Voorwoord - Foreword | DSHS

Het is mij een genoegen u middels dit voorwoord welkom te mogen heten. Voor u ligt een catalogus waar we ontzettend trots op zijn. Het is namelijk een symbool van samenwerking. Het betekent dat we er met ons team weer in geslaagd zijn een collectie te vormen waar de markt volgens ons behoefte aan heeft.

We zien dat de sport steeds veeleisender wordt, dat vraagt van ons een reactie om het geheel naar een nog hoger niveau te brengen. Het kennen van de markt en de ervaring is een bepalende factor. De collectie van deze 16e editie laat dan ook zien waar we voor staan.

Ik nodig u van harte uit om onze collectie goed te bestuderen. Laat het ons weten wanneer u vragen heeft. Er is ons alles aan gelegen u te koppelen aan het juiste paard.

Emile, Paul, Timothy & Michel HendrixDe familie Hendrix runt één van de be-kendste en meest succesvolle spring- en handelsstallen van de wereld. Door hun betrokkenheid en kennis van getalenteerde paarden hebben zij in de paardenhandel een wereldwijde klantenkring opgebouwd. Paul streeft naar perfectie en hij heeft er oog voor om de beste jonge paarden op te sporen. Samen met de ruiterervaring van Emile voelen de broers samen feilloos aan wat een sportpaard in zijn of haar mars heeft. In 2016 zijn Timothy, zoon van Emile, en Michel, zoon van Paul, officieel toegetre-den tot de selectiecommissie. Dankzij hun sportervaring, ruitergevoel en jarenlange betrokkenheid bij de veiling zijn zij een perfecte aanvulling op de commissie. Voor de Dutch Sport Horse Sales zullen deze hippische ondernemers zich vol overgave inzetten voor de beste selectie van jonge springpaarden. Met de DSHS kunnen zij hun klantenkring in een perfecte ambiance een goed samengestelde collectie jonge springpaarden presenteren.

Yves HoutackersNa ruim 12,5 jaar werkzaam te zijn ge-weest bij Equestrian Center ‘De IJzeren Man’ te Weert, is Yves in 2007 zijn eigen hippische onderneming gestart: Springstal Yves Houtackers B.V. Hij heeft zijn ervaring en kennis mede opgedaan bij de Zweedse top-amazone Malin Baryard en de Duitser Marcus Ehning. Inmiddels is Yves zelf suc-cesvol in de springsport en traint hij een groot aantal internationale ruiters. Sinds 2014 is Yves ook directeur sportief bij het CHIO Rotterdam. Voor de ontwikkeling van de Dutch Sport Horse Sales is het van be-

Emile, Paul, Timothy & Michel HendrixThe Hendrix family runs one of the best known and most successful show jumping and trading yards in the world. Through their involvement and knowledge of talen-ted horses, they have built up a worldwide clientele in horse trading. Paul strives for perfection and has an eye for scouting the best young horses. Along with Emile’s experience as a top rider they flawles-sly sense whether or not a sport horse has what it takes. Since 2016 Emile’s son Timothy and Paul’s son Michel have offici-ally joined the selection committee. Thanks to their experience in the sport, aptitude for show jumping and years of involvement in the auction they are a perfect addition to the committee. For the Dutch Sport Horse Sales these equine entrepreneurs work diligently to select the best young show jumpers. With the DSHS they are able to present their customers a well composed collection of young show jumpers in a per-fect setting.

Yves HoutackersAfter 12.5 years of employment at Equestrian Center ‘De IJzeren Man’ in Weert, Yves started his own equestrian business in 2007: Springstal Yves Houtackers B.V. He gained experience and knowledge wor-king with Swedish top rider Malin Baryard and German Marcus Ehning. Meanwhile Yves himself is successful in show jum-ping and he trains a large number of inter-national riders. Since 2014 Yves is also the sports director of the CHIO Rotterdam. For the development of the Dutch Sport Horse Sales it is important that a rider like Yves shares responsibility for the selection of

