    AirAsia Insure Travel Protection (Return-Trip Plan)

    Whereas the Insured Person has applied for the insurance hereinafter contained and has paid the Premium asconsideration for such insurance and a copy of the AirAsia Insure Travel Protection (Return-Trip Plan) Certificate ofInsurance has been issued, EQ Insurance Company Limited (hereinafter referred to as the Company) agrees to insure

    individuals who purchase return flight(s) (hereinafter referred to as the Insured Person) from AirAsia Berhad agains tloss covered by Master Policy No. DTPSHQ09-01(hereinafter referred to as the Policy) as set out herein and subject always to the exclusions, provisions terms andconditions contained in the Policy.

    POLICY DEFINITIONS

    These terms, wherever used in this Policy, are defined as follows

    Accident / AccidentalAn event occurring entirely beyond control and caused by violent, external and visible means which causes Bodily Injury

    AirAsia AirwaysThe legally authorised representative of AirAsia Berhad having jurisdiction at the place of any event or loss

    AirAsia Airway Air CarrierAny fixed-wing aircraft provided and operated by AirAsia Berhad duly licensed for the regular transportation of fare-paying passengers and operating only between established commercial airports.

    Bodily injuryInjury suffered by the Insured anywhere in the world caused solely and directly by violent accidental external and visible

    means and shall exclude bodily injury caused by sickness, disease or medical disorder and/or disease, sickness or

    illness caused by bodily injury and/or cause gradually operating upon the Insured.

    Certificate of InsuranceThe confirmation of insurance coverage which is electronically generated upon the on-line purchase of the AirAsia

    Insure Travel Protection (Return-Trip Plan).

    Civil War

    Armed opposition between two or more parties belonging to the same country where the opposing parties are of different

    ethnic, religious or ideological groups. This definition includes armed rebellion, revolution, sedition, insurrection, coup

    detat, and the consequences of martial law.

    ClinicAn establishment licensed to provide western medical treatment and diagnosis but is not legally authorised to provide

    room and board for sick persons.

    Country of Arrival

    The country where the Insured Persons Scheduled Flight is destined to depart to.

    EpidemicA sudden severe outbreak of disease that spreads rapidly and affects, within a very short period, an inordinately large

    number of people within a geographical region. For example, SARS.

    First Departure Date

    The date the Insured Person is booked on a departure flight on an insured Scheduled Flight. This date is concurrent with

    the insurance Policy commencement date.

    HospitalA place that;

    (a) operates primarily for the care and treatment of sick or injured persons;(b) has a staff of one or more physicians available at all times;(c) provides 24 hour nursing services and at least one registered professional nurse on duty at all times;

    (d) has organised diagnostic and surgical facilities whether on premises or in facilities available to the hospital on a pre-arranged basis;

    (e) is not, except incidentally, a clinic, nursing home, rest home or convalescent home for the aged, or similar institution;

    (f) registered as a hospital under the applicable law.

    Immediate Family MemberInsured Persons (i) legal spouse; (ii) legal, adoptive and/or biological children; (iii) parents; (iv) grandparents;

    (v) parent-in-law; (vi) brother or sister; (vii) niece or nephew; (viii) aunt or uncle, who resides in Singapore.

    Insured Person

    AirAsia Guest whom an Air Ticket has been purchased and who has been issued with an AirAsia Insure Travel Protection Return-Trip Plan Certificate of Insurance for that scheduled flight(s).

    In-PatientA person who is confined in Hospital or Medical Establishment as registered in-patient on the recommendation of a

    physician according to Standard Medical Practice for a period suitable for treatment of the Injury.

    Injury

    Bodily injury caused solely and directly by an Accident within 90 days from the date of such Accident.

    Medical Establishment

    An establishment which can provide room, board and medical services to sick persons and registered as Medical

    Establishment under the applicable Law.

    Medical Necessity

    Medical services which meet the following conditions:-

    (a) are in conformity with the diagnosis and treatment of the Injury suffered by the person being treated ;(b) there is a clear medical indication according to Standard Medical Practice of western medicine;(c) are not provided simply for the convenience of the person being treated or his/her family or the serviceprovided; and(d) Conform to standard medical treatment and is necessity for the Injury suffered by the person being treated.

    Out-Patient

    A person who receives medical treatment as the Out-Patient Department or an Emergency Room of a Hospital or

    Medical Establishment or Clinic but there is no medical necessity according to the Standard Medical Practice for such

    person to be hospitalised as In-Patient.

    Qualified Medical Practitioner

    A person qualified by degree in western medicine who is licensed under any applicable laws and acting within the scope

    of his/her license and training. Furthermore, the attending or consulting Qualified Medical Practitioner cannot be an

    Insured Person, the Insured Persons spouse, a person booked to accompany the Insured Person on the trip, or an

    Immediate Family Member of the Insured Person.

    Medical Expenses

    Expenses incurred overseas within 90 days of sustaining Injury which the Insured Person paid to a Qualified Medical

    Practitioner, Hospital and/or ambulance service for medical surgical, x-ray, Hospital or nursing treatment including the

    cost of medical supplies and ambulance hire and including the cost of dental treatment where such treatment is

    necessarily incurred to restore sound and natural teeth and is caused by an Accident. All treatment including specialist

    treatment must be prescribed or referred by a Qualified Medical Practitioner in order for expenses to be reimbursed

    under this Policy and will not exceed the usual level of charges for similar treatment, medical service or supplies in thelocation where the expenses were incurred had this insurance not existed.

