Pacific Telesis Mobile Services d.b.a. Pacific Bell Wireless submits this Environmental Assessment as a modification to an existing site, PL 006-08, located on 2329 Santa Clara Avenue, Alameda, California. PBMS obtained all required local permits. This EA is submitted as a major environmental action pursuant to 47 CFR $0 1.1301-1.1319, implementing the National Environmental Policy Act of 1969. The facility was constructed on a building located within the Park Street Historic Commercial District which is listed in the National Register of Historic Places (NRHP).

The installation of this facility was found to have no signifcant adverse effects on persons or property in the vicinity, to be compatible and harmonious with the design and use of surrounding properties, and consistent with the City of Alameda’s Design Review Guidelines. No other environmental criteria listed by the FCC regulations will be significantly impacted by this site.

1 .O INTRODUCTION

VERTEX Engineering Services, Inc. (VERTEX) was contracted by Pacific Bell Mobile Services (PBMS) to conduct a Federal Communications Commission (FCC) Environmental Assessment (EA) of an existing antenna site referenced as PL-006-08, 2329 Santa Clara Avenue, Alameda, California. VERTEX reviewed the potential for environmental impacts to the site based on information provided by PBMS.

This Environmental Assessment (EA) was prepared in accordance with the requirements of the National Environmental Policy Act of 1969 (NEPA) and is intended to provide the environmental analysis required to support FCC approval of the project.

Based on information provided to VERTEX from PlanCorn, Inc. (compiled from information obtained by Brown & Mills, Inc. of Sacramento, California), the site is located within the Park Street Historic Commercial District listed on the National Register of Historic Places. Information obtained by Brown & Mills, Inc. included a search of the National Register of Historic Places database for Alameda County via the Internet.

2.0 SITE DESCRIPTION

The site consists of antennas mounted on the roof of a 3 to 4-story commercial building. The base transceiver station (BTS) equipment cabinet is also located on the roof. The site does not involve high intensity white lights to be located on the antenna or supporting structures in a residential neighborhood. Therefore, lighting is not a concern to this assessment.

3.0 ZONING

The site is located in the city of Alameda, and is zoned CBD - Central Business District. Adjacent properties generally consist of retail and commercial development. The City of Alameda issued a design review approval to Pacific Municipal Consultants on October 16, 1995 for the installation of antenna and associated equipment. The permit stated that the installation is categorically exempt from CEQA Guidelines, Section 15301. The project was found to have no significant adverse

effects on persons or property in the vicinity, to be compatible and harmonious with the design and use of surrounding properties, and the will be consistent with the City’s Design Review Guidelines.

4.0 PUBLIC CONTROVERSY

There is no known public controversy on environmental grounds concerning construction of this project site.

5.0 SITE SELECTION

The roof-mount antenna is needed in the project area in order to support radio frequency telecommunications coverage in the vicinity of the site. The selected location was considered the preferable location within the feasible range of alternatives, based on radio signal tests, structural analysis, environmental considerations, safety considerations, cost, access, and minimization of effects on other uses of the site.

6.0 REVIEW OF FCC ENVIRONMENTAL CRITERIA

The following criteria were assessed during the site investigation to comply with the Federal Communications Commission Rules and Regulation, 47 CFR 0 1.1307. The NEPA Checklist prepared by PlanCorn, Inc. for PBMS and dated June 21, 1999 is included in the attachments.

National Register of Historic Places

According to the research conducted by Brown & Mills, Inc. on December 11, 1997, which included a search of the National Register of Historic Places database for Alameda County via the intemet, the site is located within the Park Street Historic Commercial District listed on the National Register of Historic Places.

Since this is an existing antenna location, no public controversy relating to the installation was raised, and proper permitting was issued by the local agency, an evaluation and recommendation letter was sent to the State of California Office of Historic Preservation (SHPO) on behalf of PBMS. The California SHPO refused to comment on this site since it has already been built. A copy of the SHPO’s letter was sent to the Federal Communications Commission (FCC) on April 12, 1999 and is attached.

7.0 SUMMARY AND CONCLUSIONS

An Environmental Assessment (EA) has been completed for the project site located at 2329 Santa Clara Avenue, Alameda, California. VERTEX reviewed the potential for environmental impacts to the proposed site based on information provided by PBMS for the site. A summary of the findings is as follows:

l The site is located within the Park Street Historic Commercial District listed on the National Register of Historic Places.

l The City of Alameda issued a design review approval to Pacific Municipal Consultants on October 16, 1995 for the installation of antenna and associated equipment. The permit stated that the installation is categorically exempt from CEQA Guidelines, Section 15301. The project was found to have no significant adverse effects on persons or property in the vicinity, to be compatible and harmonious with the design and use of surrounding properties, and will be consistent with the City’s Design Review Guidelines.

Based on the summary of findings detailed above, VERTEX concludes that the installation of the cellular antennas at the site appear to have been properly reviewed and permitted by the City of Alameda, and to be compatible and harmonious with the design and use of surrounding properties. Therefore, the site does not appear to impact the character of the Park Street Historic Commercial District.

There are no other environmental concerns related to this site.

RE: California Cellular Sites

Dear Ms. Seidel:

Recently I have received letters from carriers requesting comments by the State Historic Preservation Officer on cellular sites that are already built and operating, In effect, these carriers are requesting Section 106 consultation after the fact. Therefore unless the FCC tells me othennrise, I will assume that the FCC deemed it appropriate for these projects to proceed, despite not having in hand evidence of compliance with Section 106.

Under 36 CFR Part 800, construction of an undertaking before the Section 106 process has begun or been completed constitutes foreclosure of the Advisory Council on Historic Preservation’s ability to comment on an undertaking and to consider alternatives. Given these circumstances the comment of the State Historic Preservation Officer on already complete projects is superfluous.

I would like to request your comments on what the FCC feels is the best way for these situations to be addressed so that the FCC’s responsibilities, the interest of the carriers, and the integrity of the Section 106 process can all be reasonably and lawfully sustained.

I would also request your advice on how to deal with the following projects from Pacific Bell Mobile Services that are already constructed and operating:

Ms. Kochian has 7 years of experience in conducting Phase I, Phase II, and Phase III Environmental Site Assessments (ESA). Ms. Kochian’s Phase I ESA experience includes preparation of reports for commercial, industrial, and residential properties, as well as agricultural environmental site inspection questionnaires (AG-ESIQ). Additionally, Ms. Kochian has produced FCC/NEPA audits and transaction screens for the wireless communication industry for the siting of PCS/Cellular towers.

Ms. Kochian is also experienced in conducting Phase II/III ESAs.
