ROCK FM AND CASH FOR KIDS “HAPPY STREET” (the “Competition”)

COMPETITION SPECIFIC TERMS AND CONDITIONS

These terms should be read together with our general competition terms at: http://www.bauerlegal.co.uk/radio-competition-terms.html which also apply to this competition.

Rock FM and Cash for Kids are looking to find the happiest street or community within its local area!

If you and your neighbours believe that you live on the happiest street around, then you and one other can enter this Competition on the street’s behalf to prove just how happy your street is!

The five lead names that best demonstrate their happiness will be asked to take part in a fundraising final. The street that raises the most amount of money will win a street party for their entire street to be held on Sunday 21 August 2016!

Please note that when we refer to streets, we mean ‘communities’ as well e.g. villages, caravan parks or small shopping centres.

How to enter

Two entrants (the “Leaders”) will enter the Competition on behalf of their street by submitting 250 words online about why their street is the happiest street along with their fundraising ideas. Remember, we’re not looking for the ‘best’ or the ‘nicest’, we’re looking for the happiest! Entrants must not write about a specific person living on the street unless they have that person’s express consent.

Entrants will ideally reside on a street that is suitable for hosting a street party (i.e. not a main road) and where all residents consent to having a street party. However, this is not necessarily a deal-breaker! We will work to find an alternative area to host the Prize, but if there is no local school, community centre, green field etc. suitable to host the winner’s party, unfortunately your street will not be eligible to take part in the Competition.

The Leaders can enter free of charge on the Rock FM website www.rockfm.co.uk/happystreet (the “Website”). One entry per street will be accepted.

Start date and end date

You can enter the Competition online from 8am on Monday 6 June (“Start Date”) until 5pm on Thursday 23 June (“End Date”)

Any entries received before the Start Date or after the End Date (for whatever reason) will be invalid.

Key Competition dates

All online entries will be reviewed and an initial ten successful streets will be chosen on Friday 24 June.

We will narrow these ten streets down to a final five on Friday 8 July.

The winning street will be announced on Monday 1 August.

When the winner is announced, the decision is final and no correspondence will be entered into.

The names of the winning Leaders and their hometown will be posted on the Website and on social media after they have been announced live on-air.

Restrictions on entry

The Competition is open to UK residents aged 18 years or over at the date of their entry – this means that the Leaders must be 18 years or over, however under 18’s can, of course, attend the street party.

As stated above, entrants must live on a street suitable to host a street party, or with a contingency facility nearby. The street must be within Rock FM’s broadcast area - please contact the Radio Station if you require further guidance.

Employees (and their family members) of the Promoter (or any company in the same group) or any company involved in the Competition, including the Prize Provider, are excluded from directly entering the Competition and their entries will not be considered. However, if they live on the street that wins, they will not be prevented from attending the street party. The street party will be open to a maximum of 200 people, therefore please bear this in mind when choosing who to involve in the fundraising.

Judging Details

Stage 1 – Online Entry

All valid online entries received by the End Date will be assessed by a panel of judges appointed by the Competition Promoter.

The judging will take place on Friday 24 June, and an initial shortlist of 10 streets will be chosen to participate in the next stage. The panel will pick the 10 happiest entries based on the Leaders’ online entry.

Stage 2 - Interviews

The successful Leaders from the 10 shortlisted streets will be contacted by telephone and email on the afternoon of Friday 1 July, and the Leaders will be invited to the final selection process.

The final selection process will take place on Wednesday 6 July and Thursday 7 July at the radio station, where the Leaders of the streets will be interviewed by a panel, and asked to answer a series of questions.

The Leaders must be able to arrange travel to and from the radio station on these dates (and pay for such travel) and may be required to take part in Competition publicity, including photography.

The Panel will select the finalists based on:

1.   Ability to fundraise for Cash for Kids; 2.   Closeness of the community; 3.   Characters within the team and potential on air value; 4.   Location of the street; and 5.   Weather contingency facility (school/community centre/working men’s club/green field).

Stage 3 – Fundraising Final

The 5 final streets (the “Finalists”) will be notified by 5pm on Friday 8 July. The Finalist Leaders will be invited to the station on Monday 11 July to collect their fundraising packs and equipment to use during the Fundraising Weeks. The Finalists will also be interviewed by the Presenter and the recording and audio from such interviews will be used on the Website.

The Finalist Leaders can then undertake their fundraising activities for Rock FM’s Cash for Kids Charity from Monday 11 July until 12 noon on Sunday 31 July 2016 (the “Fundraising Weeks”).

All Leaders must be able to take part in the Fundraising Weeks and arrange their schedule during that time accordingly. Promoter shall have no responsibility for this, or for any costs incurred by the Leaders in doing so. Fundraising can be held after work and during weekends. It is not expected that the 20 days is taken off work.

The Finalists must raise as much money for Rock FM’s Cash for Kids charity during the Fundraising Weeks as they can. Midday of Sunday 31July 2016 will be the deadline for all funds to be submitted and the funds will be counted and verified by an external adjudicator.

