BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:5

Sec. 1. RCW 35.61.150 and 2019 c 198 s 1 are each amended to6read as follows:7

(1) Metropolitan park commissioners selected by election8according to RCW 35.61.050(2) shall perform their duties and may9provide, by resolution passed by the commissioners, for the payment10of compensation to each of its commissioners at a rate up to the11daily compensation maximum amount provided in subsection (3) of this12section for each day or portion of a day spent in actual attendance13at official meetings or in performance of other official services or14duties on behalf of the district. However, the compensation for each15commissioner must not exceed the annual compensation maximum amount16provided in subsection (3) of this section per year.17

(2) Any commissioner may waive all or any portion of his or her18compensation payable under this section as to any month or months19during his or her term of office, by a written waiver filed with the20clerk of the board. The waiver, to be effective, must be filed any21

time after the commissioner's election and prior to the date on which1the compensation would otherwise be paid. The waiver shall specify2the month or period of months for which it is made.3

(3)(a) For purposes of the references in subsection (1) of this4section, the daily compensation maximum amount is one hundred twenty-5eight dollars and the annual compensation maximum amount is twelve6thousand two hundred eighty-eight dollars. However, for any7metropolitan park district with facilities including an aquarium, a8wildlife park, and a zoo, accredited by a nationally recognized9accrediting agency, the annual compensation maximum amount is twenty-10four thousand five hundred seventy-six dollars.11

(b) The dollar thresholds established in this subsection (3) must12be adjusted for inflation by the office of financial management every13five years, beginning ((July 1, 2023)) January 1, 2024, based upon14changes in the consumer price index during that time period.15"Consumer price index" means, for any calendar year, that year's16annual average consumer price index, for Washington state, for wage17earners and clerical workers, all items, compiled by the bureau of18labor and statistics, United States department of labor. If the19bureau of labor and statistics develops more than one consumer price20index for areas within the state, the index covering the greatest21number of people, covering areas exclusively within the boundaries of22the state, and including all items shall be used for the adjustments23for inflation in this section. The office of financial management24must calculate the new dollar threshold and transmit it to the office25of the code reviser for publication in the Washington State Register26at least one month before the new dollar threshold is to take effect.27

(4) A person holding office as commissioner for two or more28special purpose districts shall receive only that per diem29compensation authorized for one of his or her commissioner positions30as compensation for attending an official meeting or conducting31official services or duties while representing more than one of his32or her districts. However, such commissioner may receive additional33per diem compensation if approved by resolution of all boards of the34affected commissions.35

Sec. 2. RCW 36.57A.050 and 2018 c 154 s 1 are each amended to36read as follows:37

Within sixty days of the establishment of the boundaries of the38public transportation benefit area the members of the county39

legislative authority and the elected representative of each city1within the area shall provide for the selection of the governing body2of such area, the public transportation benefit area authority, which3shall consist of elected officials selected by and serving at the4pleasure of the governing bodies of component cities within the area5and the county legislative authority of each county within the area.6The members of the governing body of the public transportation7benefit area, if the population of the county in which the public8transportation benefit area is located is more than four hundred9thousand and the county does not also contain a city with a10population of seventy-five thousand or more operating a transit11system pursuant to chapter 35.95 RCW, must be selected to assure12proportional representation, based on population, of each of the13component cities located within the public transportation benefit14area and the unincorporated areas of the county located within the15public transportation benefit area, to the extent possible within the16restrictions placed on the size of the governing body of a public17transportation benefit area. If necessary to assure such proportional18representation, multiple cities may be represented by a single19elected official from one of the cities. A majority of the governing20board may not be selected to represent a single component city. If at21the time a public transportation benefit area authority assumes the22public transportation functions previously provided under the23interlocal cooperation act (chapter 39.34 RCW) there are citizen24positions on the governing board of the transit system, those25positions may be retained as positions on the governing board of the26public transportation benefit area authority.27

