terms of reference

for the project were issued by MoEF [Ref No.: J-11015/148/2010-IA.II(M)] on

28.02.2010. Draft EIA/EMP report was prepared by complying the TOR points. Baseline

studies were conducted during March-May, 2011. Ambient Air Quality Parameters were

reported to be within permissible limits except for PM10. The PM10 readings at one site is

exceeding the norms because of the wheat harvesting season in which the left over

wheat stubble are burnt, this entrainment in higher PM10 value is a temporary phase.

Sediment budget calculation was done by using Dandy-Bolton Equation, in which the

entire catchment area of the river was considered to calculate the annual replenishment

rate. The proponent has also submitted the Approved Mine Plan which was approved by

State Geologist, Director of Industries, Punjab vide letter number 22737-ghi dated 28-

12-2012. The Public hearing was held on 09.09.2013 at village Tiwana, SAS Nagar by

Punjab Pollution Control Board chaired by Sh. Puneet Goyal (ADC), SAS Nagar. Major

issues raised by the Public were regarding, compensation to be paid to the land owners,

bank protection, maintenance of road etc. The objections and suggestions raised by the

participants were taken on record and responded by the PP. Cumulative study report,

taking into consideration the traffic scenario along with level of service of the road as per

IRC and fugitive dust emission has been submitted by the proponent.

5. River Bed Mining of Sand from River Ghaggar, located in

Village Sarangpur, Tehsil Dera Bassi, District SAS Nagar, Punjab (29.30 ha).

The proposal is for environmental clearance for Sarangpur Sand Mining Project from

the bed of River Ghaggar in Village Sarangpur, Tehsil Dera Bassi, District SAS Nagar,

Punjab for the production of 44,000 TPA. The mine lease area is of 29.30 ha. The

proposed mining area is reported lying between Latitude - 30°24'18.77"N to

30°24'55.57"N and Longitude - 76°54'15.44"E to 76°54'45.81"E in topo sheet No.

43A/15. An Interstate Boundary between Punjab and Haryana lies within 10km radius of

mine lease area. No forestland is involved. There is no Protected Forest within 10 km

radius from mine lease boundary. It was reported by the project proponent that there is

no National Park/Wldlife Sanctuary/Elephant Reserve within 10 km from the boundary of

the mine lease. Mine working will be manual. Ultimate working depth will be upto 3 m

from river bed level. Mining will be done in layers of 1 m depth to avoid ponding effect

6. River Bed Mining of Sand from River Ghaggar, located in

Village Bahourhi, Tehsil Dera Bassi, District SAS Nagar, Punjab (42.91 ha).

The proposal is for environmental clearance for Bahourhi Sand Mining Project from

the bed of River Ghaggar in Village Bahourhi, Tehsil Dera Bassi, District SAS Nagar,

Punjab for the production of 1,28,877 TPA. The mine lease area is 42.91 ha. The

proposed mining area is reported lying between Latitude - 30°34'5.54"N to

30°34'56.44"N and Longitude - 76°46'29.99"E to 76°46'32.92"E in topo sheet No.

43K/14. An Interstate Boundary between Punjab and Haryana lies within 10km radius of

the mine lease area. No forestland is involved. Bir Bagarpura, Bir Baraul, Bir Dadrala

and Bir Kheri Protected Forest lies within 10 km radius from mine lease boundary. It was

reported by the project proponent that there is no National Park/Wildlife Sanctuary

within 10 km from the boundary of the mine lease. Mine working will be semi-

Punjab for a production of 1.76 Lakhs TPA. The mine lease area is 105.22 ha. The

proposed mining area is reported lying between Latitude - 31°16'29.33"N and Longitude

- 76°24'37.88"E in topo sheet No. 53A/7. An Interstate Boundary between Punjab and

Himachal Pradesh lies within 10 km radius of the mine lease area. No forestland is

involved. There is Katarthar Protected Forest within 10 km radius from mine lease

boundary. It was reported by the project proponent that Jhajjar Bachauli Wildlife

Sanctuary lies within buffer zone of the mine at a distance of 9.5 km in East direction.

The mine working will be opencast by semi-mechanized method without involving drilling

No. SEAC/11223-30) dated 4/3/2010. Draft EIA/EMP report was prepared by complying

the TOR points. Baseline studies were conducted during March-May, 2011. Ambient Air

Quality Parameters were reported to be within permissible limits. Sediment budget

calculation was done by using Dandy-Bolton Equation, in which the entire catchment

area of the river was considered to calculate the annual replenishment rate. The Public

hearing was held on 02.04.2012 at Village Talwara Gujran, Pathankot by Punjab

Pollution Control Board chaired by Smt. Sarojini Gautam Sharda, Additional Deputy

Commissioner, Pathankot. Major issues raised by the Public were regarding, villagers

employment, dust pollution, bank protection, maintenance of road etc. The objections

and suggestions raised by the participants were taken on record and responded by the

PP. The proponent has also submitted the Approved Mine Plan which was approved by

State Geologist, Director of Industries, Punjab vide letter number 1485-A dated 01-02-

2013. Cumulative study report, taking into consideration the traffic scenario along with

level of service of the road as per IRC and fugitive dust emission has been submitted by

the proponent.

25. River Bed Mining of Sand/gravel from River Ravi, located in

Village Shehar, Tehsil Pathankot, District Pathankot, Punjab (9.8 ha).

