Pittman, Dutton & Hellums is a civil litigation law firm with a long history of successfully serving its clients. For over 25 years, the attorneys at Pittman, Dutton & Hellums have been fighting for individuals involved in a wide variety of accidents at both the state and federal levels. Pittman, Dutton & Hellums handles cases ranging from vehicular accidents and insurance fraud to medical malpractice and complex product liability. Several years ago, the firm extended its traditional practice to include pharmaceutical litigation, defective medical prod-ucts and litigation outside the State of Alabama.

The attorneys have achieved national promi-nence in the field of mass torts by standing up against pharmaceutical giants and the manufactur-ers of medical devices and equipment. The firm is currently handling mass torts involving Avandia (diabetes medication), Hydroxycut (dietary sup-plements), Transvaginal Mesh products (TVM) and Mirena IUDs. In 2012, the firm settled ap-proximately 150 cases against manufacturers of hormone replacement therapy medications on be-half of women that contracted cancer and/or other injuries.

Additionally, the firm has made a significant commit-ment to representing individuals who received a metal on metal hip implant as part of a total hip replacement proce-dure. Currently, the attorneys are pursuing claims against DePuy Orthopaedics concerning the ASR and Pinnacle hip implant systems and also against Stryker over the Rejuve-nate and ABG II hip implant systems.

Over the years, Pittman, Dutton & Hellums has honed its reputation as successful courtroom advocates while vig-orously litigating single event cases. Although centrally lo-cated in Birmingham, the attorneys have handled cases in every county in Alabama and in each of its federal districts. While the attorneys successfully settle numerous cases ev-ery year, they strongly believe that oftentimes the best re-sults can be achieved by a willingness to take a case to trial. According to the Alabama Jury Verdict Reporter, the attor-neys at Pittman, Dutton & Hellums have consistently tried more cases to verdict than any other plaintiff ’s law firm in the State since 2002, and was the “most prolific” plaintiff ’s trial law firm in 2010. In 2012, attorneys Carter Clay and Lucas Griffin obtained a $3 million jury verdict in Madison County, Alabama on behalf of an individual that was in-jured in a motor vehicle accident.

Pittman, Dutton & Hellums also believes in giving back to the community. Each year, the attorneys donate both time and money to local charities, churches and arts orga-

nizations. The attorneys at Pittman, Dutton & Hellums provide scholarships to various educational institutions and donate re-sources to various organizations throughout the state. The law firm is not only committed to serving their clients, they are com-mitted to making Birmingham a better place.

Premier Group, Inc., an aviation company based in Birmingham focusing on aircraft sales, acquisition and brokerage, is announcing the formation of a strategic partnership with Corporate Flight Management (CFM) located in Smyrna and Nashville, TN.

“Premier Group and CFM share a lot of similar values, “said Steven Allen, Jr., Premier Group CEO. “We met three years ago through a mutual client and have developed a good working relationship. This alignment will allow both companies to offer aircraft charter services on demand.”

Allen cites CFM’s solid reputation in the aviation industry for safety and maintenance. Premier’s worldwide expertise in sales

and leasing, marketing and business development combined with CFM’s proficiency in charter, FAA technical requirements, certifications and safety inspections creates a turn-key one-stop shop for corporations with flight operations.

The partnership of these two highly- regarded aviation firms, which will build upon the history of strong customer service from both companies, creates a joint fleet of over thirty airplanes, including

single engine pistons, twin turbines, light, mid-size, super mid-size, and large cabin corporate aircraft. The joint partnership creates one of the largest fleets in the mid-south region. The planes range from four-passenger capacity to over thirty-passenger capacity.

