    PEDAVEEDU, MATTAMPALLY VILLAGES, MATTAMPALLY MANDAL,

    SURYAPET DISTRICT, TELANGANA STATE.

    SAGAR CEMENTS LIMITED (SCL) is a leading cement manufacturing

    company in the states of Andhra Pradesh and Telangana.

    Sagar Cements Ltd (SCL), is operating a Cement Plant with Clinker

    production capacity of 2.0 Million Tonnes Per Annum (MTPA), Cement

    production capacity of 2.35 MTPA and 7 MW Waste Heat Recovery Based

    Captive Power Plant (WHRB CPP) at Mattampally Village & Mandal,

    Suryapet District, Telangana State.

    The limestone requirement of the Cement Plant is is being met from Captive

    Mine of the company i.e., Sagar Cements Limestone Mines (Amalgamated

    Area: 326.63 Ha). The cement plant exists within the mine lease area.

    PRESENT PROPOSAL

    Sagar Cements Ltd (SCL) has obtained EC vide Lr. J11015/53/2003-1A

    /II(M) dated 09-12-2004 for its captive Limestone mine i.e., Sagar cement

    Limestone Mine - 1 [ML area 196.35 Ha & 0.8 million TPA production]

    located at Pedaveedu Village, Mattampally Mandal, Suryapet District,

    Telangana State., under the provisions of EIA notification, 1994.

    Further, SCL has also obtained EC vide Lr. J-11015/375/2006-IA-II (M)

    dated 18.07.2007 for its captive Limestone mines i.e., Sagar cement

    Limestone Mine - 2 [ML area 130.28 Ha & 2.5 million TPA production]

    located at Mattampally village, Mattampally Mandal, Suryapet District

    (earlier Nalgonda), Telangana State, under the provisions of EIA notification,

    2006.

    The State Government accorded order for amalgamation vide G.O. Ms. No.

    73 dated 13th March 2008 for these two mining leases, which expires on

    17.08.2024. Now both leases are being operated in single mode for overall

    production capacity of 3.3 million TPA (0.8 MTPA + 2.5 MTPA). Further,

    Approval of Modified mining plan for amalgamated mining area i.e 326.63

  • ha and limestone production 3.3 million TPA was obtained from IBM dated

    21.03.2018. Consent is also obtained from Telangana State Pollution

    Control Board for overall amalgamated area of 326.63 ha and production

    capacity of 3.3 million TPA.

    Present proposal pertains to obtaining Environmental Clearance (EC) for

    “Sagar cement Limestone Mine”, Captive Limestone Mine of SCL spread

    over an area of 326.63 Ha at Pedaveedu, Mattampally Villages, Mattampally

    Mandal, Suryapet District, Telangana State (earlier Nalgonda), Telangana

    State with 3.3 MTPA limestone production as per MoEFCC Notification, S.

    O. 1530(E) dated 6th April 2018 (Annexure - I).

    As per the Notification, Mining projects, which were granted Environmental

    Clearance under the EIA Notification, 1994, and but not obtained

    environmental clearance for expansion / modernisation / amendment under

    the EIA Notification, 2006 are required to obtain Environmental Clearance

    in order to bring under the regulatory framework of the EIA Notification,

    2006.

    In this context SCL proposes to obtain Environmental Clearance for Sagar

    cement Limestone Mine spread over an area of 326.63 Ha with the present

    production of 3.3 MTPA limestone production under the EIA Notification,

    2006 and amendments there off.

    The proposed project falls under Category ‘A’ project as per MoEFFCC

    Notification, S.O. 3977(E) dated 14th August 2018 (Annexure - II).

    Presently the Mine is in operation with all valid clearances. The history of

    the Mining lease giving details of the clearances obtained time to time with

    respect to Mining lease and consents are given below.

    Survey No.:202, 203, 269/P, 270, 271, 273 to 295, 296/P, 297, 305/P,

    306/P, 307/P (ML-2) Mattampally Village of Mattampally Mandal, Suryapet

    District, Telangana State into a single lease Co- terminus with the first lease

    MMDR, 2015, extension of mining lease period is upto 17- 08- 2034.

