We understand and accept that:

1. The Strategic Investment Service (“SIS”) is an independent service, offered by acsis limited (“acsis”), which provides a range of independent investment vehicles and investment strategies. These are registered and regulated by the relevant authorities and offered by acsis as an integral part of lifestyle financial planning.

2. acsis is registered as a Financial Services Provider in terms of section 8 of the Financial Advisory and Intermediary Services Act 37 of 2002 (License No 26/10/588).

3. The SIS Endowment and SIS Living Annuity are Long-term insurance policies, issued and underwritten by BoE Life Limited, in terms of the Long-term Insurance Act, No. 52 of 1998.

4. The SIS Retirement Annuity Fund is registered by the Registrar of Pension Funds (number 12/8/37162/1) and SARS (number 18/20/4/41382).

5. The SIS Preservation Pension Fund is registered by the Registrar of Pension Funds (number 12/8/37160/1) and SARS (number 18/20/4/41437).

6. The SIS Preservation Provident Fund is registered by the Registrar of Pension Funds (number 12/8/37161/1) and SARS (number 18/20/4/41460).

7. BoE IA acts as administrator only to the Long-term insurance policies and retirement funds detailed above. The principal is BoE Life Limited or the relevant retirement fund.

8. The SIS investment strategies are registered collective investment scheme portfolios under the Collective Investment Schemes Control Act No. 45 of 2002, managed by Strategic Investment Service Management Company Limited (a member of the ACI). Values of participatory interests within collective investment scheme portfolios fluctuate relative to the market values of the underlying securities comprising the portfolio. Standard Bank Limited is the registered trustee of the scheme.

9. Tailored Portfolio Only: I/We hereby appoint Old Mutual Investment Administrators (Pty) Ltd, t/a BoE Investment Administrators (“BoE IA” or “the administrator”), an administrative Linked Investment Services Provider, licensed as such by the Registrar of Financial Services Providers in terms of section 8 of the Financial Advisory and Intermediary Services Act, No 37 of 2002 (“the Act”), or its assignees to administer the investments, as selected by me/us on this application form (“my/our investments”). BoE IA has established the nominee company, BoE Link Nominees (Pty) Ltd, as the custodian of my/our investments. BoE Link Nominees (Pty) Ltd shall be the registered holder of my/our investments. This mandate may be terminated by either party by forty eight hours written notice and the administrator will either pay the funds comprising my/our investment to me/us, or register my/our investments in my name (subject to the terms and conditions of the relevant manager) within fourteen days of the expiry of the said notice period, provided that the administrator has received the applicable investment funds from the relevant investment provider.

10. Tailored Portfolio Only: The minimum regular monthly withdrawal that may be requested is R500. The maximum regular monthly withdrawal that may be requested is 20% of the initial investment value. For all percentage withdrawal payments, payment will be based on the current market value of the investment on the date of withdrawal. If the requested monetary value of a withdrawal exceeds the current market value of the investment at the date of withdrawal, the current market value of the investment will be paid out in full.

11. I/We hereby authorise acsis and/or the administrator to invest the investment amount into the investment strategy chosen by me/us from time to time. The administrator shall reinvest all income and accruals, including cash and interest, arising from my investments from time to time (distributions currently take place at the end of March and September) and the administrator shall thereafter manage such reinvested income and accruals, which shall be regarded as forming part of my/our investments.

12. Endowment Only: The initial term of this investment is 5 years. The Long Term Insurance Act restricts the investor to a maximum of one loan and one disinvestment during the first five-year period of a policy. The amount due in respect of such loan or disinvestment will be deducted from the investment value due to the investor or any beneficiary prior to any payment of policy benefits by the administrator.

13. Endowment Only: A loan or disinvestment will only be permitted in respect of a policy that has been ceded, if the administrator has received the prior written consent of the cessionary, to such loan or disinvestment.

14. Endowment Only: I/we acknowledge that I am/we are aware that I/we have the right to withdraw from this investment contract within 30 days of receipt of my policy document, which right shall be exercised by giving written notice to acsis. The administrator may deduct the cost of benefits and investment losses incurred until the

date of the refund from the investment amount refunded. This option is not available where during the 30-day period, the investor has switched from the funds originally invested in or any benefit has been paid or claimed.