Additionally, the partnership will accelerate expansion to smaller regional and municipal airports, including the Birmingham-Metro area, Huntsville, Montgomery, Destin, Pensacola, Mobile/Gulf Shores and the Panhandle. Allen said the partnership with Corporate Flight Management out of the Nashville/Smyrna area, “We will be able to offer a major savings in maintenance and fuel, crew, and insurance,” said Steve Allen, Sr., President

and Founder of Premier Group. “A full-service company can more efficiently manage a physical asset and spread the costs over a lot of customers.” Steven added that the strategic partnership will enhance efficiencies of scale and buying power for companies looking to acquire.

All of this will be boosted by a full-time safety department with a Director of Safety. Inspections can be done in-house at a certified, accredited facility saving money and time and ensuring the highest attention to detail.

The strategic partnership is not just about managing airplanes and flight operations, it’s also about people. “After all, when you’re looking to someone to handle your flight operations, it’s very personal,” said Steven Allen, Jr. Trust, integrity and expertise are vital. Common cultural values are important.

That’s why it’s not surprising to find that there are strong bonds between Premier and CFM. Both companies have second-generation aviators at the helm-- Steven Allen, Jr., at Premier Group and Allen Howell, CEO, at CFM. Both grew up in aviation families. Allen Howell’s father started out as a crop-duster and had an uncle who had an airplane he flew out of a cow pasture. Both attended college and majored in business. Their love of aviation pulled them into the business.

Founded in 1982, CFM (flycfm.com) has grown to include locations in Tennessee, Alabama, Connecticut, Mississippi and soon to be in Destin. Howell says that Alabama has always been of interest to him since he is from Montgomery and attended Auburn-Montgomery. After graduation, he joined his father in Tennessee and was the first employee of CFM 30 years ago. They bring successful operating infrastructure on a large scale to provide private air charter to both small and large groups. They are in the top 100 operators in the US with safety Platinum standards that exceed the FAA with ARGUS and IS-

BAO Industry audits and DOD approved.

Allen, Jr. said Premier Group is growing, CFM is growing and now is the perfect time to capture one-another’s strong suits that play hand in hand to both grow business, expand private charter usage in the southeast and abroad, and expose our clients to the idea and feel of turn key.

“Barry Lambert, COO and director of Aircraft Sales and Acquisitions, joined in 2010 and administers all aircraft research, sales and acquisitions,” he said. “Ryan Waguespack recently came on board to handle the partnership with Corporate Flight Management and will be a direct contact for charter clients and aircraft owners.” “Our goal is to offer aviation that is simple, affordable and turn-key,” he said. “Aircraft owners can add their plane or planes to our charter fleet to help offset the cost of aircraft ownership and reduce the burden of maintaining all of the due diligence that goes with aircraft ownership. Our crews will operate the aircraft, we can do all maintenance in-house, and manage all associated due diligence. If you need it, you call us and we give you the hourly rate and take care of everything. All you have to do is show up.”

This Premier Group/ Corporate Flight Management partnership is a perfect combination of expertise and passion, paying big dividends to corporations and aviation enthusiasts throughout the Southeast.

Helmets for Kids: Teaming up for Bicycle Safety From the time the training wheels come

off, skinned knees , bumps, and bruises are just part of the learning curve as a child learns to ride a bike. Unfortunately, many serious ac-cidents also occur. According to the Centers for Disease Control, more than two hundred fifty thousand children are injured in bicycle related crashes each year. Head injuries are among the most serious and many of those in-juries involve children who were not wearing helmets. Wearing a helmet has long been rec-ognized as the single most important safety precaution a bicycle rider can take.

When attorneys at Birmingham law firm Cory Watson Crowder & DeGaris learned that Children’s of Alabama needed more bi-cycle helmets for their Safe Kids program, the firm donated one thousand helmets to the hospital’s program that provides bike hel-mets to patients who otherwise may not have a helmet. That was in the summer of 2012. A few months later, the firm pitched in to help Children’s with their bicycle safety tent at the

United Way’s Read and Romp event, and since that time, the law firm has expanded its Helmets for Kids program, partnering with other agencies and non-profits to provide a total of more than two thousand bicycle hel-mets for Birmingham area children who need them.

