    The undersigned, Deteotive Sergeant Patrick Lynch, being duly oworn, does depose and state that he is aof the Ansonia Police Department and has been since April 11,1990. At all times mentioned herein he

    as a member of said department. The following facts and circumstances are stated from personaland observations as well as information received from other police officers acting in their official

    and from official police reports and statoments made by prudent and credible wttnesses.That on 6/1 Ol11 atabout 1919 hours the Ansonia Police Department received a 91 1 calt for an unresponsive

    at 41 HubbellAve second floor. Officers Smith and Esposito were the patrol units assigned to the call andtheir arrival found Robert Vlasaty and Kathy Rivera performing CPR on Kyle Robinson with Angel Santiagothem instructions he was receiving over the phone from the rnedicaldispatcher. Officers Smith and

    took over CPR untilthe following medical personnalarrived on scene, Paramedics Wes Young andAEMT Dalton Browning and EMT Thomas Dempsey.

    That while medical personnelcontinued to care for Kyle Robinson Off, Smith spoke with Angel Santiago, whohimself as Kyle's father. Santiago told Off. Smith he had fed Kyle a bottle of formula and was in the

    of making dinner for Kyle's siblings when he heard a noise from the living room where he left Kyle oncouch. Santiago stated when he went into the living room he found Kyle unresponsive so he yelled for

Kyle's heaft was not beating on its own and he was not breething on hisown. Kyle was transported to Griffin Hospitalwhile medical personnel continued CPR until he could bestabilized. Once at Griffin Hospital it was determined that Kyle's heart had Dot been beating on its own for atleast 25 minutes. Eventhough ihe hospitalwas able to get Kyle's heart beating on its own he was intubated andplaced on a respirator to assist him in breathing. Once Kyle was stebilized he was transported to the Yale NewHaven Hospital Pediatric lntensive Care Unit(YNHH PICU) and admitted on 6110111.5) That Kyle Robinson's rnother was identified as Kelly Robinson. Angel Santiago was not Kyle's father but wasengaged to Kelly and lived with Kelly, Kyle and Kelly's two other male children. Santiago was not the father ofany of Kelly's children.6) That while at Gn'ffin HospltalAngel Santiago was again interuiewed, this time by Det. Tenney, and Santiagoprovided a written statement which Santiago wrote himself. Santiago provided the following information in hiswritten statement, he was feeding Kyle around 1820 to 1830 houre when Kelly called him and he told her that hewas feeding the kids. Santiago put Kyle on the couch with a baby blanket under the bottle to hold the bottle up toKyle's mouth and he went into the kitchen to feed the other kids. After making the other kids.dinner and settingthem up at the kftcnen table he checked on Kyle and he was fine. Santiago then fed and cleaned up efter thedog and when he went to chack on Kyle he found Kyle had throwrr up and his mouth was filled with milk. Kyle'seyes had rolled to the back of his head so Santiago picked him up put him on the floor and started to press onKyle's chest. \Nhen Santiago pushed on Kyle's chest Kyle spit up milk so he kept pumping his chest andbreathing into Kyle's mouth but Kyle was not breathing. Santiago then called 911 and was told to continue CPR

    he did until Robert Vlasaty and Kathy Rivera came upstairs, that Robert told him he was doing it wrongRobert and Kathy took over CPR until police and paramedics arived at the apartment. Santiago estimated

    time the Kyle was left unsupervised was about 15to 20 minutes.That Santiago consented to a search of the apartment, signing the oonsent form in the presence of Det.

    A search of the apartment on 6/10/1 1 was conducted by this writer and Det. Adcox- The apartment wasto be neat and orderly. Seized from the living room in the apartment was a onesie, towel, baby blanket,

