Executive Summary
This document is the first supplementary Resettlement Action Plan (RAP) for the Section
Grabovnica-Grdelica which aim was to identify the adverse impacts associated with the expropriation of
the necessary land for the construction of the Grabovnica- Grdelica section of the E-75 in Southern Serbia
and present the plan to deliver the compensation and assistance entitlements, in accordance with policy
provisions adopted for this project, to enable the affected people to maintain or improve their living
standards. Additional objectives, in so doing, are to bring a greater transparency to the expropriation
process. and ensure that the said process is conducted in accordance with applicable domestic legislation
and the safeguard policies of the World Bank.
The RAP was provided with the World Banks No Objection and has been publicly disclosed on April 26,20 12.
In line with the Loan Agreement and after the respective procedures were finalized a Contract for Construction works was signed with the Greek Company TERNA S.A:
In line with the provisions of the Resettlement Policy Framework any additional impact should be considered and dealt with in line with the basic provisions of the Framework and the Resettlement Action Plan properly authorized and disclosed. The implementing entity expresses its reassurance that the additional expropriation will be followed by the same principles as determined in the respective RAP for this section.
During the implementation period and execution of works under the respective Construction works contract a discrepancy was identified between the Main design and Bill of quantities and the actual needs for construction works. Usually the main design envisages the expropriation of necessary land to allow regulation of river beds if such works are envisaged and necessary under the Design. However such land was not part of the Main design of expropriation and therefore not part of the process conducted for land acquisition in respect of the main alignment and structures. By request of the Employer CoS initiated development of supplementary technical documents resulting in expropriation of additional land.
This Annex deals with the additional land expropriation for purposes of acquiring land for regulating the river bed of the river South Morava that requires the expropriation of 0,5694 hectares of land (5694 square meters), within the Cadastral Municipalities of Mala Kopasnica and Grdelica Selo. The number of project affected persons (PAPs) and cases within each of the Cadastral Municipalities is in Mala Kopasnica 3 parcels, 1 with one owner, 2 with co-owners and Grdelica Selo26 parcels 1 5 with one owner, 4 with coowners, 3 are in state property. Total number of expropriated parcels are 25 (3 in state property), with 16 sole owners and 6 co-owners. (Note that one PAP might be owner of one or 2 parcels, as two or more owners might be co-owners of one, two and more parcels). Area in state property covers 1 . 1 87 m2, or 20.8% of expropriated land. Average size of expropriated parcels privately owned is around 205 m2.
The RAP documents the information-gathering and analytical process to ensure that the proposed developments leave no individual (project affected person or PAP) worse off than they were in the preproject state. The process involves the assessment of all physical or economic impacts. displacement, or temporary or permanent loss of assets or facilities that may be experienced by the communities along the road.
The Expropriation process has commenced during January 20 1 5 and is expected to be finished until August 2015.
Up to day, 5 compensation offers have been made to owners and acceptance by the owner is pending- The other owners shall be submitted with offers ones the proceeding reaches the compensation stage. So far

no owner has opted to enter judicial process.
Nature of Impacts
The following impacts were identified in this additional land acquisition:
a)Permanently acquired land consisting of cultivated and non/cultivated land within the line of acquisition. The cultivated land includes paddy field, dry field, vegetable field, non-cultivated land and forestry field.
Legal Framework for Land acquisition and compensation payment
The legal procedure for Land acquisition and compensation payment are outlined in the original Resettlement Action Plan. Basic principles and rules have been set and they shall be respected and applied throughout the process of acquisition of this additional land.
Budget and cost
Basic Cost of expropriation includes land compensation cost, compensation for standing crops, and other taxes. All the funds made available through PERS are estimated and designated through the Law of the Budget for 20 1 5 and Business Plan of PERS, by which the necessary amount of needed funds are transferred to the PERS. The Government made those funds operable by passing the Law through the Parliament. The law of the Budget has been passed through the Parliament and disclosed at the Official herald of Republic of Serbia. The estimated budget is 3.200.000,00 RSD (app 26.666,00 EUR) which covers the average compensation amount of 700 RSD/m2 (cca. 6,5 EUR/ m2).
The execution of the Budget, which shall be proof of compensations paid, shall be certified by PERS, The respective Municipality shall certify that the expropriation of land is finalized,
Socio-economic data
The census of people affected by the project has been done through the identification of owners whose property will fall under the impact of additional land acquisition. The key element to the social impact is that no structure is subject to expropriation. The next element, with the same relevance to the social impact, is that the area of expropriated land parcels is rather small and therefore, it may be concluded that most of the expropriated parcels are to be considered as minor impact, either being less than 20% of the total land property of household/ family and without expropriated the structures
In line with respective provisions of the RPF consultations were held with the PAPs in order to exchange information. Best practice in previous expropriation showed that free flow of information between project implementing entities and PAPs is essential to promoting effective public consultation and participation and to achieving the objectives of resettlement activities. Since the impact is rather small whilst serving the individual hearings PAPs were informed about need for additional land acquisition and individually informed al:>out the an~a to be expropriated . The CoS team also informed the PAPs about salient features of the Law of expropriation in respect of payment.
