Local East County Attorneys Giving Back To the Community

The San Diego Law Library (“SDLL”) is joining county law and public libraries throughout the state in celebrating Law Week, May 1 - May 6. First established in 1958 by President Dwight Eisenhower, Law Day is a day of national dedication to the principles of government under law. It is meant as a time to reflect on the role of law in the foundation of the country and to recognize its importance for society. Congress officially declared May 1 as Law Day in 1961. Law Week is an extended celebration of Law Day. In honor of Law Week, SDLL will host a series of events designed to increase access to justice. For more information on SDLL’s Law Week events, go to: sandiegolawlibrary.org/law-library-celebrates-law-week-2016.

For the Foothills Bar Association, Law Day reflects our tradition of community service. Some individuals in our community are unable to afford an attorney’s hourly rate and the annual Law Day event has been our way to donate a few hours of our time and expertise to someone in need of counsel.

This year, the FBA will again partner with SDLL for Law Week recognition and service. On May 2 at the El Cajon Public Library from 2:00 – 4:00, several of our FBA members will volunteer their time to assist the public by providing presentations and individual consultations on various legal topics, including family law and marital dissolution, landlord-tenant, probate and trusts, general civil and criminal matters. We appreciate the time and effort of these volunteers in continuing the FBA’s community service tradition.

Main There are too many homeless or non-patrons of the law library utilizing the sinks in the mens restroom to wash, shave, etc. I’d like to help the homeless and unwashed, but the only restroom for men at the law library is not the place for such help. Persons, such as attorneys, who need to use the restroom should be provided a clean facility. The homeless persons I observe in there make a mess at the sinks and don’t clean up the sink. ~ Anonymous

Resolution: The San Diego Law Library RULES OF CONDUCT: “Unacceptable behavior includes but is not limited to the following” 11. Using library restrooms inappropriately including but not limited to bathing or washing of clothes. Any person who violates these rules may be asked to leave or be removed from the Law Library by the Law Library staff, security guard, or peace officer. We have signage in each restrooms prohibiting bathing, shaving, and laundering. The security guard routinely monitors the restrooms for prohibited activities.

Main Purchase for resale cloth shopping bags silk screened with the law library logo, so when a patron checks out multiple books, they have the option of purchasing a cloth carry bag (similar to the ones at grocery stores). Patron Incident Reports Branch: Brief Description of Incident: Main Patron Kamal Mahdavi was using computer station 9. He left the computer area

and did not leave any note or anything similar to let anyone know that he was coming back. Another patron came in and sat down at computer station 9. Patron Mahdavi came back and began yelling at the patron stating that he had to leave, that station 9 was his computer. Staff attempted to calm patron Mahdavi down and explained to him that computers are not saved for specific people. Patron Mahdavi made a spitting motion that was ignored by the patron on station 9. Patron Mahdavi sat at station 7 and began to work without further disruption. Patron has been the subject the following incident reports: 1, 145, 159, 161, and 233. Incident Number 267

Branch: Brief Description of Incident: Main A male patron came into the library and informed iDesk staff that he was suicidal.

IDesk staff went to get a senior staff member. Senior staff went out and saw a man with a backpack standing between the stairs and the iDesk just staring forward. She asked the iDesk staff to call 911 and iDesk staff made the call explaining the situation and giving a description of the man. Security Staff began talking to the man. Two county maintenance workers were here and one stood nearby watching the man - aware of the situation. Security Staff continued to talk to the man and got him to sit down and separated him from his backpack - he talked with him until the police and suicide prevention counselor arrived. The police took the man into custody for a psychatric evaluation. Incident Number 268

Statistics Review – April 2016

Summary Downtown had its fourth good month in a row. In April, they answered 76 patron inquiries per day, similar to the previous three months. This is the first time in over a year that they had four solid months in a row. Also, the daily gate count was 138, a 27% decline from previous Aprils. This is due to the change making the Wi-Fi and charging stations available solely to members. There has been a considerable drop in patrons who were not using the law library for legally related purposes. Another way to look at it is to compare the patron inquiries to the gate count. In April, Downtown answered 55 inquiries for every 100 patrons. In April 2015, it was 36 inquiries for 100 patrons. Vista bounced back up after seeing its run of strong months come to an end after 13 months. They were back up to 47 patron inquiries and their daily gate count was 72. Both are typical for April.