    The Company will indemnify the Insured Person for follow-up treatment in Singapore within 30 days from date of return

    for any injury sustained whilst overseas, provided the initial treatment is received during the overseas trip up to 10% of

    the Accidental Medical Reimbursement Limit.

    Pandemic

    An outbreak of infectious disease, which meets the following criteria set by World Health Organisation (WHO that

    spreads through population across a large region or worldwide.

    (i) Emergence of a disease new to a population.(ii) Agents infect humans, causing serious illness.(iii) Agents spread easily and sustainably among humans.

    Pre-Existing Condition

    Any disease (and complications), symptom or disorder suffered by the Insured Person within 12-month period preceding

    the effective date of the Policy which would cause an ordinary prudent person to seek diagnosis, care or treatment or

    cause a Qualified Medical Practitioner to provide diagnosis, care or treatment.

    Public Places

    A place to which the general public has access, for example (but not limited to) airports, shops, restaurants, hotel foyers,

    parks, beaches, golf courses, driving ranges, public buildings and like places.

    Standard Medical Practice

    An international standard practice of western medicine leading to proper treatment for patients according to medical

    necessity and records on the injury, examination results, autopsy results or any other record (if any).

    Scheduled Flight

    Commercial flights scheduled by AirAsia Berhad, it being always understood that by AirAsia Berhad has at all times the

    requisite and valid licences or similar authorisations for scheduled air transportation and landing rights for fare-paying

    passengers as issued by the relevant authorities in the country in which it operates, and that in accordance with such

    authorisation, maintain and publish schedules and tariffs for passenger service between named airports. In addition,

    departure times, transfers and destination points shall be established by reference to the Insured Persons Scheduled

    Flight ticket.

    Serious Sickness

    Sickness certified as being life threatening and requiring immediate treatment by a Qualified Medical Practitioner and

    which results in the Insured Person or Immediate Family Member being certified by that Qualified Medical Practitioner as

    unfit to travel or to continue with his/her original trip.

    Sickness

    A symptom, disorder, illness or disease by the Insured Person.

    Time

    Any reference to a time or a date in the policy context or in the context of a coverage period refers to Singapore time.

    Travel Assist ProviderA company providing services for Insured Person while abroad, such as medical care advice, emergency medical

    evacuation and repatriation service.

    Travel Companion

    A person who has travel bookings to accompany an Insured Person on the Trip.

    Trip

    A journey undertaken by an Insured Person travelling on AirAsia Airways Air Carrier and is limited within the boundary of

    the specific country where the Insured Person disembarks from an AirAsia Airways Air Carrier.

    PERIOD OF INSURANCE

    Commencement of Cover

    Except for Trip Cancellation benefit, the cover commences upon the Insured Persons checking in for departure of an

    AirAsia Airways flight in the itinerary which includes the time the Insured Person is inside any airport premises for the

    purpose of commencement or continuation of the same Scheduled Flight

    The cover for Trip Cancellation benefit commences on the date the Travel Insurance for Commercial Airlines Guest is

    purchased by the Insured Person.

    Expiry of Cover

    The cover ends upon safe disembarkation of the Insured Person at the end of the scheduled return flight provided this

    falls within 30 days of the First Departure Date. The insurance shall terminate automatically on the 31 days of the First

    Departure Date stated in the flight itinerary even if the return flight has not begun.

    Section 1 Personal Accident Benefits

    In the event of an Accident happening during the period of insurance, if the Insured Person suffers

    bodily Injury which results in his death or disablement, the Company will, subject to the exclusions,

    limitations, provisions, terms and conditions of the Policy, pay compensation as provided in the Table

    of Compensation below and Schedule of Benefits:-

    Provided that:-

    (a) such death or disablement occurs within Ninety (90) calendar days immediately after the date ofAccident causing such death or disablement;

    (b) the maximum compensation for which the Company shall be liable during the period of insurancein respect of one Insured Person is 100% of the Sum Insured specified for Personal AccidentBenefits. If the amount of compensation paid by the Company under this section is still less thanthe total Sum Insured, the coverage provided by the Company shall be equal to the remainingamount of the Sum Insured until the expiry of the period of insurance;

    (c) loss of limb means loss by complete and permanent physical severance of a hand at or abovewrist or of a foot at or above the ankle or total functional disablement of these organs and wherethere is clear medical indication confirming permanent loss of use;

    (d) loss of sight means the entire and permanent irrecoverable loss of sight

    (e) loss of Hearing means permanent irrecoverable loss of hearing where:-If a dB = Hearing loss at 500 Hertz

    If b dB = Hearing loss at 1,000 Hertz

    If c dB = Hearing loss at 2,000 Hertz

    If d dB = Hearing loss at 4,000 Hertz

    1/6 of (a_2B+2C+d) are above 80 dB

    (f) Total Disablement means Injury of a permanent nature which solely and directly totally disablesand prevents an Insured Person from attending to any business, occupation of any and every kind

    or he/she has no business or occupation, from attending to his usual duties.

    (g) Loss of Speech means the disability in articulating any 3 of the 4 sounds which contribute to thespeech such as labial sounds, the alveololabial sounds, the palatal sounds and the velar soundsor total loss of vocal cord or damage of speech centre in the brain resulting in aphasia.

    Exclusions applicable to Section 1

    This Insurance does not cover any Injury arising from or in consequence of the following:-

    (1) While the Insured Person is engaging or participating in a brawl.

    (2) While the Insured Person is committing a felony or being arrested or resisting an arrest.

