The Township Committee of the Township of Hillsborough met in a Regular Meetingon the above date at 8:00 PM. Those in attendance were as follows: Mayor Joseph Tricarico,Deputy Mayor Christine Jensen, Second Deputy Mayor John Gelardi, Committeewoman SonyaMartin, Committeeman Robert Mack, Township Attorney Karl Kemm (for Emil Philibosian),and Township Clerk Gail W. McKane.

Following Roll Call and Salute to the Flag, Mayor Joe Tricarico advised that notice ofthis Regular Meeting was given to the Township Clerk, posted on the bulletin board atMunicipal Complex, and written notices sent to the Messenger Gazette, Hillsborough Beaconand the Courier News. All notices were given at least 48 hours in advance, and to the extentknown, the items on the agenda.

WHEREAS, the 2000 Hillsborough Junior Raider Varsity Football Team had

THE PERFECT SEASON

WHEREAS, the 2000 Junior Raiders are in their seventh season in the Mercer CountyFootball League; and

WHEREAS, the 2000 Junior Raiders were undefeated champions in both the regularseason and the conference tournament; and

WHEREAS, the 2000 Junior Raiders scored 294 points in nine games, averagingthirty-two and a half points per game which is more than five touchdowns per game; and

WHEREAS, the 2000 Junior Raiders allowed twenty-eight points in nine games,averaging less than three and a half points per game which is less than one touchdown pergame and recorded six shutouts of opponents in nine games; and

WHEREAS, the 2000 Junior Raiders advanced to the conference tournament six out ofseven years and to the conference championship four out of seven years and becameundefeated regular season and undefeated tournament champions three out of seven years; and

WHEREAS, the second place team had only one regular season loss and onetournament loss, both at the hands of the Junior Raiders.

NOW, THEREFORE, BE IT PROCLAIMED that we, the Township Committee ofthe Township of Hillsborough, do hereby commend all the players, managers and coaches fortheir dedication and commitment to the sport and to those principles of good sportsmanship andteam play, which such activity endorses. I further commend each of the participants in theHillsborough Junior Raider Varsity Football Team for the honor that they have brought tothemselves, their organization and our community.

ORDINANCE TO RELEASE, VACATE AND EXTINGUISH ANY AND ALLPUBLIC RIGHTS IN AND PORTIONS OF HAMILTON ROAD IN THETOWNSHIP OF HILLSBOROUGH IN THE COUNTY OF SOMERSET

STATE OF NEW JERSEY

WHEREAS, the Township Committee of the Township of Hillsborough, County ofSomerset, State of New Jersey is of the opinion that the public interest will be best served byabandoning, vacating, releasing and extinguishing any and all public rights which saidTownship may have in and to portions of Hamilton Road all as delineated in Exhibits A, B, Cand D attached hereto.

NOW, THEREFORE, BE IT ORDAINED by the Township Committee of theTownship of Hillsborough, County of Somerset, State of New Jersey as follows;

1. The public rights and interests in portions of Hamilton Road as more particularlydescribed in Exhibits A, B, C and D attached hereto and made a part herebyvacated, abandoned and released.

2. All of the aforesaid vacations are as delineated in the sketch attached hereto asExhibit D.

3. All rights of public utilities and CATV companies to the premises as aforesaid arehereby expressly reserved and excepted from this vacation.

4. The appropriate municipal officers are hereby authorized to execute any collateraldocuments necessary to effectuate the purposes of the vacation ordinance. TheTownship Attorney is authorized to prepare any and all documents, including deedsof conveyance of the right-of-way, which is herein vacated, abandoned andreleased.

5. The Township Clerk shall, within sixty (60) days after such Ordinance becomeseffective, file a copy of this Ordinance, together with a copy of Proof ofPublication, with the Clerk of Somerset County and comply in all respects with therequirements of N.J.S.A. 40:67-21.

6. This Ordinance shall become effective twenty (20) days after final passage,publication according to law and filing with the Somerset County Clerk’s Office.

AN ORDINANCE TO AMEND CHAPTER 87, “FIRE ZONES”, SECTION 5,“FIRE ZONES DESIGNATED” OF THE CODE OF THE

TOWNSHIP OF HILLSBOROUGH SO AS TO ADD SIX ADDITIONAL FIRE ZONES

WHEREAS, Christopher C. Weniger, Hillsborough Township Fire Official, hasdetermined that certain clarifications and additions need be made to Chapter 87 (Fire Zones) ofthe Municipal Code of the Township of Hillsborough for the health, safety and welfare of itsresidents; and

WHEREAS, the Township Committee is in accord with the recommendations of theTownship Fire Official.

