In fact, ASHRAE 189.1 is referenced within the code as a possible compliance path, and cooperating sponsors of the code include the U.S. Green Building Council and ASHRAE itself (along with the American Institute of Architects (AIA), ASTM International, and the Illuminating Engineering Society). However, code developers maintain that IgCC is not redundant but rather a necessary part of advancing sustainability in mainstream buildings: the code is intended to raise the “floor,” meaning the enforceable regu- latory minimums, while giving voluntary certi- fications more flexibility to push the “ceiling” of high-performance possibilities ever higher. The code is also written to streamline with other in- ternational codes, including the International Building Code (IBC) already enforced through- out the U.S. IgCC, when adopted by a jurisdiction, applies to all commercial buildings—both new and exist- ing—as well as to all residential buildings over three stories. In addition to the many manda- tory requirements, which represent the bulk of the code, jurisdictions may include their own requirements—such as light pollution control or stormwater management—and in some cases make exceptions to the code. The International Green Construction Code (IgCC) was finalized November 6, 2011, in Phoe-nix after a two-year development process. Al-though many jurisdictions have already adopt-ed IgCC, the full code will not be published until March 2012.

Anyone familiar with the LEED rating systems or the ASHRAE standards will likely feel right at home with IgCC, which covers much of the same territory. In fact, ASHRAE 189.1 is referenced within the code as a possible compliance path, and cooperating sponsors of the code include the U.S. Green Building Council and ASHRAE itself (along with the American Institute of Architects (AIA), ASTM International, and the Illuminating Engineering Society). However, code developers maintain that IgCC is not redundant but rather a necessary part of advancing sustainability in mainstream buildings: the code is intended to raise the “floor,” meaning the enforceable regu-latory minimums, while giving voluntary certi-fications more flexibility to push the “ceiling” of high-performance possibilities ever higher. IMPORTANT NOTICES REGARDING CITY OFFICE CLOSURE DUE TO MANDATORY FURLOUGH

WelcomeThe LDT Bulletin is one way we are increasing communication between the City and our customers. These bulletins will also be located in our lobby area at 630 Garden Street. To subscribe to the City LDT Bulletin please send an email to: [email protected]________________________________________CITY OFFICES CLOSED DUE TO MANDATORY FURLOUGHMost City ADMINISTRATIVE OFFICES are closed due to an unpaid mandatory furlough for City employees on Wednesday, November 23rd. Offices will also be closed on Thursday, November 24th and Friday, November 25th due to the Thanksgiving Holiday.

Most City ADMINISTRATIVE OFFICES are also closed due to an unpaid mandatory furlough from December 19 through January 2, 2012. Offices will re-open on Tuesday, January 3, 2012. This includes the Community Development Department located at 630 Garden Street. As such, Zoning & Enforcement staff will not be able to prepare Zoning Information Reports during these furlough dates, and Building and Safety staff will not be available to accept or review plans for building permits.

ZONING INFORMATION REPORTS (ZIR’s) The Municipal Code requirement to obtain a ZIR prior to the close of escrow (SBMC Section 28.87.220) will remain in effect during this furlough. In order to accommodate the needs of the real estate community as best we can, we are committed to completing all ZIRs received by Thursday, December 8th, prior to the furlough. We will make every effort to complete additional ZIR applications received during the week of December 12th, but cannot commit to this at this time, as we don’t yet know the extent of our ZIR workload for that period.

While we cannot accept ZIR applications in person during the two-week furlough, agents may continue to mail them in and we will begin working on those applications when we return on Tuesday, January 3rd. If an escrow opens and closes during our two-week furlough, agents are still required to submit an application as soon as possible, either in the mail or in person once our office re-opens. We will waive the double “After the Fact” ZIR fee if valid escrow instructions are provided to verify the escrow opening and closing dates occurred during our furlough.

If you have any questions regarding the furlough period and how this relates to ZIRs, please call the Planning Counter at 564-5578.

BUILDING AND SAFETY PLAN CHECK AND INSPECTIONS While there will not be Building and Safety counter staff available to accept or review plans during the furlough, there will be limited Building and Safety inspection staff available Monday through Thursday, the week of December 19th and Tuesday through Friday, the week of December 26th. Building and Safety inspection staff will NOT be available for inspections Monday, January 2, 2012 but will resume normal business hours Tuesday, January 3, 2012. Use the inspection request line as you normally would, by calling 564-5492.

We ask that, if an inspection can be postponed until after the first of the year, please do so.

FIRE PREVENTION Fire Prevention Staff will be on duty Monday through Thursday the week of December 19th and Tuesday through Friday, the week of December 26th. Staff will NOT be available Monday, January 2, 2012 but will resume normal busi-ness hours Tuesday, January 3, 2012. Please contact them at 564-5702.

FOOT SAFETY - ITS A SHOE IN FOR SAFETY

The foot is something that doesn’t get much attention unless there is a problem. Therefore, to avoid possible injury, it’s important to think about safeguarding the foot before undertaking any job.

Workers may be exposed to various hazardous conditions on the job, including slippery surfaces, climbing hazards, handling or working around heavy equipment and machinery and working around electricity. These different working conditions may require different safety footwear to protect the foot, and the worker, from injury.

When choosing safety footwear, you must select the legally approved shoe or boot required for the job activity, equipment, and situation. Some situations may require metal-toed boots to protect the top part of the foot. These steel-toed shoes provide extra protection over the top of the foot and can make a difference in preventing an injury in an accident.

