Background

The Community Plant Variety Office (CPVO) is a decentralized agency of the European Community, which has been operating since 1995.

The CPVO administers a system of Community plant variety rights, a specific form of industrial property rights relating to new plant varieties.

The CPVO grants rights ensuring industrial property protection for eligible new plant varieties. These rights are valid for a duration of either 25 or 30 years.

Its clients are breeders from a wide range of countries in Europe and beyond.

To date, the CPVO has no systematic knowledge of the opinion of satisfaction or dissatisfaction nor of the expectations of improvement from their clients.

Objectives

The CPVO would like to continue developing and optimizing its services in order to guarantee the satisfaction of its customers and maintain their commitment to the system.

In this context, the CPVO decided to carry out a survey, the objectives of which were to reveal the opinions of CPVO customers concerning:

ü The quality and cost of the current system

ü The quality and cost of the services provided

ü The quality of the means of communication, in general and especially the e-business solutions provided

The carrying out of the survey was awarded to IFOP International through a European call for tender n°2004/S104-084520 .

Methodology (1/2)In order to reach the defined objectives, a quantitative client study, with auto-administrated questionnaires was carried out.

A customer listing was supplied by the CPVO including about 500 client contacts with information about the country, name, postal address, telephone number, email address (when available), language of communication, and number of files registered with the CPVO.

To guarantee a sufficient number of respondents, two different means for responding were made available : via a paper questionnaire that was posted to breeders and via a questionnaire available on line.

In the end, 273 questionnaires of CPVO customers were completed, enabling a reliable statistical analysis.

The study fieldwork was carried out from week 45 to week 49 in 2004.

Overall, the results of the CPVO client satisfaction survey conducted in late 2004 are very good. They indicate that customers are generally happy with the services provided by the CPVO and that it results in a good perception of the institution.

A few areas of optimisation have however been identified, none of them really undermining the generally positive tone of the survey. The main expectations towards optimisation tend to revolve around the notion of a simplification of the client’s work. They are primarily expressed in relation to invoicing, the geographic scope of protection and the availability of online services.

More generally, it appears that client satisfaction would be positively influenced by communication geared towards educating the customers on certain aspects of the CPVO’s services which are not well known or not perceived as positively as they should be. These aspects are: delivery times as well as protection rights and the enforcement of titles in courts.

1. Overall satisfaction (Q1)

Global client satisfaction towards the CPVO is high. 90% of clients say they are satisfied overall, including 51% who say they are extremely or very satisfied.

Global satisfaction is good among all categories of clients, but more strongly positive than on average in the agricultural field (96% of satisfied clients) and less strongly in the ornamentals field (85%). This corresponds to a general trend in this survey where the satisfaction of ornamentals clients tends to lag a bit behind that of the other categories of breeders, particularly agricultural ones, without however being alarming. This lower level of satisfaction among ornamental breeders seems to be related to the relative complexity of this field (due to the numerous plant varieties that exist) and the duration of procedures generally perceived as long.

When looking at the impact of the various components of CPVO services on the global satisfaction of clients, the areas that influence overall satisfaction the most are the effectiveness of the protection in general (and more particularly the scope of exclusive rights provided to holders as well as the geographic scope of protection) and the ease of completion of the procedures. This implies that the CPVO actions that are most likely to have a significant impact on customer satisfaction are the ones taken in these areas.

2. Opinion about the effectiveness of the protection of plant varieties (Q22 – Q23 – Q24 – Q25 – Q26)

- 1/3The DUS assessment is fairly well perceived, but the delivery time of reports is not perceived as being completely satisfactory

Overall, the effectiveness of the protection of plant varieties is quite satisfactory with 76% of satisfied clients. Perceptions are more positive among breeders who work in the agricultural field (82% satisfied, 9% dissatisfied) than among those in the ornamentals sector (71% and 22% respectively) and in vegetables / fruits (70%, 20%). In the two latter categories, the dissatisfaction rate concerning the effectiveness of the protection is at an average level as compared to results usually recorded in this type of study.

When analysing in detail, 3 out of 4 clients are satisfied with the scope of exclusive rights provided to them and with the geographic scope of protection. But concerning the geographic scope of protection, there are more dissatisfied respondents among the clients of the ornamentals field than among the clients of the agricultural or vegetables/fruits sector (21% vs. 10% and 9% respectively). We can note that 13 clients mentioned spontaneously that they would like the CPVO to extend its geographic scope of the plant variety protection, some of them even suggesting “a worldwide protection in one application”.