    Mining Plan for amalgamated lease for 326.58 Ha is approved by IBM vide

    The Sagar Cements Limestone Mine - I was accorded EC under EIA

    Notification 1994 for 196.35 ha / 0.8 MTPA in the name of “Sagar Cements

    Limited” Vide Lr. No. J-11015/53/2003-IA-II (M) dated 09.12.2004 for 0.8

    MTPA (Enclosed as Annexure – IV).

    The Sagar Cements Limestone Mine - II was accorded EC under EIA

    Notification 2006 for 130.28 ha / 2.5 MTPA in the name of “Sagar Cements

    Limited” Vide Lr. No. J-11015/375/2006-IA-II (M) dated 18.07.2007 for 2.5

    MTPA (Enclosed as Annexure – V).

    REQUEST

    The operating ML-1 and ML-2 are having valid Environmental clearance and

    are Amalagamated. The mining plan was approved by IBM for Amalgamated

    lease area. Valid consent to operate (for Amalgamated lease area) is existing.

    Since all the clearances are existing, SCL requests MoEFCC for issual of

    Environmental Clearance as per EIA Notification, 2006 for Amalgamated lease

    of 326.63 Ha for 3.3 MTPA Limestone production.

    NOTIFICATION

    New Delhi, the 6th April, 2018

    S. O. 1530(E).—Whereas, the Hon’ble Supreme Court, vide judgment dated the 2nd

    August, 2017 in Writ

    Petition (Civil) No. 114 of 2014 in the matter of Common Cause versus Union of India and Ors., inter-alia, has directed

    that the validity of the environmental clearance granted for mining projects under the notification number S.O. 60(E),

    dated the 27th

    January, 1994 (hereinafter referred to as the EIA Notification, 1994) of the Government of India in the

    erstwhile Ministry of Environment and Forests shall be five years, and for considering expansion under the EIA

    Notification, 1994, the annual production of 1993-94 or immediately preceding year shall be the base year;

    And whereas, the Hon’ble Supreme Court vide judgment dated the 7th

    February, 2018 in Special Leave to

    Appeal (Civil) No. 32138 of 2015 in the matter of Goa Foundation versus M/s Sesa Sterlite Ltd., & Ors. has reiterated

    that the validity of the environmental clearance for mining projects granted under the EIA Notification, 1994 shall be five

    years;

    And whereas, the Hon’ble Supreme Court in its aforesaid judgment dated the 7th

    February, 2018 has held that

    para 9 of the notification number S.O. 1533 (E), dated the 14th

    September, 2006 of the Government of India in the

    erstwhile Ministry of Environment and Forests (hereinafter referred to as the EIA Notification, 2006), provides that the

    environmental clearance would be valid for the estimated project life subject to a maximum of 30 years;

    And whereas, in the view of the above, there would be two categories of cases related to mining projects under

    EIA Notification, 1994, namely: -

    (a) mining projects, which were granted environmental clearance under the EIA Notification, 1994, and also

    granted environmental clearance for expansion / modernisation / amendment under the EIA Notification, 2006;

    and

    (b) mining projects, which were granted environmental clearance under the EIA Notification, 1994, and but not

    obtained environmental clearance for expansion / modernisation / amendment under the EIA Notification, 2006.

    And whereas, as per third paragraph above, the projects mentioned in clause (a) of fourth paragraph above do

    not suffer from the infirmity of validity of environmental clearance being five years;

    And whereas, the projects mentioned in clause (a) of fourth paragraph above, do not suffer from the infirmity of

    expansion vis-à-vis the base production as these projects were already appraised and granted environmental clearance

    under the EIA Notification, 2006;

    And whereas, all mining projects mentioned in clause (b) of fourth paragraph above are required to obtain

    environmental clearance under the EIA Notification, 2006, in pursuance of the aforesaid judgments of the Hon’ble

    Supreme Court;

