SYDNEY CORPORATION (AMENDMENT) BILL :— Clause 1 having been dealt with,— Clause 2. (1) (a) The triennial election of aldermen directed by section Postponement

nineteen of the Sydney Corporation Act, 1932, to he held on the first Welectierf day of December, one thousand nine hundred and thirty-three, is hereby postponed until a day (in this Act referred to as "the appointed day ") to be appointed by the Governor and notified by proclamation published in the Gazette.

The day so appointed shall not be later than the thirtieth day of Tune, one thousand nine hundred and thirty-four.

(b) The aldermen in office at the commencement of this Act may, subject to the provisions of the Sydney Corporation Act, 1932, as amended by subsection one of this section, remain in office until the election of aldermen on the appointed day is held, and shall then retire from office, but may at such election be re-elected if otherwise qualified.

(2) Nothing in this section shall affect the operation of section twenty of the Sydney Corporation Act, 1932.

CONSTITUTION AMENDMENT (LEGISLATIVE COUNCIL ELECTIONS) BILL :—

Clause 4. The Constitution Further Amendment (Legislative Council Elec-tions) Act, 1932, is further amended-

* (b) by inserting after the Third Schedule (as inserted in the Constitution

Further Amendment (Legislative Council Elections), Act, 1932, by section three of this Act) the following new Schedule:—

FOURTH SCHEDULE. DIVISION I—LEGISLATIVE COUNCIL.

Special Rules for Regulating the Conduct of Proceedings at a sitting held for the purpose of taking the Votes of Members of the LegMlative Council at any Election under the Constitution, (Legislative Council Elections) Act, 1932-1933.

9. A Member desiring to vote shall, when called by the President, conic forward to the Table and obtain his ballot-paper from the Clerk.

Unless he desires his vote to be marked in accordance with section 19A of this Act, he shall forthwith retire alone to one of the unoccupied voting compartments and mark his ballot-paper, and having marked his ballot-paper he shall deposit it in the ballot-box and resume his seat or retire from the Chamber.

Where the ballot-paper of a Member is marked in accordance with section 1.9A of this Act; and deposited in the ballot-box, the Member shall resume his seat or retire from the Chamber.

1.1. At the hour appointed in the Writ for the termination of the taking of the votes at a sitting, the President shall announce that such hour has arrived and shall direct that the doors be locked.

The doors having been locked, the President shall then inquire whether there is any Member present who has not yet received a ballot-paper and desires to vote.

Every such Member shall rise in his place, and his name shall be recorded by one of the Clerks at the Table upon a list, which shall be handed to the President.

An opportunity to record their votes shall be given to such Members, and also to any other Members who, having received their ballot-papers before the hour appointed in the Writ for the termination of the taking of the votes, have not at that hour completed the recording of their votes.

After such opportunity has been given the President shall declare the ballot closed.

DIVISION D.—LEGTSDATIVE ASSEMBLY.

to the Clerk for the purpose of satisfying him, in accordance with subsection three of section nineteen of this Act, that the ballot-paper has been spoilt by mistake or accident; nor shall this section operate to preclude the marking of a vote pursuant to section 19A of this Act. [Read.]

GUARDIANSHIP OF INFANTS BILL :— Clause 1 having been dealt with,— Clause 2. The Infants' Custody and Settlements Act of 1899 is amended— '17 1,14.°Art809to.

(a) by omitting section five and by inserting in lieu thereof the following substituted s. 6 ' now section:—

5. (1) The Supreme Court in its equitable jurisdiction may, upon Custody of the application of the mother of any infant, make such order as it infant. may think fit regarding the custody of the infant and the right of access thereto of either parent, having regard to the welfare of the

infant, and to the conduct, of the parents, and to the wishes as well of the mother as of the father.

The fact that a parent contemplate* leaving the jurisdiction shall not of itself be regarded as a reason for denying such -parent the custody of the child or depriving such parent thereof if the court is satisfied that the welfare of the child will best; be served by allowing such parent to have or retain such custody.

(2) The power of the court under this section to make an order as to the custody of an infant and the right of access thereto may be exercised notwithstanding that the mother of the infant is then residing with the father of the infant.

(a) A sum not exceeding £4,260,000, payable out of the Consolidated Revenue Fund, to defray the expenses of the various Departments and Services of the State during the months of October, Novem-ber, and December, or following month of the financial year ending 30th June, 1934, to be expended at the rates which are shown on the Estimates for the financial year ending 30th Juno, 1934, as laid upon the Table of the House, subject to the rate of 'any reduc-tion that may hereafter be made in the expenditure of the year 1933-1934.

(b) A sum not exceeding £2,981,000, payable out of the Government Railways Fund, to defray the salaries, maintenance and working expenses, and other expenses of the Department of Railways during the months of October, November, and December, or following month of the financial year ending 30th June, 1934, to be expended at the rates which are shown on the Estimates for the financial year ending 30th June, 1934, as laid upon the Table of the House, subject to the rate of any reduction that may hereafter be made in the expenditure of the year 1933-1934.

(c) A sum not exceeding £77,000, payable out of the Road Transport and Traffic Fund, to defray the salaries, maintenance and working expenses, and other expenses of the Department of Road Trans-port and Tramways during the months of October,' November, and December, or following month of the financial year ending 30th June, 1934, to be expended at the rates which are shown on the Estimates .for the financial year ending 30th June, .1934, as laid upon the Table of the House, subject to the rate of any reduction that may hereafter be made in the expenditure of the year 1.933-1934.