Katokyboy HDH Deze om meerdere redenen opvallende Katokyboy HDH beschikt over alle eigenschappen waarmee hij kan uitgroeien tot zowel een tophunter als een internationaal succesvol springpaard. Hij is geheel volgens de filosofie van Hans Dings gefokt, met diens valkkleurige oogappel Cream On Top als moedersvader. In de Stal Hendrix-competitie maakte deze vierjarige hengst keer op keer indruk met zijn enorme vermogen, fantastische reflexen en uitzonderlijke techniek. Zijn vader Arezzo VDL presteerde zelf verdienstelijk op internationaal 1.50m-niveau met Jessica Kürten en Jur Vrieling, en drukt een stempel op de fokkerij met succesvolle nakomelingen als Edgar M, Electra B, Hampshire en Farezzo. Katokyboy HDH A remarkable horse for multiple reasons, Katokyboy HDH possesses all the traits to become a top hunter as well as an internationally successful show jumper. He was bred according to the philosophy of Hans Dings, whose buckskin beauty Cream On Top is Katokyboy HDH’s dam’s sire. In the Stal Hendrix competition, this four-year-old stallion impressed time and again with his enormous scope, fantastic reflexes and exceptional technique. His sire Arezzo VDL, who rightfully competed at the international 1.50m level under Jessica Kürten and Jur Vrieling, is putting his stamp on the breeding industry with successful offspring such as Edgar M, Electra B, Hampshire and Farezzo. F.Kalyana Dreams ZMet zijn geweldige, lichtvoetige galop en atletisch vermogen maakte deze F.Kalyana Dreams Z al veel indruk in de Stal Hendrix-competitie. Hij combineert zijn springtalent met goede rijkwaliteiten en een zeer sportief model. De vierjarige ruin komt uit de tweede jaargang van verrichtingskampioen Flying Dream, die inmiddels in China op 1.40/1.50m-niveau presteert en een goede indruk maakt met zijn oudste nakomelingen in de jonge paardenwedstrijden. F.Kalyana Dreams Z vertegenwoordigt van moederszijde de bekende Ulana-stam, een sterke vertakking van Holsteiner stam 242. He combines jumping talent with good riding qualities and excellent sporthorse conformation. The four-year-old gelding is out of the second crop of foals by performance test champion Flying Dream, who currently is competing at the 1.40/1.50m level in China and making a good impression with his oldest offspring in the young horse competitions. On his dam’s side, F.Kalyana Dreams Z represents the renowned Ulana-line, a strong branch of Holsteiner-line 242. His dam Alyana Z, who competes internationally at the 1.30m level, is a half-sister to the international 1.50m show jumper Quasibobo Z (s.Quasimodo Z), ridden by Sacha Kainz. F.Kalyana Dreams Z’s granddam Cenlana Z is a full-sister to the international 1.50m horse Team Harmony Chelto Z, ridden by Robert Harrison. Quickly van de HagenhorstOp de najaarskeuring van Zangersheide in 2018 liet deze veelbelovende Quickly van de Hagenhorst al geen enkele twijfel bestaan over zijn springtalent en daarmee verdiende hij het dekbrevet. Ook onder het zadel blinkt deze vierjarige zoon van de veelbesproken Grand Prix-hengst Quickly de Kreisker uit met zijn lichtvoetigheid en enorme vermogen. De Holsteins gefokte hengst lijkt alles in huis te hebben om uit te groeien tot een paard voor de grote sport. Hij komt uit de zeer succesvolle fokkerij van Otto-Boje Schoof en is daarmee nauwverwant aan talloze internationale springpaarden. Zo is zijn moeder Z-Caretana een halfzus van het internationale 1.55m-springpaard C T (v.Casall) waarmee Hugo Simon heel wat overwinningen behaalde. Grootmoeder Klaudia is een halfzus van het 1.50m-paard Carl der Grosse 4 (v.Carolus I) van Pedro Yrigoyen en is onder meer ook terug te vinden in de tweede generatie achter Nick Novak’s 1.50m-troef Climbus (v.Cartani). Quickly van de HagenhorstAt the 2018 Zangersheide fall stallion approval, this promising horse named Quickly van de Hagenhorst left no doubt about his jumping talent and therefore earned his breeding licence. Under saddle, the four-year-old son of the highly acclaimed Grand Prix stallion Quickly de Kreisker also excels with his light-footed movement and enormous scope. The Holsteiner-bred stallion possesses all the traits needed to become a horse for the elite sport. He is from Otto-Boje Schoof’s very successful breeding program and is therefore closely related to numerous international show jumpers. His dam Z-Caretana, for example, is a half-sister to the international 1.55m show jumper C T (s.Casall) with whom Hugo Simon achieved many victories. Quickly van de Hagenhorst’s granddam Klaudia is a half-sister to the 1.50m horse Carl der Grosse 4 (s.Carolus I), ridden by Pedro Yrigoyen, and can also be found in the second generation of this pedigree behind Nick Novak’s 1.50m trump card Climbus (s.Cartani), among others. Jean CoutureNet zoals haute couture op modegebied het neusje van de zalm betreft, is ook deze Jean Couture van uitzonderlijke klasse. Deze zeer moderne vijfjarige hengst valt op met zijn enorme gedragenheid, lichtvoetige galop en fantastische manier van springen. Met een 9 voor het springen en een 9 voor de rijdbaarheid won hij al een wedstrijd van de Stal Hendrix-competitie, waarin hij keer op keer heeft laten zien een ongekend talent te zijn. Jean Couture komt uit een sterke moederlijn waarin louters topverervers zijn opeengestapeld. Zijn moeder Douglas is een halfzus van de KWPN-kampioenshengst In Between (v.Toulon), die bij het Zangersheide goedgekeurd werd, en grootmoeder Zuduela is een halfzus van het internationale 1.45m-springpaard Fancy (v.Vigaro) van Weronika Wilska. Deze familie leverde al talloze internationale sportpaarden zoals ook Viceroy (v.Tangelo van de Zuuthoeve), Non Stop R (v.Lux) en Dimodo (v.Quasimodo Z). Jean CoutureJust as haute couture fashion is concerned with the cream of the crop, so is this horse named Jean Couture of exceptional class. This very modern five-year-old stallion stands out with his excellent carriage, light-footed canter and fantastic way of jumping. With a 9 for jumping and a 9 for rideability, he won a contest in the Stal Hendrix competition in which he showed unprecedented talent time and again. Jean Couture comes from a strong dam-line, which features a succession of top sires. His dam Douglas is a half-sister to the KWPN champion stallion In Between (s.Toulon), who was approved by the Zangersheide studbook; and Jean Couture’s granddam Zuduela is a half-sister to the international 1.45m show jumper Fancy (s.Vigaro), ridden by Weronika Wilska. This family has produced numerous international sporthorses, including Viceroy (s.Tangelo van de Zuuthoeve), Non Stop R (s.Lux) and Dimodo (s.Quasimodo Z). Given his great talent and strong pedigree, this son of the good Grand Prix breeding stallion Arezzo VDL is among the eye-catchers of the collection.