The quality of the DUS assessment of the candidate plant varieties and the correspondence with the CPVO regarding the DUS tests are generally satisfactory. One can notice that a few clients (7 respondents) spontaneously requested making compulsory the declaration of the genetic origin to characterize the plant variety and to control the infringements as this is evidence which is legally accepted.

The speedy delivery of reports is more of an issue. While satisfaction is good among certain categories of clients such as breeders in the agricultural field or breeders who have registered less than 5 files with the CPVO, other categories show some concern regarding this area:

- 34% of clients who registered 20 or more files with the CPVO, ie “big clients”, are dissatisfied with the speed of delivery of reports. More generally, the more files the client has, the more likely he/she is to be dissatisfied with the delivery time of reports.

- 43% of the clients who work with other international organisations to register plant varieties are dissatisfied (vs 45% satisfied) with the speed of delivery of reports.

- 39% of clients in the ornamentals field are not satisfied either.

These figures are not alarming as the time of delivery is an obvious constraint for the breeder (making it very difficult to reach a full level of satisfaction, a bit in the same way as where price is concerned), but they show that the CPVO would benefit in finding ways to speed up its report delivery system or at least in educating clients through communication about the factors taking part in the report preparation process and influencing delivery time as well as the measures taken to speed up the process.

2. Opinion about the effectiveness of the protection of plant varieties (Q22 – Q23 – Q24 – Q25 – Q26)

- 3/3The regulation of protection rights is not widely known.

In terms of ease of enforcement of protection rights, more than half of the respondentsare satisfied with the respect of the protection of their plant varieties by those involved in the industry (57%).

However, many clients do not position themselves regarding the rules in Council Regulation 2100/94 on enforcement (Do not know = 60%), about the enforcement of the title in courts (Do not know = 56%) and about the rules under National law on enforcement (Do not know = 41%), indicating a general lack of awareness of these rules and their enforcement. The satisfaction rate on each of these items is mild (27%, 24% and 37% respectively). Concerning the enforcement of the title in courts, there are more dissatisfied clients among “big clients” (20 or more files registered with the CPVO) than among “small clients” (less than 5 files registered with the CPVO) : 26% vs. 13%.

As the breeders do not know the regulation well, it can be noticed that 3 clients spontaneously ask for the implementation of an inter-professional jurisdiction with plant variety experts.

All in all, regarding the effectiveness of the protection of the plant varieties it can be said that:

- Even if it is perceived as delivering well on these items, the CPVO generally has to take constant care of the respect of the protection of the plant varieties, the scope of exclusive rights and the geographic scope of protection, because effectiveness is what clients pay for first and is what influences their overall satisfaction with the CPVO the most.

- It would be beneficial that the CPVO communicates more to educate breeders about delivery times as well as protection rights and the enforcement of titles in courts. In the latter, the CPVO could for instance provide information on cases and problems treated by the jurisdiction in order to demonstrate that this protection is really effective.

3. Opinion about the technical procedures (Q2 –Q3) - 1/2

Clients are satisfied with the technical procedures of the CPVO, in particular those who work in the agricultural field

Overall, the technical procedures are very satisfactory with 87% of satisfied clients (including 36% “very” or “extremely” satisfied). In particular a very large majority of the clients is satisfied with the ease of accessing the information, the adequacy of the information and the ease of completion of the procedures (91%, 91% and 85% respectively). Besides, considering the response time from the CPVO services and the clarity of the procedures, clients are also clearly satisfied. The speed of completion of the technical procedures is also quite appreciated, with 76% of satisfied respondents.

However, in spite of a good global satisfaction with technical procedures, we have observed a few discrepancies between some categories of clients:

- Regarding the technical procedures, the level of global satisfaction is higheramong clients who registered agricultural crops (98%) than among those who registered ornamental crops (80%) or vegetables/fruits/miscellaneous crops (89%).

- When looking at specific aspects of the technical procedures, one can notice that ornamentals clients are not as pleased as those in the agricultural or vegetables/fruits/miscellaneous field on three dimensions:

§ clarity of the procedures (28% dissatisfied ornamentals clients vs. 10% dissatisfied agricultural clients and 12% dissatisfied vegetables/fruits/miscellaneous clients)

§ response time from the CPVO services (20% dissatisfied ornamentals clients vs. 9% dissatisfied agricultural clients)

§ ease of accessing the information (14% dissatisfied ornamentals clients vs. 2% dissatisfied agricultural clients and 6% dissatisfied vegetables/fruits/miscellaneous clients)

3. Opinion about the technical procedures (Q2 –Q3) - 2/2

- There are more satisfied clients among those who have already registered plant varieties with a National organisation compared to those who work with the CPVO exclusively, especially for the evaluation of the ease of accessing the information, the adequacy of the information and the ease of completion of the procedures (94%, 94% and 88% for National organisation clients vs. 82%, 82% and 77% for CPVO exclusive clients). This infers that the CPVO information seems to be easier to access and more accurate than the information of National organisations.

