You’ve heard the horror stories: An attorney mails you a letter stating that your handicapped parking spaces are not in compliance with ADA requirements. They ask you to pay
them to make this problem go away. You wonder if you are being scammed or if you have a legitimate ADA (Americans with Disabilities Act) violation on your hands. What should you do? Myth Buster #1: The ADA is more employer friendly than you may have been led to believe. Not only is there a toll-free line you can call to ask ADA questions and get timely answers, but there are also free publications available to small businesses to help you be proactive and informed about what the ADA requires for existing facilities. Before you panic, CEA recommends you first arm yourself with the following information: The ADA Guide for Small Business. This guide presents an informal overview of the basic ADA requirements for small businesses who provide goods or services to the public. The guide omits many of the legal terms found in the ADA, but it references key sections of the regulations. Myth Buster #2: The ADA understands it is not possible for many businesses, especially small businesses, to make their facilities fully accessible. They can help you make improvements easily and with little expense. The ADA only requires that accessibility be “improved without taking on excessive expenses that could harm the business.” They also understand that these improvements may be an on-going process. Myth buster #3: The ADA is more interested in seeing a business make progress on their ADA “to-do list” as opposed to expecting everything to be in full compliance today. The primary way a business owner can improve accessibility is to “remove physical barriers that are readily achievable.” An example of this might be repainting parking lot lines so that they meet ADA requirements and allow people in wheelchairs to safely exit a vehicle. You can print out a complete copy of the ADA Guide for Small Business at: www.ada.gov/smbusgd.pdf . The ADA Checklist for Readily Achievable Barrier Removal. This guide is written in a checklist format and details some of the more common requirements found in the ADA Standards for Accessible Design (Standards). Myth Buster #4: This publication reminds employers that full compliance is only required for new construction and alterations. The requirements presented in the guide are designed to help employers determine what may be readily achievable barrier removal for existing facilities. You can print out this checklist at: www.ada.gov/racheck.pdf and use the ADA Guide For Small Business as a reference guide.
Myth Busters About the ADA
CEA also recommends your use the ADA Technical Assistance Updates. ADA-TA is a series of technical assistance updates from the Disability Rights Section of the Civil Rights Division of the Department and provides practical information on how to comply with the ADA. Myth Buster #5: The goal of the series is to clarify misunderstandings about the requirements of the ADA and to highlight its flexible, common sense approach to accessibility. TA updates have two standard features: Common Questions (which include questions received through complaints and calls to their information line) and Design Details (supplemental information and illustrations of specific design requirements). Print this out: http://www.ada.gov/adata1.pdf Still Nervous? For free answers to questions about the
ADA or to learn more about the law, call the ADA Information Line toll-free at 1-800-514-0301
For added protection, employers can also call in a certified assessment specialist. SB1608 encourages employers to get Certified Access Specialist Program (CASP) Inspections. Find a consultant in your area from the CA state architect website: https://www.apps.dgs.ca.gov/casp/casp_certified_list.aspx
