WineGavel has been bringing the excitement of fine and rare live wine auctions to the Bay Area and the West Coast for over one year. For our September 18th 2010 sale, we have again partnered with AME Restaurant located in the St. Regis hotel in San Francisco’s fashionable SOMA district. Bidders who attend the live auction will be able to partake in a sit down lunch featuring the wine friendly cooking of acclaimed chef Hiro Sone. As with our other events, BYO is encouraged and the mood will be festive.

Our September auction is again bookended by two significant collections. With over 400 lots, there is great variety across the board for drinkers, thinkers, and collectors. All of the wines in this catalog have been thoroughly inspected by our team for authenticity and condition and are currently lying in Napa County under perfect storage conditions.

Our first consignment, Classics From the Cellar of a Pacific Heights Physician, is the display of a lifetime of collecting and enjoying fine wines. Top flight Bordeaux, like 1959 Chateau Mouton Rothschild and 1966 & 1970 Chateau Latour, as well as other classed growths are on display. Not to be missed from Burgundy are Vosne-Romanee villages cru from two of the greats, Leroy and Henri Jayer. California classics like Heitz Martha’s and Mondavi “unfined” are also available. An extremely rare magnum of 1966 Deutz, Cuvee William Deutz is certain to reward the persistent bidder.

Immediately following is, A Small Piece of a Big Pie, featuring rarities like Araujo Eisele Cabernet Sauvignon and Syrah in large formats, northern and central Californian cult Pinots from Kosta Brown, Brewer Clifton, and Radio-Coteau, among others. Don’t miss lot 104, the 100 point 2007 Scarecrow Cabernet Sauvignon, in original wooden case.

Lot numbers 113 through 178 features Fresh Wines Of A Southern California Businessman. Commencing with 1998 & 1999 Champagne from Perriere Jouet and Louis Roederer, bidders will also find rare magnums of 1999 Dom Perignon. Further beyond, multiple solid cases of pristine modern Bordeaux will be on the block. Don’t miss the 2005 Chateau Canon La Gaffiliere, which is on one hand controversial and on the other, an exceptionally well made wine.

A Touch of Class From Southern California, Passionately Acquired Wines From An East Bay Gentleman, & Wines From a Southern California Gentleman all contain portions of overall much larger collections. From rare large formats to single bottles of Screaming Eagle, bidders will find a wide variety of collectibles to choose from. One of the notable highlights here is the 1999 Valdivaca Madonna del Piano Brunello and a bottle of 2002 Screaming Eagle.

A knowledgeable collector who has been in the know for many years has offered up A Swath of Peter Michael which features rare magnums from one of California’s most consistent producer of world class Chardonnay.

Fine White Burgundy is a review of many solid wines from the past 20 years in village, 1er cru, and grand cru range. All wines are in excellent condition and will be an opportunity to experience properly aged white wine. Ramonet, Leflaive, Sauzet, Verget, Pernot, Jadot, and others fill out the roll call of the who’s who of White Burgundy.

If acquiring high scoring wines in excellent condition is your forte, Wines From A Stunning Collection will offer an opportunity to add to your cellar. With almost every single wine receiving a 95 point or higher score, almost every lot is a highlight! A few to note: 1995 Ausone en magnum, 2005 Mommesin Clos de Tart in OWC, 1990 Meo-Camuzet Richebourg, 1994 & 1997 Colgin Herb Lamb Vineyard, 1996 & 2001 Harlan Estate, and Shafer Hillside Select in magnums. Bid with confidence here as these wines were removed from a pristine cellar.

The final portion of our auction, Quality and Depth: Wines of an East Coast Industrialist, is strong in solid cases of classed growth Bordeaux. Most of the best Chateaux are represented, with an emphasis on the left bank. A variety of vintages from Chateau Lafite Rothschild will certainly garner attention here, with Chateaux Latour and Mouton Rothschild also being well represented. A unique solid case of 1965 Chateau Latour, in very good condition, is a unique find indeed. The two cases of 1983 Mouton Rothschild are both in excellent condition with clean labels and fill levels. Moving closer to the present, a range of Bordeaux from the early to late 1990’s are all in pristine condition and are perfect for further aging in an equally cool and damp cellar. From California, the unique and famous 1974 Heitz Martha’s Vineyard and rare first vintage of Jordan are available. Concluding the consignment and our September auction is a case of the 100 point 1992 Taylor’s.