15. Living Annuity Only: I understand and accept: • that the investment will increase or decrease in line with market

fluctuations • the risk associated with living annuities as compared to

conventional annuities, particularly in the light of my personal risk profile

• the impact that a downturn in the market will have on my income and that capital may be eroded in order to maintain the required level of income

• the income restrictions imposed by the Commissioner of SARS in circular RF 1/96, particularly that income levels may only be varied annually on the income anniversary date

• that the SIS Living Annuity is not subject to the 30 day cooling off period.

16. Living Annuity Only: I have taken note of the following: • Where the SIS Living Annuity is your only source of income and

you require a pre-tax annuity of greater than inflation plus 1-3%, based on the capital available to purchase the annuity, you should in consultation with your Financial Planner consider a different type of annuity.

• It is important that you, in conjunction with your Financial Planner, review your lifestyle objectives and income requirements at least annually.

• In terms of directive 135 issued by the Financial Services Board, you have the right to transfer your SIS Living Annuity to another insurer.

17. Living Annuity Only: I have taken note of the following tax consequences: • Annuities are taxed at the annuitant’s marginal rate of tax. • In terms of current legislation, the investment returns generated

by the SIS Living Annuity are not subject to tax. • On death of the annuitant: Where applicable, should a beneficiary

elect to take the remaining capital as a lump sum within 6 months of the death of the annuitant, the lump sum will be taxed at the annuitant ’s average rate of tax. The lump sum may also be subject to Estate Duty.

18. Living Annuity Only: The investor will be obliged to draw an income of between 2.5% and 17.5% of the investment value per annum at the anniversary date. These minimum and/or maximum income percentages are subject to review by SARS from time to time and, should SARS change the minimum and/or maximum income percentages, the investor’s chosen percentage may be amended automatically to ensure continuous compliance with the applicable percentages. Income will be generated by the repurchasing of the underlying investments or from the income generated on the underlying investments. Annuity income for investments received by the administrator on or before the 14th of the month will be paid at the end of that month. Annuity income for investments received after the 14th of the month will only be paid at the end of the following month. Income tax, if applicable, will be deducted at source in accordance with the relevant tax rates determined by SARS. The onus is on the investor to provide tax directives where applicable. All annuity payments, elected as a percentage, will be calculated on the initial net investment amount for the duration of the first year of investment.

19. Living Annuity Only: I declare that the origination of the investment amount is an approved retirement fund. I warrant that the rules of the transferring fund allow me to purchase an annuity in my own name and for my benefit and that the benefits offered in terms of this product coincide with the benefits in terms of my transferring fund.

20. SIS Preservation Funds Only: I understand that the amount that is available to me on withdrawal prior to retirement from the Preservation Fund may be restricted in terms of conditions imposed by the transferring fund, and that these conditions, if any, and SARS Practice note RF1/98 have been explained to me. In particular, I understand that, subject to any restrictions from the transferring fund and SARS Practice Note RF1/98, I may not make more than one withdrawal prior to retirement from the Preservation Fund. Any remaining benefits will only be payable on my retirement or death.

21. SIS Retirement Annuity Only: If not already a member and where appropriate, I hereby apply for membership of the SIS Retirement Annuity Fund. I agree to be bound by the rules of the Fund and the conditions of the contract (both as amended from time to time). I understand that in terms of these conditions, amongst other things: • I cannot withdraw, apply for a loan or use my investment contract

as collateral security for a loan; 22. unless a written instruction indicating an earlier retirement is

received, retirement date is the first anniversary month of commencement of membership of the Fund, after attainment of 69

years of age, provided that such age shall not be earlier than the member ’s 55th birthday (unless retiring due to ill health or permanent disability).

23. SIS Retirement Annuity Only: In the event that the contribution payable in terms of this application is a lump sum transfer from another approved fund, I hereby authorise and instruct the transferring fund to pay such an amount into the Fund with immediate effect.

24. SIS Preservation Funds and Retirement Annuity Only: I understand and accept that: • This investment may not be ceded, assigned or pledged and is

subject to section 37A and B of the Pension Funds Act No.24 of 1956.

• Taxes will be levied on the investment in accordance with the South African Revenue Services’ relevant tax rules and rates, which may change from time to time.