All of the items were taken from the couch where Kyle Robinson was just prior tothe 911 call and the floor where he was found by first arriving officers.8) That on 6/11/11 Det. Tenney, Off. Esposito and Oft. Frolish met wfth Sandra Liquindoli of the Department ofChildren and Families(DCF) at the PICU while Liquindolispoke wlth Kelly Robinson. Kelly told DCF thatSantiago told her he found Kyle unresponsive with his eyes rolled to the back of his head so Santiago shookKyle a little to try and wake him. Kelly said that Santiago's description of Kyle gave her the impression that Kylewas lifeless like a doll when Santiago picked him up. Kelly also stated that Santiago told her that one to two daysprior to 6110111 he fell asleep with Kyle on his lap and Kyle fell off his lap and onto the floor, that Kyle cried alittlE but stopped. Kelly said she was told by a doctor at the hospital that the injury to Kyle could have occunedup to two days prior to Kyle going to the hospital.9) That once Kyle Robinson was transfened to Yale New Haven Hospital PICU he was given neurologicalexams, CT and MRI scans, to access his brain function, along with blood tests and other medicaltreatment tomaintEin the stability of his organs. Kyle's prognosis was reported to be grim with brain death being listed as themost likely outmme. The testing of Kyle included a skeletal survy, MRl, CT scen, and ophthalmology exam.From his admission to the PICU and during his entire time in the FICU, Robinson's condition never changed.Robinson was cornpletely unresponsive, he was unable to breath without the aid of a respirator, he showed noresponse to stimulus, his pupils were fixed and dilated, there were no spontaneous movements, and no gag orough reflex. Rohinson was considered to be brain dead upon anivalatthe PICU on 6/10/11 and was officially

    brain dead at 1020 hours on O6112t11.That the MRI and CT scans revealed Kyle Robinson had bilateralsubdural hemonhages, which is bleeding

    both sidos of the brain in the area betwaen the brain and skull, most commonly caused by trauma- Theexam showed bilateral retinal hemonhages, which is bleeding in both eyes and also most

    caused by trauma. A complete skelatal exam was done on Kyle, an xray taken during the skeletalrevealed a possible skullfracture but no injuries to any other part of his body was found during the exam.

These findings were consistent from the timeKyle was admifted on 6hAh 1 until he was pronounced dead on 6n411,12) That on Ah4l11 an autopsy was preformed by Dr. Susan Williams on Kyle Robinson at the State ofConnecticut Office of the Chief Medical Examiner(OCME) in Farmington. Dr. Williams is an Associate MedicalExaminer at the OCME. At the conclusion of the autopsy Dr. Williarns listed the cause of Kyle's death as BluntHead Trauma and the manner of death as Homicide. After the autopsy was cornpleted the OCME sent Kyle'sbrain and spinal cord to the Children's Hospital of Philadelphia for a neuropathology exaffiination.13) That on 6114111 Kelly Robinson was interviewed at the home of her mother in West Haven by Off. Frolishand Det. Tenney. The interview was to establish a time line for 6110111, Kyle Robinson's health prior to theincident on 6110111, who had contact with him and who took care or him, The following information was leamedfrom Kelly Robinson during the interview. About two days prior to 6110111 Kyle had felt warm to the touch butwas not running a fever so she did not take him to the doctor. Kelly did not report any other health issues withKyle and said that he was eating normally, On the moming of 611g111 Santiago gave Kyle his bottle between0300 and 0400 hours and another bottle before Kelly left for court at about 0850 hours. Kelly was in cout't until1100 hours, she went to a store in Derby and then home. Kelly went home for lunch with her children, that Kylewas up but in the crib and then she left for work around 1240 hours. Kelly called home from work at about 1815hours and Santiago told her the older boys were eating dinner and everything was okay. Later she received aallfrom Sarrtiago, she could not recallthe time, but Santiago wa$ crying and telling her something was wrong

    Kyle so she told him to call 91 1. Kelty called her boss to tell him she had to leave, she then closed the store,home where she met the police and then went to Griffin Hospital. While at the PICU Santiago told Kelly

The only time Santiago did not watch Kyle was when theywent looking for an apanment or when Santiago had court. Santiago had been the only person other than Kellyto be with Kyle since 618111 end she was not aware of anyone being at the house on 6110111 prior to Kylebecorning sick.15) That on 6117111 the medical personnel who responded to 41 Hubbell Ave on 6/10/11 were interviewed at thepolice depaftment by Ofl, Frolish, lnterviewed were Thomas Dernpsey, EMT for Ansonia Rescue MedicalService(ARMS), Dalton Browning, AEMT for ARMS, Robin Fischer, Paramedic for Valley Emergency MedicalServices(VEMS), and Wes Young, Paramedic for VEMS. All of the interviews were recorded both audio andvideo.16) That the following information was obtained from the interview of EMT Thornas Dempsey. Dempseyprepared medicalequiprnent needed by the paramedics and rode in the back of the ambulance with Kyle andthe paramedics to Gnfin Hospital. Dempsey recalled the paramedics using suction to clear Kyle's rnouth andbelieved they were suctioning vomit from Kyle's mouth.17) That the following information was obtained from the interview of AEMT Dalton Browning. Browning obtainedthe events leading up to the dtnbulance being called, the name and DOB of Kyle, and pertinent medical historyrom Santiago. Santiago told Erowning that he left Kyle having a bottle and when he returned Kyle had vomitednd was unresponsive. Kyle had no medical history but had not been himself over the previous few days but