In his earlier days, he was a passionate wine lover who belonged to several bay area wine societies including the Medical Friends of Wine, the tastevin hanging on his cellar door a testament to the festive dinners and wines poured over the years. Many of these bottles hadn’t moved for some time before we came upon them, and as a result, the clarity and condition of the wines appeared to be excellent. All of the following lots were removed from an in home below grade temperature controlled cellar.

C h a t e a u mo u t o n ro t h s C h i l D 1959Pauillac, 1er cru classétop shoulderlightly soiled label, lightly cut capsule“I am always blown away by the 1959 Mouton, one of the greatest Moutons made in the last thirty-five years. Every time I have this wine it is undeniable that Mouton made a richer, more persuasive wine in 1959 than in 1961. Astonishingly young and unevolved, with a black/purple color, the wine exhibits a youthful nose of cassis, minerals, and new oak. It is exceptionally powerful and super-extracted, with the fruit supported by high levels of tannin and some lusty quantities of alcohol. This mammoth, full-bodied Mouton-Rothschild should continue to evolve for another 20-30 years. It may well be a 100-year wine!” WA 100 Pts.

The wine may have turned the corner and begun its decline. I have never tasted it out of larger format bottles, but I suspect magnums of this wine might merit an outstanding evaluation. The wine has always been a classic Bordeaux, with more fruit and body than many 1966s. There is a degree of austerity, but the wine’s dominant characteristics include a complex, tobacco, cedar, and red currant-scented nose, medium body, excellent concentration and ripeness, and a spicy, long, moderately tannic finish.”WA 89 Pts.

Honeysuckle, orange blossom, lemon oil, tropical fruit, and floral notes are found in this unctuously-textured white. Full-bodied and dry, with good underlying minerality, crispness, and an alluring freshness, it is impossible to know how such a wine will age. “In 1982 Sir Peter Michael established the Peter Michael winery on a square mile of rocky volcanic ridges that form the western face of Mount St. Helena in Sonoma County. From the beginning, the wine growing philosophy was modeled on the French tradition infused with a few modern influences:

I have since purchased it at auction because of its price/quality ratio. Haut-Brion, which can begin life as a soft, light wine, never appeared to have much intensity when tasted beside the phenomenal La Mission-Haut-Brion and La Tour-Haut-Brion. However, over the last 5-7 years that has changed. Either the wine has put on considerable weight, or I was off-form the many times I tasted it when young. The wine has developed the hauntingly complex, tobacco, roasted herb, singed leather, smoky, sweet, fruity nose of a great Haut-Brion. Full-bodied and intense, with noticeable ripe tannin, this is a wine of considerable richness and intensity. It offers delicious drinking after 1-2 hours of decanting, even though noticeable tannin remains. This wine is capable of another 15-20 years of cellaring. Yes, I did indeed underestimate this wine. I tasted it a half-dozen times in 1995 and at each tasting it was a formidable wine. Do not be surprised to see this rating go even higher, as I do not believe the 1975 Haut-Brion has reached its pinnacle. Impressive!”WA 93 Pts.

However, a bottle tasted, of all places, in Seoul, Korea in February, was only a few points short of perfection. That amazing performance motivated me to pull another bottle out of my cellar and follow it over the course of two days. Sure enough, by the second day the wine was roaring from the glass. The 1990 Lafite has turned out far better than my early assessment. While it still possesses some firmness, and performs like a late adolescent in terms of its evolution, it boasts gorgeous aromas of cedar, tobacco leaf, cassis, and lead pencil shavings. It represents the essence of what vintage port can achieve. The color is an opaque black/purple, and the nose offers up fabulously intense aromas of minerals, cassis, blackberries, licorice, and spices, as well as extraordinary purity and penetration. Yet this is still an unformed and infantile wine. If Chateau Latour made a late-harvest Cabernet Sauvignon, I suspect it might smell like this. In the mouth, the wine is out of this world, displaying layer upon layer of concentrated black fruits backed by well-integrated tannin and structure. This is a massive, magnificently rich, full-bodied port that will be far more flattering in its youth than were such Taylors as the 1983, 1977, or 1970. It possesses awesome fruit, marvelous intensity, and lavish opulence, all brilliantly well-delineated by the wine’s formidable structure. Neck Levels for Bordeaux and Bordeaux Shaped Bottlesneck level – The level is into the neck of the bottle. This is a normal level for wines less than 10 years old. In wines 10-30 years old, a neck level usually indicates pristine storage history.