    And whereas, the Ministry of Environment, Forest and Climate Change deems it necessary for implementation

    of the aforesaid judgments of the Hon’ble Supreme Court as well as for the protecting and improving the quality of

    environment and abating the environmental pollution, that all projects mentioned in clause (b) of fourth paragraph above,

    be brought under the regulatory framework of the EIA Notification, 2006;

    Now, therefore, in exercise of the powers conferred by sub-section (1) and clause (v) of sub-section (2) of

    section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (4) of rule 5 of the Environment

    (Protection) Rules, 1986, the Central Government hereby directs, after having dispensed with the requirement of notice

    under clause (a) of sub-rule (3) of the rule 5 of the said rules in public interest, for implementation of the aforesaid

    judgments of the Hon’ble Supreme Court, that the project proponent in all such cases involving validity of the

    environmental clearance and expansion of mining projects vis-à-vis the base production, shall make application within

    six months from the date of issue of this notification in Form-1 as given in Appendix-II of the EIA Notification, 2006, for

    grant of environmental clearance under the provisions of the EIA Notification, 2006, and all such applications shall be

    considered by the concerned Expert Appraisal Committee or the State Level Expert Appraisal Committee, as the case

    may be, who shall decide on the due diligence necessary including preparation of Environmental Impact Assessment

    Report and public consultation and the application shall be appraised accordingly for grant of environmental clearance.

    Environment (Protection) Rules, 1986, the Central Government directed that on and from the date of its publication, the

    required construction of new projects or activities or the expansion or modernisation of existing projects or activities

    listed in the Schedule to the said notification entailing capacity addition with change in process or technology or product

    mix shall be undertaken in any part of India only after prior environmental clearance from the Central Government or as

    the case may be, by the State Level Environment Impact Assessment Authority, duly constituted by the Central

    Government under sub-section (3) of section 3 of the said Act, in accordance with the procedure specified therein;

    And whereas, the said Ministry has received requests, for delegation of more powers to State Environment

    Impact Assessment Authority (SEIAA) and District Environment Impact Assessment Authority (DEIAA) with respect to

    grant of Environment Clearances;

    And whereas clause (a) of sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986 provides that,

    whenever the Central Government considers that prohibition or restrictions of any industry or carrying on any processes

    or operation in any area should be imposed, it shall give notice of its intention to do so;

    And whereas, a draft notification for making amendments in the Environment Impact Assessment Notification,

    2006 in exercise of the powers conferred under sub-section (1) and clause (v) of sub-section (2) of section 3 of the

    Environment (Protection) Act, 1986 read with clause (d) of sub-rule (3) of rule 5 of the Environment (Protection) Rules,

    1986 was published, vide number S.O.3933 (E) dated the 18th December 2017, inviting objections and suggestions from

    all the persons likely to be affected thereby, within a period of sixty days from the date of publication of said notification

    in the Gazette of India;

    And whereas, copies of the said notification were made available to the public on 18th December 2017;

    And whereas, all objections and suggestions received in response to the above mentioned draft notification have

    been duly considered by the Central Government;

    Now, therefore, in exercise of powers conferred by sub-section (1) and clause (v) of sub-section (2) of section 3

    of the Environment (Protection) Act, 1986 (29 of 1986), read with clause (d) of sub-rule (3) of rule 5 of the Environment

    (Protection) Rules, 1986, the Central Government hereby makes the following further amendments in the Environment

    Impact Assessment Notification, 2006 namely:-

    In the said Notification, in the SCHEDULE, for item 1(a), 1(c), and the Schematic Presentation of Requirements

    on Environmental Clearance of Minor Minerals including cluster situation in Appendix-XI and entries relating thereto,

    the following item and entries shall be substituted, namely:

    (iii) River bed mining projects on account

    of inter-state boundary.

    (1) Mineral prospecting is exempted;

    (2) The prescribed procedure for

    environmental clearance for mining of

    minor minerals including cluster situation

    is given in Appendix XI;

    irrigation to Drip irrigation etc.) by an

    existing project, leading to increase in

    Culturable Command Area but without

    increase in dam height and submergence,

    will not require amendment/ revision of

    EC.
