FAR Interim Rule March 16 2011 The procurement provisions of the NOAA are implemented in the FAR through a defined and structured rule making process However it was determined that Section 811 of the Act needed to be effected in the FAR sooner than the normal rule making process allows In this instance Section 811 was implemented by publishing an interim rule in the Federal Register The interim rule (76 FR 14559) was issued to implement the requirement of section 811 to require a Justification amp Approval (JampA) prior to awarding a sole source contract in an amount over $20 million under the 8(a) Program ( 15 USC 637 (a)) As a result FAR 6204 6302- 5 6303- 1 amp 2 6304 15607 and 19808 were amended Once the interim rule was published DoD immediately began to comply with the rule

Evolution of t he FAR

The FAR is a substantial and complex set of rules governing the Federal Governments purchasing The FAR is issued and maintained jointly under the statutory au thorities granted to the Secretary o f the Department o f Defense (DoD) Administrator of General Services (GSA) and the Administrator for the National Aeronautics and Space Administration (NASA)

Statu tory authorities to issue and revise the FAR have been delegated to the Federal Acquisition Regulation Council made up of representatives from DoD GSA and NASA

The FAR applies to most agencies in the Executive Branch The Legislative and Judicial branches are not required to comply with the FAR but tend to follow it in spirit and content In addition Executive Branch agencies (such as the DoD) issue supplemental regulations (the Defense Federal Acquisition Supplement DFARS) that include purchasing rules unique to these agencies

DFARS is a supplement to the FAR that provides DoDshyspecific acquisition regulations that DoD acquisition officials and contractors doing business with DoD must follow for the procurement of goods and services

For example EAR 19SOSCbl states the following The SBA procurement center representative (or i f a procurement cen ter representative is not assigned see EAR 19402Cal) may appeal the Contrac ting Officers rejection to the head of the contrac ting activity (or designee) within 2 working days after receiving the notice The head of the contracting activity (or designee) shall render a decision in writing and provide it to the SBA representative within 7 worlcing days Pending issuance of a decision to the SBA representative the Contracting Officer shall suspend action on the acquisitionbull