The Helmets for Kids program is part of the firm’s Cory Watson Cares initia-tive. Through Cory Watson Cares, the firm partners with local non-profit organizations that expand educational opportunities, raise awareness of injury prevention, improve the community and help people live healthier, safer and happier lives.

“We care about keeping kids safe and bicycle helmets are part of that,” said Ernest Cory of Cory Watson Crowder & DeGaris. “The community education component is also very important; we partner with others who are interested in helping kids and pro-viding safety education.” Children who re-ceive helmets through the Helmets for Kids program are provided age-appropriate safety booklets, a coloring book for younger chil-dren, and a brochure for older kids.

Buzzy the Safety Bee Spreads the Buzz about Accident

Prevention After talking with educators and leaders

in the non-profit sector, the firm accepted the recommendation that they create a mascot, a friendly character that kids could relate to and respond to. Children were given a chance to vote for their favorite mascot, and Buzzy the Safety Bee got the most votes and became the firm’s official ambassador for child safety and accident prevention. A friendly little bumble bee, Buzzy always wears his helmet, and he uses his Facebook page and Twitter account to provide safety tips , news about local enter-tainment options for families, and links to community agencies that serve children and their families.

TEMPO! Family Fun Festival at Railroad Park

The Cory Watson team is looking for-ward to sponsoring TEMPO!, a Family Fun Festival, presented by Childcare Resources on Saturday, April 13th. . TEMPO! will offer families unique entertainment, healthy food choices, bicycling activities, games and community resources. The event will engage the com-munity in building awareness and promoting strong, healthy families.

Pro Bono

How law firms make the city better. by Richard James

Birmingham’s law firms, as most across the United States, have pro bono components built into their DNA, but many firms and individual attorneys have gone beyond the classic definition of a prescribed number of hours of legal work to become deeply involved in chari-ties and cultural initiatives that make Bir-mingham a better place.

Leila Watson, a partner in the Bir-mingham law firm Cory Watson & De-garis, is one of those types of attorneys.

“My husband Robert and I are private supporters of many charitable organiza-tions. We prefer local charities – where the money, the workers and the benefi-ciaries are all in the same community. It makes Birmingham a better place and it adds accountability. We prefer organiza-

The classic definition of pro bono is professional work undertaken

Lloyd Gathings founded Gathings Law more than 20 years ago on the basic concept that every person, regardless of social or economic status, is entitled to receive the best representation in court and a level playing field when they enter the litigation arena. This remains our guiding principle today, and we believe this principle, together with the outstanding results we have achieved for our clients, is the foundation for our continued growth and success over the years.

Other lawyers, both in Alabama and across the country, have recognized the expertise of Gathings Law and

Trust, Respect and Results. The foundation of our society is built on trust. We trust other drivers to follow the rules of the road. We trust manufacturers to follow established safety standards. We trust financial advisors and consultants to honestly lead us and protect our financial interests. We trust insurance companies to pay our claims after we have faithfully paid our premiums. And when that trust is violated, we expect the wrongdoer to make good. If we can’t reach a resolution on our own, it sometimes helps to consult a lawyer.

But not just any lawyer. You want a lawyer that you respect and that you can trust – someone with extensive experience handling the kind of case you are facing. According to Lisa Borden, our communi-ties are home to thousands of nonprofit organizations that address a wide range of health, arts,

education, charitable and community needs. All are faced with complicated and con-stantly changing compliance issues and legal requirements. Most have voluntary boards of directors who need to be knowledgeable about a variety of laws and regulations affect-ing them, but also have shoestring budgets and therefore lack the legal counsel they need to avoid well intentioned but risky guesses on important issues. To help com-munity nonprofits to meet these important needs, the Baker Donelson Nonprofit Insti-tute was formed – a program in which our attorneys provide these basic legal services on a pro bono basis, allowing nonprofit orga-nizations to conserve valuable resources and apply them to meeting their goals.

