What lead to Roe v. Wade? In the 20th Century (the 1900s), some statthes made abortion legal. If someone wanted to get an abortion, they would have to go to a legal state. This was hard for poor people, who could not afford to travel. In 1970, Jane Roe wanted to have an abortion in Texas but it was illegal in Texas So Jane Roe filed a suit against Wade (the Dallas County district attorney) because she thought she had the right to privacy (Amendments 1, 4, 5, 9, and 14) Jane lost, so she appealed It was appealed directly to the U.S. Supreme Court U.S. District Court (Dallas, Texas)  U.S. Supreme Court This case skipped a U.S. Court of Appeals

The Decision• The U.S. Supreme Court voted 7-2 in favor that women have the right to an

abortion• Dissenting Opinion:

Abortion is not a private matter because a physician is also involved Mandating when states can allow abortion is the job of a legislative body, not a judicial

body• Majority Decision:

The Supreme Court decided that a woman’s right to privacy is protected under the 14 Amendment (which guarantees personal liberty to all American citizens)

Abortion is legal during 1st trimester in all states Legality of 2nd and 3rd trimester abortions is up to the states

Impact of Roe v. Wade• This court case affected all people involved in pregnancy, but particular women and their

right to privacy and personal liberty.• All American women are allowed to have an abortion during the 1st Trimester (~13 weeks

of pregnancy)• Individual states decide if they want to make it illegal after that• Women can have an abortion at any time in the following states:

Alaska Colorado D.C. Mississippi New Hampshire New Jersey New Mexico Oregon Vermont West Virginia

• Still a debatable topic in the United States today