• The administrator shall pay amounts to my dependants and/or beneficiaries upon my death in accordance with section 37C of the Pension Funds Act No.24 of 1956.

• The board may, at its sole discretion, transfer my fund benefit to an appropriate investment strategy to ensure compliance with Regulation 28 of the Pension Funds Act No.24 of 1956 and/or any other regulatory obligation and/or fiduciary duty of the board.

25. Investments into the selected underlying investment strategies will be made within seven working days (excluding Saturdays, Sundays and public holidays) after receipt of a fully completed application form and any other standard requirements, as determined from time to time, and the investment amount by the administrator. Debit orders will be invested within six working days, after receipt of a valid instruction by the administrator. Switches will be processed within three working days, after receipt of a valid instruction by the administrator, unless otherwise advised at the time.

26. Neither the administrator nor acsis nor any of the retirement funds/long-term policies/insurer/SIS investment strategies detailed above provides any guarantees whatsoever in relation to investment performance. I/We accept that I/we carry the full investment risk and I am/we are required to meet any accrued tax liability. Provided that acsis and/or the administrator and/or any of their officers, employees or agents exercise reasonable care and diligence in the management of my/our investments, acsis and/or the administrator and/or any of their officers employees or agents shall not be liable to me/us or any third party for any loss sustained by me/us in terms of this agreement.

27. Neither acsis nor the administrator nor (where applicable) the relevant retirement fund nor (where applicable) the relevant insurer can be held responsible for any acts or errors of commission or omission, timing standards, practices and procedures, negligent or otherwise of any third party.

28. All payments to me/us will be paid directly by the administrator to my/our bank account, as specified in this application form. Should I/we wish to request payment to be made to any other banking account in my/our name, I/we will provide acsis with all such requirements, as may be determined by acsis from time to time. Neither acsis nor the administrator is under any obligation whatsoever to accede to any request to make a payment to any specific banking account. No payments will be made to third parties unless obliged, by law, to do so.

29. I/We hereby appoint the financial planner named herein as my/our financial planner. I/We may withdraw and/or amend this appointment at any time, by giving written notice to acsis.

30. I/We authorise the administrator to make all reports and statement pertaining to my/our investment available, in whatever format, to acsis on a continuous basis and I/we further authorise acsis to make such reports available, in whatever format, to my/our financial planner on his/her request.

31. I/We authorise acsis and/or the administrator to accept instructions by facsimile or e-mail and hereby waive any claim that I/we may have against acsis and/or the administrator and indemnify acsis and the administrator against any loss incurred as a result of either of them receiving and/or acting upon such communication.

32. I/We understand and accept that acsis has been appointed to manage my/our selected investment strategy, as well as the underlying investments contained in my/our selected investment strategy, at their discretion.

33. I/We understand and accept that: • Prices of participatory interests in portfolios are calculated on a

net asset value basis. • For the SIS Cash Strategy (registered as the SIS Money Market

Fund) a constant unit price will be maintained. • Forward pricing is used. • A portfolio may borrow up to 10% of the market value of the

portfolio to bridge insufficient liquidity. • The SIS Investment Strategies may be closed to new investors to

allow the manager to manage it more effectively in accordance with its mandates

34. I/We warrant that all information and/or statements given in this application form, and in all documents which have been or will be signed by me/us in connection with this application/investment, whether in my/our handwriting or not, are true and correct and shall form the basis of this investment. I/We warrant that I am/we are the beneficial owner(s) of the investment amount or that I am/we are duly and validly authorised to invest the investment amount, and that all monies deposited into the applicable account in respect of this investment were obtained from legitimate sources. I/We further warrant that in making and maintaining such investment, I/we have and will continue to comply with all relevant legislation, including, but not limited to the Financial Intelligence Centre Act and the Income Tax Act. I/We understand that this application, along with the standard Terms and Conditions of the SIS investment contract, constitute the entire agreement between the administrator (and, where applicable, the relevant retirement fund and/or insurer) and myself.

35. I/We warrant and declare that I/we have read, understood and accept the information and the terms and conditions contained in this application form, and I/we agree to and consider myself/ourselves bound by said terms and conditions.