    (3) While the Insured is operating or serving as crew member in any aircraft.

    (4) Miscarriage.

    (5) Bacterial infection except pyrogenic infection or tetanus or rabies which occurs through anaccidental cut or wound.

    (6) Any act of the Insured Person while under the influence of intoxicating liquor or drugs. Under theinfluence of intoxicating liquor shall apply to the case when a blood test shows at least 150 mg.Percent of alcohol.

    (7) While the Insured Person is engaging in any kind of race involving motorized vehicles, boat,horse-racing, competitive skiing and jet-skiing, competitive skating, professional boxing,parachuting (except for life-saving purpose), while boarding or alighting from or travelling on a

    balloon or glider.

    (8) While the Insured Person is boarding or alighting from or travelling in an aircraft not licensed forregular transportation of passengers and not operated by a commercial airline.

    Section 2 Travel Inconvenience Benefits

    2(a) Trip Cancellation

    The Company shall reimburse the Insured Person up to the maximum limit as specified for Trip

    Cancellation in the Schedule of Benefit for any unused and non-refundable portion of the AirAsia

    Airways Air Ticket fare if at the time of scheduled departure, the Insured Persons trip is cancelled due

    to any of the following occurring within 30 days before the date of departure of the Trip.

    (a) death or Serious Injury or Serious Sickness or compulsory quarantine of the Insured Person, theInsured Persons Immediate Family Member or Travel Companion;

    (b) witness summons or jury service of the Insured Person.

    Provided that this insurance is effective only if it is purchased before the Insured Person becomes

    aware of any circumstances which could lead to the cancellation of his/her trip.

    Exclusions applicable to Section 2(a)

    (1) The Company shall not be liable for any loss resulting directly or indirectly (in whole or in part)from:-(i) Cancellation by AirAsia Airways.

    (ii) Any loss or damage covered by any other existing insurance or which will be refunded byan airline, travel agency or any travel service provider.

    (iii) Any loss or damage caused by government regulations or control, or bankruptcy,

    insolvency or any payment default of the travel agency or carrier and which leads to

    travel cancellation.

    (2) The Company will not pay for any loss should this insurance be purchased less than 7 daysbefore the date of departure (with the exception death or Serious Injury resulting fromAccidents only of the Insured Persons, the Insured Persons Immediate Family Member orTravel Companion).

    2(b) Trip Curtailment

    The Company shall reimburse the Insured Person up to the maximum limit as specified for Travel

    Curtailment in the Summary of Benefit for the additional expenses incurred by the Insured Person forairfare (economy class) and tax and fuel charges already included in the airfare, if the Insured Person

    has to return to Singapore from overseas due to the occurrence of any of the following events:-

    (a) Death or Hospitalisation of the Insured Person due to Serious Sickness or serious Injury;

    (b) Death of Insured Persons Immediate Family Member or Travel Companion residing inSingapore;

    (c) Hospitalisation of Insured Persons Immediate Family Member residing in Singapore due toSerious Sickness or serious Injury;

    (d) Natural disasters (such as typhoon or earthquake) which prevent the Insured Person from

    continuing with the Trip;

    (e) Unexpected strike, riot or civil commotion beyond the Insured Persons control;

    (f) Quarantine of the Insured Persons upon Medical advice

    Coverage under this section is effective only if the coverage is purchased before the Insured Person

    becomes aware of any circumstances which could lead to such travel curtailment.

    Exclusions applicable to Section 2(a) and Section 2(b)

    The Company shall not be liable for travel curtailment expenses arising from or in consequence of the

    following:-

    (1) when the travel curtailment is due to the Insured Persons mental or nervous disordersincluding but not limited to insanity;

    (2) AIDS or when blood test indicates the presence of HIV and other AIDS-related diseases.

    (3) Pandemic and Epidemic

    (4) Venereal disease or any sexually transmitted disease.

    Special Condition applicable to Section 2(a) and Section 2(b)

    An Insured Person may claim either for Travel Curtailment or Travel Cancellation benefit for the sameevent but not for both.

    2(c) Baggage and Personal Effects

    The Company will indemnify the Insured Person for loss or damage to baggage or personal effects

    (which includes clothing and personal effects worn or carried on the Insured Person, in suitcases and

    like receptacles) of the Insured Person during a trip up to the maximum limit as specified for Baggage

    and Personal Effects in the Schedule of Benefits in consequence of the following:-

    (a) While the baggage or personal effects is under the care and control of the staff of the hotel orcarrier company, the loss or damage must be substantiated by written documentation fromthe hotel or carrier management ;

    (b) If the baggage and personal effects is taken from the Insured Person by force or coercion byanother person, such loss or damage must be reported to the police having jurisdiction at theplace of loss within 24 hours from the incident. Any claim must be accompanied by writtendocumentation from the police.

    Provided that all items must be owned by or in the custody of or which is loaned or entrusted to the

    Insured Person.

    At sole discretion of the Company, the Company may make payment or reinstate or repair subject to

    due allowance for depreciation and wear and tear. Depreciation may not be applied to electronic items

    that are purchased less than 1 year from the date of the Accident if the Insured Person can produce

    supporting document (i.e. original receipts or original warranty cards) for claims.

    Where any item consists of articles in a pair or set, the Company shall not be liable to pay more thanthe proportionate value of any particular part or parts which may be lost, without reference to any

    special value which such article may have a part of such pair or set. The Company may at its option

    elect to either repair or replace any part, to restore the pair or set to its value before the loss or pay the

    difference between the cash value of the loss or damage of covered baggage and personal effects

    before and after the loss.

