GREETINGA PROCLAMATION

WHEREAS in and by section 2 of Chapter 15 of the Acts passed by the Legislature of Prince Edward Island in the Session thereof held in the year two thousand and fifteen and in the sixty-fourth year of Our Reign intituled “An Act to Amend the Smoke-free Places Act” it is enacted as follows:

“This Act comes into force on a date that may be fixed by proclamation of the Lieutenant Governor in Council.”,

AND WHEREAS it is deemed expedient that the said Act, Stats. P.E.I. 2015, c. 15 should come into force on the 1st day of September, 2015,

NOW KNOW YE that We, by and with the advice and consent of our Executive Council for Prince Edward Island, do by this Our Proclamation ORDER AND DECLARE that the said Act being “An Act to Amend the Smoke-free Places Act” passed in the sixty-fourth year of Our Reign shall come into force on the first day of September, two thousand and fifteen of which all persons concerned are to take notice and govern themselves accordingly.

MONTHLY NOTICE PURSUANT TO THE JUDICATURE ACT,RSPEI 1988, CAP J-2.1

TAKE NOTICE THAT pursuant to Section 30 of the Judicature Act, the Finance Committee has fixed the annual rate of interest to be paid on money paid into the Supreme Court of Prince Edward Island for the month of August, 2015 as follows:

1. The annual interest rate for August, 2015 is 0%.

2. All money paid into court in trust in which a beneficiary is named or designated earns interest at the annual interest rate.

3. Subject to section 6, all other monies paid into court shall earn interest at the annual interest rate provided that:

(a) the amount paid into court is $20,000.00 or more; and (b) the amount on deposit is for a period of not less than six months.

4. The amount of interest payable shall be calculated by multiplying one-half of the annual interest rate by the minimum balance on the ledger card or computer facsimile in the preceding six months.

5. Interest payable shall be calculated every six months, for the period from April 1 to September 30 and from October 1 to March 31.

6. Monies paid into court for bail, fines, jury fees and restitution or any other like purpose shall not earn interest.

ROADS ACT HIGHWAY ACCESS REGULATIONS

AMENDMENT

(Approved by His Honour the Lieutenant Governor in Council dated August 11, 2015.)

Pursuant to subsection 29(1) of the Roads Act R.S.P.E.I. 1988, Cap. R-15, Council made the following regulations:

1. Schedule B-2, INFILLING AREAS of the Roads Act Highway Access Regulations (EC580/95) is amended by the addition of the following after clause 1(2)(a):

(b) in the Community of Rustico, that segment of highway which lies between the intersection of Route 243 and the Church Road and Route 243 and the Buntain Road;

2. These regulations come into force on August 22, 2015.

EXPLANATORY NOTES

SECTION 1 adds a provision which designates approximately 1.04 km of Route 6, in the Community of Rustico, as a Collector Infilling Area to allow for the creation of new parcels of land to facilitate subdivision and development. SECTION 2 provides for the commencement of these regulations.

SMOKE-FREE PLACES ACT GENERAL REGULATIONS

AMENDMENT

(Approved by His Honour the Lieutenant Governor in Council dated August 11, 2015.)

Pursuant to section 20 of the Smoke-free Places Act R.S.P.E.I. 1988, Cap. S-4.2, Council made the following regulations:

1. Subsection 2(1) of the Smoke-free Places Act General Regulations (EC279/03) is amended by the deletion of the words “, as depicted in Schedule A,”.

2. (1) Subsection 4(2) of the regulations is amended by the deletion of the words “Schedule B” and the substitution of the words “the Schedule to these regulations, which forms part of these regulations”.

(2) Subsection 4(4) of the regulations is revoked.

3. (1) Subsection 5(1) of the regulations is amended by the deletion of the words “subsection 2(1) and subsections 4(1) and (2)” and the substitution of the words “these regulations”.

(2) Subsection 5(3) of the regulations is amended by the deletion of the words “depicted in Schedules A to C” and the substitution of the words “posted in accordance with these regulations”.

4. Schedules A, B and C to the regulations are revoked and the Schedule as set out in the Schedule to these regulations is substituted.

5. These regulations come into force on September 1, 2015.

SECTION 1 removes a reference to Schedule A, which is revoked by these regulations. SECTION 2 removes a reference to Schedule B and replaces it with a reference to a new Schedule substituted by these regulations. It also revokes a provision that requires a sign to be as depicted in Schedule C, which is also revoked by these regulations.


SECTION 3 substitutes more succinct wording and corrects an error in a reference to a subsection. It also removes a reference to signs depicted in schedules that are revoked by these regulations and substitutes a reference to signs posted in accordance with the regulations. SECTION 4 revokes Schedules A, B and C of the regulations, which prescribe the appearance of particular signs, and substitutes a new Schedule. SECTION 5 provides for the commencement of these regulations.