Safety shoes or boots with impact protection should be worn when workers carry or handle materials such as heavy packages, objects, parts or tools and for other activities where objects may fall onto the foot. Workers should be required to wear safety shoes or boots with impact protection when their work involves wheeling carts that carry heavy materials; handling heavy, bulky tools (paper, fabric, carpet, lumber etc.); working around heavy pipes or in situations where a heavy object may roll over a workers foot.

Safety shoes or boots with puncture protection should be required where a worker could step on sharp objects such as nails, wires, tacks, screws, large staples, scrap metal, etc. And special types of insulating shoes or conductive shoes may be necessary for certain types of electrical work.

Employers should instruct their workers in the correct safety footwear necessary for the work they will be required to perform or situation they may encounter on the job. They should also understand the importance of wearing the protective footwear. Safety awareness and healthy workers comes from a total safety program that includes ongoing education and training in personal protective equipment on the job.

Los pies son algo que no recibe mucha atención a no ser que exista algún problema. Por lo tanto, para evitar posibles lesiones, es importante pensar en salvaguardar los pies antes de empezar alguna tarea.

Los trabajadores pueden estar expuestos a varias situaciones peligrosas en su trabajo, incluyendo superficies resbalosas, pel igros al subirse en algo, manejo de equipos pesados o trabajos en las cercanías de maquinarias o electricidad. Dichas diferentes situaciones de trabajo pueden requerir diferente calzado de protección para proteger a los pies y al empleado de lesiones.

Al seleccionar los zapatos de protección, se deben escoger los zapatos o botas legalmente aprobados para la tarea de trabajo, el equipo o la situación. Parting may be ‘sweet sorrow’ but it’s also more paperwork for contractors. Nothing ‘ventured’, nothing gained. As a license qualifier departs it can also open up new avenues of individual op-portunity. Another contractor faces a dire situa-tion, and last I want your feedback to share…

Q: I am in the process of leaving my company. What steps do I need to take to remove myself from their license as I was the Responsible Man-aging Employee (RME) for the A & B. Being that I took and passed the tests is it possible for me to carry my own license forward into my next ven-ture or do I need to re-test? Please let me know how to go about this. Thank you A: The first step would be to complete and file a Notice of Disassociation to remove yourself from your present license. Since the license belongs to the corporation not you as the RME, you can take these classifications anywhere you want; however, you may not take the license number. If “your next venture” is to operate as a Sole own-er, you’ll need to apply for a new original license. If you intend on qualifying as a RME on another corporation, you’ll need to file two applications for additional classifications. Either way there is no need to re-test. Q: I have enjoyed reading your Q&A in the ‘Cali-fornia Builder & Engineer’ for many years. About 10 years ago I was forced to bankrupt my

Engineering Company. I also had an unrelated contracting company. One of the listed credi-tors was a bank. About the same time as I was making this filing, a company purchased what they thought was a recoverable obligation. They either did not know or did not care if they were violating an automatic stay. Nevertheless, they failed to file a demand un-der a list of creditors and proceeded to secure a judgment from a Court. I knew nothing about the court action and was not served notice of the hearing. This is by way of background. I am upset at the actions of the Contractors Board since they will not issue my ‘pocket card’, even though my fees are paid, and I requested ‘inac-tive’ status. After the Contractors License Board had deposited my renewal check, they sent me a letter saying they could not issue my pocket li-cense, which is required when contracting. Section 7071.17 of the B & P Code regarding judgments states “construction related”. What does a credit card issued to Engineering Compa-ny have to do with my contractor’s license? Any suggestions on what to do?

A: Your license has been renewed Inactive until 2013 but is suspended due to “an outstanding civil judgment”. I do not know why the Board would hold back issuing a pocket card with an “inactive” license. Conversely, with an Inactive

license the pocket card is not critical since you cannot do any contracting. I would suggest providing the CSLB with a copy of your BK, which lists the applicable bank credi-tor? Often this is the only thing the Board looks for. I do not believe it matters that someone else purchased the asset; however, I would consult with a bankruptcy attorney to see if this is an is-sue. If this doesn’t work you might try making the argument that “a credit card issued to an Engi-neering Company” is not “construction related” however, it’s up to the CSLB to determine what does and does not fall into this category. CONTRACTOR ALERT: If you have called or emailed the Governor’s Office regarding the CSLB hiring freeze, please contact me with the response you have received. Hardest hit are the Board’s enforcement efforts against the under-ground economy and the “phone units” ability to respond to everyday calls from contractors and consumers.

Water conservation and efficiency—IgCC estab-lishes maximum flow rates for fixtures and water consumption limits for appliances depending on the building type. Hydronic heating systems may not use potable water. Extensive provisions for rainwater storage and graywater systems are included.

Indoor environmental quality and comfort—“Smoking shall not be allowed inside of build-ings,” according to the code, which also addresses radon, asbestos, VOCs (referencing California reg-ulations), sound transmission, and daylighting.

Commissioning, operations, and maintenance—Extensive pre- and post-occupancy commis-sioning are required by the code, along with

education of building owners and maintenance personnel.

IgCC includes a prescriptive path (a “cookbook” approach that smaller buildings may follow) and a modeled performance path (a more flex-ible approach to meeting energy performance targets, required for buildings over 25,000 ft2). During the final hearings, a third compliance path—an outcome-based approach advocated by a coalition comprised of the New Buildings In-sititue (NBI), the U.S. Department of Energy, AIA, the Building Owners and Managers Association International, and the National Trust for Historic Preservation—was removed from the code. Ac-cording to NBI communications director Stacey Hobart, the outcome-based code concept was well received, but committee members felt it was too new and were not quite ready to include it. The coalition plans to refine its proposal and re-submit it for the 2015 revision of IgCC.