Within such sixty-day period, any city may by resolution of its28legislative body withdraw from participation in the public29transportation benefit area. The county legislative authority and30each city remaining in the public transportation benefit area may31disapprove and prevent the establishment of any governing body of a32public transportation benefit area if the composition thereof does33not meet its approval.34

In no case shall the governing body of a single county public35transportation benefit area be greater than nine voting members and36in the case of a multicounty area, fifteen voting members. Those37cities within the public transportation benefit area and excluded38from direct membership on the authority are hereby authorized to39designate a member of the authority who shall be entitled to40

represent the interests of such city which is excluded from direct1membership on the authority. The legislative body of such city shall2notify the authority as to the determination of its authorized3representative on the authority.4

There is one nonvoting member of the public transportation5benefit area authority. The nonvoting member is recommended by the6labor organization representing the public transportation employees7within the local public transportation system. If the public8transportation employees are represented by more than one labor9organization, all such labor organizations shall select the nonvoting10member by majority vote. The nonvoting member shall comply with all11governing bylaws and policies of the authority. The chair or cochairs12of the authority shall exclude the nonvoting member from attending13any executive session held for the purpose of discussing negotiations14with labor organizations. The chair or cochairs may exclude the15nonvoting member from attending any other executive session. The16requirement that a nonvoting member be appointed to the governing17body of a public transportation benefit area authority does not apply18to an authority that has no employees represented by a labor union.19

Each member of the authority is eligible to be reimbursed for20travel expenses in accordance with RCW 43.03.050 and 43.03.060 and to21receive compensation, as set by the authority, in an amount not to22exceed forty-four dollars for each day during which the member23attends official meetings of the authority or performs prescribed24duties approved by the chair of the authority. Except that the25authority may, by resolution, increase the payment of per diem26compensation to each member from forty-four dollars up to ninety27dollars per day or portion of a day for actual attendance at board28meetings or for performance of other official services or duties on29behalf of the authority. In no event may a member be compensated in30any year for more than seventy-five days, except the chair who may be31paid compensation for not more than one hundred days: PROVIDED, That32compensation shall not be paid to an elected official or employee of33federal, state, or local government who is receiving regular full-34time compensation from such government for attending meetings and35performing prescribed duties of the authority.36

Sec. 3. RCW 53.12.260 and 2011 c 152 s 1 are each amended to21read as follows:22

(1) Each commissioner of a port district shall receive ninety23dollars, as adjusted for inflation by the office of financial24management in subsection (4) of this section, per day or portion25thereof spent (a) in actual attendance at official meetings of the26port district commission, or (b) in performance of other official27services or duties on behalf of the district. The total per diem28compensation of a port commissioner shall not exceed eight thousand29six hundred forty dollars in a year, as adjusted for inflation by the30office of financial management in subsection (4) of this section, or31ten thousand eight hundred dollars in any year, as adjusted for32inflation by the office of financial management in subsection (4) of33this section, for a port district with gross operating income of34twenty-five million or more in the preceding calendar year.35

(2) Port commissioners shall receive additional compensation as36follows: (a) Each commissioner of a port district with gross37operating revenues of twenty-five million dollars or more in the38preceding calendar year shall receive a salary of five hundred39

dollars per month, as adjusted for inflation by the office of1financial management in subsection (4) of this section; and (b) each2commissioner of a port district with gross operating revenues of from3one million dollars to less than twenty-five million dollars in the4preceding calendar year shall receive a salary of two hundred dollars5per month, as adjusted for inflation by the office of financial6management in subsection (4) of this section.7

(3) In lieu of the compensation specified in this section, a port8commission may set compensation to be paid to commissioners.9

(4) For any commissioner who has not elected to become a member10of public employees retirement system before May 1, 1975, the11compensation provided pursuant to this section shall not be12considered salary for purposes of the provisions of any retirement13system created pursuant to the general laws of this state nor shall14attendance at such meetings or other service on behalf of the15district constitute service as defined in RCW 41.40.010(37):16PROVIDED, That in the case of a port district when commissioners are17receiving compensation and contributing to the public employees18retirement system, these benefits shall continue in full force and19effect notwithstanding the provisions of ((RCW 53.12.260)) this20section and RCW 53.12.265.21