The proposal is for environmental clearance for Shehar sand/gravel mining project

from the bed of River Ravi in Village Shehar, Tehsil Pathankot, District Pathankot, Punjab

for the production of 1 Lakh TPA. The mine lease area is of 9.8 ha. The proposed mining

area is reported lying between Latitude - 32°20’ 39.45’’ to 32°20'54.44"N and Longitude

- 75°33’24.61’’ to 75°33'39.43"E in topo sheet No. 43P/7 & 43P/11. An Interstate

Boundary between Punjab and Jammu & Kashmir lie within 10 Km radius of the mine

lease area. No forestland is involved. Dhanor Reserved Forest lies within 10 Km radius

from mine lease boundary. It was reported by the project proponent that there is no

National Park/Wildlife Sanctuary within 10 km from the boundary of the mine lease.

Mine working will be semi-mechanized. However, no drilling & blasting is proposed.

Ultimate working depth will be upto 3 m from river bed level. Mining will be done in

layers of 1 m depth to avoid ponding effect and after first layer is excavated, the process

will be repeated for the next layers. The ground water level is reported to be 5 - 7 m

below ground level. In order to maintain safety and stability of river banks 3 m or 10%

of the width of the river whichever is more will be left intact as no mining zone. Water

annual replenishment rate. The Public hearing was held on 21.03.2012 at Village Shehar,

Pathankot by Punjab Pollution Control Board chaired by Smt. Sarojini Gautam Sharda,

Additional Deputy Commissioner, Pathankot. Major issues raised by the Public were

regarding, villagers employment, dust pollution, bank protection, maintenance of road

A meeting of the Expert Committee for declaration of Eco-Sensitive Zones around

Wildlife Sanctuaries/ National Parks was held in the Ministry on 31st May, 2016 in the

Ministry of Environment, Forest & Climate Change, Indira Parayavaran Bhawan, New Delhi,

under the Chairpersonship of Dr. Amita Prasad, Additional Secretary. The list of participants

is annexed. The following thirty one (31) proposals were considered for finalising the draft

Eco-Sensitive Zone (ESZ) notifications:

No comments were received from public/stakeholders. The Expert Committee stated

that the minimum extent of ESZ should be mentioned. The Committee recommended that

the proposal be revised and sent to Ministry along with detailed justification of the ESZ area

and extent being finalised by the State Government.

3.23 Eco-sensitive Zone around Bandli WLS, Himachal Pradesh

Bandli Wildlife Sanctuary is situated in Mandi district, Himachal Pradesh is spread

over an area of 32.11 sq km. The sanctuary supports rich biological diversity of flora and

fauna. This inckudes rare and endangered species such as the leopard, Leopard Cat, Jungle

Cat, Goral, Himalayan Civet, Himalayan Yellow Throated Marten, Black Bear, Porcupine,

Flying Squirrel, Barking Deer, etc

Shri P. L. Chauhan, CCF (WL), Govt. of Himachal Pradesh apprised the committee

about the proposal. The draft notification was published on July 17, 2015. The salient

features are as follows:

Area of PA : 32.11 sq. kms

Proposed ESZ area : 1.68 sq kms

Proposed Extent : Up to 50 meters

Generic comments received from Shri Debi Goenka, Conservation Action Trust,

Mumbai were discussed during the meeting. After the presentation, Expert Committee

suggested that the proposal may be re-visited and revised.

3.24 Eco-sensitive Zone around Jhajjar Bachauli WLS, Punjab

Jhajjar-Bachauli Wildlife Sanctuary is situated in Rupnagar District, Punjab and

spread over an area of 1.16 square kilometres. The sanctuary supports a number of wild

species such as Sambhar deer, Barking Deer, Python, Cobra, Red Jungle Fowl etc.

Shri Dhirendra Singh, APCCF & CWLW, Govt. of Punjab apprised the committee

about the proposal. The draft notification was published on November 17, 2015. The salient

features are as follows:

Area of PA : 1.16 sq. km

Proposed ESZ area : 0.65 sq km

Proposed Extent : Up to 100 meters

No comments have been received from public/stakeholders. The Committee

suggested that Shivalik Forest Range may be mentioned in the notification. Location map

may be provided. The Committee after deliberations recommended finalisation of the draft

notification subject to furnishing the aforesaid details.

3.25 Eco-sensitive Zone around Harike Lake WLS, Punjab

Harike Wildlife Sanctuary of an area of 86 square kilometres is the largest wetland in

northern India. This wetland-cum-wildlife sanctuary is located about 55 kilometres from

Amritsar city, that falls in District Tarn Taran, Ferozepur and Kapurthala This Sanctuary was

also accorded the status of a Ramsar Site in 1990 under the Ramsar Convention. The

protected area is mostly a water based area with 14 aquatic taxa, 24 terrestrial species. The

main water based plant species include Najas, Hydrilla, Ipomoea, Azolla sp., Potamegeton,

Vallisneria, etc. The area is also known to support 16 taxa (72 species) of fish, 6 taxa of

frogs and toads, 7 species of turtles (including International Union for Conservation of Nature

Testudines turtles), 13 species of mammals (including smooth Indian Otter and Indus River

Dolphin), 391 species (59 percent migratory) of birds and 4 species of snakes.

about the proposal. The draft notification was published on November 17, 2015. The salient

features are as follows:

Area of PA : 86 sq. kms

Proposed ESZ area : 393.44 hectares

Proposed Extent : 100 meters

the State Government informed during the presentation that Harike Lake is the backwater of

a river. The Committee after deliberations recommended for finalisation of draft notification.
