I/We confirm that I/we have read and understood the meaning and purport ofthe Application Guidelines for making this application which are:
1. This Application Form is being submitted by me /us to you at yourregistered office and/or at the offices of your authorized marketing agencies to
be notified in the advertisements of the projectalong with the payment bydemand draft/pay order/cheque mentioned above which is

2. The allotment, if made, will be based on a first come first allottedbasis. The process of which, for all intents, will be fair, transparent andequitable. You shall, however, be entitled to reject my/our applicationand forfeit the application money received, without interest, withoutassigning me / us any reason whatsoever &/or if the said applicationmoney is not realized.
3. If I/we/any of us is/are a Person of Indian Origin or a Non-Resident
Indian, my/our application(s) should be made in conformity with theregulations governing the transactions for the acquisition of immovableproperty by such persons and it shall be me/our responsibility toascertain and fulfil all regulatory requirements including those governingforeign exchange transactions.
4. I/We may withdraw my/our application money; at any time before youprovisionally allot an Apartment against my/our application by executingan Agreement To Sale (ATS). In all such cases, however, you will beentitled to forfeit 5 % of my application money towards service charges.
5. If I/we fail to pay the due amounts as per the demand letters by anymeans of communication through letter/email of any sums due to youI/we will become liable to pay interest at the rate of 15 % per annum toyou on the amount payable from its due date of payment till the dateits entirety together with the interest is paid by me/us and if the delay isbeyond a period of two months from the due dates, you shall at yourdiscretion, become entitled to cancel the application and refund allamounts paid till then after deducting service charges of 5% of the TotalPrice and & 5% of club charges along with interest dues and/ orpayable.
6. .You will also be entitled to reject/ cancel my applications in case of thesame containing information that is incorrect , misleading, incomplete&/or on my/ our committing and breach of the terms and conditions ofthis application form or non payment of any dues . In all such cases,you will refund me / us without any interest all amounts received till thatdate after deducting service charges 5% of the Total Price and & 5% ofclub charges along with interest dues and/ or payable
7. . The layout plans as shown in the Brochure/Presentation are all tentativeand subject to change at your discretion and/or for obtaining theapproval of the concerned authorities.

the apartment applied by me I/we will execute the Agreement to sale asand when requested by you. On my/ our failure to do so you and entitled
to cancel my application and as a consequence of the same refund me /us without any interest all amounts received till that date after deductingservice charges 5% of the Application Money along with interest duesand/ or payable.
9. The layout plan, as may be amended and approved from time to time,shall supersede the proposed tentative layout plan that has now beenmade available now and the plan as amended shall automatically form apart of the ATS without any further reference.
10. Any changes/directions/conditions imposed by any competent authorityat any stage while approving the proposed layout plans shall be bindingon me /us as well as all the other Applicants without the requirement ofany formal approval or consent from any of us for making any changes.If an application for provisional allotment of any Apartment is required tobe cancelled by you for such change of plans, you will refund all amountspaid by the concerned Applicant but without any interest.
11. I/We, as well as all the other Apartment Owners, will compulsorily haveto become members of the proposed Club in Shrachi Dakshin uponpayment of Club Membership Charges to be decided by you and all taxesthat may be payable on such Club Membership Charges. Besides anindividual owner and his/her spouse, dependant parents and children willbe entitled to use the Club upon payment of such Club MembershipCharges and/or user charges for its facilities .
12. I/we may transfer the allotment at any time before registration of theSale Deeds subject to your approval and upon payment of a transfer fees of 3% of the Total Price of the Property to you.
I / We hereby also declare and confirm that:
1.. I/We accept and agree to abide by the Application Guidelines mentionedabove and the Price and Payment Schedule to be prescribed by you.
2. I/we have clearly understood that this Application Form for provisionalallotment will not make me/us entitled to final allotment of anyapartment even after you acknowledge the receipt of the ApplicationMoney and/or issue the allotment letter for an Apartment.
3. I/We further confirm that this application will be binding only after I/weexecute the ATS on the standard format as will be provided by you thatthe allotment shall become final only upon my/our fulfillment of all the

conditions set out in the ATS and the full and final payment there under.
4. I/We further agree to sign and execute necessary documents as andwhen required by you.
5. If, however, I/we fail to execute ATS within the period prescribedtherefore, the allotment may be treated as cancelled at your solediscretion and the company shall be entitled to forfeit 5 % of myapplication money towards service charges.
6. I/We am/are making this application with the full knowledge that theplans for the Complex are not yet sanctioned by competent authority.
7. In the event I/we am/are allotted an Apartment/Bungalow, I/weunconditionally agree to pay all sums due in terms of the Price andPayment Schedule within the due dates of their payments as set out inthe ATS and not dispute the cancellation, if made at your sole discretion,if I fail to pay any of the amounts due on time or violate any of the termsand conditions of the ATS
8. I/We hereby give my/our irrevocable consent to become a member ofthe body of the owners to be formed in accordance with the applicablelaws and will be subject to other applicable statutory laws, rules and by-
laws and execute necessary documents as and when required inconformity with the requirements stipulated by you.
9. I/We solemnly declare and undertake to use the Apartment to be allottedto me/us for residential purposes only.
10. I/We hereby solemnly declare that all the foregoing statements are trueto the best of my/our knowledge and that nothing relevant has beenconcealed or suppressed. I/We also undertake to inform you of anyfuture changes related to the information and details shown in this
Application Form.
12. I/We have signed the Application Form after having read and understoodits meaning and purport and hereby confirm and accept that all previousapplication Form /papers signed/delivered by me to you for theApartment, if any, shall stand void and cancelled after signing &delivering this Application Form to you.