The dollar thresholds for salaries and per diem compensation22established in this section must be adjusted for inflation by the23office of financial management every five years, beginning ((July 1,242008)) January 1, 2024, based upon changes in the consumer price25index during that time period. "Consumer price index" means, for any26calendar year, that year's annual average consumer price index, for27Washington state, for wage earners and clerical workers, all items,28compiled by the bureau of labor and statistics, United States29department of labor. If the bureau of labor and statistics develops30more than one consumer price index for areas within the state, the31index covering the greatest number of people, covering areas32exclusively within the boundaries of the state, and including all33items shall be used for the adjustments for inflation in this34section. authorized for one of his or her commissioner positions as1compensation for attending an official meeting or conducting official2services or duties while representing more than one of his or her3districts. However, such commissioner may receive additional per diem4compensation if approved by resolution of all boards of the affected5commissions.6

Sec. 4. RCW 54.12.080 and 2010 c 58 s 1 are each amended to read7as follows:8

(1) Commissioners of public utility districts shall receive9salaries as follows:10

(a) Each public utility district commissioner of a district11operating utility properties shall receive a salary of one thousand12eight hundred dollars per month, as adjusted for inflation by the13office of financial management in subsection (6) of this section,14during a calendar year if the district received total gross revenue15of over fifteen million dollars during the fiscal year ending June1630th before the calendar year.17

(b) Each public utility district commissioner of a district18operating utility properties shall receive a salary of one thousand19three hundred dollars per month, as adjusted for inflation by the20office of financial management in subsection (6) of this section,21during a calendar year if the district received total gross revenue22of from two million dollars to fifteen million dollars during the23fiscal year ending June 30th before the calendar year.24

(c) Commissioners of other districts shall receive a salary of25six hundred dollars per month, as adjusted for inflation by the26office of financial management in subsection (6) of this section, for27each commissioner.28

(2) In addition to salary, all districts shall provide for the29payment of per diem compensation to each commissioner at a rate of30ninety dollars, as adjusted for inflation by the office of financial31management in subsection (6) of this section, for each day or portion32thereof spent in actual attendance at official meetings of the33district commission or in performance of other official services or34duties on behalf of the district, to include meetings of the35commission of his or her district or meetings attended by one or more36commissioners of two or more districts called to consider business37common to them, but such compensation paid during any one year to a38commissioner shall not exceed twelve thousand six hundred dollars, as39

adjusted for inflation by the office of financial management in1subsection (6) of this section. Per diem compensation shall not be2paid for services of a ministerial or professional nature.3

(3) Any commissioner may waive all or any portion of his or her4compensation payable under this section as to any month or months5during his or her term of office, by a written waiver filed with the6district as provided in this section. The waiver, to be effective,7must be filed any time after the commissioner's election and prior to8the date on which the compensation would otherwise be paid. The9waiver shall specify the month or period of months for which it is10made.11

(4) Each district commissioner shall be reimbursed for reasonable12expenses actually incurred in connection with such business and13meetings, including his or her subsistence and lodging and travel14while away from his or her place of residence.15

(5) Any district providing group insurance for its employees,16covering them, their immediate family, and dependents, may provide17insurance for its commissioner with the same coverage.18

(6) The dollar thresholds for salaries and per diem compensation19established in this section must be adjusted for inflation by the20office of financial management every five years, beginning ((July 1,212008)) January 1, 2024, based upon changes in the consumer price22index during that time period. "Consumer price index" means, for any23calendar year, that year's annual average consumer price index, for24Washington state, for wage earners and clerical workers, all items,25compiled by the bureau of labor and statistics, United States26department of labor. If the bureau of labor and statistics develops27more than one consumer price index for areas within the state, the28index covering the greatest number of people, covering areas29exclusively within the boundaries of the state, and including all30items shall be used for the adjustments for inflation in this31section. or her districts. However, such commissioner may receive additional1per diem compensation if approved by resolution of all boards of the2affected commissions.3