"Board" means the New South Wales Dried Fruits Board. "Buck currants" means dried fruits produced solely from currant grapes

and which contain more than five per ceritum of berries containing seeds.

"Buy" includes barter or exchange; and also includes agreeing to buy; and "bought" has a corresponding meaning.

"Cleanness" in relation to dried fruits means free from foreign substances. "Dealer" means any person who buys or sells in any one year whether on

his on behalf or as agent for another person more than one ton of dried fruits, but does not include—

(a) i a person who sells only such dried fruits as have been bought from dried fruits dealers who are registered as such with the board.

(b) a person who is the owner of a packing shed registered as such with the board;

(c) a grower who sells the dried fruits produced by him only to a packing shed or dealer registered as such with the board;

(d) an auctioneer who sells dried fruits in the ordinary course of his business.

No. i. PUBLIC SERVICE SALARIES (AMENDMENT) BILL :—

Clause 1 having been dealt with,— Clause 2. (1) The Public Service Salaries Act, 1931-1933, is amended by Amendment

omitting subsection two of section four and by inserting in lieu thereof of Act , the following subsection:— No. 29, 1931.

(2) (a) In the application of the provisions of this section to the (Rebates.) case of a married male officer, or an officer who is a widower or a divorced person with dependent child or children, or an officer who is a widow, a deserted wife, or a divorced person with dependent child or children, the provisions of paragraphs (b), (0), and (d) of this subsection shall have effect.

(b) Where the salary of the officer does not exceed the rate of three hundred and twenty-five pounds per annum, the officer shall be entitled to a rebate from the deductions prescribed by this section of an amount in accordance with the following scale:—

Amount of rebate from the deduction prescribed by

Not exceeding the rate of two hundred Thirty pounds per annum. pounds per annum.

In excess of two hundred pounds per annum Twenty pounds per annum. and not exceeding two hundred and sixty-eight pounds per annum.

In excess of two hundred and eighty pounds Ten pounds per annum. per annum and not exceeding three hundred pounds per anum.

In excess of three hundred pounds per aim= Five pounds per annum. and not exceeding three hundred and twenty-five pounds per annum.

(c) Where the salary of the officer is in excess of the rate of two hundred pounds per annum, such salary shall not be reduced below two hundred pounds per annum; and where it is in excess of the rate of two hundred,an'd siXty2eight pounds pet Sit) num it shall not be reduced below two hundred and forty-six pounds ten shillings per annum; and where it is in excess of the rate of two hundred and eighty pounds per annum it shall ribt be reduced below bt6 hbridred and fifty-one pounds per annum; and where it is in excess of the rate of three hundred pounds per annum it shall not be reduced below two hundred and sixty-two pounds ten shillings per annum; and where it is in excess of the rate of three hundred and twenty-five pounds per annum it shall not be reduced below two hundred and seventy-eight pounds ten shillings per annum.

(d) The provisions of this subsection shall not operate to entitle an officer to the payment of salary at a rate in excess of that which would have been payable if this section had not been enacted. -

(2) The rebates referred to in paragraph (b) of subsection two of seetibit ioilr of the Public Service Sdlaries Act; 19314933, as amended by this Act, and any adjustments rendered necessary by the provisions of paragraph (c) of the said subsection two, shall be made in the case of each officer as from the commencement of the first pay period applicable to the officer in the month of November in the year one thousand nine hundred Mad thirty-throe.

DAIRY PRODUCTS BILL :— Clauses 1 and 2 having been dealt with,— Clause 3, (1) There shall be a Board to be called the "New South Wales Dairy

Dairy Products Board," which shall consist of seven members appointed Products. Board. by the Governor. (2) Of the members so appointed—

(a) one shall be nominated by the Minister; (b) two shall be persons nominated by the boards of directors of

companies which are manufacturers as the representatives of such companies;

(c) two shall be persons nominated by the boards of directors of societies registered under the Co-operation Act, 1923-1932, which are manufacturers as the representatives of such societies;

(d) two shall be nominated by the Primary Producers' Union of New South Wales as the representatives of such union.

The nominations pursuant to paragraphs (b), (c), and (d) of this subsection shall be made in the manner prescribed.

" This subsection shall not extend to flour coming into existence in New South Wales after the commencement of the Flour Acquisi-tion (Amendment) Act, 1933."

(c) (i) by inserting in subsection one of section four after the word "exercised" the words "after the commencement of the Flour Acquisition (Amendment) Act, 1933, or";

(ii) by inserting at the end of the same subsection the words "which-ever shall be the earlier date."

(3A) The Commissioner for Main Roads appointed under the ca rditsrYtiliriV4 Transport (Division of Functions) Act, 1.932, shall in each year pay to the Treasurer from the Country Main. Roads Fund for the credit of Consolidated Revenue Fund such sums as may be required to provide for interest, sinking fund and other loan charges on loans appropriated for country main roads or Federal Aid Roads in the Western Division after the thirty-first day of December, one thousand nine hundred and twenty-four, and before the first day of Tidy, one thousand nine hundred and twenty-eight.

The provisions of this subsection shall not apply to loans on which interest, sinking fund or other loan charges are payable as and to the extent elsewhere provided in this Act. The rates, terms and conditions of payments in accordance with this sub-section shall be as agreed upon by the Commissioner and the Treasurer.