Attorneys in the Birmingham office pro-vide a wide variety of pro bono services to their community. The Birmingham office is very active in pro bono work with the Bir-mingham Volunteer Lawyers Program and the Homeless Experience Legal Protection (HELP) program, and spearheaded the cre-ation of HELP’s two weekly shelter clinics in Birmingham. The successful program, which is in its fourth year of operation, is coordi-nated by Pro Bono Shareholder Lisa Bor-den, and includes volunteers from many law firms across the city. Birmingham associate Kevin Garrison is expanding advocacy for Birmingham’s homeless and indigent popu-lation by representing plaintiffs in class ac-tion litigation designed to stop the operation of unconstitutional debtor’s prisons in mu-nicipalities in the Birmingham metropolitan area. Birmingham attorneys also were instru-mental in the Alabama State Bar’s highly successful Pro Bono Celebration Weeks in 2009 and 2010, helping to organize legal clinics for the poor around the state.

Alabama Appleseed also benefits from a great deal of effort by Baker Donelson at-

torneys, who have participated in many Ap-pleseed projects including efforts to reform Alabama’s antiquated constitution, studying ways to better provide health care coverage to the poor, and assisting low income fami-lies who own their property and are strug-gling with title issues. Birmingham attorneys are currently representing two indigent Ala-bama death row inmates in post-conviction proceedings.

Homeless Experience Legal Protection (H.E.L.P.) enlists local attorneys, law stu-dents, and law firm secretaries and parale-gals in cities across the country to provide pro bono legal assistance to homeless indi-viduals.

This assistance often takes the form of a single consultation but occasionally extends further, depending on clients’ needs. Volun-teers meet with their clients at local shelters and other social service organizations that are accessible to the homeless population.

H.E.L.P. began in New Orleans in early 2004, when a newly appointed federal dis-trict court judge, Jay Zainey, accompanied his fellow judges to serve a meal at a local shelter. While serving the meal, Judge Zainey began to think how much more an attorney could do for the shelter clients, and how that kind of service could change people’s lives.

With that simple but electrifying thought, H.E.L.P. was born. Judge Zainey began to round up volunteer lawyers to staff a weekly clinic at the shelter, and had more success than he had ever imagined. Soon he had hundreds of lawyers, clinics in more than one shelter, and the desire to do even more. H.E.L.P. began to expand to other cities, prodded and encouraged by Judge Zainey and helped along by law firms who were volunteering in New Orleans but also had offices in other cities. Today, H.E.L.P. volunteers are providing free legal services to the homeless in over 15 cities, and the list continues to grow.

The Alabama Appleseed Center for Law & Justice, Inc. is a non-profit, non-partisan public interest legal advocacy organization whose mission is to work for systemic policy reforms that achieves justice and fairness for low-income and unrepresented and other vulnerable populations that usually have little, or no, voice in developing or changing policies that impact their lives.

The mission of Alabama Appleseed is

Since 2008, the firm has doubled the yearly number of hours our attorneys devote to pro bono work, and is aiming even higher. Baker Donelson attorneys receive up to 50 hours of billable credit from the firm for work they do for our pro bono clients.

Most people who need to hire a lawyer never expected that they would need one. Ex-perts at all phases of the civil litigation process, the attorneys at Morris, Haynes, Hornsby, Wheeles & Knowles have developed their practice with one goal in mind – to ensure that their clients have the best chance for a successful recovery with regard to their legal claims. We handle a wide variety of civil litigation, ranging from tractor trailer accidents to car wrecks to product liability claims to commercial litigation to environmental claims.