    Exclusions applicable to Section 2(c)

    (1) This insurance does not cover:-

    (a) animals

    (b) automobiles and automobile equipment, trailers and caravans, boats and other meansof transport equipment (including accessories)

    (c) contraband, illegal transportation or trade.

    (d) documents, identity papers, credit and payment cards, stored value card, cash cards,Ez link cards, transport tickets, cash, , bank notes, coins, promissory notes, bonds,coupons, stocks and securities

    (e) hired or leased equipment

    (f) eye glasses, contact lenses, hearing aids, prosthetic limbs, wheelchair, artificial teethor dental bridge

    (g) household goods (i.e. property which a person will not generally take with him/herwhilst on a trip including clothing not needed during a trip, cooking utensils, homeappliances, furniture).

    (h) computers including handheld computers and personal digital assistants.

    (i) musical instruments, objects of art, antiques, collectors items, jewellery such asdiamond, gold, silver including golden articles, gem stones, watches, silverware andsouvenirs (souvenir refers to any item which serves as a symbol or reminder of anevent or place or any item sold or given as souvenir).

    (j) perishables and consumables

    (k) loss or damage of goods or samples

    (l) loss or damage of data recorded on tapes, software, discs or otherwise.

    (m) ski sets, snow skis, bicycles, sailboards, golf clubs, tennis rackets and other sportingequipment except whilst checked in as baggage

    (n) when the baggage is left unattended by the Insured Person on any conveyance orpublic place or any loss or damage as a result of the Insured Persons failure to takedue care and precaution for the safety of such property.

    (o) Loss or damage to Insured Persons baggage and its contents, which are sent inadvance, items mailed or shipped separately.

    (p) Loss or damage to property which is recoverable from other source insured under anyother insurance policy or is refundable by any carrier, hotel or airline.

    (2) The Company shall not be liable for any loss or damage resulting from:-

    (a) breakage of brittle or fragile articles, cameras, musical instruments, radios and suchsimilar property

    (b) confiscation or expropriation by order of any government or public authority

    (c) criminal acts

    (d) gradual deterioration or wear and tear

    (e) moths, insects or vermin

    (f) inherent vice or damage

    (g) mysterious disappearance

    (h) transportation of contraband or illegal trade

    (i) seizure whether for destruction under quarantine or custom regulation or not

    (j) damage sustained from any process of repair, cleaning or adjustment made by theInsured Person.

    (3) The Company shall not be liable for more than S$200 any one item/article or pair or set ofarticle.

    Special Conditions applicable to Section 2(c)

    (1) The Insured Person must report the loss or damage to the police or responsible officer of theaircraft, vessel or conveyance on which he/she is travelling and obtain a writtendocumentation of such loss or damage from such authority unless the Insured Person cannotdo so due to circumstances beyond his/her control.

    (2) The Insured Person must take all reasonable precautions for the safety of the insuredproperty. Any loss or damage to any insured property must be reported immediately to thepolice, hotel or carrier management or any authority having jurisdiction at the terminal ofdestination.

    (3) The Insured Person must take every possible step to ensure that their baggage and personaleffects are not left unattended.

    (4) In the event of any payment under this insurance, the Company shall be subrogated to all theInsured Persons rights of recovery against any person or organisation and the InsuredPerson shall execute and deliver instruments and papers and do whatever that is necessaryto secure such rights. The Insured Person shall do nothing to prejudice such rights and shallnot take any legal action against person who causes such loss or damage subsequent to theloss.

    2(d) Flight Delay

    In the event the scheduled AirAsia Airways Air Carrier as defined in which the Insured Person had

    arranged to travel is delayed for at least six (6) consecutive hours from the original scheduled Time

    specified in the itinerary supplied to the Insured Person, and this delay is due to strike or industrial

    action of the airline employees, inclement weather, mechanical breakdown, derangement or structural

    defects of a AirAsia Airways Air Carrier, the Company will pay the Insured Person a flat fee of S$75.00

    for every six (6) consecutive hours of delay up to the maximum limit of S$600.00.

    The period of delay shall be calculated from the original scheduled departure time of the Scheduled

    Flight until the commencement of the first available alternative flight offered by the airline. A letter from

    the airline management or its handling agents confirming the duration and reason of such delay shallsuffice as proof for purposes of claim for this benefit.

    Exclusions applicable to Section 2(d)

    The Company shall not be liable for any loss arising from:-

    (1) the failure of the Insured Person to check in according to the itinerary supplied to him/her

    (2) the failure of the Insured Person to obtain written confirmation from the airline management or itshandling agents of the number of hours delayed and the reason for such delay

    (3) strike or industrial action existing on the date of the Trip is arranged

    (4) the late arrival of the Insured Person at an airport (except for late arrival caused by a strike or anindustrial action).

    (5) AirAsia crew rotation.

    2(e) Public Transport Delay

    In the event the scheduled Public Transport as defined in which the Insured Person had arranged to

    travel in overseas is delayed for at least six (6) consecutive hours from the original scheduled Time

    specified in the itinerary supplied to the Insured Person, and this delay is due to strike or industrial

    action, inclement weather, mechanical breakdown/derangement or structural defects of public

    transport, the Company will pay the Insured Person a flat fee of S$75.00 for every six (6) consecutive

    hours of delay up to the maximum limit of S$600.00 during the Policy period.

