I. Project Description

a. Goals and Objectives

The Construction/Rehabilitation/Improvement of the Dumalon-Zambales-Baluno-Capisan-Malagutay-San Roque-Calarian-Cawit-Sinunuc and Maasin Water System Project (subsequently referred to as the Dumalon Water System Project, for brevity) aims to provide clean and potable water supply services for the waterless barangays in the west coast of the city, particularly at Barangays Baluno, Capisan and Dulian.

With the increase in the line pressure, as this water system will be interconnected with existing pipelines, the project will also improve the services at barangays Calarian, Cawit, Malagutay, San Roque and Sinunuc.

b. Rationale

Despite being classified as a highly urbanized city, there are still a good number of barangays without access to clean and potable water and are thus outside the service area of the Zamboanga City Water District. Punong Barangays would often request from the City Mayor water system projects for their respective barangays. But unfortunately, because of the lack proper skills and knowledge in the management, operation and maintenance of waterworks, which are oftenly operated by non-technical persons, these barangay water systems do not survive and the constituents are forced to go back to carrying water from raw springs and deep wells. Although the local government has appropriated the necessary funds for the development of water systems, it is concerned however on the sustainability of these projects if it will be left at the hands of non-technical persons. Mayor deemed it proper to entrust to the proper agency that has the appropriate expertise on water system development, operation and maintenance. . Based on previous water system projects which did not survive, he found that regardless the educational qualification of the managers, if one does not have the knowledge and skills needed to manage a local waterworks, the same would still fail. And even if the local government has its own Engineering Department, its personnel are not equipped with the

proper training on the management, operation and maintenance of waterworks.

It was through the initiative of the City Mayor Celso Lorenzo Lobregat that a Memorandum of Agreement (MOA) has been signed with the Zamboanga City Water District (ZCWD) to construct and operate this water system projects. The local government proposed to ZCWD, being the agency mandated to provide water services in Zamboanga City under P.D. 198 and has the expertise and technical know-how to undertake the development of water system projects. The Sangguniang Barangay of Baluno passed a resolution resolving to strongly support and recommend to the Honourable Mayor for ZCWD to develop, supply, operate and maintain the water system of the Dumalon River at Sitio Zambales, Barangay Baluno, this city. The Sangguniang Barangay of Capisan also resolved to approve the installation of a water system in their barangay purposely to maintain, develop and operate the water system in the said barangay. The Sangguniang Barangay of San Roque also adopted a resolution resolving to support the construction of water program at Dumalon River. The Sangguniang Barangay of Dulian-Pasonanca also resolved in a resolution to request the Mayor through ZCWD General Manager, Leonardo Rey D. Vasquez, for the establishment of Barangay Water Work System at their barangay connecting Dumalon River. The Sangguniang Barangay of Cawit also passed a resolution of no objection for the water connection of the ZCWD to pass through at Barangay Cawit to sustain water for Cawiteños. The Sangguniang Barangay of Malagutay passed a resolution requesting ZCWD to give potable water in said barangay since said barangay needs its service and that water is a basic need. The said MOA between the Local Government of Zamboanga City and ZCWD was signed by the parties on December 13, 2011.

It has been agreed that the local government will procure the necessary materials, particularly of pipes and bends, for these water system projects and turn-over the same to ZCWD for the construction and maintenance thereof. ZCWD for its part will provide all necessary labor, materials, equipment and other supplies not provided by the City for the completion of the project. After the project has been completed, it will be the latter that shall be responsible for the supply, operation and maintenance of the water system and ensure the distribution of clean and potable water to its intended concessionaires in Barangays Baluno, Capisan, Malagutay, San Roque, Calarian, Cawit, Sinunuc and Maasin.

c. Project Area and Location

The project has total pipe length of 55.352 kilometers. The trench has a total depth of 0.76 meters from top of pipe to the natural grade line, and trench width of 0.41-0.525 meters depending on pipe size.

The proposed two (2) units of concrete ground tank will require 300 square meters each at different locations (Baluno and Sitio Bandera, Barangay Dulian-Pasonanca).

The proposed intake facility will have a dimension of 10 meters by 3 meters at an identified site along the Dumalon River.