Even if the technical procedures are well perceived, the CPVO could improve the clarity of its procedures and the response time from the CPVO’s services, especially towards the ornamentals clients. This is confirmed by the fact that 18 clients expressed through open-ended questions the need for a faster processing of applications, whether they relate to examination, registration or global communication. A solution would be to communicate with the clients about the procedure itself, and then explain to them why the procedures can be so complex and/or so long. Here again, the challenge is to educate the client.

4. Opinion about the financial procedures (Q4 – Q5)

Clear and accurate invoices. Payment by means of a charge account held with the CPVO is not so commonly used.

Overall, the financial procedures are very appreciated : 88% satisfied clients including 44% of extremely or very satisfied clients. In particular, there is no problem with the accuracy and the clarity of the invoices. Actually, almost all the respondents are satisfied with the invoices, whether it is for the accuracy or the clarity (respectively 95% and 93%).

Regarding the clarity of the invoices, there are more satisfied people among big clientsthan among small or medium clients (99% vs. 91% and 90%) but satisfaction is still high among all categories of clients.

In addition, those who are aware of the payment by means of a charge account held with the CPVO and who use it are satisfied with it (only 4% of dissatisfied people). However, more than half of respondents do not seem to be able to rate it (Don’t know = 55% overall, 62% among the bigger clients and 44% among small ones).

One can notice that four clients spontaneously asked the CPVO to gather all annual fees for plant varieties and then to introduce one payment only at a unique date in a year. Also, four other clients complained that the CPVO should be more flexible concerning delays of payment.

5. Opinion about the languages used by the CPOV (Q6 – Q7 – Q8)

A great quality and range of languages that makes communication easier than with other organisations.

The CPVO is providing more than enough on language facilities and is laudable for its linguistic proficiency. Actually, scores regarding languages used by the CPVO are remarkably high. 94% of the clients are satisfied, and 77% of them are extremelyor very satisfied with the languages used by the CPVO. Especially, a great majority of the clients is satisfied with the possibility to use a language which they are comfortable using to communicate with the CPVO (95% are satisfied and 37% of extremely satisfied). English is undoubtedly the language which the greatest proportion of the respondents is comfortable with, whatever the situation is (questionnaires, web site, invoices and verbal or written communication). English is followed by Dutch, French and German respectively. Overall, 99% of the clients who participated in the survey are comfortable with one of these four languages. This indicates that should the CPVO wish to limit its languages of communication to these four, client satisfaction would not be affected.

The level of satisfaction towards languages used is particularly high among clients who have already worked with international organisations (as compared to those who work with the CPVO exclusively). This is specially the case in terms of :

- overall satisfaction with the languages used (97% of satisfied clients among international organisations clients vs.88% among CPVO exclusive clients),

- the possibility to use a language which clients are comfortable with (100% of satisfied clients among international organisations clients and 97% among National clients vs. 88% among CPVO exclusive clients).

In other words, the CPVO is perceived as making more efforts than other organisations to facilitate the communication with its clients.

6. Opinion about the overall quality of the services (Q9)

Outstanding services, but a desire for simplifying matters

The overall quality of the services is exceptionally well perceived with 94% of satisfied clients.

However, some suggestions were formulated spontaneously through open-ended questions to perfect as much as possible the quality of the services provided by the CPVO:

- ten clients recommend improving communication, particularly for follow-ups of the technical procedures ;

- seven clients consider the current official forms and technical procedures to be too complicated ;

- according to six clients, from a practical point of view, it would be easier to have the document related to technical procedure in a Word format.

In summary, there is a certain desire for simplifying matters.

7. Opinion about the costs of the system (Q11 –Q12)

Fees are generally at an acceptable level

Overall, 65% of the clients are satisfied with the fees collected by the CPVO and the clarity of the fees structure is well perceived (more than 75% of the clients are satisfied with it). These are good results, more positive than the average in this kind of survey.

At 65%, the level of satisfaction with the annual fees tends to be the highest compared to the level of satisfaction of the other fees (45% for the application fee, 42% for the examination fees, 55% for the take over fee). Globally, fees are perceived as acceptable, especially for companies with 50 or more employees who are more satisfied with the application fee (900€) and the take over fee (240€) than companies with less than 50 employees (satisfaction rates are 52% and 62% for big companies vs. 39% and 50% for small companies respectively).

