    INTRODUCTIONRespondents City of Placerville and City Council ("City") make the following retum to

    the Peremptory Writ of Mandate ("Writ") issued by tftis courl on October 29,2012. The courtdirected the City to take cetlain actions rvith respect to the City's envirorulerfiaI analysis andapproval of the proposed Clay Sh'eet at Main Street/Cedar Ravine Realigrulent and ClayStreet Bridge at Hangtown Creek Replacernent Project ("the Project") and to file a retuirr towrit rvithin fofiy-five days of notice of the rvrit's issuance. Notice was given on Novernber 7,2012. As discussed below, the City has taken the actions requiled by the Writ by vacating thedecisions and actions by rvhich the City approved the Project, including the adoption of anidtial study/rnitigated negative declaration (iS/MND) and a mitigation rnonitoring andreporling prograln (I\4MRP) Thus, tire City iras fuiiy compiieci rvith aii the requirements of theWtit. For tiris reason, the City lespectfuily requests that the courl d.ischarge the Writ.

    FACTUAL BACKGROUNDThe pioposed Project is located in downtown P1acerville. IAR 1:7.] The Project

    includes thr"ee distinct elements. First, the Project rvould realign hryo intersectiols into asirgle, four-legged intersection with a roundabout. IAR I:7 ,210-211.] Second, the projectrvould replace the existilg single-1ane Clay Stleet Blidge u,ith one that can accommodate twolanes of tlaffic plus a cur-b and sidervalk on both sides of the bridge. tARi :I0,25,2I4,3:605.]Thfu"d, the Project would extend the El Dorado Trai1, a pedestrian and bike trail on the nofihbank of Hangtorvn Cteek, fi'om Clay Str:eet to Bedfor:d Avenue, furlhering tire County's long-tenl goal to establish a continuous trail fi'orn tire rvestetrr to eastem ends of the County. IARI:17, 2II, 2I3.1 At a hearing on February 8, 201 1, the City Council voted. to approve theProject, adopt the IS/MND, and adopt a MMRp. IAR 3:l7r-j72,14:3953-3959.1On Marcl-r 21,2011, the adequacy of the IS/MND u,as challenged by a Petition for Writof Mandate filed by Petitioner, ailegirg that in adopting the IS/MND and approving theProject, the City failed to cornply rvith the provisions set forlh under the CalifonriaEnvirorulental Quality Act ("CEQA") (Public Resources Code section 21000, et seq.). Thecase was briefed for a healing, rvhich v,as held on August 26,2011, in the E1 Dorado County

    Superior Court.Ori October 29,2012, the Superior Court issuecl a Perernptory \Vrit of Mandate

    ("\4rrit") directing the City to rescincl its prior approval of the Project and its acloption of theIS/MND and to pt'ovide the coutt rvith evidence of such actiols g'itldl fort1.g11,s cla,vs ofnotice of such u'r'it. Tlie Writ is attached as Exhibit A. Notice u,as prorridecl on November 7,2012.

    DISCUSSIONThe City has taken tirnely action to coilpl1,-rvith the pi'ovisions of the \Vrit.

    Otr December I1 ,2012, the City Council fol the City of Placelville adoptecl Resolution No.8060, tvhich set aside Resolution 7876, by rvhich the Council oliginally approved the project,adopted the IS/ivIND, aud adoptecl tlie irzlt\{RP. Thus, tliese actions have been rescinclecl, asrequired by the \\irit. (See Resolution No.8060, attachecl as Extribit B.) As suclr. the City 1is,complied rvith all of the temrs of the writ.

    CONCLUSIONThe City actecl to comply rryith tire provisions of the \4rrit. Pursuant to the City

    Council's adoption of Resolutioir No. 8060, the approi,al of the Project and acloption of theIS/I4ND and Mi\41{P have been set aside. The City submits that tiiis reilrm dernonstrates fullcompliance rvith the \Vrit. Havillg now fully complied rvitli the requirenelts contailed iu theWrit, as detnonstrated in this lehtm and attaclunents, Respondents respectfully lequest that thecourt discharge tire Writ.