The project will run from Sta. 00+000.00 at an elevation of 869.00 meters AMSL. Geographically, the impounding facility will be located at N 7°3’7.38” E 122°1’55.2” at Sitio Dumalon in Barangay Baluno, this city. The pipeline will be passing through the following barangays: Baluno; Capisan; Pasay Road, San Roque; Malagutay; Flamingo, Upper Calarian; and Cawit.

1. Source Verification and Monitoring

This is the first stage in the project preparation stage. A probable surface water source is identified by the Environment and Watershed Protection Division or as may be determined by Barangay Officials requesting for water system services for their respective barangays. Site inspection is immediately scheduled and conducted. During this activity, water samples are taken for laboratory analysis, flow is gauged by volumetric methods, and initial studies and survey conducted to gather necessary data and information to help determine the viability of the water source.

Succeeding site visits are made as part of source monitoring in order to determine which factors may have changed in the course of time. It also aims to study other factors which may affect the quality and quantity of the water source such as upstream population and activities.

Surrounding environment is studied together with its effects to the water source. Human habitation, ambient vegetation, and agricultural activities, especially in the upstream portion of the source, are determined and are examined against the water source. These impacts are taken into consideration

whether an identified body of fresh water can be considered for source development.

2. Data Gathering and Market Survey

Relevant studies are subsequently made particularly as to the classification and ownership of the land where the source may be located. It is determined whether it forms part of public land or of private ownership.

The classification of the land where the source is located has been identified based on existing laws covering the same. The source is located within the outskirts of the Buffer Zone based on the delineation of the Pasonanca Natural Park (PNP) under Presidential Proclamation 132 which was signed by President Joseph Ejercito Estrada on July 22, 1999. It categorized the Pasonanca Watershed Forest Reserve as a Protected Area under the category of the Natural Park and its peripheral areas as Buffer Zone. As such, all activities are subject to the provisions of the National Integrated Protected Areas System (NIPAS) Act of 1991. Thus, necessary permits for the activities undertaken within should be secured.

To determine the classification of the land which were identified as probable sites for the construction of concrete ground tanks, a study was made with the maps in the Office of the City Assessor. The Office of the Community Environment and Natural Resources Officer – West was consulted to determine whether the identified sites at Barangay Baluno and at Sitio Bandera, Barangay Dulian-Pasonanca where the proposed concrete ground tanks will be constructed still form part of public land. And if so, ZCWD will secure the necessary land use permits for the purpose.

A market survey was also made to determine the market potential of the proposed area where the proposed water system will be constructed. Data on existing and projected population was used as well as the present rate of consumption.

A Zoning Certification of the areas directly affected by the project will also be secured from the Office of the City Planning and Development Officer. This will be used in determining whether the project is in accordance with the zoning classification and will not be in conflict with the Master Plan of Zamboanga City.

3. Topographic Survey of the project site (for the impounding dam, pipe network and concrete ground tanks)

The Survey Team of the Planning and Design Division, with the assistance of Forest Guards and with the coordination of barangay officials where this activity was conducted was also sought. The data derived from this will be used for the preparation of hydraulic analysis and simulation using EPANET, a freeware designed by US Environmental Protection Agency as an aid in designing water systems. This activity also aims to gather the necessary data which may affect the pipelaying activities including soil type, obstructions and contour.

4. Application of Pertinent Permits

In compliance with existing rules, the proponent submitted an application for Water Rights over the Dumalon River with the National Water Resources Board.

Considering that the source is located within the Buffer Zone of a Natural Park and is subject to the provisions of the NIPAS Act of 1991, the proponent has also sought the clearance for the activities that will be undertaken therein for the development of the water source.

Since the proposed project sites for the construction of concrete ground tank is located within a public land classified as Timberland, an application for Special Land Use will also be submitted with the CENRO-West of the Department of Environment and Natural Resources IX.

The necessary building permit will also be secured from the City Engineer’s Office in view of the various civil, electrical and mechanical works involved in this project.

Excavation permits would also secured from the Office of the City Engineer where diggings will be made along barangay and city roads.

