Trustee Sanctions

2300.11 Sanctions

Al ^S!.f?r..sc!n?tk?rlsJ-An^ Tru^te^?.f the L9S An9eies Community CollegeDistrict may be sanctioned on the folbwing bases:1. Vioiation of District rules and regulations, including but not !Emited to

the Statement of Ethics and the Standards of Conduct on Campusarticulated in Chapter 9 of the Board Rules;

2. Vioiation of state or federal law;

3. Conduct Sikely to create Jiability for the District; or,

4. Any other conduct incompatible or inconsistent with the position ofTrustee.

B. Forms of Sanction - Sanctions of a Trustee may be imposed in thefollowing forms:

5. Reprimand;

6. Censure;

7. Requirement for the repayment of District funds;

8. Bar from reimbursement for expenses with District funds;

9. Removal from an officer position; or,

10. Withholding of pay.

B. Votes required;

1. Five affirmative votes shall be required for the imposition of a sanction on a Trustee; I.

2. Notwithstanding any annual confirmation regarding the authority of the StudentTrustee, the Student Trustee is not eligible to move, second or vote upon themposition of a sanction on a Trustee. 'However the Student Trustee maintains theright to participate in the discussion of a potential sanction;

c. Procedure:

1. Presentation of Initiating Motion

a. Prior to the consideration of a motion for the imposition of a sanction on aTrustee, a motion must be presented and adopted that articulates the charges

2302. GROWTH, The Board of Trustees is responsible for growth in both academic and physicalareas.

2302.10 Pians for Growth and Deveiopment. The Board shaii estabiish policies for andapprove current and long-range educational plans and programs and promoteorderly growth and development of the community colleges within the'DJstrict.

2304. COLLEGE.CALENDAR. The Board of Trustees shall determine which holidays it wiobserve and on what days It will observe them within the framework of providing thenecessary number of days of instruction to qualify for state apportionments.

Terminate for convenience the contract of Policy Masters, Inc., effective April30, 2013, and authorize the issuance of a Request for Proposals for theposition of the Office of the inspector Genera!.

Background: The ongoing re-com petition of the Building Program Manager(PM) contract presents an opportunity to reevaluate a variety of BuildingProgram-related functions. Among them is the Office of the Inspector General(0!G), which was authorized by the Board of Trustees in March 2010. Since itsinception, the office has been filled by Policy Masters, inc., which received acontract to perform the duties of the office starting in October 2010. Sincethen, the Building Program has seen substantial change, and one of theprimary changes of policy to be effectuated by the new PM contract is acentraiization of management and authority. That contract is currently undernegotiation, and it is expected to include the addition of a quality assurancefunction. After review, it has been determined that the current structure of theOIG contract should be reevaiuated and recast in light of the new scope of thePM contract, without artificially constraining that assessment with incumbentcontractua! commitments. Thus, the staff recommends that the Boardterminate the current OIG contract and authorize the development andissuance of a new RFP for the OIG. Staff recommends that the currentcontract with Policy Masters be terminated for convenience, effective April 30,2013.

While it is the intention of staff to complete the RFP process and have acontractor in place by April 30, 2013, delays beyond that date are possible. Insuch a case, staff proposes to make arrangements with current staff or aProgram contractor to administer the Whistleblower Hotline and other timesensitive functions until such time as the contractor is in place to execute thenew OIG functions.

The Board is furnished a copy of the Commission's proposod.budget and ie invited to Qpublic hearing by the Commission during the month of May. 11206. SUSPENSION AND DISMISSAL OF A CLASSIFIED EMPLOYEE. The Board ofTrustees may suspend for a period of not more than 30 days, demote, or dismiss aclassified empioyee for reasonabie cause. 11207, POWERS OF PERSONNEL COMMISSION iN CONDUCTING HEARINGS ANDJNSPECTtNG RECORDS OF BOARD OF TRUSTEES. Background:Administrative Regu!ation C-12, Chancellor Review of Board Rules, Administrative Regdations andProcedurai Guides, has recently been revised and reieased by the Office of Genera! Counsel. Theregulations require a triennia! review of such rules, regulations, and guides to inciude policyconsiderations, titles, operational changes, and legal and regulatory changes. These amendments arebeing done to bring Chapter Xl into compliance with this requirement.Chapter X! of the Board Ruies addresses Personnei Commission operations. The sections included inthis chapter address basic functionai areas where the roies and authorities of the PersonneCommission and Board of Trustees converge. The proposed changes are in iarge part necessitated bychanges in the Education Code or legai decisions that have occurred over the years. The otherchanges are intended to bring greater ciarity by correcting language and construction.

The proposed amendments have been widely shared for review and comment with Districtadministration.