ChabalitoDeze opvallende, vijfjarige schimmelruin combineert een prachtig bloedgemaakt model met een fantastische manier van springen en hij is bovendien heel plezierig in de omgang. Voor zowel de spring- als de huntersport is Chabalito een ware aanwinst. Deze Holsteiner vertegenwoordigt de fokkerij van de bekende familie Ritters en hij komt uit de tweede jaargang van de inmiddels op 1.50m-niveau succesvolle hengst Casalito van Christian Hess. Zijn moeder leverde in combinatie met Conello al het internationale springpaard Chikkimikki waarmee Angelique Rüsen onder meer de tweede plaats opeiste in de 1.50m-Grand Prix van CSI2* Biblis. Ook de nationale 1.40m-springpaarden Claudine 10 (v.Claudio) en Claudia 37 (v.Claudio) evenals het internationale 1.35m-paard La Costa (v.Larimar) zijn uit dezelfde moeder als Chabalito gefokt. Interview - Fredrik Spetz“Sometimes a little bit of luck is involved”

Since the paths of Fredrik Spetz and the Hendrix family crossed ten years ago, the collaboration between them has grown from strength to strength. The Swedish rider was introduced to Paul and Emile by his friend Erik Jerneld. “Over the years a good relationship has developed. The Hendrix family is always helpful, supportive and we are good friends”, Fredrik begins to tell. “I’ve visited the auction many times, but it was not until 2017 that we purchased a horse. We came close to buying other horses many times before, but as you know sometimes there is a little bit of luck involved”.

Yet there is no shortage of horses that have come from Stal Hendrix at Stall Spetz. “I think there are close to 15 horses from the Hendrix family at our stables right now”, continues Fredrik, who runs his own show jumping stable from his parents’ yard. “My father Johan was also active in the sport when he was younger, now he trains and coaches other riders a lot. My mother Ansa has always managed the family business. Until 2007 we owned a riding school as well. So you can really say I learned the basics at home”.

Future prospectFredrik lives with his partner Kristin and their 1,5-year-old son Axel. Because the family is based in Sweden, Fredrik has to travel a lot. “So when I visit, I try to stay in Baarlo for several weeks on end. I combine riding shows and training with Emile. Being able to learn from him is fantastic”, Fredrik says enthusiastically.

He speaks in the same manner about the horses he rides, that have come from Stal Hendrix. “When we look for a horse, their age or experience plays only a small role. It really depends on their potential. For example, Great Kenney. She was purchased as a five-year-old by Philippa Ringborg. I’ve been riding her for three years now and she is really developing into an excellent horse that is capable of great things in the future”.

Success storyI have had a good season in which quite a few horses from Hendrix have played a significant role. Such as Flanagan, Janou and Dustin. If I had to choose one horse that has truly impacted my career it would be Dustin. He is a real success story. He is owned by Charlotte Rapp Hamrén and was well produced and showed at 1.40m level with Tim Hendrix before I started riding him. Dustin took me to nice shows in Oslo, Maastricht, Gothenburg, Drammen NC and the GCT in Stockholm”.