5. Hiring of Project Workers, other than skilled

The proponent coordinated with the barangay officials of the directly affected barangays to submit to the proponent a list of residents in the barangay who are interested to work for the project with their corresponding skills.

If the property sought to be used for the purpose of this project falls within a privately-owned property, then lot acquisition negotiations would have ensued. But in this case, since the greater portion of the project component will be located in public lands, the corresponding permits will be secured from appropriate government agencies will be secured.

For the purpose of pipelaying works, it will be ensured that a Right of Passage has been secured where the pipelines would have to pass through private properties, through a Memorandum of Agreement. Pipelines passing through private properties will be resorted to only where the laws of hydraulics would require the same. In most cases, pipelines would have to pass along areas where a road right of way exists.

II. Pre-Scoping Activity (summary documentation of social preparation activities)

Negotiations have been cooking up between the local government of Zamboanga and the Zamboanga City Water District to address the clamour of waterless barangays since 2010. This is in response to the request of these barangays to the city mayor to fund water system projects for their respective barangays. ZCWD, being the responsible agency to deliver water services in the city and which has the technical expertise to undertake water system projects, was tapped by the City to construct a series of water system projects.

Public consultations were conducted in the different barangays which will be benefitted by this project. Representatives from the proponent ZCWD together with representatives from the Local Government of Zamboanga City were present to discuss to the different barangays the project. A pre-orientation on for applicants for water connection was also made to give the community an idea of the expected procedure for water services connection when the project will already be completed. As a result of these consultations, barangay resolutions

endorsing the water system project was forwarded by the recipient barangays to the City Legal Office which were appended to the Memorandum of Agreement signed by City Mayor of Zamboanga, Hon. Celso L. Lobregat, and the General Manager of ZCWD, Mr. Leonardo Rey D. Vasquez. The MOA signing, which took place last December 13, 2011, was witnessed by the following Punong Barangay:

Upon completion of the complete engineering plans for the project, the same was approved for Project Implementation. Project Description report of this proposed project was submitted to the EMB IX together with the application for Public Scoping for. A preliminary list of stakeholders and a partial list of invitees to the public scoping were prepared. Invitations have been prepared to be sent out to the stakeholders and invitees. The venue and its meals have been arranged by the proponent since the Environmental Monitoring Fund had not yet been established.

III. Scoping Process (process documentation of the actual scoping activity)

The Public Scoping Activity was conducted at the ZCWD Teodoro Araneta Training Center at Pasonanca, this city, last December 18, 2012. Although it was stated in the invitation that the activity will start at 8:30 AM, but since the schedule was in conflict with the Christmas Party of the League of Barangays with the mayor, it actually started at 9:30 AM.

The activity was attended by different Punong Barangays from the beneficiary barangays of this project. Western Mindanao State University, who has an experimental forest on the outskirts of the Buffer Zone area, was also represented in the scoping activity. Although originally not on the pre-listed list of invitees, a last minute invitation was given to the Protected Area Superintendent (PASu) of the Provincial Environment and Natural Resources Office (PENRO), which was accepted. The City Government of Zamboanga was also represented. (See attached attendance sheet).

Although the National Irrigation Administration was invited for the Public Scoping, they did not send in any representative to attend the

same. They have been invited as one of the interested stakeholders considering their proposed project which runs in conflict with the present project.

The Environmental Management Bureau (EMB) IX of the DENR was headed by EnP Sixto Tolentino, Jr. together with Engr. Winnie Ramos and her staff.

The proponent was headed by Engr. Arnulfo Alfonso, together with Engr. Carlos L. Perez, Sr., Engr. Marie Claire C. Bongo and Engr. Anne Aubrey R. De Guzman-Bugtong.

Present also during the Public Scoping were the members of the Review Committee headed by its chairman, Engr. Albeus G. Sarthou, together with Engr. Josefino Belocura. The other member of the three-man EIARC was Engr. Ilde B. Deloria, although he was not present at that time because of a prior commitment.