Sec. 5. RCW 57.12.010 and 2008 c 31 s 1 are each amended to read4as follows:5

The governing body of a district shall be a board of6commissioners consisting of three members, or five or seven members7as provided in RCW 57.12.015. The board shall annually elect one of8its members as president and another as secretary.9

The board shall by resolution adopt rules governing the10transaction of its business and shall adopt an official seal. All11proceedings shall be by resolution recorded in a book kept for that12purpose which shall be a public record.13

Each commissioner shall receive ninety dollars for each day or14portion thereof spent in actual attendance at official meetings of15the district commission, or in performance of other official services16or duties on behalf of the district. However, the compensation for17each commissioner shall not exceed eight thousand six hundred forty18dollars per year. In addition, the secretary may be paid a reasonable19sum for clerical services.20

Any commissioner may waive all or any portion of his or her21compensation payable under this section as to any month or months22during the commissioner's term of office, by a written waiver filed23with the district at any time after the commissioner's election and24prior to the date on which the compensation would otherwise be paid.25The waiver shall specify the month or period of months for which it26is made.27

No commissioner shall be employed full time by the district. A28commissioner shall be reimbursed for reasonable expenses actually29incurred in connection with district business, including subsistence30and lodging while away from the commissioner's place of residence and31mileage for use of a privately owned vehicle at the mileage rate32authorized in RCW 43.03.060.33

Sec. 6. RCW 68.52.220 and 2013 c 167 s 9 are each amended to19read as follows:20

(1) The affairs of the cemetery district must be managed by a21board of cemetery district commissioners composed of three members.22The board may provide, by resolution passed by the commissioners, for23the payment of compensation to each of its commissioners at a rate of24up to ninety dollars for each day or portion of a day spent in actual25attendance at official meetings of the district commission, or in26performance of other official services or duties on behalf of the27district. However, the compensation for each commissioner must not28exceed eight thousand six hundred forty dollars per year.29

(2) Any commissioner may waive all or any portion of his or her30compensation payable under this section as to any month or months31during his or her term of office, by a written waiver filed with the32clerk of the board. The waiver, to be effective, must be filed any33time after the commissioner's election and prior to the date on which34the compensation would otherwise be paid. The waiver must specify the35month or period of months for which it is made. The board must fix36the compensation to be paid the secretary and other employees of the37district. Cemetery district commissioners and candidates for cemetery38

district commissioner are exempt from the requirements of chapter142.17A RCW.2

(3) The initial cemetery district commissioners must assume3office immediately upon their election and qualification. Staggering4of terms of office must be accomplished as follows: (a) The person5elected receiving the greatest number of votes is elected to a six-6year term of office if the election is held in an odd-numbered year7or a five-year term of office if the election is held in an even-8numbered year; (b) the person who is elected receiving the next9greatest number of votes is elected to a four-year term of office if10the election is held in an odd-numbered year or a three-year term of11office if the election is held in an even-numbered year; and (c) the12other person who is elected is elected to a two-year term of office13if the election is held in an odd-numbered year or a one-year term of14office if the election is held in an even-numbered year. The initial15commissioners must assume office immediately after they are elected16and qualified but their terms of office must be calculated from the17first day of January after the election.18

(4) Thereafter, commissioners are elected to six-year terms of19office. Commissioners must serve until their successors are elected20and qualified and assume office as provided in RCW ((29A.20.040))2129A.60.280.22

(5) The dollar thresholds established in this section must be23adjusted for inflation by the office of financial management every24five years, beginning ((July 1, 2008)) January 1, 2024, based upon25changes in the consumer price index during that time period.26"Consumer price index" means, for any calendar year, that year's27annual average consumer price index, for Washington state, for wage28earners and clerical workers, all items, compiled by the bureau of29labor and statistics, United States department of labor. Sec. 7. RCW 70.44.050 and 2008 c 31 s 2 are each amended to read7as follows:8