Bn – Bottom Neck level: acceptable for wines 10-20 years old. In bottles 20-30 years old, a base neck level is an excellent level and usually indicates excellent storage history.

VTS – Very Top Shoulder level: acceptable level for wines 20 to 30 years old. Considered excellent for bottles older than 30 years.

Generally indicates that a wine has been properly cellared.

TS – Top Shoulder level: acceptable for wines 30-40 years old. In bottles older than 40 years, a top shoulder level usually indicates proper storage.

uS – Upper Shoulder level: acceptable for wines 40-60 years old. In bottles older than 60 years, an upper shoulder level usually indicates excellent storage history. For mid 20th century or older wines that have not been reconditioned, this is considered an

acceptable level. For bottles with excellent storage history, risk of oxidization is low.

MS – Mid Shoulder level: acceptable for wines 60 years old or older, unless they were previously re-conditioned. If the cork is sound and the bottle has an excellent storage history, risk of oxidization is low to moderate.

lS – Low Shoulder level: usually an indication that the wine is spoiled. Bottles with this level are rarely sold by reputable auction houses.

Measurements are normally taken below the cork, if visible.

1.5 cm or better: normal level for wines that are 10 years old or less and a good level for wines aged from 10-20 years.

2 to 3 cm: acceptable level for wines 10-25 years old and an exceptional level usually indicating excellent storage for wines more than 25 years old.

3 to 4 cm: acceptable level for wines 25-40 years old and a very good level for wines older than 40 years.

4 to 5.5 cm: acceptable level for wines 40-60 years old and an excellent level for any wine older than that. Cork condition and clarity of wine need to be taken into account for wines with this level of ullage and are sometimes noted in the cataloguing process.

CataloG layout Wines are normally grouped by individual consignments and introduced by a heading that provides information about the storage history and provenance of the wines. WineGavel makes every effort to verify that all wines were properly stored prior to being delivered to our temperature and humidity-controlled warehouse. Every bottle has been diligently inspected by the WineGavel team and then described as accurately as possible at the time this catalog was published. Buyers of older and more fragile wines are advised to take proper considerations for natural variations of ullage and general condition No returns will be accepted as stated in the Conditions of Sale.

From time to time we use tasting notes in our catalogs from some of the world’s leading wine critics. Where applicable, the most recently dated tasting note is used. In certain instances, we use only the critic’s point score. Additionally, certain wines may be followed by a tasting note from a WineGavel staff member or associate. Information regarding such notes can be found in the Cataloging and Bottle Condition Notes section of this catalog.

Each lot contains an estimate with the expected range of prices that the given lot may sell for. All values are based on current market prices for similar or identical wines. WineGavel provides all purchasers with multiple options for air and ground transport. WineGavel does not in any way

represent the shipment of wines across state lines as legal nor does WineGavel take responsibility for the legality of shipment of alcoholic beverages into any state. Generally states regulate the shipment of wines into and across their borders. Some states require that the purchaser, consignor or shipper possess certain licenses or permits, while other states have a strict prohibition on such shipments, and may not allow them in any form. WineGavel advises all buyers to investigate and understand, on their own examination, the wine shipping laws and regulations of the state to which they intend the wine to be shipped prior to the purchase of wines at auction. WineGavel can assist in making arrangements to have wine purchased at auction shipped through the appropriate channels. All domestic shipments will be subject to a 1% insurance charge, International shipments will be charged 2% for coverage. Insurance covers only breakage or loss. WineGavel cannot be held responsible for any other changes to the wines during shipment. It may be required for the wines to be repacked in heavy duty Styrofoam shipping boxes. The wooden or cardboard cases will normally be shipped separately at an additional charge. Insurance coverage does not cover confiscation by any government or law enforcement agency as a result of any violations of any shipping laws by any buyer. Loss or breakage resulting from transportation shall be reported to WineGavel in writing within three days of incident. Any lots that are split into two or more parts for multiple deliveries or pickups will be subject to a $10 service charge per split, per lot.

