2 Prospective purchasers are assumed to have inspected the properties in which they are interested and to have made all usual pre-contract searches and enquiries.

3 The successful Bidder is bound under contract as soon as the Auctioneer’s gavel falls on his/her final bid. Immediately thereafter the purchaser will be handed a card to complete supplying details of his/her name and address and those of his/her solicitors.

4 IMPORTANT REVISED NOTICE TO BUYERS - PAYMENTS OF DEPOSITS. Deposits are payable on the fall of the hammer and buyers are either required to bring a Banker’s Draft/Building Society cheque for an amount representing a minimum of 10% of the purchase price, or alternatively a Personal Bank Debit Card (not CreditCard, Business Debit Card or Cash Card) can be used for payment. Bidders should notify their bank in advance that they may be making a higher than usual transaction on their card and we would recommend that bidders check whether or not their debit card has a payment limit prior to the auction. STIPULATIONS

1 ORDER OF SALE. The Auctioneers reserve the right to sell any of the following lots privately prior to the auction and to withdraw any lot or any part thereof without disclosing the reserve price and to alter the lotting or the boundaries.

2 PARTICULARS, PLANS AND SCHEDULES. The particulars and acreages stated therein together with the plans are believed but are not guaranteed to be correct. They are given by the auctioneers to assist viewers but are specifically excluded from any contract and prospective purchasers must satisfy themselves as to the information therein contained.

3 RIGHTS OF WAY AND EASEMENTS. All lots are sold subject to and with the benefit of all existing rights, including rights of way, water, light and other easements, rights of access as at present enjoyed and all wayleaves for poles, stays, cables, underground pipes and water pipes whether or not mentioned in the particulars or Special Conditions of Sale. CONDITIONS OF SALE - APPLICABLE TO ALL LOTS These General Conditions of Sale relate to all the properties or Lots offered for sale at this auction but must be read in conjunction with and subject to the Special Conditions of Sale (if any) itemised below for each individual property or Lot.

1 In these Conditions the following words shall have the following meanings:

1.1 “the property” is the property specified in the memorandum annexed hereto

1.2 “the Vendor’s solicitors” are the conveyancer for the Vendor of the property

2 The property is sold subject to the foregoing general remarks and particulars of sale and any revisions or alterations announced before or at the auction and to the Standard Conditions of Sale (4th Edition) as far as the same are not varied by or inconsistent with any of the following conditions which in the event of inconsistency shall prevail.

3 Copies of any documents referred to in the Conditions of Sale (whether General or Special) are available for inspection before the day of auction at the offices of the Vendor’s Solicitors during office hours and by prior appointment only (and with the exception of the Standard Conditions of Sale copies will be supplied on request on payment of proper copying charges) and whether or not inspecting the same the Purchaser shall be deemed to purchase with full knowledge thereof and shall raise no requisition thereon or make objection thereto

4 In the Standard Conditions of Sale:

4.1 “the Seller” means “the Vendor” and “the Buyer” means “the Purchaser”.

4.2 The “Contract Rate” means the yearly rate equal to 5% above the base lending rate of National Westminster Bank Plc for the time being in force calculated on a daily basis.

4.3 “Accrued Interest” shall mean interest actually earned by Messrs Lambert & Foster there being no obligation on Messrs Lambert & Foster to place any monies on deposit.

4.4 Conditions 2.2,2.3,3.1.3,3.1.4,4.4.2,5.1.1 and 5.1.2. shall not apply.

4.5 Condition 4.6.4 shall be varied in that the covenant in the Transfer shall be to observe perform and indemnify.

4.6 In Condition 1.3 the words “and notwithstanding anything else herein contained a Notice shall be validly served on a party if served upon a party’s Conveyancer” shall be added after the words “in writing” in that Condition.

5.1 The sale is subject to a reserve price.

5.2 The Vendor or a person on his behalf may bid up to or beyond the reserve price.

5.3 The Auctioneer may refuse a bid.

5.4 If there is a dispute about a bid the auctioneer may resolve the dispute or restate the auction at the last undisputed bid

6 A deposit of 10% of the purchase price shall be paid to Lambert & Foster as agents upon the signing hereof.

7 If a cheque tendered in payment of all or part of the deposit is dishonoured when first presented or if the successful bidder fails to pay such deposit the Vendor may, within seven working days of being notified that the cheque has been dishonoured, or the deposit has not been paid, as the case may be, give notice to the Purchaser that the Contract is rescinded and in which event the Vendor shall have available the remedies referred to in Standard Condition of Sale 7.5.2.

9 The Vendor sells with full title guarantee

10.1 The tenure of the property is freehold

SPECIAL CONDITIONS OF SALE

10.2 The property is sold subject to the various rights covenants stipulations and other matters (if any) as appear in the documents of title (save and except any mortgage or legal charge created by the Vendor and secured upon the property) and the Purchaser having had the opportunity of making all appropriate enquiries shall be deemed to purchase with full knowledge thereof and shall make no objection thereto nor raise any requisition thereon.

11 Completion shall take place 28 days from the date hereof at the offices of the Vendor’s Conveyancers or as they shall direct.

12 The property is sold with vacant possession on completion subject only to.

12.1 Any unauthorised occupation by squatters or others in which event the Vendor shall not be required to take any steps to remove any such unauthorised occupants or squatters nor shall the Purchaser be allowed to delay completion on account thereof and

12.2 The proviso that the Vendor shall not be obliged to remove anything from the property that is now there but shall be entitled to remove therefrom such fixtures fittings and chattels (not included in the sale) as the Vendor shall deem fit

13 The property is sold subject to:

13.1 All local land charges and all matters capable of registration as local land charges whether registered or not and

13.2 All notices served or to be served or orders demands proposals or requirements made or to be made by local or other applicable authority (whether before or after the date hereof) and

13.3 All actual or proposed notices charges orders restrictions agreements conditions contraventions or other matters arising under the Town and Country Planning Act 1990 and

13.4 All wayleaves or similar agreements or consents

13.6 The Purchaser shall make such enquiries as he thinks fit to satisfy himself in respect of the aforesaid matters prior to such auction without any liability on the part of the Vendor to disclose the same.

14.1 The Purchaser shall satisfy himself as to the boundaries of the property and no error or valuation shall annul the sale or entitle the Purchaser to any compensation in respect thereof

14.2 The Purchaser hereby acknowledges that he has not entered into this contract relying upon any representation or statement made by or on behalf of the Vendor either orally or in writing other than such as shall have been made on behalf of the Vendor by his Conveyancers in writing in replies to enquiries raised in writing by the Purchaser’s Conveyancers on his behalf prior to signing hereof.

15.1 In the event of any conflict between the General Conditions of Sale and the Special Conditions of Sale the latter shall prevail.

15.2 In the event of any conflict between the provisions of the Conditions of Sale (whether General or Special) and any provisions of the general remarks and particulars of sale herein before referred to the former shall prevail

The provisions of this agreement shall remain in full force and effect to the extent that the same remain to be implemented or fulfilled notwithstanding that completion has taken place.

The Special Conditions of Sale as applicable to particular lots, will be issued as a supplement to the main catalogue and shall be taken as forming part of the same. Whether or not inspecting the same the Purchaser shall be deemed to purchase with full notice of the said conditions and other deed and documents aforesaid.