Each commissioner shall receive ninety dollars for each day or9portion thereof spent in actual attendance at official meetings of10the district commission, or in performance of other official services11or duties on behalf of the district, to include meetings of the12commission of his or her own district, or meetings attended by one or13more commissioners of two or more districts called to consider14business common to them, except that the total compensation paid to15such commissioner during any one year shall not exceed eight thousand16six hundred forty dollars. The commissioners may not be compensated17for services performed of a ministerial or professional nature.18

Any commissioner may waive all or any portion of his or her19compensation payable under this section as to any month or months20during his or her term of office, by a written waiver filed with the21district as provided in this section. Any district providing group insurance for its employees,27covering them, their immediate family, and dependents, may provide28insurance for its commissioners with the same coverage. Each29commissioner shall be reimbursed for reasonable expenses actually30incurred in connection with such business and meetings, including his31or her subsistence and lodging and travel while away from his or her32place of residence. No resolution shall be adopted without a majority33vote of the whole commission. The commission shall organize by34election of its own members of a president and secretary, shall by35resolution adopt rules governing the transaction of its business and36shall adopt an official seal. All proceedings of the commission shall37be by motion or resolution recorded in a book or books kept for such38purpose, which shall be public records.39

Sec. 8. RCW 85.05.410 and 2007 c 469 s 8 are each amended to25read as follows:26

Members of the board of diking commissioners of any diking27district in this state may receive as compensation the sum of up to28ninety dollars for actual attendance at official meetings of the29district and for each day or part thereof, or in performance of other30official services or duties on behalf of the district and shall31receive the same compensation as other labor of a like character for32all other necessary work or services performed in connection with33their duties: PROVIDED, That such compensation shall not exceed eight34thousand six hundred forty dollars in one calendar year, except when35the commissioners declare an emergency. Allowance of such36compensation shall be established and approved at regular meetings of37the board, and when a copy of the extracts of minutes of the board38meeting relative thereto showing such approval is certified by the39

Each24supervisor shall be entitled to reimbursement for reasonable expenses25actually incurred in connection with business, including subsistence26and lodging while away from the supervisor's place of residence and27mileage for use of a privately owned vehicle in accordance with28chapter 42.24 RCW. All costs of construction or maintenance done29under the direction of the board of supervisors shall be paid upon30vouchers or payrolls verified by two of the said supervisors. All31costs of construction and all other expenses, fees and charges on32account of such improvement shall be paid by warrants drawn by the33county auditor upon the county treasurer upon the proper fund, and34shall draw interest at a rate determined by the county legislative35authority until paid or called by the county treasurer as warrants of36the county are called.37

(1) In a zone with supervisors elected pursuant to RCW 86.15.050,19the supervisors may, as adjusted in accordance with subsection (4) of20this section, each receive up to one hundred fourteen dollars per day21or portion of a day spent in actual attendance at official meetings22of the governing body or in performance of other official services or23duties on behalf of the zone. The compensation for supervisors in24office on January 1, 2015, is fixed at one hundred fourteen dollars25per day. The board of county commissioners shall fix any such26compensation to be paid to the initial supervisors during their27initial terms of office. The supervisors shall fix the compensation28to be paid to the supervisors thereafter. Compensation for the29supervisors shall not exceed ten thousand nine hundred forty-four30dollars in one calendar year.31

(2) A supervisor is entitled to reimbursement for reasonable32expenses actually incurred in connection with performance of the33duties of a supervisor, including subsistence and lodging, while away34from the supervisor's place of residence, and mileage for use of a35privately owned vehicle in accordance with chapter 42.24 RCW.36

(3) Any supervisor may waive all or any portion of his or her37compensation payable under this section as to any month or months38during his or her term of office, by a written waiver filed with the39

The27total amount of such additional compensation received by a director28may not exceed eight thousand six hundred forty dollars in a calendar29year. The board shall fix the compensation of the secretary and all30other employees.31