WineGavel™ and/or the auctioneer may have a direct or indirect ownership interest in any or all lots in the sale resulting from ownership or purchase by WineGavel™ of the lots (or an agreement to purchase), or from an advance of monies or property to the seller, or a guarantee of minimum proceeds made by WineGavel™ to the seller.

II. The highest bidder shall prevail. Should any dispute arise between bidders, the decision of the auctioneer as to the successful bidder and the re-offering or resale of the lot under dispute shall be final. The auctioneer shall regulate the bidding and reserves the right to refuse any bid believed by him not to be made in good faith. Any bid which is merely, or which is merely a nominal or fractional advance over the previous bid, may be rejected by the auctioneer, at his discretion. Neither we nor the auctioneer shall be liable for errors and omissions in executing instructions to bid, whether caused by our negligence, the auctioneer’s negligence, or otherwise.

III. Any lot in this sale may be subject to a reserve. The auctioneer or its agent shall have the right to bid on behalf of the seller for any lot subject to a reserve. The auctioneer may open bidding on any lot by placing a bid on behalf of the seller or the auctioneer and may further bid on behalf of the seller or the auctioneer by placing successive or consecutive bids for a lot or by placing bids in response to other bidders. Any “hammer” price listed is the price for which a lot closed on the floor at the sale (or a reserve price), and such prices do not indicate whether or not any lot met its reserve price if such a price had been established. Bid only as much as you are prepared to pay as in most cases, bidders will pay their top bid.

IV. E-Mail, Fax, or Telephone Bidder. A successful e-mail, fax or telephone bidder will be notified of lots purchased and must remit payment before the lots are shipped. Payment must be received by us within fifteen (15) days of notification. Delivery to a successful bidder will be based on the instructions given by the customer in the “Collection and Delivery Form” which will be included with payment.

V. Title shall not pass to the buyer until full payment is received by WineGavel™.

VI. If a bidder shall fail to comply with these Conditions of Sale, then, as to any lot with respect to which such failure to comply occurs, we shall be entitled (but not obligated), at our sole discretion, to resell the lot or cause it to be resold by public or private sale, without notice to the bidder and in any manner of sale (whether or not commercially reasonable), and to hold the non-complying bidder liable for any deficiency in the purchase price attending such resale, as well as for all charges, costs and expenses incurred in both sales, and all incidental damages. In no event shall any surplus arising from such resale be payable to the non-complying bidder.

VII. If WineGavel™ takes any action to enforce these Conditions of Sale, or to secure payment of any amount due to us from a bidder or purchaser, the defaulting bidder or purchaser shall be liable for all legal and other costs and expenses incurred by us, including but not limited to reasonable attorneys’ fees.

VIII. Successful bidders agree to pay for lots as specified above and no credit will be extended. A late payment charge of 1 1/2% per month shall be imposed on overdue payments. A minimum monthly surcharge of $10 shall apply. All lots purchased in California are subject to sales tax, unless the purchaser is a licensed entity, in which case any and all documentation regarding that entity’s license(s) must be submitted to WineGavel™ prior to each sale. A 19% Buyer’s Commission will be added to all purchases. Lots will be considered as paid when all fees, including but not limited to, shipping, handling, late charges, purchase price, commissions, and any and all sales or use taxes are paid in full.

IX. All agents will be personally liable and responsible for the purchases of those persons they represent, and for other costs and expenses which would be the responsibility of the buyer under these terms and conditions.