Ay CarambaThe horse that caught Fredriks eye at the auction in 2017, Ay Caramba, definitely meets the expectations. “Really that is no surprise. My experience has taught me the horses that come from Hendrix all possess quality. I visited the auction with Charlotte Rapp Hamrén, one of the horse owners I ride for, and this time luck was on our side and we were able to bring Ay Caramba back to Sweden. We are very happy with him. He is a very careful and sensitive horse. We are taking the time to develop him, but he is definitely going in the right direction and is a horse for the future”.

Interview - Katharina Offel “All the horses have at least been as good or even better than I imagined’’

German rider Katharina Offel is a regular visitor of the Dutch Sport Horse Sales. She has also known the Hendrix brothers for a long time. “We go way back. I met them back in the day when Emile was still riding. It was only when I started my own stable in 2013, that I began doing business with them”. Since then Katharina, also known as Kathi, has together with her owners purchased three horses at the Dutch Sport Horse Sales and they’ve all impressed her in different ways.

In 2015 Kathi moved to the Netherlands and since 2017 the Olympic show jumper happily calls the village of Bemelen, near the city of Maastricht, her home. Together with her partner Jannicke she runs the newly built stables of Katharina Offel Sporthorses. Two of the three horses acquired at the DSHS-auction have since found new owners. “Until now we’ve had a lot of luck, because all the horses have at least been as good or even better than I imagined. Normally we visit the auction

every year. We always try the horses we find interesting beforehand. We trust Paul and Emile. They make an effort of showing the horses they think will fit or be a good match for my clients and students”.

My friend“We bought Gerton and Hardy in 2016. Gerton really clicked with me right from the start. He was competitive, careful and fully lived up to my expectations. He was such an easy going horse, but also such a winner!”, Kathi looks back. Winning at least one YH-class almost every show he entered, Gerton made quite an impression. “Not only his achievements were very good, also his character was really special. I always referred to him as my friend. He is still a winner with his new Finnish owner. She is a junior rider and does very well with him at 1.40m level”.

Learn each day“Hardy was also a horse that possessed all the qualities needed to succeed. In the beginning of this year he was sold to Qatari

rider Bassem Mohammed”. Nico, which is short for Nicolo, is a firm favourite at Kathi’s stables. “We bought him in 2018 as a six-year old at the DSHS. He is a very classic horse with a great character. Next to being scopey, eager and careful, he always has the will to clear every round and learn each day. We are going to produce him carefully, as we believe that he has the potential to be a very successful Grand Prix horse one day”.

De vijfjarige Jykarlos valt telkens op met zijn geweldige springkwaliteiten, inzet en potentie. Five-year-old Jykarlos turns heads time and again with his amazing jumping traits, willingness and potential. Jive Z.G.Enkele maanden voor de veiling kon deze overtuigend springende Jive ZG aangekocht worden. Ze blinkt uit met haar onbegrensde vermogen en geweldige rijkwaliteiten. Daarmee lijkt ze alles in huis te hebben voor de grote sport. Deze vijfjarige merrie komt uit de eerste jaargang van de onder Ludger Beerbaum zeer succesvolle Grand Prix-hengst Zinedine. Op hun imponerende palmares prijken onder meer de tweede plaatsen in de 5*-Grand Prix van zowel Parijs als GCT London. Ook deze moederlijn heeft haar waarde in de sport reeds bewezen. Deze uiterst getalenteerde Naomi van het Keizershof is één van de uitschieters van deze collectie vanwege haar onbegrensde mogelijkheden als springpaard en excellente afkomst. Van haar vader Cardento is al menigmaal met succes een zeer getalenteerd paard geveild in de Dutch Sport Horse Sales en de topvererver levert met deze zesjarige merrie wederom een groot toekomsttalent. Van moederszijde voert Naomi van het Keizershof de waardevolle prestatiegenen van stempelhengst For Pleasure, die zelfs anno 2019 nog tot de beste verervers wereldwijd behoort. This very talented mare named Naomi van het Keizershof is one of the outliers of this collection because of her unlimited possibilities as a show jumper and her excellent pedigree. Her sire Cardento frequently produces very talented horses that are sold in the Dutch Sport Horse Sales auction, and with this six-year-old mare he has produced another great future talent. On her dam’s side, Naomi van het Keizershof carries the valuable performance genes of the foundation stallion For Pleasure, who even in 2019 still ranks among the world’s best sires. Her dam Benthe produced the now eight-year-old Keizershof Z (s.Bustique), who is very successful at the 1.45m level with Ali Ramsey. Benthe is a half-sister to both the Grand Prix horse Sjoeke (s.Calvados), who competed under Olivier Philippaerts; and the successful international 1.50m horse Firkov du Rouet (s.Baloubet du Rouet), ridden by Eric Lamaze. Cassano Deze grootramige Cassano is gefokt in Zweden en heeft daar de eerste jaren zijn opleiding gehad. Vanaf dit jaar is hij met veel succes uitgebracht in Nederland, waar hij menigmaal opvallend presteerde bij de zesjarigen. Cassano combineert zeer veel vermogen met uitstekende rijkwaliteiten en is daarmee een paard voor de toekomst. Zijn vader Click and Cash was jarenlang succesvol op het hoogste niveau met Niklas Arvidsson en plaatste zich in meerdere Nations Cup-wedstrijden, Grand Prix en nam deel aan de Wereldbekerfinale in 2013. Als vererver timmert hij aan de weg met in opkomst zijnde internationale 1.50m-paarden als Click n’Chic HDC (Patrice Delaveau) en Mama Mia (Alexander Zetterman). Moedersvader For Feeling brengt de waardevolle prestatiegenen in van For Pleasure en heeft zelf naam gemaakt als vader van Meredith Michaels-Beerbaum’s topspringpaard Fibonacci. In de derde generatie treffen we de Zweedse hengst Anart, die met Peter Eriksson internationaal heeft gesprongen.

