These officers will become eligible for consideration for promotion to the cadre of Assistant Registrars as on 28.04.2016

1) Smt H B Aparna, Section Officer has to be reverted to the cadre of Senior Assistant in view of the following reasons

This official was appointed as Typist on 15.01.1997. Subsequently she was promoted as FDA on 26.06.2008. Further vacancies in the

cadre of Senior Assistant arose in the year 2009. However for according to the rules prevailing in the year 2009 the educational

qualification required that the candidate must have a degree. But the officer did not possess a degree qualification. Hence she did not

fullfil educational requirement for the said post. Hence she could not be promoted as Senior Assistant in 2009. Subsequently she

acquired degree qualification in the year 2011. Thus she was promoted as Senior Assistant on 07.07.2011 in the vacancies that arose in

2011. Further she was promoted as Section Officer on 10.01.2017.

After revising the seniority lists in view of the Judgment of the Hon'ble Supreme Court of India in B K Pavithra’s case, the officials

belonging to SC/ST category who were promoted as Senior Assistants in the year 2009 were reverted to the cadre of First Division

Assistant and in there place employees belonging to General Category who were holding a degree qualification have to be promoted.

Since Smt H B Aparna did not possess the degree qualification as on 18.08.2009 her juniors in the cadre of FDA namely S Madhu, K L

Rajeshwari, R Vijayalakshmi, K Lalithamma and M Niguna became eligible for consideration for promotion to the cadre of Senior

Assistant as on 18.08.2009. But as Smt H B Aparna did not have educational qualification as mentioned above she continues to be

eligible for promotion as Senior Assistant from 2011 only and not from 2009.

Hence eventhough the said officer is a General Category Employee, in the year 2017, she will not be eligible for consideration for

promotion to the cadre of Section Officer as her seniors S Madhu, Rajeshwari, R Vijayalakshmi, K Lalithamma and M Niguna, Senior

Assistants stand at Sl Nos 1,3,4,5 and 6 respectively and she stands at Sl. No 7 in the revised seniority list of Senior Assistant as on

31.12.2016.

The officer Smt L Shylashree was promoted as

Section Officer on 10.01.2017.She was at Sl.No. 3 in the

cadre of Senior Assistant as on 31.12.2016. She was

promoted to the cadre of Section Officer on 10.01.2017




her promotion for the post of Section Officer as on

Shylashree has to be reverted to the cadre of Senior

Assistant and kept in the seniority list at Sl No 34 for

the year 2016. Even presently, on the basis of regular

given, Smt L Shylashree doesnot fall within the zone of




consideration.

The officer Sri Sudhakar Rao Kasture was promoted as

Senior Assistant on 18.08.2009. Further he was promoted

as Section Officer on 10.01.2017 under 371J reservation. As

on 31.12.2008 his seniority in the cadre of FDA was at Sl.No

153. As on 31.12.2016 he was at Sl.No. 1 in the Hyderabad

Karnataka Local cadre (371J) in the cadre of Senior

Assistant .

After redoing the seniority in terms of the directions of

the Hon'ble Supreme Court in the case of B.K. Pavithra, the

officer did not fall into the zone of consideration for his

promotion for the post of Senior Assistant on 18.08.2009

and Section Officer as on 10.01.2017 as the officer's

seniority in the cadre FDA was at 168 in the year 2008.

Hence his promotion for the post of Senior Assistant as on

18.08.2009 was without any legal basis.Similarly his

promotion to the cadre of Section Officer as on 10.01.2017

under 371J is also without any legal basis.

Therefore, while refixing his seniority, Sri Sudhakar Rao

Kasture has to be reverted to the cadre of FDA and kept in

the seniority at Sl No 168 as on 31.12.2008. Even presently,

on the basis of regular promotion i.e without the benefit of

reservation being given, Sri Sudhakar Rao Kasture doesnot

fall within the zone of consideration for promotion to the

post of Senior Assistant and Section Officer. However, he

shall be considered for promotion to the said post as and

when he falls within the zone of consideration.
