Beyond the Basics of Competitive Bidding

Who should attend?SCMP designation holders and experienced supply-chain and contracts professionals who want to refresh their contracting skills, build their knowledge of procurement contracts and increase their skills in order to move to the “next level” in their organization.

Why this workshop? Many learning opportunities provide an introduction to competitive bidding and the basics of the process. This workshop will review those but off er a more practical focus on building skills for use at work. This workshop was designed to give practitioners exposure to best practices and then an opportunity to apply them in a way that simulates “on-the-job” settings. Participants will be able to return to work with selected methods, tools and templates for immediate application that will enable the creation of greater value for their respective organizations. In addition to its focus of practice excellence, the workshop is unique because it is delivered by an individual who has “practiced what he preaches” in many diff erent and diverse industry environments.Setting Strategy for sourcing processes, providing accurate and comprehensive Scopes of Work, creating RF(X) that meet company needs, managing and reporting processes as well as evaluation practices will give the attendees and their employers the knowledge and tools to help their organizations achieve a competitive advantage.

What value can I expect? The workshop is designed to promote study of “real-life situations” that are relevant to practitioners and their organizations. It focuses on exploring the best practices that should be employed at the 5 key stages of the competitive bidding process.

About the InstructorRichard Venerus, MBA, LL.B.Richard is the principal of RV & Associates – a procurement consultancy specializing in supporting and improving the performance of strategic sourcing and contracting functions in private and public sector organizations. RVA’s

practice relies on Richard’s 15 years of mixed experience as procurement counsel and as a sourcing specialist and leader. In addition to a degree in Law, Richard holds a Master of Business Administration degree from the Schulich School of Business, as well as a Bachelor of Commerce degree in Economics. He is also a certifi ed Change Management expert. Richard is a frequent instructor, facilitator and presenter of procurement and contracting subject matter, for the Supply Chain Management Association.

Prerequisites:• At least two years’ experience in Strategic Sourcing; and/or• 3-5 years of exposure to Strategic Sourcing; and/or• SCMP designation.

Practical Procurement™

Page 17: SCMA Alberta Professional Development Workshops 2015 - 2016

Learning MapStrategy Setting:For many reasons, sourcing processes are often executed without the benefi t of a strategy. Even in a resource-constrained environment, individual practitioners can support each competitive bidding action with an intelligent strategy. This course will provide participants with a “Strategy Tips List” which - if diligently applied in practice - will result in improved eff ectiveness of the RF(X) process – which in turn should result in better supplier selection decisions.

Scope Writing:One of the key hallmarks of competitive bidding success is having an accurate and comprehensive scope that provides the supplier market with full information about compelling revenue opportunities. The practice of gathering requirements and writing scopes for RF(X)’s is an acquired skill. The workshop will provide participants with a Sourcing Requirement Gathering tool and instructions on how to use it eff ectively for professional results. Better requirements gathering should result in more accurate scope setting, more focused RF(X) drafting and ultimately, higher quality supplier submissions.

Drafting Practice:There is an art to creating a fl exible competitive process document that results in a “trifecta” of: process effi ciency, meeting supplier expectations of “fair treatment” and ensuring compliance with procurement laws. This part of the workshop will provide participants with a sample annotated RFP template, which the instructor will use to showcase practice tips on how to create the “best-for-you” documentation.

Management:Sourcing professionals benefi t from conscious application of selected project management practices throughout the RF(X) process. The workshop off ers a sample project plan for an RFP that will serve as a platform to highlight key activities that are often given “short shrift” in competitive bidding situations, including stakeholder management, communications planning and status reporting.

Evaluation Practice:Many organizations miss the opportunity to become excellent at supplier evaluation – arguably the most important part the competitive bidding process. This part of the workshop will explore best-in-class evaluation methods and provide evaluation tools that - if diligently used – will result in optimal supplier selection while being “bullet-proof” on issues of fairness and perceived bias.

Who should attend? The seminar was developed for SCMP designation holders and experienced supply-chain and contracts professionals who are looking for a refresher on their contracting skills, to build their knowledge of procurement contracts and increase their skills in order to move to the “next level” in their organization.

Why this workshop? The Workshop activities include a combination of lecture and class discussion with strong emphasis on group learning. The material will be delivered by a senior practitioner who will establish a dialogue with participants that encourages them to learn from each other’s experiences as much as from those of the instructor. The Workshop is designed to promote study of “real-life situations” that are relevant to practitioners and their organizations. While there are many learning opportunities that deliver information on the basics of contracts - there are comparatively few that focus on developing practical skills for use at work. This workshop was developed by an experienced procurement consultant and qualifi ed lawyer, with experience providing contracting services to organizations within a diverse set of Albertan industries.

What value can I expect? This Workshop is helping defi ne a new type of competence that will diff erentiate the successful companies in the global market. The companies that focus on the creation of eff ective and effi cient strategic supplier development programs will benefi t from a new and sustainable competitive advantage. In addition to providing a refresher on the contracting life-cycle, the workshop is focused on exploring the following 4 key areas of the procurement contracting process. The Instructor will give practitioners access to both con-tracts formation, and design knowledge; also providing opportunities to apply that knowledge in-class in a way that simulates “on-the-job” contexts. Participants should be able to return to work with new skills for interpreting and developing contracts, work tools and templates, which will immediately enable attendees to create greater value for their respective organizations.

Prerequisites:At least two year’s experience in a contract-related role and/or 3-5 years of exposure to contracts in a non-contracts related role.

Learning MapStrategy and Design:For many reasons, contracting activities are conducted without the benefi t of a strategy. This course will provide participants with a “Design Approach” document, when diligently applied in practice will result in more eff ective processing of contracts and improved negotiation outcomes.

Scope Writing:One of the hallmarks of contracting success is having an accurate and comprehensive scope that informs and supports the operative provisions of the contract – as well as its users. The gathering of requirements and the writing of scopes for contracts is an acquired skill. The workshop will provide participants with a Contracts Data-Gathering Approach Tool and instructions on how to use it eff ectively for professional results. Skilled requirements gathering should result in more accurate scope setting, more focused and clearer drafting of intended outcomes and ultimately, higher quality contracts.

Sculpting the Operative Provisions:There is an art to creating a fl exible contract document that can accommodate its business context as well as assure compliance within the prevailing legal environment. This part of the workshop will explore how supply chain practitioners can understand and modify their organization’s standard form contracts to create “best-for-the-situation” documentation.

Key areas of focus are:• Contract Structure – the materials will present a basic structure that you can apply to help deconstruct and interpret most forms of procurement contracts, whether for physical goods, intangibles or services.• Contract Formation – the Workshop will explore legal knowledge about how contracts are formed and how they can fail to form or be made invalid by circumstances or the actions of parties.• Commercial Model/Price Structure – in this focus area, attendees will be introduced to and explore several of the more common commercial models that are found in procurement contracts.• Risk Management – the materials will explore the concept of Supply Chain Risk Management (SCRM), and then look at how contracts can be used as a risk mitigation tool. In par-ticular, the risk management provisions that are typical in procurement contracts will be reviewed and elaborated upon.• Contract Management - the workshop will fi nish by briefl y reviewing the activities and processes associated with the separate functions of contract administration and supplier performance management.

“Experience and knowledge in both legal and procurement, helpful with delivering material and answering questions. Also provided examples and elaborated on

group comments.”