Cassano This large horse named Cassano was bred in Sweden, where he underwent his first years of training. He started competing in the Netherlands at the beginning of this year, achieving great success and turning heads many times in the six-year-old division. Cassano combines very abundant scope with outstanding riding qualities, making him a horse for the future. His sire Click and Cash competed successfully for years at the highest level with Niklas Arvidsson and placed in multiple Nations Cup competitions and Grands Prix; and in 2013, he showed in the World Cup final. As a sire, he is making inroads with emerging international 1.50m horses such as Click n’Chic HDC (Patrice Delaveau) and Mama Mia (Alexander Zetterman). Night’s Watch Met zijn geweldige instelling, lichtvoetigheid en zeer goede springmanieren is Night’s Watch een droompaard voor iedere ruiter. Deze zesjarige vosruin is een echte meewerker en stamt af van de Mecklenburger hengst Coratio, die goede zaken deed in de Duitse verrichtingstest in Schlieckau. Hij is een zoon van Pia-Luise Aufrecht’s internationale 1.50m-merrie Carolin 38 en is zelf op beperkte schaal ingezet voor de fokkerij. We zien Coratio hier samengebracht met de merrie Gora II, die de internationaal springende Gotthard-zoon Golden Miller combineert met de halfbloedhengst Ischabal. Zij bracht in combinatie met Cellestial al het internationale 1.35m-paard Cuba 26 van Marcos Luis Ortega Quintana. Ook overgrootmoeder Molora II (v.Modus xx) zorgt voor waardevolle bloedsinbreng en zij staat bovendien tevens aan de basis van het internationale 1.50m-springpaard Elektra F (v.Exmiras) van Sebastian Numminnen.

Night’s Watch With his amazing disposition, light-footed movement and very good jumping manners, Night’s Watch is every rider’s dream horse. This six-year-old chestnut gelding is truly a cooperative fellow; and his sire is the Mecklenburg stallion Coratio, who excelled in the German performance test in Schlieckau. He is out of Pia-Luise Aufrecht’s international 1.50m mare Carolin 38 and is used for breeding on a limited scale. Here we see Coratio united with the mare Gora II, whose bloodlines combine the Gotthard son Golden Miller, an international show jumper, with the half-Thoroughbred stallion Ischabal. Bred to Cellestial, she produced the international 1.35m horse Cuba 26, ridden by Marcos Luis Ortega Quintana. I.Wellie R58 Overal waar I.Wellie R58 verschijnt krijgt hij de ogen op zich gericht. Dankzij zijn opvallende verschijning en enorme springkwaliteiten werd hij als driejarige verkozen tot reservekampioen op de KWPN hengstenkeuring. Ten behoeve van de sport is hij vervolgens gecastreerd. In de jonge paardenwedstrijden maakt deze eyecatcher veel indruk en ondanks dat er constant veel interesse voor hem is, kon I.Wellie R58 behouden blijven voor deze veiling. Hij is een product van de succesvolle Stal Roelofs-formule, en stamt af van de met Kasey Ament op Grand Prix-niveau presterende hengst Dexter R. Zijn moeder S.Wellie 12 etaleerde haar kwaliteiten zelf op 1.35m-niveau en haar achtjarige zoon C Wellie (v.Calvin Z) plaatste zich deze zomer al in 1.45m-rubrieken op Spruce Meadows. In combinatie met Namelus R bracht ze bovendien al het internationale 1.35m-paard E Wellie van Conor Drain. Grootmoeder M.Wellie 34 is ook terug te vinden in de moederlijn van het succesvolle 1.50m-paard Z Wellie 72 (v.Celano) van Rima Da. Uit deze stam komen verder Grand Prix-paarden als Medoc II, Vici R, Monolino en Fantom.