    Exclusions applicable to Section 2(e)The Company shall not be liable for any loss arising from:-

    (1) the failure of the Insured Person to check in according to the itinerary supplied to him/her

    (2) the failure of the Insured Person to obtain written confirmation from the carriers or their handlingagents of the number of hours delayed and the reason for such delay

    (3) strike or industrial action existing on the date of the Trip is arranged

    Section 3 Emergency Medical and Evacuation Expenses

    3(a) Accidental Medical Reimbursement

    If the Insured Person is involved in an Accident which on a trip which require medical treatment in a

    hospital either as an In-Patient or Out-Patient, the Company will indemnify the Insured Person up to

    the maximum limit for Accident Medical Expenses Reimbursement as specified in the Schedule of

    Benefits which are all reasonably and necessary expenses actually incurred for such medical

    treatment, according to medical necessity, and standard practice

    If the Insured Person is entitled to a refund of all or part of the expenses from any person or any other

    source, the Company will only pay the amount of Accident Medical Expenses over and above the

    refunded amount up to the Accident Medical Expenses Reimbursement as specified in the Schedule of

    Benefits.

    The Company will indemnify the Insured Person for follow-up treatment in Singapore within 30 days

    from date of return for any injury sustained whilst overseas, provided the initial treatment is received

    during the overseas trip up to 10% of the Accidental Medical Reimbursement Limit

    Exclusions applicable to Section 3(a)

    The coverage under this insurance does not cover the following expenses:-

    (1) Treatment or correction of any congenital defect.

    (2) Health or rest care, convalescence, any medical examination and treatment not related to theInjury.

    (3) Miscarriage.

    (4) Non-western medical treatment including alternative treatment i.e. acupuncture, natural therapy,massage and chiropractic therapy.

    (5) Artificial limbs and aids such as walking stick, eyeglasses, hearing aid, speech device, all kind ofcardiac stimulator.

    (6) Dental care unless necessitated by an injury caused by an Accident, excluding dental restoration,orthodontic, crowning, scaling, filling services or denture fitting but including the expenses fordental treatment necessitated by Accident to sound and natural teeth.

    (7) Medical service or surgery expenses relating to an Injury incurred in order to gain the benefitprovided under this Policy.

    (8) Cosmetic treatment to correct any physical defects and cosmetic surgery, unless necessitated byan Injury caused by an Accident to restore such organs function.

    (9) Medical expenses incurred when the attending physician is the Insured Person or the InsuredPersons Immediate Family Member.

    (10) Inoculation or vaccination except for rabies after being wounded by an animal and for tetanusafter an Injury.

    (11) Injury sustained while the Insured Person is engaging or participating in a brawl.

    (12) Injury sustained while the Insured Person is committing a felony or being arrested or resisting anarrest.

    (13) Injury sustained while the Insured is operating or serving as crew member in any aircraft.

    (14) Injury sustained whiles the Insured Person under the influence of intoxicating liquor or drugs.Under the influence of intoxicating liquor shall apply to the case when a blood test shows atleast 150 mg. Percent of alcohol.

    (15) Injury sustained while the Insured Person is engaging in any kind of race involving motorizedvehicles, boat, horse-racing, competitive skiing and jet-skiing, competitive skating, professional

    boxing, parachuting (except for life-saving purpose), while boarding or alighting from or travellingon a balloon or glider.

    (16) Injury sustained while the Insured Person is boarding or alighting from or travelling in an aircraftnot licensed for regular transportation of passengers and not operated by a commercial airline.

    3(b)(i) Emergency Medical Evacuation

    In the event of a sudden and unforeseen Injury suffered by the Insured Person during a trip inoverseas and if in the opinion of the appointed Travel Assist Provider or an authorised representative

    of the appointed Travel Assist Provider, it is judged medically appropriate transfer the Insured Person

    to another location for medical treatment or to return the Insured Person to Singapore, the Company

    shall pay directly to the appointed Travel Assist Provider the expenses charged by appointed Travel

    Assist Provider or an authorised representative of the appointed Travel Assist Provider for such

    evacuation which may include air ambulance, surface ambulance, railroad or any other appropriate

    means up to S$40,000.00.

    All decision as to the means of transportation will be made by the appointed Travel Assist Provider or

    an authorised representative of the appointed Travel Assist Provider, and will be based upon medical

    severity of the Insured Persons condition and/or medical necessity..

    Covered expenses are expenses for services provided and/or arranged by the appointed Travel AssistProvider or an authorised representative of the appointed Travel Assist Provider for the transportation,

    medical services and medical supplies necessarily incurred as a result of an emergency medical

    evacuation of an Insured Person.

    Exclusions applicable to Section 3(b)(i)

    The coverage under this section does not include Emergency Medical Evacuation expenses arising

    from or in consequence of the following:-

    (1) Any expenses incurred for services provided by another party for which the Insured Person is notliable to pay or any expenses already included in the cost of a scheduled trip.

    (2) Any expenses for a service not approved or arranged the appointed Travel Assist Provider or anauthorised representative of the appointed Travel Assist Provider, unless the Insured Person orhis/her travelling companion cannot for reasons beyond their control notify the appointed TravelAssist Provider or an authorised representative of the appointed Travel Assist Provider during anemergency medical situation and such extra expenses can be justified. In any event, theCompany reserves the right to reimburse the Insured Person only for those expenses incurred forservices which the appointed Travel Assist Provider or an authorised representative of theappointed Travel Assist Provider would have provided under the same circumstances and up tothe limit specified in the Schedule of Benefits.