NOW, THEREFORE, BE IT ORDAINED by the Township Committee of theTownship of Hillsborough, County of Somerset, State of New Jersey as fo11ows:

Section 1- 87-5 (Fire Zones Designated) shall be modified to add the following sections:

Ordinance 2000-38: An Ordinance to amend Chapter 77, Development Regulations, of theTownship code of the Township of Hillsborough, establishing ArticleXI, Tree Preservation, to regulate the removal and preservation oftrees

Mayor Tricarico introduced the matter.

Deputy Mayor Jensen offered a motion to open the public hearing for Ordinance 2000-38.Seconded by Committeewoman Martin.

Walter Rodgers, Taylor Avenue, asked if a developer could take a parcel of land, propose a“clustered” development and place that cluster within the ‘critical footprint’ area and removeall of the trees on those lots.

Deputy Mayor Jensen explained that this ordinance provides that trees may not be removedprior to Planning Board approval of a site plan and that no more than 20% of existing treescould be removed on a given lot when site plan approval is obtained.

Mr. Rodgers then suggested that the draft sketch requirement be changed to an overlay tosimplify viewing the proposal.

Mayor Tricarico asserted that he felt this ordinance did a good job of stopping a developerfrom large-scale removal of trees while at the same time not infringing on the rights ofhomeowners to control the look of their property.

Committeeman Mack noted that the Township Committee always had the ability to amend theordinance to make it better in the future.

ORDINANCE 2000-38

AN ORDINANCE TO AMEND THE DEVELOPMENT REGULATIONSOF THE TOWNSHIP OF HILLSBOROUGH TO REGULATE THE REMOVAL AND

PRESERVATION OF TREES

WHEREAS, the Township Committee of the Township of Hillsborough is concernedabout the indiscriminate removal of mature trees and the destruction of forested areas; and

WHEREAS, the preservation of mature trees and forested areas is a key strategy in themanagement of environmental resources, particularly watershed management, air quality andambient heating and cooling; and

WHEREAS, the preservation of mature trees and forested areas is critical tomaintaining a high quality of life and rural environment in Hillsborough Township;

WHEREAS, the pre-application removal of trees in the Township has had substantialnegative impacts on visual quality and other indicators;

NOW, THEREFORE, BE IT ORDAINED, by the Township Committee of theTownship of Hillsborough, County of Somerset, State of New Jersey, that Chapter 77,Development Regulations, of the Township Code is hereby amended to establish a new Article,Article XI, Tree Preservation, as follows:

ARTICLE XITREE PRESERVATION

SECTION 77-160. PURPOSE.

It shall be the purpose of this Article to preserve and protect the environment, aesthetics andrural character of the Township of Hillsborough by restricting and otherwise controlling theremoval of mature trees throughout all land within the Township.

SECTION 77-161. DEFINITIONS

TREE shall mean any flowering, ornamental or nursery stock tree with a caliper measurementof 3 inches or greater, any deciduous or coniferous tree of 6-inch caliper or greater or anyconiferous tree 8 feet or greater in height.

CALIPER shall mean the diameter of a trunk as measured at a height of four feet above grade.

CRITICAL FOOTPRINT AREA shall mean an area of new home construction that includesthe portions of a private residential lot reserved for driveways and the actual building foot printplus an additional 20 feet beyond the perimeter of the building footprint.

SECTION 77-162. APPLICABILITY

A. The following activities shall be regulated by this Article:1. Removal of more than 3 trees per calendar year on properties that can be subdivided,

multi-family parcels and unimproved lots.2. Removal of any tree on an improved non-residential lot.3. Cropping or trimming of trees or other activities that will adversely affect the lifespan

of the tree.

B. Exemptions. The following activities are exempt from the provisions of this Article:1. Removal of trees on developed single- and two-family residential lots that cannot be

subdivided, other than removal of trees that were planted as part of an approvedsubdivision or municipal street tree planting program. Such trees shall be replaced in alike number in the same location or elsewhere on the property.

2. Clearing of trees required in connection with new home construction that are locatedwithin the critical footprint area.

3. Routine maintenance, such as trimming, that will not adversely affect the lifespan ofthe tree.

4. Removal of trees of any size shown to be dead or diseased or that are otherwisedamaged and a threat to the health, safety and welfare of the public.