I.Wellie R58 Wherever I.Wellie R58 goes, he gets noticed. Thanks to his striking appearance and enormous jumping talent, he was declared the reserve champion of the KWPN stallion selection as a three-year-old, after which he was gelded for the sport. In the young horse competitions, this eye-catcher makes a big impression and — despite constant interest in him — we were able to retain I.Wellie R58 for this auction. 1. Algemeen 1.1 De Dutch Sport Horse Sales [danwel Hendrix

Events B.V., zaakdoende onder de naam Dutch Sport Horse Sales] (hierna zowel af-zonderlijk als gezamenlijk te noemen: DSHS), organiseert in haar functie van bemiddelaar tussen verkoper en koper op 24 september 2019 de Dutch Sport Horse Sales (hierna te noemen: de veiling) op de accommoda-tie van Equestrian Centre de Peelbergen te Kronenberg. De veiling zal plaatsvinden on-der toezicht van een notaris.

1.2 Deze veilingvoorwaarden zijn van toepas-sing op alle tijdens de veiling gesloten koopovereenkomsten met betrekking tot via DSHS aangeboden paarden, alsmede alle overeenkomsten die daaruit voortvloeien.

1.3 Op deze overeenkomsten is Nederlands recht van toepassing.

1.4 Deze voorwaarden worden vóór aanvang van de veiling bekend gemaakt en zijn in de veilingcatalogus opgenomen.

2. Verkoop/VeilingTijdens de veiling zullen de paarden onder het za-del voorgesteld worden. De paarden zullen tijdens de veiling per opbod in Euro’s worden ver-kocht, tenzij anders aangegeven, met een minimale inzet van € 30.000,-. Er wordt geboden in bedragen van € 2.000,- tot € 50.000,- en daarbo-ven in bedragen van € 5.000,-.Een potentiële bieder/koper zal aan zijn/haar bod worden gehouden, totdat een eventueel hoger bod volgt. Krijgt de koper de afslag door de vei-lingmeester toegewezen dan is die betreffende koper verplicht het rekening bedrag te voldoen, zoals in artikel 3 berekend. In geval van twijfel betreffende de geldigheid van een afslag, kan het

[also known as Hendrix Events BV, trading un-der the name Dutch Sport Horse Sales] (here-inafter individually and collectively referred to as: DSHS), organises in its function as an intermediary between sellers and buyers the Dutch Sport Horse Sales (hereinafter: the auction) on the 24th September 2019 on the property of Equestrian Centre de Peelbergen in Kronenberg in the Netherlands. The auc-tion will be held under the supervision of a notary.

1.2 These auction terms and conditions are ap-plicable to all sales agreements concluded during the auction related to the horses of-fered via DSHS, as well as any agreements resulting from that.

1.3 This agreement is governed by Dutch law.

1.4 These terms and conditions are to be an-nounced prior to the start of the auction and are also included in the auction catalogue.

2. Sale/AuctionDuring the auction horses will be presented under saddle. The horses will be sold during the auction by bidding in the Euro currency, unless otherwise stated, with a minimum starting bid of € 30,000.00. Bids are to be made in increments of € 2,000.00 at a time up to € 50,000.00, and above that bid incre-ments are to be made in € 5,000.00 at a time. Potential bidders/buyers will be held to their bids until a higher bid has been received. If the auctioneer awards a bid to a buyer, the relevant buyer is obliged to pay the amount due as de-fined in Article 3. In case of doubt concerning the validity of a bid, the previous bid can be ac-cepted again, after which bidding can resume.

3. Afrekening veilingbedrag en -kosten3.1 Direct na afloop van de veiling dient de

koper zijn/haar betalingsverplichtingen te vervullen op het veilingbureau. Indien de koper hieraan niet voldoet, is DSHS gerechtigd de bieding niet te erkennen en ongeldig te verklaren en het gekochte paard opnieuw te veilen, dan wel het ge-kochte paard toe te wijzen aan de een na hoogste bieder. De koper is in dat geval van rechtswege in verzuim en is gehouden de daardoor veroorzaakte schade aan DSHS te vergoeden, onverminderd de overige rechten van DSHS.

3.2 Het rekening bedrag wordt als volgt berekend: Afslagprijs + 6% commissietoeslag + 1½% verzekering (optioneel) + Rekening bedrag exclusief 21% Nederlandse omzetbelasting Het rekening bedrag is per direct opeisbaar.

Betaling geschiedt per bank, het is niet mo-gelijk het rekening bedrag in contanten te voldoen. Verrekening van eventuele tegen-vorderingen is uitgesloten.

3.3 Het is DSHS toegestaan om informatie in te winnen omtrent de financiële gegoedheid van een betreffende bieder/koper en deelna-me aan de veiling door en het sluiten van een overeenkomst met de betreffende bieder/ko-per afhankelijk te stellen van de ingewonnen informatie.