X. Under no circumstances, including, but not limited to negligence, will WineGavel™, its officers, directors, employees, agents, or affiliates be liable to any bidder or any third party for any indirect, incidental, special, consequential, punitive or exemplary damages (including, without limitation, damages for loss of business, loss of profits, loss of opportunity, or business interruption) arising out of participation in any auction, or the placing or acceptance or rejection of any bid, or the sale (or failure to consummate a sale) for any lot or lots, or resulting from failure or breach of security, mistakes, omissions, interruptions, deletions, or loss of files or data, errors, defects, delays in operation or performance, regardless of the cause including, but not limited to, acts of God, communication failure, theft, destruction or unauthorized access to WineGavel™ Fine and Rare Wine Auction’s computer network, programs or services, or for any claim by any other party. Not withstanding anything to the contrary in this agreement, the exclusive remedy for all damages, losses and causes of action which a bidder or other person or entity participating or involved in any auction may incur or suffer, whether in contract, tort (including negligence), equity, at law or otherwise, shall be to recover damages in an amount that is not in excess of the wholesale value of any lot that may be the subject of any such dispute.

XI. In the event of any dispute under these Conditions of Sale, or any dispute between the auctioneer and bidders, or between any parties requesting inspection of any of the lots of the auctioneer, or between persons offering their lots to be auctioned and the auctioneer, the exclusive jurisdiction and venue over any such dispute shall be in the Federal and state courts having jurisdiction and located in San Francisco, California, the parties waiving any other jurisdiction or venue to which they may be entitled.

XII. The auction is being conducted by WineGavel™ and no individual auctioneer, employee, office or director of WineGavel™, shall be held to any personal liability hereunder for negligence or otherwise.

XIII.The placing of a bid shall constitute acceptance and agreement of these Conditions of Sale.

XIV. Warranty Information, Buyer’s Remedies: (i) All property is sold “as is”, and neither WineGavel™ nor the consignor make any guarantees, warranties or representations, expressed or implied, with respect to the property, except as to warranty of title. WineGavel™ will only accept returns in the instance of an obvious or egregious cataloging error on the part of WineGavel™. Buyers will have 14 days after the sale to bring forth any issue regarding any lot. (ii) Neither WineGavel™ nor the consignor make any representations or warranty of any kind, expressed or implied, with respect, but not limited to any of the following characteristics of the property: age, authenticity, provenance, physical condition, importance, size, quality, quantity, parity, value, historical references or significance, material, source, or origin. (iii) All information in the catalog or elsewhere, concerning the characteristics mentioned in (ii) above, is offered to the bidders as a statement of opinion only. It is not intended to contain statements of fact for which we or the consignor may be held liable. This disclaimer of liability on our part applies whether the information is included in the catalog, advertisements, announcements, or communicated through our representatives, bill of sale or elsewhere, and whether written or oral. (iv) Neither WineGavel™, nor the consignor, shall be responsible for ensuring the correctness or accuracy of descriptions or other information in this catalog or elsewhere. The bidder assumes the full responsibility to inspect and evaluate the Property to his or her complete satisfaction prior to any purchase. The bidders and buyers must make an independent judgment about (1) the Property, (2) its value, and (3) descriptions or other information about the property. We may, without in any way diminishing the disclaimers of liability contained in this Paragraph and elsewhere, mention in the description of the lot, significant damage, although this does not include all faults, imperfections and deficiencies. (v) Neither WineGavel™ nor the consignor make any warranty or representation, express or implied, concerning the re-marketing of any wines purchased at our auctions. (vi) The estimates provided by WineGavel™ are merely our opinion of the price that a willing buyer might pay for the Property at auction. The actual price that might be realized at auction or upon sale of the Property may be substantially different from these estimates. We shall not be liable in any way for such estimate or differences in the final selling price. (vii) If there is any breach of a warranty of title, buyer’s sole remedy shall be to rescind the sale and receive a refund of the purchase price, including the buyer’s commission. This means that neither we, nor the consignor, shall have any liability for other damages, such as but not limited to , direct, indirect, special, incidental or consequential damages. No refund will be made until the Property is returned at buyer’s expense to the premises of WineGavel™ or where the Property was purchased in the same condition as the Property was in at the time of the sale. We act only as an agent for the consignor and make no independent warranty of any kind.
