LEONARD ZOIC CONVICTED OF SWINDLE IN HISTORIC COSTA RICA TRIAL The Commission announced that Leonard C. Zrnic has been convicted in a Costa Rican court of the crime of swindle in a case involving the fraudulent sale of $13 million in securities by a Costa Rican boiler room. Zrnic, a Canadian citizen, controlled the operation, which sold securities of International Swiss Investments Corporation (lSI) and its subsidiaries The Leverage Fund and The Sulfur Fund. The case was filed as a result of cooperation between the Commission, the Judicial authorities in Costa Rica, Interpol Costa Rica, the Costa Rican Securities Commission (Comision Nacional De Va10res), and the United States Embassy in Costa Rica. In addition, a Commission staff member provided evidence during the trial concerning the fraudulent scheme and its U.S. victims. This case is further evidence of the Commission's efforts to provide international enforcement assistance for the protection of U.S. investors from fraudulent securities schemes perpetrated by foreign nationals outside the United States. Zrnic was sentenced to fifteen years prison in Costa Rica. Other defendants in the case were acquitted, including Zrnic'a wife, who ia also Canadian, and three Costa Ricans. The Commission announced that Leonard C. CIVIL COMPLAINT FILED AGAINST FRANCIS LIKMER, STEPHEN HOLLOWAY AND HUBERT POETSCHKE

The Commission announced that on August 5 a civil injunctive action vas filed in the Eastern District of Michigan against Francis E. Limmer, Stephen A. Holloway and HubertPoetschke seeking permanent injunctions against Limmer, Holloway and Poetschke from future violations of the registration and antifraud provisions of the federal securities laws and, in addition, against Holloway from future violations of the broker-dealer registration provision of the Exchange Act. The complaint also seeks disgorgement and prejudgment interest from Holloway and Poetschke.

According to the complaint, from in or about February 1987 through June 1990 approximately $3,000,000 worth of unregistered promissory notes were sold to numerous investors for investments in entities known as GT&T Limited Partnerships. MOTION FOR AN EX PARTE APPLICATION FOR AN ORDER TO APPEAR.AND SHOW CAUSE RE: CIVIL CONTEMPT

The Commission announced that on July 27 it filed an Ex Parte Application For An Order To Appear And Show Cause Re: Civil Contempt (Application) based on the failure byDavid T. Levaughn (Levaughn) and RLL Securities, Inc. (RLL) to comply with orders entered September 11, 1992, and October 13, 1992 (Disgorgement Orders) requiring Levaughn and RLL to disgorge $168,574.46 and pay $34,433.22 in prejudgment interest.

The Commission's Application requests the Court to find Levaughn and RLL in civil contempt of the Disgorgement Orders for failing to pay the required amounts (lesspartial restitution to investors in the amount of $29,258.75 paid by Levaughn in a Shelby County, Tennessee crilllinalaction) and requests the Court to order them to pay within fourteen days.

The Disgorgement Orders resulted from Levaughn's and iLL's default to a complaintfiled by the Commission on July 14, 1992 alleging that from March 1990 through July 1992. the defendants, through fraudulent means, solicited over 100 potentialinvestment advisory c~ients, many of whom were single women responding to personalads placed in various local and national magazines and newspapers by Levaughn. \SEC v. SUMMARY JUDGMENT AS TO THE AMOUNT OF DISGORGEMENT AND PREJUDGMENT INTEREST ENTERED AGAINST JAY WERNER

The Commission announced that on June 10, 1993 the Honorable Harvey E. Schlesinger,U.S. District Judge for the Middle District of Florida, entered a Summary Judgment as to the Issue of Disgorgement and Prejudgment Interest (Summary Judgment) Against Defendant Jay Verner (Verner) of Aventura. Florida. The Summary Judgment orders Werner to disgorge $21,050 in ill-gotten gains and to pay $8,827 in prejudgmentinterest.

The Commission alleged in its complaint, filed on June 3, 1992, that Werner offered and sold interests in the form of unregistered investment contracts in public pay telephone sale--leaseback contracts by means of misstatements and omissions of material facts. On June 30, 1992~ the Court entered a Permanent Injunction against Verner, by consent (see LR-13272 and LR-13305). [SEC v. Bassam Haje, et al., Civil Action No. 92-510-CIV-J20] (LR-13747)