In the event of any disputes arising with or dur-ing the bidding process, the decision of the no-tary shall be binding.

3. Settlement of auction amounts and expenses3.1 Immediately after completion of the auction

buyers are obliged to settle amounts due in the auction office. If a buyer should fail to comply with this obligation, DSHS shall be entitled not to recognise the offer and to de-clare the auction invalidate, after which the purchased horse will again be made availa-ble for auction or alternatively the purchased horse is to be allocated to the second high-est bidder. The buyer shall in this event be considered to be in legal default and shall be liable to compensate DSHS for any dam-age incurred, without prejudice to any other rights that DSHS may have.

3.2 The amount due shall be calculated as fol-lows:

ately. Payment is to be made by bank trans-fer and cash payment of the amount shall not be accepted. Settlement of any counter-claims is excluded.

3.3 DSHS is entitled to gather information on the financial situation of a specific bidder/buyer and participant to the auction and may decide to make the conclusion of an agree-ment with the relevant bidder/buyer condi-tional, based on the information obtained.

3.4 Bij afrekening op het veilingbureau bestaat de mogelijkheid voor de koper om een verze-kering af te sluiten voor het gekochte paard. Een dergelijke verzekering wordt niet door DSHS afgesloten.

4. Veilingpaarden; aansprakelijkheid4.1 De aangeboden paarden in de veiling zijn ge-

identificeerd op afstamming, geslacht, kleur en geboortejaar, zoals deze in de catalogus zijn aangegeven. DSHS sluit aansprakelijk-heid uit met betrekking tot de gezondheids-toestand, de prestaties en/of gebruiksdoel-einden van de te veilen paarden.

4.2 DSHS is niet aansprakelijk voor schade aan personen of zaken, ontstaan voorafgaand aan, ten tijde van en na de veiling, behoudens indien deze schade het gevolg is van opzet of bewuste roekeloosheid van DSHS of haar leidinggevende ondergeschikten.

4.3 De paarden die via de veiling verkocht zullen worden zijn ten laatste 3 maanden vooraf-gaande aan de veiling röntgenologisch in orde bevonden. Een gebruikelijke klinische (sportpaarden-)keuring heeft ten laatste twee weken vóór de veiling plaatsgevonden.

4.4 De veterinaire bevindingen kunnen vooraf-gaande aan de veiling op verzoek van de po-tentiële koper worden ingezien en toegelicht door veilingdierenarts E. Enzerink, of zijn plaatsvervanger.

5. Afgifte, risico- en eigendomsoverdracht5.1 Direct na de gunning van een paard gaat het

risico met betrekking tot het gekochte paard over op de koper en zijn alle verantwoorde-lijkheden en aansprakelijkheden, alsmede alle risicofactoren overgedragen aan de be-

4. Auction Horses; liability4.1 The horses offered in the auction are identi-

fied by origin, sex, colour and year of birth, as stated in the catalogue. DSHS excludes liability with regard to health status, the performance and/or purpose of use of the horses to be auctioned.

4.2 DSHS cannot be held liable for damage to persons or property arising prior to, during or after the auction, except if such damage is caused by intent or deliberate recklessness on the part of DSHS or its subordinates.

4.3 The horses sold through the auction have been found to be in good condition following a radiographic test conducted at least three months prior to the auction. A standard clini-cal examination (for sport horses) has been completed at the latest two weeks prior to the auction.

4.4 Veterinary findings can be provided upon the request of potential buyers prior to the auc-tion and a more detailed explanation can be provided by E. Enzerink, the auction veteri-narian, or his substitute.

5. Release and transfer of risk and ownership5.1 Immediately after a bid on a horse has been

accepted, any risks related to the purchased horse shall be transferred to the buyer and any responsibility and liability, as well as all risk factors are transferred to the respective buyer. The buyer shall indemnify DSHS from any claims brought by third parties.

5.2 De eigendom van het gekochte paard gaat op de koper over op het moment van afname als bedoeld in artikel 5.3 van deze voorwaar-den, doch niet eerder dan nadat koper de vol-ledige koopsom en eventuele op grond van niet-nakoming verschuldigde bedragen aan DSHS zal hebben voldaan.

5.3 De koper is verplicht het gekochte paard af te nemen op de door DSHS vastgestelde plaats en tijd en bij gebreke daarvan binnen de daarvoor in de veilingcatalogus gestelde termijn, indien DSHS daarom verzoekt op vertoon van een deugdelijk legitimatiebe-wijs. De levering van het gekochte paard vindt plaats door de afname. De afname bestaat uit het door de koper ophalen van het gekochte paard. De afname kan eerst plaatsvinden nadat de volledige koopsom en het overigens verschuldigde door de ko-per is voldaan. Indien de koper de afname weigert of nalatig is met het verstrekken van informatie of instructies noodzakelijk voor de afname zal het gekochte paard door DSHS worden weggehaald en worden ge-stald voor rekening en risico van de koper. De koper is in dat geval verplicht alle aan-vullende kosten, waaronder in ieder geval de stallingskosten, aan DSHS te vergoeden. Indien het paard is gekocht door een bui-tenlandse koper zal koper, behoudens de situatie waarin de koper voornemens is het paard in Nederland te exploiteren, en met inachtneming van een redelijke termijn die nodig is om de vervoersformaliteiten naar het buitenland te regelen, zorgdragen voor direct vervoer van het gekochte paard naar het buitenland.