Generally, clients tend to be more concerned about the costs that have to be incurred before the protection is granted - the application fee (900€) and the examination fees (from 1020 to 1200 €) - than with the annual fee. As it were, 22 clients spontaneously expressed that the application fee and the examination fees are too expensiveconsidering among other things that protection may not be awarded.

In the end, one can consider that the CPVO fee structure is well appropriate. Should a need arise to increase fees, it would have to affect primarily the annual fees and the fees charged to larger companies (e.g through a system where part of the fee relates to the size of the applicant’s structure).

8. Opinion about the communication provided by the CPVO (Q14 – Q15 – Q16 – Q17 – Q18) - 1/2

Internet and telephone are the most used and appreciated communication media

The communication provided by the CPVO is very well perceived. Overall, 90% of the clients are satisfied with the communication media provided by the CPVO.

The web site, the telephone and the CPVO online database are the most used communication media, with respectively 91%, 87% and 79% of users. Besides the web site and the telephone gather the greatest score of satisfaction with 84% and 83% respectively: it is not surprising as clients tend to use supports which they are satisfied with.

We can note that, with regards to the communication provided by the CPVO, there are more dissatisfied people among ornamentals clients compared to agricultural clients (10% vs. 3% of dissatisfied people).

In a logical way, clients who have registered 20 or more files have more experience of the CPVO communication media than the smaller ones (less than 5 registered files):

§- 93% have contacted the CPVO by telephone vs. 81% among companies with less than 5 files registered ;

§- 88% have looked up the online database (vs. 65%) ;

§- 73% say they have received the Official Gazette (vs.21%).

§- 36% consulted the annual report on the web site (vs. 16%).

8. Opinion about the communication provided by the CPVO (Q14 – Q15 – Q16 – Q17 – Q18) - 2/2

The more regular clients of the CPVO also tend to be more satisfied with the communication media than the more sporadic ones (95% vs. 81% satisfied). Especially, those clients with more than 20 registered files have a particularly good opinion about written documents such as the Official Gazette and written information delivered by post. According to theseregular clients, more than for the other ones, the CPVO communication media are not only clear enough but keep them sufficiently informed.

As only a few clients (17%) have already attended meetings between the CPVO and the breeders, the CPVO could promote them more, especially towards the small clients who tend to appreciate this type of event less than the big clients (92% vs. 68% have never attended such meetings).

Almost half of the clients (48%) did not give their opinion on the Official Gazette, probably because they do not read it. Actually, the Official Gazette is not clear enough for some clients, especially because of the different languages used. For that matter, seven clients suggested that the CPVO should send it by e-mail rather than in paper format : in this way one language adapted to each client would be directly accessible.

At this stage, a few clients suggest spontaneously to use email as one of the communication media, for example to receive the status report for an application from the CPVO (3 respondents), and also online newsletters (4 respondents). Communication by email generally seems to be very welcomed by breeders.

9. Opinion about a possible introduction of e-business / internet solutions (Q19 – Q20 – Q21)

Most clients would really like the CPVO to develop online services

Clients’ reaction to some of the online services proposed is so positive that the CPVO should very clearly try to launch them in the very near future. This is the case for e-mail alerts with the mention of important deadlines regarding the CPVO applications,electronic access to documents, electronic tracking of progress regarding the technical procedures and electronic applications which interest a large majority of the clients who say they would use them (respectively 93%, 90%, 90% and 88% of declared intent to use).

We can note that, as expressed by eight clients, information available on-line on existing plant varieties would be seen as an advantage.

E-services (electronic invoicing, electronic tracking of progress regarding the financial procedures) would be a solution to the desire for simplification expressed by the clients, especially clients who answered the questionnaire by internet who are obviously very open to this media. However the levels of intent to use of these services (63% for electronic invoicing, 65% for electronic tracking of progress) probably makes it less of a priority for implementation.

Secured electronic payments (with a credit card number) seems to be more of an option for small companies with less than 50 employees or for those who have registered less than five files. On-line payment would contribute to fulfill their desire for simplification whereas in larger structures payment processes seems to be running fine without that type of option.

Causal Tree : Methodology Q1

An analysis of the relative impact of the different features in the overall opinion score.

The causal tree analysis is a multivariant analysis or partial regression which seeks to define the weight of the causality of a factor on another.

The objectives are three-fold :

– Organise the items amongst themselves, grouping them into different families

– Calculate if there is a significant causal relationship between the level of overall opinion score and the average score given to the different features researched

– Measure the weight of this effect