36. I/We acknowledge and confirm that I/we shall be bound by any legislation applicable to my/our investments, that the administrator may request written amendments to this agreement or signature of a new agreement, if amendments to or new legislation necessitate such, and that the administrator may appoint agents or third parties to fulfil any or all of the functions to be carried out by it.

37. I/We hereby consent to acsis and/or the administrator making enquiries of whatsoever nature for the purpose of verifying the information disclosed in this application and I/we expressly consent to acsis and/or the administrator obtaining any other information concerning me/us from any source whatsoever to enable acsis and/or the administrator to process this application.

38. I/We warrant to acsis and the administrator, that I am/we are acting on my/our own account and that I/we made my/our own independent decisions to make this investment and as to whether it is appropriate or proper for me/us, based upon my/our own judgement, and upon advice from such financial planner I/we may deem necessary. I am/we are not relying on any communication from acsis and/or the administrator, whether written, oral or implied for investment advice or as a recommendation to make the investment. Save for anything to the contrary referred to herein, I/we have not received from acsis and/or the administrator any assurance or guarantee as to the expected benefits, save that the benefit will be determined by reference to the value of the investment portfolio.

39. In the case of trusts, companies and close corporations: • I/we warrant that I am/we are duly authorised to conclude this

transaction on behalf of the trust/company/close corporation. • I acknowledge that, in the event of the trust/company/close

corporation not being in existence, I/we will be personally bound in respect of this transaction.

40. I/We understand and accept that the following fees (excl. VAT) will be levied: • An initial investment vehicle administration fee of 5% • An annual investment vehicle fee of 1.25% • The initial investment vehicle administration fee will be levied

against all investment contributions. • The annual investment vehicle fee, charged monthly in

arrears, will be calculated on the daily market value of my/our investments. This fee consists of 1% advisory fee and 0.25% administration fee.

• A switching fee of 0.2% (also applicable to phase-in instructions) will be levied on the amount switched.

• Incentives may be paid and, if so, are included in the overall costs.

• Investments placed with management companies are made subject to the provisions of the Collective Investment Schemes Control Act, 45 of 2002, and the regulations issued in terms thereof in accordance with the trust deeds of the relevant management company and subject to the management fee structure from time to time. Brokerage, marketable securities taxes, auditor’s fees, bank charges, trustee and custodian fees and RSC levies may also be charged against the portfolios.

• An initial investment strategy fee of 0.5% will be levied on each investment contribution and/or amount switched into an investment strategy (in respect of the SIS Inflation-matching, Inflation Plus 1-3, 3-5, 5-7 and 7-9 portfolios)

• An annual investment strategy fee of 0.5% will be levied in accordance with the relevant trust deed (in respect of the SIS Inflation-matching, Inflation Plus 1-3, 3-5, 5-7 and 7-9 portfolios)

• No initial fee will be levied in respect of the SIS Cash Strategy, although an annual fee of 0.31% will apply.

• The following annual fees will be levied, in respect of the underlying collective investment portfolios, in which the investment strategies (i.e. the SIS Inflation-matching, Inflation

Plus 1-3, 3-5, 5-7 and 7-9 portfolios) may from time to time invest in varying percentages and proportions:

• SIS Equity: 0.48% • SIS Flexible : 0.5% • SIS Top 100: 0.6% • SIS Bond Index: 0.35% • SIS Money Market: 0.31% • SIS Property Equity: 0.46% • SIS International Equity: 0.9% • SIS International Cash – USD: 0.4% • SIS International Property: 1.00% • SIS International Bonds: 0.65%

• A performance fee, calculated as 15% of the out-performance of the portfolio over its benchmark, may apply to the SIS Equity

Fund and SIS Top 100 Fund, but the maximum annual fee, including this performance fee, may not exceed 1.25%

• A performance fee may apply to the SIS Bond Index Fund, but the maximum annual fee, including this performance fee, may not exceed 0.9%.

• Each debit order contribution of less than R1 000 will be subject to a minimum initial administration fee of 3%. Debit orders of more than R1 000 will be subject to a minimum initial administration fee of 1.5%. Debit orders of more than R5 000 will be subject to a minimum initial administration fee of R75. The minimum initial administration fee excludes the financial planner’s fee, if any.