Dir. Tolentino, opened the program by giving the Overview of the Scoping Guidelines and the Mechanics of the Scoping Project emphasized that even government owned and controlled agencies are not exempt from the requirements of P.D. 1589. He said that all project proponents must first secure an ECC prior to the implementation of their projects. He learned that before the program started he had been informed by the participants that the project has already commenced. Thus, according to Dir. Tolentino, since the Dumalon Water System Project has commenced implementation without first securing an ECC, his office will be conducting an inspection as to the extent of the project which was already completed. He said that ZCWD then should expect a Notice of Violation, which entails the payment of penalty. Although later in the meeting, he agreed to allow ZCWD to proceed with the preparation of the Environmental Impact Statement (EIS) rather than to require the preparation of an Environmental Performance Report and Management Plan (EPRMP) (a document which is required for projects which has already commenced implementation but which has no ECC). He was willing to negotiate with the violation and said that he will report to the head office in Manila that the project merely started with the earth preparation works. Thus, according to him, penalty will be computed based on the extent of project completion, which is only at the earth preparation stage.

In his overview, he said that the objective of the public scoping was to serve as an avenue for the constituents of directly affected communities to air their issues and concerns regarding the project. This, according to him, will be used in the preparation of the EIS Report by the project preparer. In this manner, the EIS Report will be focused on the issues and concerns raised during the Public Scoping.

Engr. Carlos L. Perez, Officer In Charge of the Engineering Department presented the Proposed Project to the assembly. The Potential Impacts and Applied Measures was presented by Engr. Anne Aubrey R. De Guzman.

During the presentation of the different environmental impacts expected in the different project components, one of the concerns raised was the frequency of maintenance checks made by ZCWD of its vehicles to ensure that the emissions are in compliance with the standards set by the Philippine Clean Air Act (PCAA). Furthermore, the methodology of the determining compliance was also raised. ZCWD in response informed the assembly that there is a unit in the office who is tasked in maintaining the vehicles. It is the same unit which is responsible for registering the vehicles with the Land Transportation Office (LTO) – the same institution which is now tasked with the monitoring of vehicular emissions and the implementation of the provisions of the PCAA in the transport sector (previously it was the EMB who had jurisdiction). It was explained that during the annual renewal of registration, vehicles are submitted for emission testing at accredited testing centers in the city, the results of which are turned over to the LTO. It is then determined whether the emissions of all ZCWD vehicles are within the standards set by PCAA. Dir. Tolentino raised his concern about the smoke belchers where he asked whether the city has an existing ordinance apprehending them. It was addressed by Atty. Ed Fronda who said that at present there is none but the Sangguniang Panlungsod has passed an environmental ordinance.

Dir. Tolentino said that it was his desire to make the EIS Report of ZCWD “maganda” which is why he has raised various issues to improve the draft report. He said that the report must name particular accountable personnel who will be responsible for the monitoring the environmental compliance committed in the EIS.

Rey Modillas, Punong Barangay of Cawit, has raised the issue on the possibility of heavy metals content of the water source. He discussed to the body at large that where the water source is located was an abandoned mining site and that in the previous years a private industry studied the water quality in the area in the hope of tapping the same as a water source for a probable water system. Accordingly however, the source was found to be high in lead content. This was dispelled by Engr. Perez by assuring that the water sources of ZCWD before any water system projects are commenced, water quality studies are being conducted by the Planning and Design Division to ensure the water quality and sustainability of the water source. the water samples from the identified sources for development before engineering plans are prepared. Dir. Tolentino advised that the methodology and procedures of water analysis conducted be included in the EIS Report. Engr. Sarthou also advised the proponent to have water samples from the source studied for heavy metals content. He also recommended that the proponent include in the EIS Report the extent of the water analysis conducted, the methodology used and the parameters tested.

It was raised that there is no laboratory in the city which has the capability to perform water analysis for trace heavy metals. Dir. Tolentino offered assistance to the proponent to have water samples tested at the Mines and Geosciences Laboratory at the head office in Manila since the laboratories here in Zamboanga are not equipped in conducting laboratory analysis for heavy metals in water samples.

ZCWD however assured that the possibility of contamination of the source with the abandoned mining site was remote since it is located at a higher elevation than that of the the mining site. This was supported by Engr. Belocura has a personal knowledge as to the location of the proposed source to be tapped. He found that the laboratory analysis for heavy metals was no longer necessary. Engr. Sarthou however recommended that the said study still be conducted in order to dispel the doubts of the community. Engr. Perez agreed on this proposition and assured the body the proponent will comply with the proposal of the EIARC Chair and that it will be appended to the EIS Report.