    mention of a fever or 6ny riredication being given to Kyle. Browning also noticed what he believedbe forrnula and vomit around Kyle's mouth while thei paramedics were intubating Kyle.That the following information was obtained from the interuiew of Pararnedic Wes Young. Young describedas being naked with a blanket under him, and ashen in color.Young checked Kyle's eyes and head, he did

    see any hemorrhaging in the pupils and the head was normal. When Young went to intubate Kyle he sawwas fluid around Kyle's vocal chords which indicated to him the trachea did not close when the

    went into Kyle's mouth. According to Young this could happen if Kyle was unconscious when thehis mouth. An estimeted 10cc of fluid was suc{ioned from Kyle's throat and Young described it

    milky white with chunks that he believed to be rice.

Fiecherdescribed Kyle as being neked on the floor with nothing undemeath him. Fischer placed the heaft monitor onKyle which showed a flat line rhythrn, no heartbeat. Kyle was ashen in color but there did not appear to be anyvisible injuries. When Young tried to intubate Kyle he had to suction first and the suctioning removed about 10ccof fluid.20) That on 6117t11 Det. Tenney interviewed Robert Vlasaty at the Ansonia Police Department. The followinginformation was obtained from Robert Vlasaty's interview. On6111111 Robert was home with his wife, KathyRivera, and his daughterAtexisa Vlasaty when Alexsia went upstairs to visit Kelly Robinson's kids. Alexsia woulddo that often- Alexsia came downstairs after a short time telling Robert that Santiago needed him upstairs so heand Kathy both wont upstairs. When he walked into the apartment he found Santiago and Kyle in the livingroom, that Kyle was on the floor and Santiago was trying to do CPR but was doing it wrong so he and Kathystarting doing CPR on Kyle. While peforming CPR there was formula in Kyle's mouth also Santiago wasshaking Kyle and slapping his face, but it was not hard or violent it appeared that Santiago was just trying to getKyle to respond.2llThalbetween 6129111 and 7t2ot11 the following relatives of Kelly Robirrson were interviewed regarding Kyle

    Robinson; Carol Davoe, DanielDavoe 2nd, Helen Ramos, Larry Robinson, Lisa Eaton, Michael Boryen, andTina Bowbn. These individuals were anyone udlo could have watched Kyle. None of the listed people hadcontaci with Kyle from 6/8/1 1 to 6t1O111. Michael and Tina Bowen reported that they never watched Kyle, thatMichael was at his mother, Helen Ramos'home while she watched the children but he wes never with any of thechildren alone and neither was Tina. Lisa Eeton, Rarhos' daughter, said she remembered watching Kyle inFebruary 2011 but had not seen Kyle since. Larry Robinson watched Kyle for two days in April 2011 and thelast gme he saw Kyle was onGtltll at a family dinner. Daniel Davoe 2nd never watched Kyle. Helen Ramoswatched Kyle numerous times the last being 6t2, Ot3, 614 and 6/6 or 6/7 but that was the laet time she saw Kyle.Carol Davoe last watched Kyle by herself in May 2O11 and last saw Kyle on 615111 at the family dinner.