5. Selective thinning in conjunction with a management plan approved by the StateForester.

SECTION 77-163. BOARD APPROVAL REQUIRED

A. Planning Board or Board of Adjustment, as the case may be, approval for tree removalshall be required except where otherwise exempted herein. In deciding whether to approvean application for tree removal, the Planning Board or Board of Adjustment, as the casemay be, shall consider the following factors:1. Whether the removal of trees is justified and is related to an aesthetic and economic

improvement of the land that is in the best interests of the citizens and property ownersof the Township of Hillsborough.

2. Whether the design of improvements maximizes tree preservation.3. Whether the applicant has attempted to preserve stands of trees and existing understory

in logical locations.4. Whether appropriate measures will be taken to protect remaining trees during the

construction period.5. Whether the mitigation or tree replacement plan is satisfactory.

B. Mitigation Required. Mitigation for tree removal shall be required in accordance withSection 77-164, Mitigation Required, below. However, in no case shall more than 20percent of all trees on any lot(s) be removed.

C. Tree Preservation Plan Submission Requirements. In addition to the StandardDevelopment Application form, the following information shall be required for approvalfor tree removal:1. A rider explaining why each tree is to be removed.2. A Tree Preservation Plan that depicts:

a) The location, species and caliper of all trees to be removed on a surveyed drawing.b) The location, species and caliper of each tree within the drip line of each tree to be

removed.c) The quality, quantity and limits of vegetation on the remainder of the site and

within 200 feet of the property line.d) The location of existing and proposed structures including parking areas, detention

basins and other stormwater facilities.e) Existing contours and proposed grading.f) Proposed preservation methods of trees to remaing) The location of replacement trees, including a replacement schedule indicating

species, quantities and size in accordance with Section 77-164, MitigationRequired, below.

D. Variance Required. Deviation from the requirements of this Article shall require varianceapproval in accordance with NJSA 40:55D:70(c).

SECTION 77-164. MITIGATION REQUIRED

Replacement trees are required for the removal of any tree as regulated herein.

A. Number of Replacement Trees. Replacement shall be required in accordance with thefollowing schedule, and are exclusive of the shade trees required as per Section 77-73:

B. Replacement Species. Trees shall be replaced with the same species. In the case wherethe species is known to be disease-prone or is otherwise not ecologically or aestheticallyappropriate, other species shall be permitted.

C. Planting Standards. All replacement trees shall be nursery grown, certified and guaranteedand shall have a minimum caliper of 2.5 inches, or the industry standard equivalent for thespecies if ornamental. All trees shall be balled and burlapped and planted as per Townshipof Hillsborough standards.

D. Off-Site Contributions. If all required replacement trees cannot be provided on the subjectlot(s), an off-site contribution to the Township of Hillsborough Parks Department of a likenumber of trees or cash equivalent to be placed in a fund to be used for the purchase ofreplacement trees by the Township of Hillsborough for use on public property, shall beconsidered by the Planning Board or Board of Adjustment, as the case may be.

SECTION 77-165. PENALTY AND ENFORCEMENT

Violation of the provisions of this Article shall be considered a Class C Violation for each treeillegally removed, and for each day the offense continues without mitigation and application tothe Planning Board or Board of Adjustment, as the case may be.

REPORTS FROM COMMITTEE LIAISONS:

Mayor Tricarico

Mayor Tricarico referred to a newspaper article he recently read about the difficulty residentsare having paying local property tax. He explained that the municipal government was doingwhat it could to hold taxes stable; however, that was only about 13% of the tax bill. MayorTricarico encouraged other entities to do all they could to keep the tax burden down becausethere were many people that were having difficulty meeting the increased tax demands.

Mayor Tricarico noted the close Presidential election, and stated that the system will eventuallywork itself out. Also, he and Committeewoman Martin attended a picnic put on by theHillsborough Raiders football team, and they both had a good time.

Mayor Tricarico stated that on December 1st he has a meeting set up with the AssistantCommissioner of the DOT regarding Hillsborough’s Route 206 improvements. He stressedthat he wanted to meet with Commissioner Weinstein directly and would reschedule thismeeting.

Deputy Mayor Jensen suggested that the Mayor discuss several issues besides those of the by-pass and Route 206 widening, such as signal timing and lead-left signals.

Deputy Mayor Jensen added to Mayor Tricarico’s comments on taxes by saying that theresidents needed to understand that the municipal portion of Hillsborough’s property taxes was

only one small part of the whole. She encouraged residents to get out and vote regularly sothat they can participate in the Township's development.

Deputy Mayor Jensen noted that this is the time of year when the new appointees for Boardsand Commissions would be considered. She encouraged members of the public to submit theirresumes and letters of interest to the Township Committee.