Dir. Tolentino said that since part of the project site cuts across the protected area, the proponent must secure a recommendation or clearance from the Protected Areas Management Board (PAMB). He has been informed that such clearance has already been requested from the said Board and that it is still under review at the moment. Representing the WMSU, Prof. Barre was concerned whether the project cuts through their experimental forest, which is located along the outskirts of the protected area. ZCWD assured him that it does not. Prof. Barre asked about the monetary consideration committed by the proponent when this project was presented to then President, Dr. Grace Rebollos in 2010. However, he was informed that the said commitment was made in consideration of a forestry related project of ZCWD in the experimental forest and does not pertain to the project at hand.

Mr. Baysa of the Protected Areas Superintendent (PASu) informed the assembly that their office will be conducting an investigation on the alleged tree cutting made by the proponent in relation to the subject project. ZCWD committed to send its own representatives to join the said investigation and that it will adhere to the findings and comply to

whatever impositions that the PASu may deem proper under the circumstances.

Dir. Tolentino, noticing that the assembly was composed mainly of participants representing the government, said that the private sector in the area must also be heard on the matter. He said that the proponent should have invited the Silsilah Dialogue Movement who represents the Siembradores group in barangay Baluno. He said however that the proponent could at least get an endorsement from a private sector to be appended in the EIS Report to complete it.

Engr. Sarthou, in consideration of the excavation works involved in the project, suggested the conduct of an inverted survey in order to determine the particular geological components that could be affected by the pipelaying activities. Engr. Perez said that he believes that said study is no longer necessary since the standard trench depth according to LWUA standards is only 0.76 m from the top of pipe to the natural grade line. Dir. Tolentino however said that still that issue must be reported in the EIS and the subsequent justification of the proponent.

Barangay Maasin was concerned that since there will be no pipelaying works that will be made in their barangay, that the project will not be able to serve them including the upland areas of their barangay. Engr. Perez informed the assembly that budgetary constraints have limited the project from including pipelaying works going in the barangay. He added though that the water system project will definitely benefit the barangay as it will definitely increase the pressure in the area since the water system will be interconnected to the present pipelines, which also passes through the barangay.

At this issue, Atty. Ed Fronda gave a briefer at how the project was conceptualized. He said that punong barangays in the city often call to the mayor to ask for assistance in developing their own waterworks in the barangay. However, due to lack of technical skills on the proper operation and maintenance of these water systems these projects do not survive. Thus, it was through the initiative of the City Mayor that the present set up was devised. The City Government of Zamboanga will provide the necessary materials to construct these barangay water systems and give to ZCWD the construction, operation and maintenance thereof as it is the latter that has the technical skills on the matter. Rey Modillas confirmed the revelation of Atty. Fronda and committed that they are all for the project since it has long been their desire to have their own potable water right at their doorstep. According to him water supply is really a problem in his barangay especially during the rainy season as the water from their wells become very turbid. They had committed that they will be vigilant in protecting the water system and the water source.

Dir. Tolentino was concerned why the project was developed in the West and why not in the East. Engr. Perez said that the project is a priority water system since this has been conceptualized some years ago and that there are also water system projects that will cater to the residents in the East. He assured the EMB however that ZCWD will not implement these projects without the ECC having been issued by their office first.

Bernardo Clemente, Punong Barangay of San Roque, had raised no issue but merely expresses his gratitude for the conceptualization of the project since it will definitely increase the water pressure in his barangay.

Dir. Sixto asked why the source, being located at a high elevation, was not developed into a hydropower source. Engr. Perez said that the head is not sufficient for such development.

Rey Modillas raised whether an appeal is still possible for ZCWD to provide free water services for the barangay halls of the affected barangays, even if the resolution accepting the water system project has already been made. He asked the consensus of the Punong Barangays present in the assembly if they could draft a joint resolution asking the same from ZCWD. Engr. Perez asked them however to communicate with management on the matter.