The winning street will be the street that has raised the most money during the Fundraising Weeks.

Leaders’ Obligations

Leaders will be briefed fully when provided with the fundraising packs, equipment and signing the Cash for Kids terms and conditions. The Leaders will act as treasurers throughout the Fundraising Weeks and will be responsible for collecting the money, banking it and paying it into the Everyday Hero Page daily.

The Prize

The Prize will be hosted on the winning street on 21 August 2016, subject to 1) obtaining permission from all residents; and 2) the street passing a safety assessment for suitability. If it is not possible to host the Prize on the winning street, then the Prize will be hosted at a contingency facility. If there is not a suitable contingency facility to host the street party, then unfortunately your street will not be in with a chance of winning the Competition.

A maximum of 200 people can attend the street party – so please bear this in mind when involving participants in the fundraising. It is up to the Leaders who they invite, but please try to avoid disappointing people especially if they have been actively involved in the fundraising.

Further details of the Prize can be found on the Website. Alcohol will NOT be permitted at the street party.

Please note that where prizes are provided by third parties, the prize may be subject to the terms and conditions of that third party.

The Promoter is not responsible for any aspect of the Prize, including unsatisfactory quality or late delivery

THE PRIZE AS AWARDED IS NOT TO BE ALTERED OR EXCHANGED. NO ADDITIONAL CORRESPONDENCE ON AN ITEM TO BE ENTERED INTO.

The values of the prizes are fixed by the individual Prize Providers. A full list of prize providers will be available on the Website.

A Prize Provider may need to amend or exchange an element of the prize should any element become unavailable or impractical to provide. In such circumstances any alternative prize shall be of equal or greater value.

Data Protection

The Leaders’ personal data including telephone numbers and addresses will be collected by the Promoter and will be used to process entries. The Promoter will also provide Leaders’ names and contact details to the Prize Provider, solely for the purpose of arranging the Prize.

By entering the Competition, participants consent to the storage and processing of their personal data as described here, which shall be strictly in accordance with current UK Data Protection legislation.

Personal data may remain stored by the Promoter and the Prize Provider after the Competition has ended but will not be used for marketing purposes.

Intellectual Property

Entrants consent to their voice being used on the Promoter’s radio broadcasts and to a copy of this broadcast (the “Recording”) being stored by the Promoter for exploitation in any and all media for promotional or other purposes.

To the extent possible, entrants agree to assign to the Promoter the title to any intellectual property rights or interest that they may have in the Recording.

Entrants consent to photographs (the “Photographs”) and Recordings, which are or may be taken during or at any stage of the Competition and Street Party, being used on the Website.

In addition:

•   entrants agree that the Promoter and the Prize Provider have the right to publish and communicate to the public the Photographs and Recordings in any media including, but not limited to, online, at all times without restriction or limitation throughout the world and not only for the purpose of the Competition;

•   to the extent possible, entrants agree to assign to the Promoter the title to any intellectual property rights or interest that they may have in the Photographs and Recordings.

•   entrants acknowledge that the Promoter may edit the Photographs and Recordings in our sole discretion; and

•   entrants agree not to bring against the Promoter or the Prize Provider any actions, suits, claims and demands in respect of defamation or any infringement or violation of any personal and/or proprietary rights of any sort from the Promoter’s use of their Photographs or Recordings.

By entering the Competition all entrants assign to the Promoter all rights (including present and future copyright) in their entry and their publicity materials in all media (including, without limitation, the internet) and whether in existence now or created in the future.

Other Conditions

•   Only entries received in accordance with these Terms will be accepted.

•   One entry per street.

•   The Promoter has the right to disqualify participants if it reasonably believes participants have breached any of the Terms or if any Leaders are or become unable to fully participate in any stage of the selection process.

•   If there is any misunderstanding, mistake or dispute concerning the operation of the Competition, including the correctness or acceptability of any answers given by winner(s), or the operation of any technical/communications system, the Promoter’s decision shall be final and no correspondence or discussion will be entered into on this subject.

•   The Promoter is not responsible for any failure in email or online systems which result in an entrants’ entry not be received by the Promoter.

•   In order to maintain the quality of the Promoter’s radio programming and to protect listeners from harm, participants may be disqualified if they are incomprehensible, inaudible or if it appears to the Promoter (in its sole discretion) that the caller is driving, intoxicated or likely to offend listeners.

•   Whilst participants are on-air, they promise not to make any statement which (in the Promoter’s sole and reasonable discretion) is inappropriate or which would be likely to bring the Promoter into disrepute.

•   Other than for death or personal injury resulting from its negligence and so far as permitted by law, Promoter hereby excludes all liability for any loss, damage, cost and expense, whether direct or indirect, howsoever caused in connection with the Competition or any aspect of the Prizes.

•   The Promoter reserves the right to cancel, amend, terminate or temporarily suspend this Competition if it is required to do so due to circumstances outside its reasonable control, with no liability to any entrants or third parties.