    3(b)(ii) Mortal Remains Repatriation

    In the event that the Insured Person dies within 30 days after having sustained a sudden and

    unforeseen Injury in overseas, the Company shall pay for the relevant expenses necessarily incurred

    i.e. cost of the casket, embalming, cremation and religious rites at the place of death, including any

    expenses for the return of the Insured Persons mortal remains to Singapore arranged by theappointed Travel Assist Provider or an authorised representative of the appointed Travel Assist

    Provider. The Company shall pay directly to the appointed Travel Assist Provider or an authorised

    representative of the appointed Travel Assist Provider up to the limit specified in the Schedule of

    Benefits.

    Exclusions applicable to Section 3(b)(ii)

    The coverage under this section does not include repatriation expenses arising from or in

    consequence of the following:-

    (1) Any expenses incurred for services provided by another party for which the Insured Person is notliable to pay or any expenses already included in the cost of a scheduled trip for which the travelagency or the carrier company is liable.

    (2) Any repatriation expenses incurred for services not approved or arranged by the appointedTravel Assist Provider or an authorised representative of the appointed Travel Assist Provider.

    Section 4 24-Hours Worldwide Emergency Assistance

    Whilst the Insured Person is travelling overseas, the Insured Person may place a reverse-charge call

    to the Companys appointed Travel Assist Provider which provides the Insured Person a 24 -hour

    Worldwide Emergency Medical Assistance Services.

    General Exclusions Applicable to All Sections

    This insurance does not cover:-

    (1) payment which would violate a government prohibition or regulation ;

    (2) death or Injury directly or indirectly occasioned by war, invasion, act of foreign enemy, or hostilities or warlikeoperation (whether war be declared or not), mutiny, Civil War, rebellion, riot, strike, civil commotion, revolution,coup detat, insurrection, conspiracy, military or usurped power, martial law or stage of siege, any of the events orcauses which determine the proclamation or maintenance of martial law or state of siege, seizure, quarantine orcustoms regulations or nationalization by our under the order of any government or public or local authority;

    (3) delay, seizure, confiscation, destruction, requisition, retention or detention by customs or any other government orpublic authority or official ;

    (4) any violation or attempt of violation of laws or resistance to arrest by appropriate authority;

    (5) members of the armed forces whilst on duty or whilst engaging in or taking part in naval, military or air forceservice or operations or participating in operations of an offensive nature planned or conducted by any civil ormilitary authorities against bandits, terrorists or other elements ;

    (6) the Insured Person being employed as a manual worker, whilst engaged in offshore or in mining, aerialphotography or handling of explosives or ammunition, or firearms ;

    (7) any serious physical Injury or disability resulting directly or indirectly from, attributed to or accelerated by the use,release, or escape of nuclear of nuclear materials that directly or indirectly results in nuclear reaction or radiationor radioactive contamination; or the dispersal or application of pathogenic or poisonous biological or chemicalmaterials; or the release of pathogenic or poisonous biological or chemical materials. For purposes of thisexclusion, serious physical Injury means physical injury that involves a substantial risk of death and/or protracted

    and obvious physical disfiguration, and/or protracted loss of or impairment of the function of a bodily member oran organ ;

    (8) suicide, attempted suicide or any intentional self-inflicted injuries acted upon by the Insured Person to him/herselfwhether sane or insane ;

    (9) any Pre-Existing Medical Conditions ;

    (10) mysterious disappearance ;

    (11) while the Insured Person is driving or riding as a passenger on a motorcycle, riding or driving in any race,participating in any professional sports or in any sports in which the Insured Person would or could earn or receiveremuneration, donation, sponsorship, award or certificate of any kind ;

    (12) treatment of alcoholism or drug abuse or any other complications arising there from or any drug related accident ;

    (13) psychosis, mental or nervous disorders or sleep disturbance disorders ;

    (14) Acquired Immune Deficiency Syndrome (AIDs) or any complications associated with infection by any ImmuneDeficiency Virus (HIV) (for the purpose of this Policy, the definition of AIDs shall be that used by the World HealthOrganisation in 1987, or subsequent revision by the World Health Organisation of that definition; infection shall bedeemed to have occurred where blood or other relevant test(s) indicate in the opinion of the Company either thepresence of any Human Immune Deficiency Virus or Antibodies to such Virus) ;

    (15) any Injury sustained while serving as a crew member of any aircraft except as a fare-paying passenger in anyaircraft having a current and valid air worthiness certification issued by the appropriate authority of the country ofits registry ;

    (16) when the Insured Person is not fit to travel or is travelling against the advice of a Qualified Medical Practitioner ;

    (17) any loss , Injury ,damage or legal liability arising directly or indirectly from travel in, to or through Afghanistan,Cuba, Democratic Republic of Congo, Iran, Iraq, Liberia, Sudan or Syria; and

    (18) any loss, Injury, damage or legal liability suffered or sustained directly or indirectly by an Insured Person if thatInsured Person is :-

    (a) a terrorist ;(b) a member of a terrorist organisation ; or(c) a purveyor of nuclear, chemical or biological weapons ;(d) a narcotics trafficker.

    (19) any loss resulting directly and indirectly (in whole or in part) from :(a) pandemic(b) epidemic

    GENERAL CONDITIONS

    Entire Contract

    This Certificate of Insurance contains terms and conditions for the insurance coverage and benefits provided herein

    which shall always be subject to the terms and conditions of the Master policy bearing number . DTPSHQ09-01

    Observance of Insurance Terms and Conditions

    The due observation and fulfilment of terms and conditions of this insurance in so far as they relate to anything to be

    done or complied with by the Insured Person shall be binding upon the Insured Person as if he/she is the Insured and

    shall be conditions precedent to any liability of the Company to make any payment under this Policy.