Overall, total inquiries were lower (2929 in 2015 and 2657 in 2016) this April compared to last year, but the library was open 22 fewer days this year – 64 days in 2015 and 42 in 2016. We were open 34% fewer days while inquiries were about 9% lower.

Patron Inquiries: Downtown had its fourth strong month (76 per day) in a row for the first time in over a year. Vista (47) bounced back up after one slow month. Vista and Downtown are near their historical average.

Gate Count: Compared to the average of the last 3 Aprils, Downtown was down 27% and Vista was down about 17%. Compared to just last year, Downtown was 27% lower and Vista was about 4% lower.

Patron Inquiries Details: Downtown San Diego answered 1780 in April 2016, 23.5 days. Per day: 76 Last year, they answered 1633 in April (68 per day) and averaged 1925 (82 a day) over the last 3 years Last month, March 2016, was 1798. Per day: 75 Downtown was 12% higher than its April 2015 daily totals. El Cajon The East County Courthouse Law Library hosts clinics in partnership with the Legal Aid Society of San Diego. There is an Unlawful Detainer Clinic on Mondays, Tuesdays, and Thursdays. Vista answered 877 in April 2016, 18.5 days. Per day: 47 Last year, they answered 953 in March (48 per day) and averaged 952 (48 a day) over last 3 years. Last month, March 2016, was 708. Per day: 36 Vista was the same as its April 2015 daily totals. Chula Vista The South County Courthouse Law Library location hosts clinics in partnership with the Legal Aid Society of San Diego. There is an Unlawful Detainer Clinic on Mondays, Wednesdays, and Fridays. There is a Consumer Law Clinic on Thursdays as well. Gate Count Details: Downtown had 3249 patrons enter its gates. Per day: 138. This is about 27% lower than the average of the previous three Aprils: 191. The gate count 27% lower compared to April 2015. Vista had 1330 patrons enter its gates. Per day: 72. This is about 17% lower than the average of the last 3 Aprils: 87. The gate count 4% lower compared to April 2015. Days Open: April 2016 – Downtown San Diego was open 23.5 days, Vista was open 18.5 days. Downtown San Diego’s total includes 5 Saturdays when the library is open a half day. Vista’s totals include 5 Fridays when they were open half days. Law Librarian in the Public Library Program Update: April was the third month that the Law Library staffed the El Cajon branch of the San Diego County Library and the Civic Center branch of the Chula Vista Library for 4 hours on alternating Mondays. While at these satellite locations, the law librarian answers legally-related questions, provides instruction on using legal databases (Lexis Advance, HeinOnline, and CEB OnLaw) on the law library terminals, and gives referrals to legal providers. This month, the librarian answered 8 questions in El Cajon. The questions include reference questions about immigration and civil law suits, several referrals to legal providers including tax preparers and family law, and providing information about Law Library membership. While in Chula Vista, the librarian answered 17 questions. There were several reference questions including long patron interviews about grandparents’ visitation rights, termination of parental rights,

living trusts, estate planning, the procedure to evict tenants after judgment, and reducing felonies to misdemeanors. Additionally, the librarian made referrals to family law and CWSL clinics. Also, there were demonstrations of resources on the Law Library website, how to use Lexis and CEB databases, and where to find court forms. Lastly, the librarian answered questions about public library resources. Legal Clinics in Courthouse Library Spaces East County Courthouse Law Library hosts an Unlawful Detainer Clinic by Legal Aid Society of San Diego on Mondays, Tuesdays, and Thursdays each week. They have not reported their attendance figures. The South County Courthouse Law Library hosts an Unlawful Detainer Clinic by Legal Aid Society of San Diego on Mondays, Wednesdays, and Fridays each week. They have not reported their attendance figures.

Additionally, the Law Library hosts a Consumer Law Clinic on Thursdays each week. In April, the clinic saw 18 people.

The North County Courthouse Law Library hosts a Consumer Law Clinic on Tuesdays each week. In April, the clinic saw 6 people.

Additionally, the Law Library hosts a monthly Truancy Clinic with the District Attorney’s office. In April, the clinic saw 20 people.

Legal Clinics in Downtown Library The Downtown branch hosts a Family Law Clinic by San Diego Volunteer Lawyer Program on Wednesdays each week. In April, the clinic saw 27 people.
