Consideration of whether to issue a release adopting amendments to the Customer Pro-tection Rule, Rule lSc3-3 under the Securities Exchange Act of 1934, which will exclude the margin debit balances of certain persons who are related to principals of a broker-dealer or affiliated in a certain way with a broker-dealer from the Reserve Formula. The amendments will also exclude from the debit items the amount by which a broker-dealer's margin accounts receivable with a single customer exceeds a certain percentage of a broker-dealer's net capital prior to securities haircuts, unless the broker-dealer can demonstrate that such debit balances are directly related to credit items in the reserve formula. CORRECTION TO 1984 LOST AND STOLEN SECURITIES PROGRAM STATISTICS

In 1984, reporting institutions reported as missing, lost or stolen 491,944 certifi-tificates worth $1,708,389,602. Thus, while the number of certificates reported as lost, missing or stolen increased approximately 3.8% in 1984, the aggregate dollar value of those reports decreased by approximately 4.1%.

Previously, it had been reported that the aggregate dollar value of the certificates reported as lost, missing or stolen in 1984 had increased 18.5% over 1983.

ADMINISTRATIVE PIOCEEDIIIIS

NASD ACTION AGAINST TOWNSLEY ASSOCIATES AND PROPRIETOR AFFIRMED

The Commission affirmed sanctions imposed by the NASD on Townsley Associates, a Corning, New York brokerage firm, and Jesse M. Townsley, Jr., its former proprietor.The NASD censured the firm and Townsley, fined them $10,000, jointly and severally,and required Townsley to requalify as a registered principal within 90 days.

The Commission found, as had the NASD, that in 1980 and 1981 the firm and Townsleywere responsible for effecting transactions in the account of a customer that were contrary to her stated investment objectives. In affirming the sanctions imposed bythe NASD, the Commission stated that "such conduct reflects a callous disregard of [the] fundamental obligation to deal fairly with ••• customers." (ReI. 34-22410)

NASD SANCTIONS AGAINST TERRY DON WAMSGANZ REDUCED

The Commission reduced sanctions imposed by the NASD on Terry Don Wamsganz, a Chester-field, Missouri securities salesman. The NASD censured Wamsganz, fined him $5,000,and suspended him from association with any NASD member for three years. The Commis-sion affirmed the imposition of censure and the $5,000 fine, but reduced the suspen-sion to six months.

The commission found, as had the NASD, that in 1981 Wamsganz, acting outside the scopeof his employment, served as a finder in connection with the sale of a business that involved the transfer of 60% of the company's stOCK. However, Wamsganz failed to givehis employer prior written notice of his involvement in that transaction as requiredby NASD rules. In reducing the suspension imposed by the NASD, the Commission noted that Wamsganz's 15-year record in the securities business was otherwise unblemished,and that his misconduct in this instance only involved the failure to report his limited participation in a single transaction. An order has been issued authorizing Northeast Nuclear Energy Company (NNECO), Western Massachusetts Electric Company (WMECO), The Cnonecticut Light and Power Company (CL&P) and Connecticut Yankee Atomic Power Company (CYAPC), all subsidiaries of Northeast utilities, to amend and restate the Millstone Plant Agreement, for NNECO and CYAPC to enter into an agreement setting forth their rights respecting the CY Simulator and the Building, the amendment of the Owners Lease of the Building Site located in Water-ford, Connecticut, the sale and leaseback of Simulators 1 and 2 by NNECO, and the sale of CL&P's and WHECO's individual ownership interest in Simulator 3 and lease to NNECO.