    Misrepresentation in Application

    The benefits shall not be payable and the Policy, at the option of the Company, shall be considered voidable in the

    event:-

    (1) there is a failure to disclose or misrepresentation of any fact with respect to the Insured Person that is materialto the insurance provided hereunder which is required to be furnished as evidence of insurability ; and/or

    (2) in all cases of fraud.

    Alterations

    The Company reserves the right to amend the terms and provisions of the Policy and may at any time be amended and

    changed by written agreement between the Company and AirAsia Berhad. Any amendment to the Policy shall be

    binding on all persons whether insured under the Policy prior to, during, or after the effective date of the amendment. Noalteration in the Policy shall be valid unless approved by an authorised representative of the Company and such approval

    is endorsed hereon.

    Fitness for Travel

    At the time of incepting this insurance, the Insured Person must be medically fit to travel and not be aware of any

    circumstances which could lead to cancellation or disruption of the Trip, otherwise any claim is not payable.

    Duplication of Insurance Cover

    In the event that an Insured Person is covered under more than one travel insurance policy, underwritten by the

    Company for the same Trip, the Company will consider the person to be insured only under the policy provides the

    highest benefit level.

    Currency of PaymentPayment of any claim covered under this Policy shall be made in Singapore Dollars (S$) or its equivalent in any other

    currency at the prevailing rate of exchange as declared by Central Bank at the time of effecting payment if so required by

    the Insured Person or his/her permitted legal personal representatives.

    Compensation Limit

    The compensation limit is that expressed in the Table of Compensation and Schedule of Benefits.

    Ages

    All ages referred to in this Policy shall be the age of the Insured Person at his/her last birthday. In any claim, the age of

    the Insured Person will be determined as at the date of Injury or Sickness with reference to the birth date.

    Notice and Procedures of ClaimsUpon the happening of any event which may give rise to a claim, the Insured Person, the beneficiary or their

    representative, as the case may be, shall:-

    (1) notify the Company in writing of any loss or damage as soon as practicable and in any case within 30 days ofthe occurrence of any event which may give rise to a claim under the policy. In the event of death, immediatenotice shall be given to the Company, unless it can be shown that it is not reasonably possible to give suchnotice and that notice was given as soon as reasonably possible.

    (2) furnish to the Company, at the Insured Persons or the beneficiarys or their representatives own costs andexpenses., the following documents:-

    Claim for Accidental Death

    (a) Claim form as prescribed by the Company(b) Death Certificate(c) Copy of Autopsy Report(d) Copy of Police Report(e) Copy of the Insured Persons Identity Card with Dead stamp(f) Copy of the beneficiarys Identity card

    Claim for Accidental Disability

    (a) Claim form as prescribed by the Company(b) Qualified Medical Practitioners Report confirming total permanent disability(c) Copy of the Insured Persons Identity Card or Passport.

    Claim for Trip Cancellation(a) Claim form as prescribed by the Company(b) Letter from the airline stating the amount charged by the airline(c) Medical certificate, if the trip has to be cancelled due to serious Injury or Serious Sickness of the Insured Person

    or Insured Persons Immediate Family Member.(d) Copy of Death Certificate, if the trip has to be cancelled due to death of the Insured Person or Insured Persons

    Immediate Family Member.

    Claim for Flight Delay

    (a) Claim form as prescribed by the Company(b) Copy of the air ticket and boarding passes(c) Written notice from the airline responsible for such flight(d) Written notice from the airline confirming that the delay has actually occurred.

    Claim for Baggage or Personal Effects(a) Claim form as prescribed by the Company

    (b) Written document from the carrier management

    (c) Description and prices of the lost or damaged items

    (d) Police Report, if the loss or damage occurs under threat or use of violence

    Claims for Accidental Medical Expenses

    For any claim made for medical expenses resulting from Accident, the following documents must be submitted to the

    Company by the Insured Person, at his/her own expense, within 30 days after discharge from the Hospital, Medical

    Establishment or Clinic.

    (a) Claim form as prescribed by the Company(b) Copy of the Insured Persons Identity Card or Passport(c) Qualified Medical Practitioners report describing significant symptoms, diagnosis and result of treatment

    (d) Original receipt with description of expenses or summary statement of expenses and receipt. The company willreturn the original receipt to enable the Insured Person to claim from other insurers(s) any expenses that areirrecoverable from the Company. If the Insured Person has been refunded by the state welfare scheme or otherinsurance, the Insured Person may submit the copy of receipt of such refund from the state welfare or othersources in order to claim from the Company any amount that has not been recovered.

    Claims for Trip Curtailment

    (a) Claim form as prescribed by the Company

    (b) Copy of the latest air ticket purchased including receipt

    (c) Medical certificate, if the trip has been curtailed due to serious Injury or Serious Sickness of the Insured Person or

    Insured Persons Immediate Family Member

    (d) Copy of death certificate, if the trip has been curtailed due to death of the Insured Person or Insured Persons

    Immediate Family Member

    Claims for Emergency Medical Evacuation

    The Insured Person or person concerned must take the following action:-

    (a) Contact and notify the Company or the appointed Travel Assist Provider without delay.

    (b) If the Insured Person is injured while in some remote area, the Insured Person shall seek first aid from local

    Qualified Medical Practitioner. The appointed Travel Assist Provider will then arrange for appropriate means of

    evacuation and coordinate and made arrangement for further treatment by a Physician.