Dir. Tolentino, upon presentation of the project component on the recruitment and hiring of local skills, emphasized that although it is a condition in the ECC that priority in the hiring of manpower will be given to the constituents in the directly affected communities provided they are qualified. He had been informed that ZCWD implements the 60-40 system in the manpower selection as its commitment to the barangay.

Dir. Tolentino asked whether there is a resolution from the Sanggunian on the subject project as it encompasses several barangays. Atty. Fronda pointed out that the City Government would not proceed with any project when it is against the will of the barangay concerned. Memoranda of Agreement must always be appended with the barangay resolution of the concerned barangay.

Upon the presentation of the potential impacts during the construction phase, Engr. Sarthou raised to the body to dispense with the discussion on the technical aspect of the project and that the same be discussed instead during the technical conference. Data from the Feasibility Study may be used according to Dir. Tolentino for the purpose of presenting the baseline characterization of the project.

Project Rationale according to Dir. Tolentino should include the statement of Atty. Fronda as the background of the project. He added that the EIS Report must also include base year of the water source. Climate Change must also be a factor in the computation of the water supply and demand projections. All aspects must be presented in the report including impact assessment on urban land use, on population and on forestry. Community relations and the socio-cultural and political issues must also be addressed in the EIS Report.

Engr. Sarthou interjected upon the discussion on the geological aspects of the project and suggested to invite personnel from the Mines and Geosciences Bureau to act as Resource Persons for this project. Dir. Tolentino however said that there is no need to invite resource persons from the Mines and Geosciences Bureau to discuss matters on the geohazards of the project as this will be addressed during the EIS Report.

Dir. Tolentino related this project to the proposed by-pass road project of the Department of Public Works and Highways. He said that this must be reflected in the EIS Report as to whether this project will be in conflict with the said project.

Dir. Tolentino, before the close of the discussions, instructed his staff to immediately thereafter, conduct a site inspection at the project site in order to investigate the extent and degree of completion of the project.

The synthesis and integration/summary of Issues and agreements on Scoping was presented by Engr. Bugtong and the Closing Remarks and Next Steps in the EIA process was given by Engr. Ramos.

IV. Summary of Agreed Upon Scope including a brief description of issues or impacts identified or perceived during the various phases of project development categorized into physical, biological and socio-economic environment

During the scoping, it has been agreed that the methodology for the conduct of emission testing be included in the EIS Report. Also, the methodology and the parameters used for the water analysis conducted at the ZCWD laboratory must be included in the EIS Report. It was also agreed that the stand of private sectors who will be directly affected by the project must also be taken since there was no such representation in the public scoping. Upon the approval of this draft, the same shall be presented to an identified private sector and to request for the position paper or endorsement of the project.

The approval of the Protected Areas Management Board must also be sought and the same to be appended in the EIS Report.

A copy of the Sangguniang Panglungsod Omnibus Resolution endorsing the project, together with the different barangay resolutions of the directly affected barangays, as well as the signed Memorandum of Agreement, must be appended to the EIS Report.

The Special Land Use Permit issued by the CENRO-West must also be appended in the EIS Report.

Geohazards involved in the project must be reflected in the EIS Report.

It has been agreed that an inverse survey will no longer be necessary given that the depth of the excavation involved in the project will only be 0.76 meters from top of the pipe to the natural grade line.

The punong barangays of the directly affected communities agreed to draft a resolution to request to the management of the proponent to grant the barangay halls free water services.

The detailed engineering of this project will be discussed in a technical conference to be attended by the proponent, the EIARC and the EMB personnel.

V. Summary of agreed upon studies to be undertaken and methodology

It was agreed during the Public Scoping for the proponent to have water sample from the source analysed for presence of heavy metals.

A study on the implications of the proposed by-pass road project of the DPWH to this proposed project will be made.

VI. Agreed Upon Scope of Participation of Stakeholders

Members of the community are given priority in the manpower of this project, provided that they are qualified.

Private sector who will be directly affected with the implementation of this project will be identified. An endorsement of this project or a position paper on its implementation will be requested from them.

The main project component, which is the source development, being located within a buffer zone, the participation of the PAMB will be indispensable and their approval for this undertaking must first be sought.