5.2 Ownership of the purchased horse passes to the buyer at the time of release as de-fined in Article 5.3 of these terms and con-ditions, but not before the buyer has settled the full purchase amount and any other amounts due to DSHS resulting from non-compliance.

5.3 The buyer is obliged to take possession of the purchased horse at the place and time as specified by DSHS, or in the absence thereof, within the term defined in the auc-tion catalogue and upon presentation of a valid identity document, if requested by DSHS. Delivery of the purchased horse takes place by means of its release. Release con-sists of collection of the purchased horse by the buyer. Release may only take place after settlement of the purchase price in full and any other amount due by the buyer. If the buyer should refuse release or if he/she should fail to provide information or instruc-tions required for the release, DSHS shall remove the purchased horse and keep it in stables at the expense and risk of the buyer. The buyer shall then be obliged to compen-sate DSHS for any additional costs incurred, including stabling costs in any event.

If a foreign buyer purchases the horse, the buyer shall - except for the situation in which the buyer intends to use the horse in the Netherlands - with due observance of a reasonable period needed to arrange export documents for the horse, ensure immediate transport abroad of the purchased horse.

6. Shortcomings (including stable vices) 6.1 If a buyer finds that the horse purchased

does not conform to the contract descrip-tion after actual delivery, the buyer shall not be entitled to any recourse if the seller has

6.2 Verkoper staat ervoor in dat het door de koper gekochte paard, tenzij voorafgaand aan de verkoop meegedeeld, niet lijdt aan de stalgebreken luchtzuigen, systematisch weven of kribbebijten en wel gedurende een periode van 2x 24 uur na feitelijke aflevering aan de koper.

6.3 Indien een dierenarts, geregistreerd als keu-ringsdierenarts voor paarden of paardendie-renarts, schriftelijk meedeelt dat één van de in artikel 6.2 genoemde stalgebreken naar zijn deskundig oordeel bestond vóór de da-tum feitelijke aflevering, heeft de koper het recht de koopovereenkomst te ontbinden met alle daaraan verbonden gevolgen.

7. Geschillen7.1 Alle geschillen - daaronder begrepen die, wel-

ke slechts door één der partijen als zodanig worden beschouwd - welke naar aanleiding van de koopovereenkomst gesloten op de veiling danwel naar aanleiding van deze vei-lingvoorwaarden met DSHS ontstaan, wor-den beslecht door NAI-arbitrage (Nederlands Arbitrage Instituut te Rotterdam), danwel in het geval de koper consument is, op diens verzoek overeenkomstig het Burgerlijk Wetboek, door de gewone burgerlijke rechter, in welk geval in eerste aanleg uitsluitend de Rechtbank Limburg bevoegd is.

6.2 The seller warrants, unless notified of such prior to the sale, that the horse purchased by the buyer does not suffer from any stable vices such as cribbing, systematic weaving or wood chewing for a period of 2 x 24 hours after actual delivery to the buyer.

6.3 If a veterinarian, registered as an inspection veterinarian for horses or a horse veterinari-an should state in writing that one of the sta-ble vices listed in Article 6.2 was established in his/her expert opinion prior to the date of actual delivery, the buyer shall be entitled to terminate the purchase agreement with all resulting consequences.

7. Disputes7.1 Any disputes with DSHS - including those

that are considered as such by only one party - resulting from the purchase agree-ment concluded at the auction or following from these auction terms and conditions, shall be settled by NAI Arbitration (Dutch Arbitration Institute in Rotterdam), or if the buyer is a consumer as defined in the Dutch Civil Code, in an ordinary civil court upon his/her request, in which case only the Court of First Instance in Limburg shall be entitled to rule on the matter.

7.2 If the seller or DSHS intends to file proceed-ings and if the buyer is considered to be a consumer, he/she shall be given the oppor-tunity to announce its decision pertaining to Paragraph 7.1 in writing within a period of one month. 7.2 Indien de verkoper of DSHS een procedure aanhangig wil maken, zal zij indien de ko-per consument is, hem/haar gedurende een maand in de gelegenheid stellen schriftelijk zijn/haar keuze als bedoeld in artikel 7.1 hiervoor, kenbaar te maken.