    Claims for Repatriation Expenses

    The Insured Person or the beneficiary or person concerned must take the following action:-

    (a) Contact and notify the Company or the appointed Travel Assist Provider without delay. The appointed Travel Assist

    Provider will then made arrangements for the return of the Insured Persons mortal remains to Singapore by themost appropriate means.

    (b) The beneficiary or relative or person concerned must submit to the Company all documents it may require within 30

    days from the date of Insured Persons Death.

    Proof of Loss

    Written proof of loss must be furnished to the Company at its said office within Ninety (90) days from the date of loss.

    Failure to furnish such proof within the time required shall not invalidate or reduce any claim if it was not reasonable

    possible to give proof within such time provided such proof is furnished as soon as possible and in no event, except in

    the absence of legal capacity, later than one (1) year from the time proof is otherwise required.

    Effect of Fraud

    Any fraud, misstatement or concealment in respect of this insurance or any claim hereunder shall render the insurancecoverage and benefits provided herein null and void.

    Medical Examination

    The Insured Person shall at his/her expense furnish to the Company all such certificates, information and evidence as

    may be required by the Company and the Insured Person shall whenever reasonably required to do so, arrange to

    submit to medical examination by Qualified Medical Practitioners appointed by the Company. In the event of death of the

    Insured Person, provided it is not forbidden by law, the Company shall be entitled to have a post-mortem examination at

    its own expense, and notice shall, where practicable, be given to the Company before internment or cremation, stating

    the name and place of any inquest appointed. In the event of any conflict of opinion between the Companys doctors and

    the Insured Persons Qualified Medical Practitioner, the opinion of the Companys doctor shall prevail and be binding on

    the Insured Person or his/her estate as the case may be.

    To Whom Indemnity is PayableIndemnity for the Insured Persons loss of life is payable to his estate. All other indemnities of this Policy are payable to

    the Insured Person except under Section 3(a) Accidental Medical Reimbursement and Section 3(b) Emergency Medical

    Evacuation & Mortal Remains Repatriation.

    Under Section 3(a) Accidental Medical Reimbursement, in the event funds for emergency medical treatment are

    guaranteed to the provider of healthcare by the appointed Travel Assist Provider or their authorised representative,

    indemnities will be payable directly to the provider of healthcare.

    Indemnity for expenses under Section 3(a) Accidental Medical Reimbursement which the Insured Person incurs directly

    will be payable to him.

    Under Section 3(b) - Emergency Medical Evacuation & Mortal Remains Repatriation , the benefits will be paid directly to

    the provider of service as indicated in the Section.

    InterestsNo indemnity from the Company shall carry any interest.

    Receipts

    The Company shall not be abided by any notice or any trust charge, a lien, assignment or other dealing with the

    Certificate of Insurance. The receipt by the Insured Person for any compensation payable herein shall in all cases be

    effectual discharge of liability of the Company.

    Rule of Refund

    The Company will not allow any refund of premium once the Policy is issued.

    Cancellation

    The Company may cancel this Policy at any time by written notice delivered to the Insured Person or mailed to his last

    address shown by the records of the Company stating when thereafter such cancellation shall be effective. In the eventof such cancellation, the Company will return promptly the pro rata unearned portion of any premium paid by the Insured

    Person. Such cancellation shall be without prejudice to any claim originating prior thereto.

    Right of Recovery

    In the event authorisation of payment and/or payment is made by the Company by which Policy liability is not engaged,

    the Company reserves the right to recover from the Insured Person or his legal representative for the full sum paid.

    Other Limitations

    (1) Land cover between destination and departure is limited to that within the country of arrival only. If the Insured

    Person travels beyond the boundary of the country, cover will exclude the geographical limits beyond theboundary of that country.

    (2) If the Insured Person departs on any public transport to travel outside the country of arrival, insurance cover willsuspend upon the Insured Persons check-in for that out-bound trip. However, cover will resume upon theInsured Persons check-out at immigration upon returning to the original country of arrival, subject to the periodcovered i.e. provided the period is still within 30 days of the first departure date of the Insured Persons flightitinerary.

    (3) Travel Assist Benefits covers all public transport undertaken during the period of land cover in the course of theTrip. This is limited to AirAsia Airways flights or, as may be arranged by AirAsia Airways pursuant to flightreschedule, within the country of arrival.

    Contracts (Right of Third Parties)

    A person who is not a party to this Policy shall have no right under the Contracts (Rights of Third Parties) Act to enforce

    any of its terms.

    Arbitration Clause

    (1) Any dispute, difference or question in which may arise at any time hereafter between the Company and theInsured Person or his legal personal representatives in relation to the true construction of the Policy or the rightsof liabilities of the parties hereto shall be referred to arbitration in Singapore and Singapore law shall applythereto.

    (2) The arbitration shall be heard by a single arbitrator to be agreed by the parties hereto within 14 days of thecommencement of the arbitration. In default of agreement, the arbitrator shall be appointed in accordance withand subject to the provisions of Arbitration Act (Cap 10) or any statutory modification or re-enactment thereof forthe time being in force. Arbitration proceedings shall be conducted in accordance with the Rules of theSingapore International Arbitration Centre.

    Governing Law

    This Policy shall be governed by and interpreted in accordance with Singapore law. The Singapore Courts shall havenon-exclusive jurisdiction.

    Condition Precedent

    The Company shall not be liable under this Policy unless the Insured Person or his/her representative, as the case may

    be, has complied with all the terms and condition of this Policy.