Committeeman Mack

Committeeman Mack advised that on November 13th the Cable Advisory Committee met withrepresentatives from Cablevision and some outstanding issues were resolved. It is expectedthat an agreement would be ready to come before the Township Committee early next year.

Committeewoman Martin

Committeewoman Martin announced that the ribbon-cutting ceremony for the Post Officewould now be held on Friday, December 1st at 10:00 AM.

Committeewoman Martin also noted that the Deer Population Control meeting date has beenchanged to November 30th at 7:00 PM at the Freeholder’s Meeting Room in Somerville.

Committeewoman Martin reported that the Thanksgiving Holiday Meal program has beenunderway and 68 families in Hillsborough have been served meals under this program.

Mayor Tricarico added that every year donated food is collected in excess of Hillsborough'sneed and this year they were able to provide 100 turkeys to New Brunswick.

Committeewoman Martin stated that the new Senior Citizens bus is scheduled for delivery onDecember 15th.

Committeewoman Martin reported that at the recent New Jersey League of Municipalitiesconvention, she and Township Engineer Frank Scarantino participated in a workshop with theState Park and Recreation Association where they made a presentation on Hillsborough’s SkatePark.

Committeewoman Martin announced that on December 7th there would be a day ofremembrance at the Garden of Honor at the Municipal Building to remember Hillsborough’sveterans and the anniversary of the bombing of Pearl Harbor.

Committeewoman Martin noted that on January 9, 2001 there would be a public hearing heldon the New Jersey State Development and Redevelopment Plan in the Freeholder’s MeetingRoom in Somerville.

WHEREAS, the Hillsborough Township Police Department wishes to apply forfunding a project under the Safe and Secure Communities Program (Grant #P-2159) and

WHEREAS, the Hillsborough Township Committee has reviewed the accompanyingapplication and has approved said request; and

WHEREAS, the project is a joint effort between the Department of Law and PublicSafety and the Hillsborough Township Police Department for the purpose described in theapplication.

WHEREAS, the Township of Hillsborough has previously agreed to join the CENTRALJERSEY Joint Insurance Fund subject only to the right to approve its assessments followingprocessing and approval of its application; and

WHEREAS, the Fund has certified an annual 2000 assessment in the amount of$305,885.79 (net of risk management consultant fee) for the coverages included in its JIFmembership.

AN ORDINANCE AUTHORIZING THE ACQUISITION OFBLOCK 150, LOT 4, APPROXIMATELY 57.1720 ACRES ON THE

HILLSBOROUGH TOWNSHIP TAX MAP

WHEREAS, the Township Committee of the Township of Hillsborough wishes toaccept the donation of Block 150, Lot 4 as shown on the Municipal Tax Map consisting ofapproximately 57.1720 acres by Triangle Associates, L.P.; and

WHEREAS, the legislature of the State of New Jersey has declared that thedevelopment of agriculture and the retention of farmlands are important to the present andfuture economy of the State and the welfare of the citizens of the State; and

WHEREAS, the development rights have been retired through the State of New JerseyAgriculture Retention and Development Program; and

WHEREAS, the Township Committee believes that the retention and preservation ofagricultural lands is beneficial to the public health, safety and welfare of the citizens ofHillsborough Township; and

WHEREAS, Chapter 32 of the Township Municipal Code allows for the acquisition ofsuch property as does N.J.S.A. 40A:12-3, 4 & 5 of the Local Land Buildings Laws; and

NOW THEREFORE BE IT ORDAINED by the Township Committee of theTownship of Hillsborough, County of Somerset and State of New Jersey authorizes itsappropriate municipal officials to execute all documents necessary transferring ownership ofnon-developable property, Block 150, Lot 4 as shown on the Hillsborough Township Tax Mapfrom Triangle Associates, L.P. to Hillsborough Township.

BUSINESS FROM THE FLOOR FOR NEW MATTERS:

Walter Rodgers, Taylor Avenue, commented that he has seen Manville Borough Public Workstrucks removing leaves in his neighborhood.

Mayor Tricarico replied that Hillsborough and Manville have entered into a shared servicesarrangement. He stated that Hillsborough often loans Manville help in the form of equipmentand other services, and this is one way Manville can return the favor. He explained thatManville personnel collect leaves in some parts of Hillsborough and Manville, and the leavesare disposed of with the rest of Hillsborough’s leaves.

Mr. Rodgers observed that Manville’s by-hand method of leaf removal appears to be moreeffective for that neighborhood than using the truck mounted leaf loaders Hillsborough uses.

Mayor Tricarico explained that Hillsborough is too large to pick up leaves by hand, whereManville is much smaller.