Santiago was on the phone and pushing on Kyle's stomach andshaking Kyle. Robert and Kathleen pushed Santiago out of the way and began to do CPR oir Kyte until thepolice and medical personnel arived. Kathleen described Santiago as hysterical and she tried to calm himdown, Durirrg the interview Kathleen demonstrated the shaking of Kyle by Santiago as someone placing therehand on another and moving the person back and forth.23) That on7l5l11 Alexsia Vlasaty was interviewed by the Department of Children and Families(DCF). Theinterview took place in New Haven, was witnessed by Det Tenney, and it was both audio and video recorded.The following information was obtained from the interview of Alexsia. On 611o111 she anived in Ansonia around1900 hours went inside to the first floor apartment at 39 HubbellAve and then went to the second floorapartment io visit Kelly Robinson's children. Artgel Santiago answered the door and was speaking with someoneon the phone. The two older children were at the kitchen table eaiing, Kyle was on the living room floor and itlooked like he was spitting up liquid. Santiago told Ale)Gia to get her father, Robert Vlasaty, so she wentdownstairs to get him and then went back upstairs. When Alexsia's dad went upstairs he began doing CPR onKyle and she could see liquid coming from Kyle's mouth. Kyle was lying on the floor face up, eyes closed withhis arms up towards his head. Alexsia also believed that Kyle grabbed her pinky when she placed her handdown near him but during the interview she said it was the first time she went upstairs and then later in theinterview said that it was after she went to get her father, Alexsia also said that when she first anived at thehousa she saw Santiago standing at the front window of the house holding Kyle with Kyle's head on his shoulderand that Santiago waved hi to her. Alexsia estimated she vuent upatairs within 5 minutes of getting to the house.24)Thal on 911111 the report from the Children's Hospital of Philadelphia was faxed to this department by theOCME- Dr. Lucy Rorke-Adams was the pathologist who completed the testing on Kyle Robinson's brain andspinal cord. The report documented injurles to the brain, neck, spinal oord and eyes of Kyle. A meeting was setup with Dr. Williams at the OCME to discuss her and Dr. Rorke-Adams' reports.25) That on 9128111 a meeting was held at the OCME with Dr. Williams. During the meeting Dr. Williamsexplained that the totality of the injuries to Kyle was indicative of severe trauma. The hernonhaging to the spinalcord, the nerve roots at the neck, the ole fac1ory bulbs in the brain and the retinas was consistent with the headbeing shaken. Dr. Wlliams reaffirmed her initial autopsy findings for cause and manner of death being blunt

    26) That on 1An4l11 a phone interviewwas done with Dr. Lucy Rorke-Adams. Dr. Rorke'Adams stated theinjuries suffered by Kyle Robinson were severe and leihal, The injuries were consistent with violent shaking, somuch so the spinal cord had separated from the brain. Dr. Rorke-Adams statsd that in her opinion the injurieshad to have occurred shortly before Kyle was brought to the hospltal. Dr. Rorke-Adams also agreed with Dr.Williams'findings for cause and manner of death. .27) Thatwithin the first two weeks of this incident Christa Cusano called from the law office of Robert Mirto

    stating they were representing Angel Santiago. Cusano went on to say that Santiago would be willing to answerany questions. lt was explained to Cusano that once all the test results came hack an interview would be set up.On 1A/21111 phone contast was made with Attomey Mirto and Christa Cusano, they stated they did notrepresent Santiago any longer and were not aware if Santiago had retained any other attomey. Attempts tocontact Santiago at the two phone numbers he provided to the department were unsuccessful. One number wasdisconnected and the other number played a prerecorded message that there was no voice rnail box for thenumber before hanging up,,28) That ex parte orders were obtained for the call records for the home phone, and cell phones of KellyRobinson and Angel Santiago. The call records confirmed Kelly Robinson's interview statements that she calledhome frorn work, then Santiago called her at work from the house phone and then Santiago called 911 on6110111.

    29) That a review was done of Kyle Robinson's medical records from Milford Hospital, where he was bom, andhis pediatrician, Staywell Pediatrics. ln the Milford Hospital records the only areas of concem was that Kyleested as a caniei for Sickle Cell disease but did not have the disease and there was a mishap while performinghis circumcision which resulted in cut that needed to be sutured. ln the Staywell pediatric records Dr. Etkin noted

    Kelly Robinson cornplained about Kyle being a noisy breather and Dr. Etkin noted the issue to beTracheomalacia is weak or soft tissue in the walls of the trachea whicfr ceuse breathing

    An QJ2t11 this writer spoke with Dr. Etkin over the telephone regarding the iracheomalacia notationKyle's medical records. Dr. Etkin stated the tracheomalacia would not stop a child from breathing and in hiswas not a factor in the death of Kyle. Robinson.

    30) That based on tho medical records, autopsy and pathology reports the following facts have beenestablished regarding the of Kyle Robinson. Angel Santiago was with the only adult with Kyle andresponsible for the care of at the time Kyle suffered his injuries. Angel Santiago gave different versions ofthe events leading up to call to 911 to the first arriving police officer and detective when interviewed, nevertelling either of the call to Robinson prior to calling 911 or about prior incidents of Kyle falling off his lap or

    off a bed. The doctors who treated Kyle at Yale New Haven Hospital noted inhe other children pushingtheir reports the injuries by Kyle were non accidental. The medicalexaminerwho completed Kyle'sautopsy documented the uries to Kyle, noting they were severe and ruled the death a homicide. Theindependent pathologistthe injuries were severe,the hospital.