A crucial part of the firm’s structure revolves around client service and satisfaction. Our attorneys and staff pride ourselves upon our ability to inform our clients of the ups and downs of their legal situation, honestly assess the possibilities of success in pushing forward with a claim and to make the process of litigating a civil matter as smooth for the client as possible. Testimonials from some of our clients can be viewed at our web site, www. mhhlaw.net, as can a sampling of the many successful verdicts and settlements we have achieved for our clients.

At Morris, Haynes, Hornsby, Wheeles & Knowles, each attorney’s case load is kept at a level that allows him or her to know each client by name and as a person, not as an anonymous claim number. Another unique aspect of our firm is its two offices, one in Birmingham and one in Alexander City. Having two offices gives the firm a greater geographical reach than most plaintiffs’ firms. In addition, our firm has a department devoted solely to researching the many legal issues and motions that arise in every case, ensuring that we have cutting edge knowledge of the latest legal opinions in most areas of the law.

In order to better serve our clients, our firm also has one of the only evidence storage warehouses owned and operated by a law firm for the pur-pose of preserving evidence in the cases that we handle, and a full time warehouse technician to maintain that evidence. The storage of vehicles or equipment following a car accident or product claim at off-site storage facilities can be quite expensive; owning our own facility helps keep our clients’ litigation costs down.

Your first consultation with us is always free of charge, and in many cases we are able to work with you on a contingency fee basis, which means that we do not charge you a fee unless we are successful in prosecuting your case.

to work for systemic policy reforms that achieves justice and fairness for low-income and unrepresented and other vulnerable populations that usually have little, or no, voice in developing or changing policies that impact their lives. The issues Appleseed addresses go to the very fabric of people’s lives touching such human issues as housing, health, financial security, workplace safety, disaster relief, access to justice, and discrimination wherever it arises.

Alabama Appleseed is affiliated with the national network of Ap-pleseed Centers located throughout North America. Appleseed was founded in 1994 with the mission to develop and help sustain a net-work of state advocacy centers that address local issues and develop and promote practical, systemic solutions. Each state center operates independently with its own board of directors and sets its own advocacy agenda. Appleseed offers the state centers support in developing its or-ganizational structure and processes and in a limited way with identify-ing national funding sources. Although new state centers receive some financial support from Appleseed during the first three years, it is the responsibility of each state center to develop and implement its own fund raising plan and to secure funding for its operations and advocacy projects.

The organizing Board of Directors for Alabama Appleseed was brought together in 1999 and has been functioning since that date. The organizing Board consisted of a number of prominent and well-known Alabamians, including former Governor Albert P. Brewer, J. Mason Davis, former Chief Justice C.C. Tolbert, Jr., former Supreme Court Justice Janie L. Shores, and Dean Kenneth C. Randall of the University of Alabama School of Law.

Baker Donelson’s Lisa Borden wrote an op–ed piece in The Bir-mingham News to promote the Bar Association’s annual Pro Bono Week.

“Simply put, “pro bono” is the provision of free legal services to those in need.

“There are few places in our country where the need is greater than right here in Alabama.

“Nineteen percent of Alabamians live at or beneath the federal pov-erty level, and one in four of Alabama’s children are currently living in poverty. Given that the poverty threshold is very low (currently just over $17,000 for a family of three), we know that many more Alabamians are struggling to get by and cannot afford to pay for the services of an attorney when a legal crisis occurs.

“Each year, hundreds of lawyers generously donate their time and resources to help low income Alabamians who would otherwise face the daunting and nearly impossible prospect of facing the court system alone, a circumstance which can hardly be called justice.

“During Pro Bono Week, Birmingham area attorneys will offer free legal clinics, and we will honor our pro bono leaders for their service. But the service of attorneys to the community is not an annual event - it is a daily commitment. The Alabama State Bar and Birmingham Bar Association Volunteer Lawyers Programs, and their attorney members, stand ready to offer assistance to low income Alabamians in need of legal representation.”

Whether the community work being done by Birmingham law firms involves legal representation or financial/volunteer support for a charity, the generosity runs deep.
